      Everyone deserves a fair trial to guarantee their constitutional rights are upheld... like unlawful search and seizure, being allowed to not talk unless they can get a lawyer etc.....but it absolutely gets my blood boiling when a defendant is very obviously guilty but the Defense Attorney tries to get that pertinent evidence excluded so the jury doesn't get to find out about it, or the Defense Attorney tries to cast blame on someone else just to try to get at least one juror to have a doubt. I just feel like if the defendant is guilty their attorney should only be allowed to make sure their rights aren't violated...but they still have to take a guilty plea
      Edit* for everyone in the comments telling me that it's the defense's job to get their client off because an innocent person shouldn't go to jail. YES I know this. When I say 100 percent guilty, I'm saying DNA evidence, witness, video evidence, digital trail etc, not just a feeling the person is guilty....but even with all these things, some defense attorneys still try to get their client off. I think that's bs

      @@scorpion-lg4ic completely agree with you. I believe what you describe is exactly what was intended in the constitution. It was never about using the system to get a guilty person off. Sadly many seem to think that’s an acceptable approach for defense lawyers to take.

      His position should not be to discredit evidence. It should be an attempt to get kohberger the best possible deal. Plead guilty, because we all know you did it, or get proven guilty and hang.

    I have seen the police blame an innocent man for a crime that he didn't commit. It was a horrible crime that he could have received life in prison, or more likely gotten the death penalty if he had been convicted. I called the FBI and explained to them why I knew that they had the wrong gut, and why I believed that I had seen the man who had run away from the crime scene moments after it happened.
    It ruined this guy's life, and destroyed his reputation. The allegations of fake evidence that law enforcement officials drummed up about him were repeated by the media, and caused me to be genuinely paranoid and fearful of law enforcement for years. This man had saved hundreds of lives at the crime scene. It gave people a false since of security, prevented law enforcement from investigating to find the real perpetrator, and it gave the man the opportunity to carry out more mass murder. I have no evidence that the Idaho law enforcement officials have falsely accused this man for killing these college students.
    But the students at the college, and other people in the community are comfortable now that the police have arrested and charged this man for the crime. I just want to make up my mind after I see all of the evidence that they have against him and his defense.
    The prosecution has the burden of proof. The last thing I want to see is an innocent man get convicted and-or the murder go free.

    What could be worse than simply assuming a person was guilty, convicting them wrongfully and letting the real offender prowl around out there to possibly murder again? None of us would be safe without good defense lawyers.

      Yes we absolutely do need good defense attorneys! People are accused of falsely of crimes everyday by police and prosecutors out of vengeance, overzealousness for re-election purposes , tunnel vision, etc It happens every day and I know many who have been a victim. I personally believe BK to be an absolute monster & guilty and I assume there will be plenty of actual evidence to tie him to the crime, but that doesn't mean he doesn't deserve a fair trial.

      Not guilty does not mean innocent. Has OJ found who murdered his wife and Ron Goldman? Do the police consider it a cold case? Are they still looking for the murderer? 9:25 I heard Dershowitz recently accuse police of planting evidence in that case.

    I've lived near Moscow Idaho my whole life. (Local news and officials refer to this area as "the quad-cities.) In my experience the reason defense attorneys here give for waving a speedy trial and putting it off for months and months is to get public attention and opinion to die down so they can eventually work out a plea agreement with the prosecution. In this case I would consider that to be a futile attempt considering it's so high profile, but also, the defendant strikes me as more inclined to go to trial to prove his innocence than he is to take a plea deal. (This is not a comment about his innocence or guilt.)

      From what I heard on another channel, the prosecution has hinted that the only plea deal that they might consider would be to take a guilty plea in exchange for life in prison without the possibility of parole and take the death penalty off the table. They are not plea bargaining down to something like a guilty plea for 20-30 years with the possibility of parole after 15 years or something like that. The parents of some of the victims have publicly stated that they want nothing less than the death penalty but they realize that not everyone is in favor of the death penalty so they would accept life in prison without the possibility of parole as a possible compromise with the families of the other victims who might not want a death sentence but that’s as far as they’re budging. I don’t think that in six months the parents who are strongly for the death penalty will have changed their minds about that. If anything the six month delay will give them more time to have experienced without their children who they miss dearly and it might make them want to see the death sentence (or life without parole) handed down that much more. I think just based upon the evidence that they’ve already revealed that they have in the probable cause affidavit alone, the prosecution feels strongly about their case and are confident in their chances at trial. Of course they haven’t gone through the discovery period yet in order to see what evidence Kohberger’s attorney has, so in going through the discovery period if his attorney can produce some exculpatory evidence, that might make them change their tune. I would imagine that the only thing that would cause them to want to deal is some kind of iron clad alibi that he was hundreds of miles away at the time of the murders or something else irrefutable to prove that it couldn’t have been him. Anything short of that is going to see this case go to trial.

Also the pings matching cameras on the very street ya that plays so those who think pings r not good enough to put him there more then once is crazy in itself. Plus at the girls job having words with them n other employees there enough to make them afraid and write in their POS system about him. Plus the fact he cleans his car and changes plates to add a plate. I mean such lame things that they are using as evidence actually in a whole are great to show he did these crimes. And I don't think you can wash blood from clothes or from cars upholstery and they haven't even said anything about weather anything showed up in the car. And to me he seems the type to wear vans just saying. If he doesn't have more then one pair seriously like a phone college kids love their vans . It's slum dunk in my opinion.

    Honestly their is nothing wrong with a defense attorney defending their client. It’s quite fascinating to see what the defense will come up with to combat the prosecutions evidence. Everyone has the right to a presumption of innocence until proven guilty and a way to follow that right is to give the accused legal representation to help fight any accusation.

    This is a great interview. The way people have attacked, ridiculed, mocked this man who has not even been proven guilty is absolutely shocking. I hope he sues everyone. This is the culture in America. If you are different, you are attacked and assumed guilty by looks alone. Thank you for this interview.

      How is it looking bad for the prosecution? It rarely ever looks this good for the prosecution. How often do they have a random item left next to the victim with dna? That is on top of all of the circumstantial evidence that we know about from one affidavit. I can’t imagine what they have that we don’t know about.

      Obviously in the court of law everyone is innocent until proven guilty. But people are free to form their own opinions and express themselves in anyway they want to even without sufficient evidence, whether that’s a detriment to the prosecution or defence. Both can co-exist at the same time.

    I’m a retired homicide detective and I can tell you that they likely have cell phone tower triangulation locations which are much more accurate as Pacific, then just cell phone tower pings

      They have a mountain of circumstantial evidence. His DNA on the sheath of the probable murder weapon is insurmountable alone. Let alone the car, the cellphone etc

      @@joedennehy386 there’s nothing insurmountable about the sheath though… contact dna only means he touched it at some point. I heard one of the experts say it could even mean it was touched by someone who had touched him and transfer his dna… a good defense could even get that taken out of evidence for trial!! I’m not saying for a second I think he’s innocent, but I’m not convinced he’s guilty either. The cell pings are something that bothers me, cell towers cover like 20 miles, yet he lives within 10 miles of where it happened… they can’t place him in that car and that also can’t even prove beyond a doubt that it WAS his car on cctv. It’s all circumstantial and circumstantial needs to be super strong to convict. There’s also the fact rear apparently the survivors heard nothing and even invited friends over hours later, I don’t know if that’s true but if it is that’s the whole crime scene contaminated and any good lawyer will absolutely knock that right out. The seeming discrepancies in the witness story…. Regardless of what we feel whether she has something to hide or not, a defense lawyer will do their damndest to convince a judge and jury that she does. This is in no way an open and shut case, slam dunk guilty, bye bye Bryan. If he gets a fair trial I can see him walking. And i hope if he did it he does not, but if he didn’t then he more than deserves that and all the people who decided he’s guilty because he doesn’t seem neurotypical need to take a good long look at themselves. I always get in my feelings when I see what people say about the guy, I have to admit. Like my son will not, cannot, eat food from a pan that meat has been cooked in… he has asd and he literally can’t stomach the very notion. He also wouldn’t hurt a soul and has frequently sacrificed things of his own to help others. He’s the gentlest boy I’ve ever met and seeing comments like the never ending “no meat in the pan he eats from? What a freak! Guilty!”really makes me question the thought processes behind the certainty of his guilt. Essay over now lol

      Well said. Thank you for sharing about your son's reaction to pans in which meat was cooked. That is not an unusual reaction for very sensitive individuals.
      I pray there is a fair trial. I wonder if his professor at De Sales who is famous for her work with some serial killers will assist in the trial in some way.

    I wonder if law enforcement and FBI have shut down looking for further suspects. If Bryan is innocent, which seems unlikely, that would mean that the killer is still out and about
    I hope they are still investigating possible other leads and individuals.

      I was a deputy for a while in my youth (I'm 76 now). I was & still have been giving my 2 cents worth, consultanting, in various criminal issues since then....now & then, here & there. Even during an Unsolved Mysteries case in '80s I asked to not to be mentioned on their program (I'd asked the S.O. to have Charles Mule followed, he was & caught in the act, on film, arrested for 29 cts CM, only 18 victims came forth in court, he spent 12, + 2 for fleeing (which is a slap on the wrist), yrs in prison....I'm adding that to my book I'm writing & why I was asked to be a deputy in the 1st place). I like my solitude privacy. Since I do not have all the facts, I cannot say for sure @ this point....how trustworthy are medias for viable info?.....we all know they're lacking.
      I can remember seeing the news that told of our arrests that wasn't what we'd told the news.....that hasn't improved thru all these decades.
      There's more to this case, aside from obviously totally horrific, that's not making sense to me. It just 'feels' there's more as to why he'd do this & was he alone in his plans.
      Perhaps it's just because he should of been smarter than this inhumane act appears (tho it's certainly best to get perps out of society) so, something is missing.
      I've always had a mind, since very small, that needs to 'put pieces together', & so far, to me, there's missing pieces.
      There's absolutely no reason for my involvement in this case hence I wouldn't even offer, they'll figure it out.....I will follow this case tho because I just gotta have things to add up. Besides, no matter how old one is, we can always learn more....I'm still learning 😁.

    I would do the same thing.
    The defense needs time to study all the evidence , gather forensics experts to weaken the DNA evidence ( No , DNA is not infallible) and prepare their counter attack.
    On the other hand , it will also give the prosecution more time to strengthen their attack.
    This is going to be a very interesting trial.

      The affidavit released only needs enough to arrest him and put him behind bars until trial. They could have more information they didn’t put in there. And that might be the only information the lawyer is going off of. He was his client. It makes sense why he would be defending him

    Clearly the authorities were under pressure to make an arrest.
    If you read the affidavit you’ll realize the evidence was completely indirect & general. The media made the evidence direct & flawless, especially the cell phone signals & the car directions. Clearly hideous!!! The car & the cell movement as described in the affidavit were like “U” shaped, how come the day after the crime his car was spotted on surveillance in Indiana? Back & forth across the states. He lives 10 miles away from crime scene, so nothing special if his phone received signals within the same radius. I can’t help but wonder what if the actual murderer still out there watching all this

    I can't remember the gentleman's name. He was arrested for shooting randomly on the interstate. Took years to find out the cops Had A Bad Case and had to make someone the criminal.

    My cell phone has pinged in Elcentro about 200 Miles from my residence. I haven't been to El Centro for at least 30 years.This has happened several times. Phone carrier could not explain why but that they have seen phones do that before. Any logical explanations?

    What kid doesn't own a pair of vans? You know the police in Idaho we're really Under Pressure to come up with a suspect. It's really amazing how people in the media and people in general are so hungry for this guy to be the person that killed those kid. This suspect is smart and I'm sure that Moscow pd. Will have a very hard time convicting .

      It doesn't matter how many kids own a pair of vans. What matters is the size of the vans that stepped in blood at the murder scene and left a print, and whether or not they can be traced back to Bryan owning THAT pair, or purchasing a matching pair. Any wear marks in the tread or the sole of the shoe (sneaker) can distinguish the shoe print from all other shoe prints. It's a whole lot more technical than simply thinking "What kid doesn't own a pair of vans"? I guess you don't find it convincing that his phone moved together with his car to all of the points mentioned in the affidavit, coming and going at specific time frames and backed up by cctv video? How do you account for that? How do you explain that away? As for the suspect being smart? Let's assume he's book smart, because if LE can tie together the sheath, the car, the phone, the vans, and any other evidence gathered from his apartment or vehicle that's being tested now, good luck w hoping for an acquittal. You say it's amazing how hungry people are to want this guy to be the killer. I have to ask... why are you so untrusting of what's been presented in the affidavit, to the point that you're so sure he isn't? I don't understand your point of view anymore than you understand mine.

    Everyone has a right to an attorney and the defense lawyers always seem to get a bad rap. Lawyers are competitive and they want to win, win, win. Understandable! But there are a lot of good lawyers who are forthright and truly care about their client. I was watching yesterday's Antifreeze murder retrial re Mark Jensen who is accused of killing his wife Julie, and at one point, the judge critically bashed the prosecuting team for not laying down their groundwork! I was taken aback by the judge's abruptness and annoyance! I don't think DarrelI Brooks (SovCit) would have stood a chance with this particular judge! No way! I don't envy lawyers at all! But God bless the good ones anyway!

      Well said! I am grateful for our legal system. There is no guarantee that anyone will not be charged with a crime. Law enforcement are capable of making mistakes and innocent persons have been charged with a crime and have even received the death penalty. Further, persons who are actually guilty can plea to get the best deal. I was once accused of stealing medication out of a coworkers desk because my office was next to hers. I was interrogated by the police. It didn't get to the point that I had to get an attorney, but during the questioning I was wondering if I would need to do that. I was threatened by the police officer that DNA could be used to find the thief. I said, "Good! You do that. Then I will stop being harassed ".

      Darrell Brooks also had a right to defend himself without a lawyer and he did a decent job. It's not just about winning. It's about making sure the trial is carried out in a fair way, even just to get a fair sentence. A legal defense ensures a person's reputation is completely accurate whether or not they're guilty. Otherwise the prosecution gets away with tacking on extraneous charges. Defense lawyers and those who choose to defend themselves should not be attacked for presenting a defense.

    Lovely man. A fair trial is now of upmost importance. Obviously the horror of Ethan, Xana, Maddie and Kaylee’s murders have happened. We wish they hadn’t!!! But here we are, now onto the next process of this horror. Bryan’s Kohberger just like everyone deserves a fair trial. I prayed so much for the victims, now I pray for Bryan Kohbergers family, and the kids families always, they are all in a pain I can only imagine and hopefully never realise. 🙏♥️🙏♥️🙏♥️🙏♥️🙏♥️

    Everything this lawyer said I agreed with. Almost all the evidence seemed circumstantial to me when I first saw the affidavit. And I do think he has the right to a fair trial . It makes me sick reading comments when people were already finding him guilty because of his appearance and major. . . There’s always 3 sides to the story. Prosecution Defense and the Truth… hopefully The jury or judge can discern the true justice.

      May the person who never tossed their garbage in the neighbors garbage can, and who never suffered from insomnia and did something crazy like wash their car or paint their bedroom in the middle of the night, may that person be the first you know to have led the perfect, sinless life! You would win the prize as the "king of garbage collection knowledge" and "God's timekeeper of every act we do that doesn't concern you".       I personally have used a neighbors trash bin when mine was full, with permission of course. And it was also my understanding that he went to the trash can at 4am, he was washing his car (winter in ID and PA) during the day. I also know quite a few people that are up at 4am everyday to get a head start on the day. All of this at this point is circumstantial.

      The American jury system is a bit problematic compared to systems where professionals judges are more responsible to deliver justice but still many people are be capable to hold that assumption and give him a fair trial in that area too. The people who can’t are the loudest but not everyone loose their ability to think clearly and judge the evidence in a fair way. Many realise that emotional jumping to conclusions isn’t justice but works against it.

      It's only a preliminary any hearing in June. Then comes the arrangement where he will have to plead innocent or guilty. If he pleads innocent the Judge will then schedule the trial.

      Yes! And it is so sad, this is how Casey Anthony got off. So many people don’t take the time to understand the way it works in a court room. Her prosecutors took it for granted too, I think. But it’s so important to be fair otherwise we end up with all of these innocent people locked up years ago -people that everyone was so sure were guilty on circumstantial evidence and then DNA gets checked and they find out the person was innocent. Sometimes it sucks but it’s so necessary.

    Sometimes it's great to have a defense attorney keep an innocent person out of jail and that's important. Sometimes they're working to get a vicious killer off the hook and I don't think anyone is okay with that. I think he did it and I pray to God he doesn't get a chance to kill someone else's child.

    I think one of the main reasons for the lawyer asking for the 5 month delay is for the media frenzy to die down. Also possibly to be able to review all the evidence as they are probably still processing some of the physical stuff. I feel terrible for this guys mother. I couldn't imagine one moment your child is a PHD student and on top of the World and then suddenly you get a call that they massacred 4 people! Its mind boggling 😢

    Just speculation.
    1. Kaylee and Madison
    The perpetrator enters the house. He pauses at the stairs to make sure no one on the second floor is awake. After this, he makes his way up to the third floor. He opens what he knows to be Kaylee's bedroom, accidently waking up the dog, he realizes she is not in her room. Promptly, he heads across the hall to Madison's bedroom. Kaylee and Madison are slain. (Reason for Theory: The room where the dog was, I would have to presume is the room that Kaylee would normally sleep in, hence accidently waking up the dog when he opened the door.) Interestingly if this is so, the question arises as to why Kaylee was sleeping with Madison that night. Had she been frightened by something or had she gone into Madison's room after they heard someone enter the house as it states in the affidavit.
    2. Dylan Mortensen
    The perpetrator walks past D.M.'s room because he thinks she was in her usual bedroom, which was on the first floor and automatically assumed the room on the second floor is empty.
    3. Xana and Ethan
    Now this part of the plot has a few variations which are plausible.
    Theory 1: The perpetrator murders Ethan Chapin first, which wakes up Xana, who in shock falls out of bed and onto the floor. Perhaps, the 'It's ok, I'm going to help you' was the perpetrators attempt at coaxing her into not fleeing in the pretenses of saving Ethan Chapin.
    Theory 2: Xana had ordered Door Dash at roughly 3: 40 pm. (this is documented) While she is eating her meal, Xana is disturbed by the commotion upstairs and upon inspection, she sees the perpetrator in the house with the knife. He is compelled to kill her because she is now a witness. Xana runs back into the bedroom, where she is attacked first, after which, Ethan Chapin is murdered. If this is the case, then Xana Kernodle and Ethan Chapin are victims by circumstance. This would explain why he would not bother going to the first floor of the house. He never intended to kill all four victims.
    If this speculation is at all true (remember at this time this is just speculation and a personal opinion) the murderer had to have been someone who was familiar with the houses floor plan and designated rooms prior to the night of the attack. With everything stated above, the murderer had to be someone they knew or someone who had seen the interior of the house previously.
    Remember, the murders were committed in an estimated total of 9 minutes. Thinking objectively, enter a random house and try to locate each and every person, stab them to death and without leaving any trace, besides a small 6 mm piece of evidence and one shoe print behind. (DISCLAIMER: If you do decide to literally try this, I am not responsible for your inane behavior.)
    Why would the murderer begin with the third floor and work their way down to only the second floor, where they would murder two of the three residents on that same floor? Why, if the murderer was targeting all four of the victims, would the perpetrator leave two potential witnesses behind?
    This was clearly a well planned and premeditated operation. The murderer would have had to be aware of Dylan and Bethany living at that residence. The perpetrator did not go into this blindly; which leaves the question of why not remove the possibility of all witnesses- Dylan and Bethany? As for Xana, the possibility that she had physically been seen by the murderer and thus, a known witness, would lead to her and Ethan's removal. In other words, they originally did not intend to kill all residents in the house, rather just one, but due to unforeseen circumstances three out of the four (Kaylee, Madison, Xana and Ethan) had become circumstantial victims.
    So, which one was the original victim? A clue might be the first room the murder entered.
    Objectively, the way this case has been built seems too hasty and too conveniently simple.

      As for stalking: There is no solid evidence that he stalked them besides the phone pings, which are vague in of themselves. Tracking accuracy can vary from 0.25 miles to several miles, depending upon how many obstacles could be blocking the tower's signal. We know the University would put Kohberger well within the ping signal at a range of 0.8 miles from 1122 King Road. This is not substantial enough for evidence of stalking. If you have any other information on the specifics of stalking it would be interesting to read.
      As for the house, the images and details were made private after being rented. Even if they were public or accessible, it still does not give enough information for such accuracy. The speed at which the perpetrator entered and navigated the house is still quite questionable. Now if Kohberger is the perpetrator (which is a possibility) had he previously entered the house without their knowledge. Could be a possibility.

      if you observe Bryan, he does not look like an evil person. they say the eyes of a person are the windows to his soul. i advise anyone who wants everyone to believe he is a villian, look at his face and demeanor again. He studies so hard and aspires to be in Law Enforcement. He does not come from a rich family. He works as a security and pizza place and teaching assistant. He struggles with depression and drugs etc. Who doesn't? But all these do not make him a murderer. It is the wrongful arrest and the malicious criticism of the media and social media that will make him a murderer. Everyone should be presumed innocent until proven otherwise. What if he would otherwise become a very good cop in Law Enforcement? Was he at the wrong place at the wrong time. We all need to put on our pair of compassionate and objective lens, He is a young man with a very bright future. I just pray God will intervene to help the cop and investigate nail the right person. We must all pray and criticize less.
