Indian embassy charges $20 per page for the Power of Attorney document. They asked me to pay $80 for a 4 page PoA document apart from the $2 per document towards the Indian Community Welfare fund.

I gave a POA for my mother recently... I just got notarized in UPS and sent it through Fedex. (I Did not send to Indian embassy) Parents should not open the mail once they receive it. Registration officer opens its in the sub-register office and registers your POA. Two people is needed for co-signing along with the person whom you give POA. It should be registered in 30 days once they receive.

Also we need to mention the registered power of Attorney document number in the sale deed or sale agreement document for reference. Otherwise the property sale deed will not be accepted. Document writers know this step. But we need to proactively register the power of Attorney and keep it ready. Also register the power of Attorney in the registrar office where property is located. Say if you are from mayavaram, and buying the property in BANGALORE , you need to register the power of Attorney in BANGALORE’s sub registrar office where the property is located.

Hi Prem - Have couple of questions .
1. I see few comments here that we can send the notarized POA directly to the recipient without getting the attestation from the Indian Embassy. Is it true ?
2. While getting it notarized in the UPS , do I need two people as witness or we need the witness only when the recipient opens the POA before the registrar in INDIA ? Thank you!

POA will expire after death. You should give power only to very Believable person. If you want you can also cancel POA when you visit india. No worries POA can’t sell you property .

Is it sufficient that POA is downloaded in bond paper? What about the stamp duty (stamp paper) used in India to execute POA (say Rs.20/100}
You can notarized and attested the POA by embassy in just the plain paper
Again when it reaches to India, the person need to registered in stamp paper

my 2 cents tips on POA document,
Let's take the names here,
NRI - who applies and buy the house from abroad
Guardian - Recipient who want to get the Power to do the activities on behalf of NRI
POA - Power of Attorney
1. There are two types of POA documents:
a. POA to the Guardian.
b. POA to the Lenders, only if NRI opting for a Housing Loan. The bank will demand POA because they need the power to sell the house in case of NRI is not able to pay the loan amount.
1. First ask the recipient to go and meet the registerer for the POA letter format for both Guardian and Lender's formats. Because each registerer plays their own game here. I am at Neyveli and I really got suffered a lot. I have literally asked to send three times with three different formats.
2. Formality on sending NRI letter:
When NRI sending Power of Attorney(POA) documents to the recipient in India, he should send the letter to Guardian's address.
The Guardian SHOULD NOT OPEN the letter on his own, however, he should submit the same to the registerer and after the registerer accepting that the letter is sealed, the recipient should open it. Mind it. This is another play by the registerer.
3. Consulate Office: When rushing to the Indian consulate for getting the NRI papers signed, please plan accordingly as the consulate office will be opened for half a day but if you reach the office before noon, they will complete your duty and leave. Always advisable to go early and complete it.
4. Try to get the POA in Bond Paper. Because it may be useful in future and hence the quality of paper does matters.
5. While sending the POA letters to Guardian, you can also plan to send the cheques requesting by Lenders if needed so that you don't need to send them in a separate courier.
6. You know it already, if you made any corrections in the document, please sign at the side of the document so that you are accepting the change. Please sign if there are no changes as well.
