    For the brain dead! The NIL agreement signed by Lucas is based on law has not been voted by congress! Its not law yet! The vote is in April, I believe! This contract is not legally binding if its not law! Wisconsin got in front of process! It it wasn't officially a law, Wisconsin would have a case! They don't!

    Apparently Lucas’s attorney checked with the NCAA. The NCAA gave Lucas’s team the thumbs up to withdraw and go to Miami. The 2 year agreement isn’t enforceable since the law hasn’t taken affect yet. Big 10 and Wisconsin can be upset all they want, but you can’t force a player to play on your team if he doesn’t want to. From the outside in looks like Wisconsin is upset because their program can’t hold on to players. Good luck recruiting from south Florida in the future.

Lucas is stuck playing for school that he doesn’t want to play at. An agreement predicated on something happening isn’t enforceable until the thing (in this instance rule) happens first. Neither party can receive a benefit until the rule/law passes.

    I'm NOT an attorney so I'm not going to sit here and pretend to be the one who knows the law when it comes to legally binding agreements between 2 parties. However, as someone who has about 15 years of experience drawing up contracts for large medical groups to sign and go into agreement with, I do know a thing or two about contract agreements as I work for a corporation that provides Locum Tenuns/temp doctors, nurse, etc., to medical facilities. For any company, entity, etc., the Agreements tend to focus heavily in favor of the party that draws up the agreement.
    For example, should things go south, and the matter needs to head to court than the party that drew up the agreement typically will have the case heard in front of a court in their state. That's usually done because the laws in their state will protect them more so and govern the contract for the purposes of their benefit and protection. That's why the party who struck up the agreement, in this case Wisconsin, should have had their legal team vet the agreement better for possible loopholes before sending it over.
    That's what the legal team gets paid to do. They're job is to look out for their client and to think outside the box to prevent circumstances such as this from occurring. Looks like Wisconsin's legal team dropped the ball when they failed to discover this possible loophole and gave the green light for Wisconsin to send Lucas's party the agreement to go over and sign. Sucks for them! They should have done a better job! Lucas's attorney simply found a loophole in the agreement and exploited it. Couple that with the fact that the law has not been passed yet therefore the agreement can't be enforced legally. Now the argument by Wisconsin could be that because the agreement was struck up in the state of Wisconsin, all matters and proceedings are still enforceable even if a court of law should not find the secondary party liable.
    We don't know what's in that agreement but I'm here to tell you, if the NCAA gave Lucas's attorney the green light for him to leave by way of unenrolling from Wisconsin, then you'd better believe, Miami is in the clear. We can make all the accusations we want to about Miami being slimy and having a history of doing shady things but at the end of the day, it's what you can prove. Wisconsin is claiming that they have proof that Miami made illegal contact with Lucas. Well, put up or shut up. Show the receipts or take the L.

    Wisconsin is 100% right to take a stand! This isn’t about Lucas at all. This is about kids being able to do whatever the hell they want. Kids will sit a whole season if NIL misses one penny holding the school hostage, but as soon as a kid signs a “contract” stating he is committed to a school two weeks later you go back on your word!? This isn’t about is the contract legal or not anymore. This is kids being able to up and leave with zero repercussions or consequences. Tell me how a kid signs a document committed 100% to a school and then leaves two weeks later without excepting phone calls or talking to coaches. If that’s not a sign of tampering idk what else is. If it was truly for his dad being sick (which was debunked) why didn’t he contact the coaches and be like hey this is the deal my dad is sick could I please transfer out here.. I’m 100% confident Wisconsin would have put his name in the portal. Except Lucas put up a lame two sentence thing on X saying he is in the portal and caught everyone off guard. His dad is on record saying he had zero idea what was going on.. hmmm seems very suspicious to me.. either way something has to change! It’s broken the way it is now and I’m proud to say that Wisconsin has a chance to push that needle forward!

    Lucas is "....attempting to leave [Wisconsin] without entering the transfer portal..." WTF!!! That's like a cop beating a dude senseless with his baton and then claiming, because the dude put his arm up to protect himself from the blow, that he was resisting arrest. Please tell me you're smarter than this. Full transparency, yes, that's a Miami logo on my hat in the pic, but bias doesn't equate to inaccuracy. Lucas did try to enter the portal. He submitted paperwork towards that end. But Wisconsin has a signed contract that specifies & is dependant upon an employee/employer relationship (something the House settlement may usher in, but to which the NCAA and its member schools have denied for decades) and is thus invalid (if not illegal). Now because of this non-employee status, schools' collective have had to create a legal separation from their schools (so Wisconsin can't use that to prevent departure either), but the Wisconsin collective could go after Lucas for breach of contract, but that's probably the ONLY thing they can do.

    • @peterf.4268
      @peterf.4268 12 วันที่ผ่านมา

      Secondly, regarding the "tampering," in the most strict sense, it doesn't exist. And in the looser, "let's scream at the wind and make unprovable accusations," way, surenit exists, and Wisconsin engages in it too. If there's a player, and for whatever reason (proximity to home, previous recruiting relationship, etc.) a team thinks that player at another school may be interested in switching, they can reach out to a family member or even the player's agent. And there's nothing that can be done. No impermissible contact has been made. Remember, when Cam Newton was at Auburn, another SEC school said his dad agreed to accept $200k for Cam to go their school..."Cam cheated," they said. "He isn't eligible," they whined. But what the NCAA had to do, was nothing. They couldn't punish a son for the sins of the father. Were they (Cam & his dad) working together? Almost certainly. Did anyone have proof? Of course not. Case closed. This is every big time transfer. When Saban left Bama and star safety Caleb Downs entered the portal with a "do not contact" designation, do you think Ohio State had some sort of contact with Downs' people? Of course. Will the Big 10 investigate & criticize that move? Of course not. And there's no reason to. Same deal here. It would have smart for Wiaconsin to just let him walk. The more they fight, the more they'll have to disclose actual paperwork, and the more they'll be liable for their own errors.

      You're just carrying the water for Wisconsin here. All you have is innuendo. You claim Miami has broken rules or pushed the envelope but you fail to provide a single example.
