Tesco refuse access with guide dog- BBC London

  • Within one week BBC News correspondent Sean Dilley was told he wasn't allowed to have his guide dog Sammy in two London Tesco stores.
    Sean was born with congenital blindness, poor sight and lost all functional vision at the age of 14.
    Guide Dogs’ research shows that 75% of assistance dog owners have experienced an access refusal at some point and 20% of those have been in supermarkets.
    Sean said: "For somebody to say that I cannot come into a shop or that I have to leave because of a guide dog in 2022, it just feels the north side of unacceptable to me."
    BBC London requested an interview with Tesco but they denied.

    It's pretty disgusting, but what's maybe more disgusting is that seemingly no one came to the mans aid to tell the staff to kindly step the F back and let him do his shopping.

    The fact he was refused entry by a supermarket - which I would bet there was a sign on the window saying "No Dog except Guide Dogs", but the fact he got abuse from people on Twitter?! Sad low life internet trolls. I happily support the Guide Dogs charity as they do stellar work and I can't even imagine losing my sight. These dogs are a life line to so many!

      I too support guide dogs for the blind. Why? To enable those who are disadvantaged to lead a more normal life.

      Nah, I'd say management needs the discipline as the staff are a reflection of their training and evidently they're NOT trained.

    What is unacceptable is when people state that people with disabilities have no business going out in public. I’ve heard that multiple times in the United States. The very sad thing is that people today seem to have absolutely no empathy for others.

      Tbh I have epilepsy and I’ve never had anyone mock me when coming out of seizures quite the opposite in fact. Maybe I’ve been lucky.

      @@boxtradums0073 lucky. I rarely have issues due to body size, fed up attitude and resting b face so to speak but know of others who've had a LOT more issues than I have because they don't have the physical size and aren't prepared or able to get LOUD when telling someone off for their bs.

      Yep. When I tried to do a college course I was told by another girl ‘that the F are you doing here if your different’ and the teacher and her whole possey pretty agreed with Her. It was mortifying for me.

    I worked in Tesco until 2017. We used to have a blind chap and his dog come in a couple of times a week. He would wait for a minute or two, and the duty supervisor on the tills would detail a staff member would walk with him and help him do his shopping. I can't believe that this happened to this man. It's simply disgraceful. The manager of this shop should be ashamed of himself.

      Had something similar when i worked in a small shop no one was assigned to him just whoever noticed him first when he came kind of thing. If a staff member was disrespectful at all to that guy they'd of been literally and figuratively kicked out of the shop.

    As a person who actually worked in Tesco for months. The problem is area managers and regional managers of Tesco. They have the power of the stores. All they care about is turnover and performance v last month and this time last year. That is it. There is no culture of professionalism or management that guides stores to upkeep customer service, tidiness, store presentation. These are all secondary to sales data. This lack of management feeds into staff at local level. Who arrive at work and simply interested in running the clock down. Which is why is you see these failing happenings.

      I worked for them for three years back in the 1980’s, they and sadly many others are notorious for disrespecting people with guide or support dogs. When I worked for The Works, they could be just as bad, and at Christmas due to an excessive amount of stock around the store would even go as low as refusing to have those using wheelchair and mobility scooters access. Their checkout rule was for staff to ask every customer, even a blind one if they had found everything they were looking for. My late Dad was blind and he tore my manager and regional new rear ends over this when he witnessed them chastise me for refusing to ask a blind lady. 🤦‍♀️

      It is against the law in the UK to prevent a person entering a shop or any public place with an assistance dog, end of. It is not up to store managers to make up their own rules. I’ll say it again, it is AGAINST UK LAW.

    Shocking, yet sadly not unusual! As an assistance dog user I know how discriminatory and ignorant the public can be to disabled people who need a dog to undertake every day tasks. I constantly have to tell staff that my dog is allowed in by law. Able bodied people ought to be very grateful that they don’t need a dog to help them do things they take for granted!

      there are people who dream this would happen to them and they do not even have a disability of any type. they fantasize about being disabled and being abused for their disability. they even self diagnose with the most serious disabilities and do not require treatment like assistance, therapy, medication, intervention, or medical procedure. they insult medical professionals in their field the disability was not diagnosed as.

      @@ramatgan1 That was going to be my point. I blame the staff involved for their general ignorance because it should be common knowledge that guide dogs are allowed. However, at the end of the day if they are doing this at work it's because the people above them have not trained or informed them.

    Assistance dogs have a right of access by law, it's actually a criminal offence to refuse access to an assistance animal in the UK, the penalty is hefty and can include prison sentences!

      Hi there. I am the person in the video. Thank you for your note. It’s not a criminal offence for a business or service provider to refuse a guide dog it’s a breach of the equality act 2010 and it is a civil wrong it is unlawful but not criminal in that context. It is however a criminal offence in England and Wales for private hire or Hackney carriage. Taxi driver to refuse or fail to carry a disabled passenger because they are accompanied by an assistance dog. Absolutely no question of prison, incidentally, but just as an aside. It’s not even a recordable offence for cabdrivers as far as the police national computer and so on. Just replying to actually rather than stating. I need you on this.

      It used to be covered solely by the equality act but it is now also covered by a act of criminal law (can't remember which one) which also deals with on duty working police dogs in the UK, but it basically makes the offence civil law and criminal law, I literally had to ask a police dog handler that I know as well as a lawyer for confirmation because I am hopefully getting a hearing dog soon, so I am trying to learn my rights and the laws and regulations for assistance dogs

      @@jakedovey7488 I’m fairly sure this is a mistake? Are you referring to the service animals protection act 2019 otherwise known as Fonn’s Law? This is the only bit of legislation relating to police, dogs, unaware of, and it relates to attacking animals that are being worked by crown servants. But definitely not covered with a disability legislation, but I am curious, fancy ask your friend? I think that’s what they’re talking about, but it’s unrelated to taxis and private hire.

      No it isn't Finns law, but I can't seem to find the law on .gov anymore which indicates that the law has potentially been repealed or amended to no longer cover this situation, I will get in touch with the police dog handler for further clarification! But it looks like if you made a complaint against the store and then they eject/ban you it becomes victimisation which is a CRIMINAL offence and can be dealt with by the police, the only real exception I can see is that if a staff member or customer has severe allergies to dogs it gets very complicated straight away! However you are still potentially able to bring a civil claim/private prosecution against the store!

    This has happened to me and my service dog in the United States more times than I can recount. Hotels and Walmarts being the worst offenders. No matter how much I explain to them that it’s the law, they are adamant that it might upset their other customers and deny us entry. I actually considered filing suit against one such hotel but honestly I cannot afford such litigation. I’m on a fixed income and barely able to exist as it is. It’s demeaning and really depressing and honestly does tear down one’s confidence. I’ve actually had the police called on me at Walmart and even they told me to just leave and stop kicking up a fuss. Writing to corporate is fruitless; all one receives is an empty apology and assurance that “everyone is welcome” and promises to do more training. I’m frankly sick of hearing this training excuse used from everyone from the cops who kill innocent people to shopkeepers and hoteliers. It’s simply unacceptable.

      That's where I'll just walk in anyway and tell them to call the cops if they have an issue. If the cops uphold the discrimination then they'll be listed on a suite as well and make it worth whilst. Even if it's a pro bono mob that takes 60-70% of any winnings, it's not the money that's of interest rather the harsh lesson.

      I would suggest trying to obtain public and media support and seeking out somebody who may be willing to take on your case pro bono. Social media is a powerful tool these days

      You dont have to pay a lawyer to file a suit against a hotel or walmart, they will take the case on account that they stand to make a lot of money.

    My good god guide dogs have been around for decades!!! Fair enough if it was someone sighted with a ‘service’ dog I could understand as this is a new thing . I love seeing people with guide dogs it takes ‘man’s best friend’ to the next level.

      @@boxtradums0073 seems the yanks call any old dog with a jacket on a ‘service dog’ and yeah most seem to be for ‘emotional support’ i think it’s a bit like getting a medical mariuana card, go to your doctor tell them you need a dog for your mental health and you get to register it as a service dog and take it everywhere with you.

      @@Dan-wo4bx actually we have very defined laws about service dogs (assistance dogs in EU) in the states -- but many stores won't enforce them (others kick out the actual legit teams against the laws) and many people try to bring esa's and untrained dogs in businesses and lie that they are service dogs. It is horrible for those of us with legitimate SD's. People call us frauds and fakes all the time and just like this man, I've been bullied horrifically online due to speaking up about an access issue with my service dog. People here assume we're all fraudulent and will attack our disabilities, saying we're unworthy of assistance or just seeking attention. If they'd only experienced the life I've lived, how different they would feel!

      I worked in a huge ASDA store for eight years and we were always made aware of assistance dogs and how much they were welcomed in the store through our on going training. We wouldn’t have DARED turn them away.

    I think that every store should have training in the form of putting the employees in sensitivity training. Make them blind and put them in a store situation and also put them in a wheelchair alone in a store carrying a shopping basket. Make sure they know when they see a person who has a dog and they are wearing working dog collars that this person is disabled in someway whether it be with sight, wheelchair or PTSD disabilities. This goes on here in the United States. It’s just appalling. I heard about one person who had notebooks with printed pages made that had the law written out on this page that they could tear out and hand it to the employee or the security guard. Believe it or not it’s working for them.

    Something like this is unacceptable behaviour! I don't blame people who have @guidedogs at times need body cameras to record some sort of evidence! For any shop such as @Tesco staff to do that, it makes me sick to the stomach!

    TESCO aught to be making a generous donation to guide dogs to back up the usual throw away apology. They can afford to show how fkn sorry they are and make a big difference for an amazing organisation. Piss poor that Massive firms like TESCO’s staff are doing this .

    30 years I have had guide dogs, experienced the very same thing time and time again. This week, my local Tesco again. Security guard insisted I had to leave with my dog. Other folk kindly intervened, a manager was summoned and we carried on, thankfully. It seems the training Tesco promise is still lacking.

    A Tesco spokesperson later stated that every little helps to try to stop customers trying to buy things in their stores so they don't have to fill the shelves up again

    I am very disappointed to watch this. I work for Tesco and can assure you that we welcome all assistance dogs in our store.I am also a volunteer guide dog puppy raiser and always walk my puppies in Tesco. Tesco need to do an investigation as to why this happened because it’s unacceptable

    Seen you both This Morning on Breakfast TV and It Lifted My spirits but also broke my heart, First of all Thank You To Your Mum for her Love and Respect and support. Second thank You to Sammy for a job well done and for all the hard work Keeping Sean safe, Good Boy Sammy, As a Person blessed with sight i was Moved and entertained, Two Years is a long wait but big up to The Army of a Team who puts in all the years of hard work Fundraising and those that Train The Dogs, We need more Funding clearly, I would have liked BBC to have a Segment more about this as it's a Nationwide response, We should be Teaching Out Kids about this, after all They are the next Gen Shed Problem solvers , Would love to see Sean do More programs on the BBC, again Thanks Sammy and Sean for the Fundraising and work Done, Respect to Anyone who has Donated, The Lord Is Our Shepherd.

    This happened to me at Sainsbury’s the other day and I was so humiliated! The manager said I was Lying and my dog was no an assistance dog even after I showed my dog assistance card 😢

    Does it need to be put into peoples contract of employment that work in retail or hospitality that they cannot refuse entry to guide dog assisted people I am very angry about this and I hope karma strikes the vile people that made this poor mans day so troubling.

    Offensive, discrimination against him and his dog is breaking the Equality Act. Tescos should be prosecuted for abusive behaviour. As for the abusive people on Twitter, prosecute them as well. Mind you I've been treated badly by both staff and customers in a local Tescos, because I have mobility issues. Also note Tescos are currently inflating their prices, way above many other supermarkets and running a con on their Clubcard, where if you use it, they lower the price down to what other supermarkets charge.
    I've never had any abuse or trouble in Sainsbury's, Morrisons, Llid or Aldi.

Keep your head down and clock off and do the same the next day. There is no concept of thinking and problem solving. The problem is store, area and HQ management.

    In the US, guide dogs and their owners are protected by the federal government against denial of entrance to any public place ,or,transportation media etc.Each guide dog owner carries with him/ her a card that states the laws and liberties afforded to that person and their dog.

Do you have a card that explains the law and the law in England and Wales makes it unlawful to refuse access. In the United States, it’s a much more complex situation. Obviously you are covered by the Americans with disabilities act, but it becomes quite complex because there are an awful lot of issues in the states with service dogs that are not actually service dogs. I believe it’s actually a felony for someone to pretend an animal is a service animal, but the Americans with disabilities act and the fourth amendment to the United States Constitution prevents anyone having to show identification. I find the whole thing fascinating. I’m currently on the waiting list to train with a new guide and so making my way around North America with a white stick at the moment. All the best to you

    Absolutely disgusting and dispicable from tesco and abusive people. Sorry for your experiences. Go to lidl, I was in there with a church member and her son who had her son's service dog with them. They were not confronted at all. 🙏🏽😊

    People in the working environment need to educate themselves for those who need guidance from a person who need guide dogs. There must be able to open all doors to disabled people no matter how they are guided in the shop or premises.

    I don’t understand this. When I began working in a supermarket over 30 yrs ago, our policy was to offer additional assistance to blind customers. We would carry their baskets and help to guide them around the store as the items would rotate to different shelves regularly, meaning it was almost impossible for blind customers to ‘map’ the layout. Why do we appear to have gone backwards? Disgusted.

    For ****'s sake the member of staff at 1:01 is in the wrong. Either close the store down and ask everyone to leave or let the guy in and allow him get on with his shopping. Being short staffed and busy is not an excuse for discriminating against a blind person.

    The other problem is TV talking heads only focus on the blind. There are many reasons for service dogs. All you do is create hostility for people with other disabilities.

      I think most of the problem is that people want to stick their noses in where it’s not wanted to cause a scene. People shouldn’t be forced to explain themselves just to get some busy body to leave them alone. I just don’t understand what is wrong with people it makes me so sad :(

      Not true - Google BBC News assistance dogs and you’ll see there’s rather a lot there. Sorry it offends you to highlight these cases, but if an assistance dog user who has an assistance dog that is not blind is refused, I’m 100% certain it would get picked up.

    not being disabled (lucky for me as i almost lost a leg), but i personally have not seen any such very bad behavior here in the USA. only good, as a old lady opened a door for me back when i was on crutches. (me 21 or was it 22?, her at least 60+). a Dr saved my leg so every time i take a step i am very grateful.
    i say every person that can who has the need of a guide dog. needs to swamp these stores and keep swamping them but not buying anything... maybe a very low cost item, like a pack of gum.
    my leg was crushed, but saved. but over my life i have know many with one kind of a disability or another.
    most "disabled" have this go for it thought in life, real go geter's. these people are a inspiration to those who think there life is a fail.

    The sad thing is that there are many people who bring their pets (NOT guide or assistance dogs) into stores. Incidents like that make it more difficult for people with legitimate guide and assistance dogs. These are people who just want to have their dogs with them everywhere, not need them. I have seem people carrying puppies around grocery stores, or smaller breed dogs sitting in grocery carts. The dog sitting with his rear end in contact with where people put their food was especially disconcerting. That being said, denying serbice and access to someone with a legitimate service dog is disgraceful.

    In America, registered guide dogs are LEGALLY ALLOWED to go everywhere and that includes grocery stores and restaurants. I thought the UK had the same laws we did. Guess not, or the employees would get carted off to jail.

      Hi there - I(‘m Sean, the guy in the report. I’m also a current US Visa holder so lived in the USA over the summer for work. We do have laws. You have the ADA we have the equality act 2010. It’s a criminal offence for cabs to refuse but councils or the London transport authority, Trnasport for London do the prosecution. It’s not a criminal offence for shops and businesses believe it or not - it’s a civil thing you’d have to sue them for.

    The stores response should that an investigation into the matter is currently being conducted and if staff member have breached the law or employee code of conduct we will determine the best course of action against those staff. You make all staff under training again and sign off knowing that if they do it again they get fired.

    It annoys me how much unawareness there is in society towards people with disabilities and their simple requirements just to be able to do the things able bodied people can do. In my son's school in the Netherlands they organised every year a wheelchair for every able bodied child in the senior class so the kids could experience how hard it is to get about town in a wheelchair for the day. The results were often hilarious but valuable lessons were learned for the onlookers, the local shops and the kids themselves. I suggest Tesco dishes out blindfolds for their managers for a similar day out and about with nothing more than a white stick for assistance.

      Fantastic teaching/retention opportunity that should be mandatory for all students. Powerful memories as most will never forget the lessons from experiencing the Real World emotions of feeling absolutely frustrated and helpless with the loss of control, now having to rely on the kindness/understanding of others.
      Inexpensive and kids will see it more as an interesting challenge to experience, instead as a waste of time.

    This is crazy. We seem to be going backwards in certain attitudes at the moment. This is not the first time I've heard about cases like this, as well as so many stories of other assistance dogs being refused, often in very agressive ways.
    Also a pound shop recently put up a sign saying nobody was allowed in the shop with any kind of mobility aids, stating that somebody accidentally damaged something with a mobility scooter so as a consequence they were banning any mobility aids in the shop. I've also heard of so many disabled people being confronted or attacked with accusations of faking their disability or being treated like they are being demanding, unreasonable, or acting entitled just for asking for fairly basic accommodations, assistance and accessibility.
    My partner is too afraid to go shopping without a carer with her because she has been treated repeatedly like she's in the way by staff, just for trying to get around our local farmfoods. I'm almost glad I'm not actually able to leave the house or interact with the public much to be honest!

    I live in California, USA, and guide dogs are allowed to enter businesses by law. Signs are posted on entrances to the building. I believe that this is a nationwide law and is covered by the Disability Act.

    I have adhd and I'm training my own service dog just started this week and nobody has said a word to me except for a security guard but he was so sorry when I showed him the harness says "service dog" tbh nobody can see my adhd and I'm not sure how effective the dog will be but I'm going to try ...oddly enough adhd mean's I don't listen to people even when I should
