In house in Focus: the implications of the Digital Markets Competition and Consumer Act

  • Recorded on 17 July 2024. The Digital Markets, Competition and Consumer Act (DMCC) makes sweeping changes to UK consumer protection law. The changes are designed to make compliance a board level issue for all businesses that interact with consumers. It also creates new obligations to deal with certain specific consumer harms that have emerged as a result of the increased importance of digital in consumer experience and sales. There are particular issues for any business that seeks to have one approach to online across the UK and EU - as DMCC is a significant divergence from the EU position under the New Deal for Consumers.
    Mills & Reeve's Katrina Anderson, who is an expert in consumer protection, e-commerce and digital regulation, along with colleague Paul Hilder, will explore the following:
    - Implications of the new GDPR style fines on existing compliance and ongoing CMA consumer investigations, particularly into Green washing and dark patterns
    - New subscriptions regime
    - What the new proposed blacklisted offences will mean for using reviews in ads and elsewhere online
    - Implications of the divergence in consumer law from the EU position - including how and when a European compliance solution is possible.
