i think the defendant may have sold the list to someone else because she mentioned that she was trying to sell the list so she probably already made her money back by selling the list but she is not saying it to the judge .

This is exactly what happens when small businesses close. You sell your Client list. My father was a doctor in a very rural area. He sold his office to retire. And 2000 patients he turned over to the new Doctor. Those client lists are valuable.

I very rarely blame racism, I very rarely use the racism card but I have family in Ukraine/Russia and most older, Russian people are just culturally not fond of black people. You won't see many black people in Russia, they bully black athletes in Russia all the time. She said that the more affluent clientele were Russian and if they're used to an older white lady then all of a sudden they are told to use a young black lady that entered the courtroom like a rockstar and wearing sunglassess, good luck. I wouldn't bet on her being successful with that client list.
Scammed would require they were misled. People that bought a pet rock weren't scammed, they weren't told the rocks had special properties; they were just stupid people. Similiarly, the defendant wasn't told the list of people were going to use them. In the business world, the list would be closer to "leads", which is a list of potiental clients. The defendant was just stupid enough to buy a list of names rather than put in the work of building out a business.
This is very common! When I decided to retire as a color specialist/hairstylist after 25 years, I sold my client list. It was very amicable for myself & the new owner. She is very successful because she works hard & is well trained & certified to serve my previous clients! I hope the defendant finds much success in her business 😊

This is going to sound mean, but I’m being honest. That should have been common sense to the defendant, especially as an experienced massage therapist. She stated she was a manager at a spa. The defendant should have kept her spa manager job and started taking her own massage clients on the side. Built up a steady clientele, even if it took some years, since she had a job as a steady income. Once she had solid clientele and reliable income, then leave her job. Instead of making $11K in payments for a client list, it would have cost her less to build her own business with loyal clients on the side of her full time job.
Her contract should have said that when she paid the deposit she should have been introduced to the current client list and hear and see what kind of feedback that brought. I think she should have negotiated for better terms on the contract and be willing to walk away if it did not serve her. Hard lesson but hopefully she will be more successful going forward and astute in business.

I have sold businesses before and $11,000 for a client list does not sound unreasonable. The seller didn't seem to misrepresent her business. However, the buyer should have conducted additional research, such as average churn rate after acquisition, percentage of clients comfortable switching from an older white woman to a younger black woman, and whether it is more cost effective to spend $11,000 on marketing to develop her own list. She just made a bad business decision and the seller shouldn't have to pay for it.

The only way I would drop that kind of money, or any money for that matter, on a client list was if I was selling a physical product. Lets say both women sold vintage wine and these affluent clients consistently purchased large amounts, it is reasonable to think the clients would continue to make the purchases with the defendent because the wine is the same product, who cares where it comes from. But to offer a service that requires a personal interaction, physical touching?? The defendent was hit with the stupid stick. I wish her the best.

I agreed with everything up to her demeanor with Doug. We all know how baiting he is. He wanted her to say she’s devastated or the judge was unfair. To say she is okay and fine is not passive aggressive. No one deserves a level of our vulnerability on a national platform. She held it together with perfection. To call her passive aggressive for waiting she was fine is a STRETCH.
Professionals often sell their client lists for substantial amounts of money. However, there's no guarantee it will work out. There's no way to become instantly successful. I feel bad for the Defendant, but there are such better, less expensive ways to build a client list. If it was that easy, everybody would be following their dreams and becoming successful within a relatively short period of time.

Her contract should have said that when she paid the deposit she should have been introduced to the current client list and hear and see what kind of feedback that brought. I think she should have negotiated for better terms on the contract and be willing to walk away if it did not serve her. Hard lesson but hopefully she will be more successful going forward and astute in business.
The plaintiff is just vile, the defendant already paid over $7,000 for the foolishness. The plaintif could of cut her "losses" and let the defendant be. I hope the defendant is able to bounce back above and beyond what she could imagine and that she goes forth with wisdom & better decision making.

I have sold businesses before and $11,000 for a client list does not sound unreasonable. The seller didn't seem to misrepresent her business. However, the buyer should have conducted additional research, such as average churn rate after acquisition, percentage of clients comfortable switching from an older white woman to a younger black woman, and whether it is more cost effective to spend $11,000 on marketing to develop her own list. She just made a bad business decision and the seller shouldn't have to pay for it.

The only way I would drop that kind of money, or any money for that matter, on a client list was if I was selling a physical product. Lets say both women sold vintage wine and these affluent clients consistently purchased large amounts, it is reasonable to think the clients would continue to make the purchases with the defendent because the wine is the same product, who cares where it comes from. But to offer a service that requires a personal interaction, physical touching?? The defendent was hit with the stupid stick. I wish her the best.

When I heard that at the end I couldn’t believe it. $30,000 per year is nothing to leave your job over. Nor is it a “business” worth buying or investing in. The defendant didn’t do her due diligence. That’s wild!
Thought the same thing. In Los Angeles 30,000 is a very low profit to earn per year. 100,000 grand and up is beneficial. The business deal was poorly contructed. I hope the defendant exercises wisdom and learned from this situation in her future practices.

Why is everyone feeling so bad for the defendant?? She was a spa manager and knew what she was getting into. She paid a fee for a list of clients which she should have known was not a guarantee. Do you think the plaintiff just should have given away her hard work for free? People pay for lists of names all the time. Companies sell your information to telemarketers constantly. This isn’t some dark, secret deal in fact it’s a pretty standard business move. Maybe you think the price tag was too high but the defendant didn’t and agreed to pay it. Wasn’t the plaintiff’s fault the defendant wasn’t as good of a massage therapist to keep the clients

She was legally scammed and the lady was truly naive. That whole deal went completely over her head. The seller knew that she would not get her clientele that way. She could’ve paid 1 million it wasn’t gonna happen. And she’s a slum for that but it was easy money so I see how the girl got got. But she didn’t have to be passive aggressive with Doug. He was just doing his job.

To say she is okay and fine is not passive aggressive. No one deserves a level of our vulnerability on a national platform. She held it together with perfection. Professionals often sell their client lists for substantial amounts of money. However, there's no guarantee it will work out. There's no way to become instantly successful. I feel bad for the Defendant, but there are such better, less expensive ways to build a client list. If it was that easy, everybody would be following their dreams and becoming successful within a relatively short period of time.

I don’t think it was a scam. I think it was a bad business deal, and bad decision on the defendants part. But she signed a contract to pay the money so she owes it. Before spending $10,000, I would speak to an accountant, other business, people, wise friends, get better counsel and advice from others. I’m sure people would’ve said don’t do it.!!!
