Here is a question how does a man who is considering looking overseas for potential wife protect himself from this being abused. Lets say the foreign wife does something like illegal like gets drunk and causes a massive accident. The man is still on the hook for this issue if he wants to divorce her. We know men and women cheat all the time here, what stops a foreign woman from getting a green card then cheating on her man causing a divorce? You said when she becomes a US Citizen he no longer on the hook for the support. So lets say they are together 10 years and get divorced but she became a citizen after 5 years of being here in the US. You are saying at that point she is not entitled to the support then? I get protecting foreign women that come here from problems. However there needs to be ways of reducing risk of the woman causing the problem or abusing the situation.
Courts hold the nuptial agreements cannot waive rights under the Affidavit of Support. It's effectively a risk-allocation mechanism, and the sponsor - versus American tax payers - takes the risks associated with a marriage. So what can you do? Be careful about who you sponsor. Greg
@@Soundimmigrationlaw I dont think the Affidavit should be waived because it was designed to protect the tax payers. With that then what you are said is true that when the Immigrate becomes a citizen or works 10 full years then and only then is the Affidavit not enforced? Is the Affidavit if she goes back to her home country to not return?
