I think the bigger issue is that artists don’t like when AI is used to recreate their image. It’s different if the fan were to draw or 3d sculpt their image, because there is a part of the artist that gets put into that process. You don’t have that with AI.

Disney had the chance to cast a near perfect doppelganger for Harrison Ford in Solo (Anthony Ingruber, who played a young Harrison Ford in the film _Age of Adaline,_ in 2015), and they blew it by casting that other guy. Ingruber looks and sounds exactly like a young Harrison Ford, and he can act. They could have cast someone like Sebastian Stan to play a young Luke Skywalker, because he looks very similar to a young Mark Hamill. But Disney doesn't care about making good decisions for Star Wars...

That´s more of a philosophical question than a legal one. Is it ok to draw Mark? Yes. It is ok to make an animated figure designed after Mark? Yes. Now, how photorealistic does it have to be to not be ok anymore? Is there a difference between a photorealistic painting and a deepfake? If yes, what would that be?
I just said this under another comment, but the way I see it, let’s say someone creates a fan made comic book for Star Wars (people have!), and then turned Luke into a violent gang member that keeps slaves, beats women, likes Nazis, whatever horrible thing you can think of. Well I guarantee you that the people that own Star Wars would shut that comic book down. Especially if it was being seen by a ton of people. So in my opinion there’s the answer. That’s not to say people shouldn’t be allowed to make fan comics, it’s to point out the main issue with using someone’s else’s character. And with this it’s even more morally wrong, because it’s an identical depiction of the actor, where the people that make it can make them do and say literally anything they want. I know SWT loves Star Wars and has good intentions, but not everyone is the same in that regard. Before you know it people will be doing the same like crazy while using deepfakes of actors to push their agendas and beliefs. But more than that, Mark Hamill would simply have no say in how he is used or depicted. And that is enough for it to be wrong. It’s one thing to make the character of Luke say and do things, it’s a whole other level when it’s the character of Luke being depicted by Mark Hamill being made to do things. For all they know, the actor wouldn’t agree to certain aspects of the story, certain actions of their character etc It’s a moral thing. And it’s also like, what do people expect? Disney could have a Luke series planned for the future, or anything similar. And no matter how bad it is, they could want to keep it so that Luke is perceived in the way he is. People shouldn’t be surprised that they aren’t allowing to take an iconic character and make their own show out of it

@OBJYN788 Hyper Realistic Animation is not allowed either. The only animation that is allowed, is like Star Wars Rebels or Disney's Frozen. Obvious CGI or animation that has a cartoon feel. Animation of a realistic scope that captures a real person, legally requires said person to be ok with it. Or it's classified as a form of identity theft. Which is why Disney asked permission of the estates of the dead actors they remade.

I think we’re crossing that invisible line into going a bit too far. Letting people make fan films where actors do whatever they want while wearing your face, I wouldn’t want that. If studios want to do they have to get permission, the actor has some say and some recourse if they don’t like what they hear. I remember years back hearing about voice actors being uncomfortable signing yaoi/yuri drawings of their characters with other anime characters from the shows they were voicing, and that was just drawings. I’m not saying we’re days away from deepfake porn, but letting someone use your face to say and do what They want, I can think of plenty of things that could go too far.

I just said this under another comment, but the way I see it, let’s say someone creates a fan made comic book for Star Wars (people have!), and then turned Luke into a violent gang member that keeps slaves, beats women, likes Nazis, whatever horrible thing you can think of. Well I guarantee you that the people that own Star Wars would shut that comic book down. Especially if it was being seen by a ton of people.
So in my opinion there’s the answer. That’s not to say people shouldn’t be allowed to make fan comics, it’s to point out the main issue with using someone’s else’s character.
And with this it’s even more morally wrong, because it’s an identical depiction of the actor, where the people that make it can make them do and say literally anything they want. I know SWT loves Star Wars and has good intentions, but not everyone is the same in that regard. Before you know it people will be doing the same like crazy while using deepfakes of actors to push their agendas and beliefs. But more than that, Mark Hamill would simply have no say in how he is used or depicted. And that is enough for it to be wrong. It’s one thing to make the character of Luke say and do things, it’s a whole other level when it’s the character of Luke being depicted by Mark Hamill being made to do things. For all they know, the actor wouldn’t agree to certain aspects of the story, certain actions of their character etc
It’s a moral thing. And it’s also like, what do people expect? Disney could have a Luke series planned for the future, or anything similar. And no matter how bad it is, they could want to keep it so that Luke is perceived in the way he is. People shouldn’t be surprised that they aren’t allowing to take an iconic character and make their own show out of it

The only animation that is allowed, is like Star Wars Rebels or Disney's Frozen. Obvious CGI or animation that has a cartoon feel.

If you don’t ask you can’t have and if there’s no signed document before the actor has past you can not do it (but this does mean it needs a law)

I think we’re crossing that invisible line into going a bit too far. Letting people make fan films where actors do whatever they want while wearing your face, I wouldn’t want that. If studios want to do they have to get permission, the actor has some say and some recourse if they don’t like what they hear.
I remember years back hearing about voice actors being uncomfortable signing yaoi/yuri drawings of their characters with other anime characters from the shows they were voicing, and that was just drawings. I’m not saying we’re days away from deepfake porn, but letting someone use your face to say and do what They want, I can think of plenty of things that could go too far.
