      They could at least give them credit for it but I guess that's an admission of guilt. But why not just throw the guy a few hundred bucks? I guess they don't want to set the precedent. They probably just hope no one notices

      Many who wish to learn law are taught to follow the word. Not the spirit. From what I've seen anyway. There are individuals who throw the word away and keep the spirit. Those are good persons

    Disney wanted to copyright Dia de los Muertos when Coco came out. An actual foreign cultural holiday. The top people there are not reasonable

      Games Workshop tried to copyright pauldrons, aka the shoulder piece of a set of armor. Some companies will try anything if they think they will profit.

      @@Jogyot3260 Most copy the look from the original Mad Max. It’s from the 70s, so it’s not hard to see how much it influenced future apocalypse products. Fallout Leather armor is straight copy.

    Unlike Disney, Bungie has given credit to all of the artists who have had their art used in their products or videos. They own up, they admit mistakes and fix them. Disney rarely if ever does anything even close to that, and they mess up a lot lot more.

      @@gothicgolem2947 Maybe, but there are so many instances of this. Disney rerelease Solo poster because they started to get pressured from the original artist and smaller news websites started to report it. And Movie posters aren't under Marvel. Some of the books aren't published by Marvel either.

    Marvel comics are especially bad at this. Not only with Star Wars.
    The most infamous example of that is the works from Greg Land, who's known for tracing memes, celebrities, and actual porn. He (and others) even got Marvel into trouble multiple times for tracing celebrities in his comics.
    It seems to me that there's a culture at Disney and especially Marvel of tracing or just adding photoshop filters into fanart and photos (the ships aren't even the worst example when it comes to Star Wars, but the horrible tracing done in some of the comics with the characters). It's probably has something to do with the heavy time constraints that megacorporations give to their artist.
    It's faster to trace over other art than making your own. And this will continue to be the case until they have longer schedules.

      Hell, Marvel got busted for stealing the design for Tau Hammerhead tanks from Warhammer 40k years ago for it's comics.

    Bungie actually apologized for the Destiny 2 fan art theft as it was an accident, contacted the artist, then credited him for it.

    I do feel, that this is to be expected. I seem to remember this being discussed in Art College, that if you do fan-art, you can expect to not own it.
    That said, they SHOULD absolutely credit the Artists. Not even specific image credits, but a "thank you for your work," section.

      So the best we can and should expect, is credit... Or a change in the law, or enforcement of something never enforced if there is legal protection.

    Really Lucasfilm needs to develop a database for approved reference material for the contract artists they employ because typically all artists just go to google for there references and can't tell the difference between what's fan art and what is a Lucasfilm creation.

    What's kind of funny is that that artist you mention at 3:06 tracing Mon Calamari Cruiser's was actually the by far most disliked artists from the 2015 run. Mainly cause most people find his art really bad, especially the faces which are probably traced as well. Probably why no one saw the tracing for a bit cause many people just disliked all the art.

      I don't recall Land doing any Star Wars comics. I think that's Salvador Larroca, whom I used to like, but his tracing is EVERYWHERE.

    Paid artists working for Disney who steal fan art are an absolute disgrace. They should be named and shamed. I’m glad you’re keeping a record of it.

    I am a Design Student and one thing I am extensivly told is to use my own designs over and over agian. The reason is not originality, but the thing is if the design you steal (or trace) is successful and you need to make something in the same style, but different you just can't.
    Say one of the ships in the comics you have mentioned is a fan favorite and everyone wants to have more of this style of ship (everyone wants more ISD inspired ships) you just can't do it and what you come up with will not be as great.
    Getting inspired by other work is key, since you can't imagine a whole picture with every detail (even a 100% original painting has development of something you came up with), if you trace it, you don't even have to be good at what you do, so you don't even have skills to continue.

    Regardless of the legality, or even ethics and morality... it's pretty pathetic that a professional would steal work like this on a job they're being paid for. Have they no pride? Are they that bad at their job? Do they have no passion?

    I think the solution that makes the most sense is that fan artists cannot sell their designs without the permission of the IP holder BUT the IP holder does not own the fan artists work and cannot use it themselves without permission from the artist. Basically It would work both ways while still protecting the IP owners rights.
    I hope someone challenges this in a legal battle because I think the courts could make some positive changes to IP laws by the end.

      As far as I'm aware, what you're suggesting is already the actual legal situation. When an artist creates a work of art, that work of art is their creative works and belongs exclusively to them. If it's in an established IP, then they can't sell it for profit, because while the artwork is theirs the things depicted in it are not.

    I'm surprised Disney isn't taking this a little more seriously. They are paying these people to make art, so when these people rip art off the internet it makes them look bad, and Disney isn't getting what they paid for. The artists stealing the work are the only ones profiting from this.

      Realistically, Disney is probably paying these people so below industry-standard that they probably don't care. Having been an artist at Disney is probably really good for your resume, so worker exploitation is probably rampant

    Bungie is usually amazing at crediting their fan artists. During the witch queen reveal stream they had an entire section for people who made fanart. So I say that we give them a pass this one time

      We gotta convince a lot of fan artists to incorporate art from rivaling companies into Star Wars art. And report whoever is using those particular pieces of stolen artwork, for copyright infringement. Cause a corporate spat and force them to think twice. Or incorporate something obscene written in aurubesh, and report those that have used stolen artwork for use of such words. They'll have no choice but to back off from using fan art if it leads to a potential lawsuit from a peer company and/or becomes the next source of outrage.

    Ignoring the moral and legal aspects, if Disney keeps stealing designs they’re going to run into the issue of having way to many ship variants than any faction logically would

    The fact that Disney has gotten too comfortable with being lazy and stealing things without credit shows that we may need to find a better source of entertainment. Disney used to bring joy to me, now it's just disappointment after disappointment, and it doesn't look like they'll learn anytime soon...

    I think a lot of artists would be happy if these companies just give them credit for their work. Personally I'd be happy if I got to see my artwork used in some official LFL content. However if they keep using your work over and over then they really should pay you. Unfortunately Disney is never going to do this, they'd rather just get copyright law changed to do what they want. It's not like they haven't done that before.

    It sucks that Disney/Lucasfilm could prey on people who are actually devoted to their craft, like EC Henry and his B-Wing design being stolen. The only good thing to come out of all of this is that now we know what the B-Wing Mark II actually looks like.

    Fleet battle between
    Grand admiral Thrawn vs. Ender Wiggin
    Each one has an equal sized fleet with equally capable subordinates, and since Ender is from a different universe each has equal understanding of the technology they’re using. They are in command of Star Wars vessels. Pick a famous fleet of your choosing I’d suggest death squadron.

      @@shinystarmiestudios4179 it’s meant to be a blind fight. Like with the deathbattle TH-cam channel I eliminate prep time for vs. matchups. Trying to figure out how prep time would impact battles is tricky. However I believe you are right if Thrawn was allowed time to study Ender he’d probably win, even assuming Ender has the same time to study Thrawn..

    A lack of creativity and an unwillingness to give credit where credit are due. It cannot be that hard to contact said creative fan and simply ask "hi, mind if we use your awesome star destroyer?". I suspect that most fans would be thrilled by such recognistion.

    I feel like at the very least, they could have an internal "art tracing" folder, which contained all of the models of ships that they had actually made, so that their artists could easily look through it. Heck, they could even run a "competition" where people submitted art and 3d models for "a chance to be featured in marvel Star Wars comics" i.e. have their work added to the folder.

    While they keep stealing artwork.. there is actually the very talented artist out there gone astray because of no employment while these people who keep tracing them get all their job.. gawd darn! they can't even do the simplest thing that take less than a minute which is crediting the actual creator

    One of the best examples I have seen on how to correctly use other people's fan art. Reclaim the Wild. Right after the table of contents it has a page titled Artists Credits. It not only says who's art is in the book, but where it is at. Credit where credit is due.

    It is disgusting how absurdly litigious we've become. People get out of things that are obviously wrong on technicalities of the law, and conversely screw other people on technicalities of the law. There's no more basic decency and proper social norms keeping us in line anymore, and no legal system can withstand that forever.

    In art school we were trained to never plaigarise another artists work. In design college they literally taught us to plaigarise images. i think you'll find this is actually something that happens in pretty much everything that's produced. Just type the most likely keyword description of an asset into google image search and you'll likely find it on the first page. Wallmart just did this the other day with mario wall stickers, they've printed fan art of characters from an sm64 rom hack.
    Itd be great if theyd just hire fan artists but we are already giving it to them for free.

    I sure can understand this in a morale sense since I firmly belive that everyone should credit art they use even when it comes from googling. So far I have no issues with demanding that Disney and Lucasfilm should credit those behind the arts they use. Its not a huge thing to give credit and or copywright shotouts to them.
    With that said I can also understand why they do not go that path since it would risk them to be sued or persued over using those artists works and I can surely understand that Disney are in no interest to open that can of warms even if its a small thing for them to do. The risk by letting the cat out of the bag is much higher than potentional reward for such honorable mentions in my opinion.
    One option could be a sort of "thank you for referense art" note in the covers of those works. That might be a way to claim theyre contribution without risking any legal claims in return.
    And if there necesserly such a "bad thing" to find youre art used by Disney in a Star Wars issue? Shouldnt it be considered a credit that they found youre work good enough to copy in an official manner and see it as a marketing help for youre art instead? Johan.

      If I recall correctly, copyright laws are the way that they are today largely in part because of Disney. Every time that original Steamboat Willy Mickey Mouse short was coming to the end of the copyright term limit, the laws were adjusted to have a longer duration. I believe this has been done a number of times over the past 50+ years.

    It’s kinda like video games such as Fallout 4’s creation club. They take mods made by players, which they (Bethesda the company) think should be in the game and pay them a share of the sale + credit them. They could easily just rip them off and add them as DLC’s themselves, but instead they support the creators in the community

    Richard Hoeg is not really the best legal mind to be listening to in the first place. If you make it, you have copyright, plain as day. Now selling it if it's based on another's IP gets into a grey area that butts up against trademark, but that's a whole other issue. Regardless, tracing in the way Disney does it is very much a copyright violation.
    Stealing designs themselves gets into the legal weeds, however, because I have seen so many obvious ripoffs that are technically not infringement, but really ride that line. The Visions example feels like an artist riffing on another's art, whereas the comics ones always feel like laziness.

Someone, somewhere has to be combing the web for this fanart and then either tracing it or cutting and pasting it on a digital drawing program. There IS a specific person doing this.

    This is just sad. Disney basically kicks in the face of their most loyal and creative fans. Imagine Disney is commissioning someone to design a ship for a movie or comic, but doesn't pay then after the work is done. How can that be legal? And what kind of person thinks "it's okay if we screw our own fans like this just because we can"?
    I loved Star Wars and Disney movies/comics since i was a child. But stuff like this makes me think: Why should i support this company that screws their own loyal long time fans like that?

    It's the Corporate need to make a unique and beautiful thing and condense down in to something that can be mass produced. They don't let artists be creative anymore.     Honestly, like you said, I don't think this is the worst case of art theft in SW. I mean, this was basically an outsourced Star Wars project with a foreign company, so I think Science SARU somehow thought that was the official B-wing. I mean, why would you purposefully steal a ship design if you could just use the official design that has been around for decades?
    Still, I think Disney should absolutely be held accountable, specially for their mainline comicbooks and movies.

    In the case of the comics tracing stuff, that’s probably more the case of the artist needing to whip out some super slick renderings in short order… they Google “super star destroyer” and aren’t diligent about checking to see if it’s another artist’s interpretation that they are tracing. Not really Disney’s or Lucasfilm’s fault. More fault on the artist not doing their due diligence about their reference material.

    I agree with your stance Eck, but also acknowledge the fact the Lucasfilm/Disney will never honor the creators of those fan-works. I wish that were otherwise, but regardless of that, I don't let that personally get me down. I commission artwork for my own projects, create literary content tied to those pieces and/or tie them in a meaningful and relevant way. Until I receive a formal cease and desist, that will be my modus operandi. The EU isn't dead, and neither is the fandom or any of their derivatives.

    If you draw something, write something, or create something and it is for, of, or pertains to Lucas Arts, Star Wars, Skywalker Sound, or Industrial light and magic it is the intellectual property of Lucas Entertainment they do not need your permission to use it, they do not owe you anything for it. You do however get the bragging rights, and perhaps if its good enough they will approach you for a paid commission, or even a employment opportunity. it is not steeling if they all ready own it.

    Oh, it isn't just fan art of the their IP's that they steal. I remember seeing a story where Marvel got sued by Games Workshop because they stole some space ship fan art, only for it turn out to be one of the Tau ships from 40k. Edit: for those wondering, it was a Tau Hammerhead, and it was in 2016.

    I think an element of this that people overlook far too often is competency. Does Disney, let alone the folks they outsource a lot of the art too, even know these are fan works? Or do they google search the ship and assume high quality enough renders were official.

    Acknowledging one's sources and giving credit where it's due should be a given, no matter what's being used. True in academia, research or entertainment. Disney have no excuse.
    For the record, neither the credits of Akariri nor the behind the scenes featurette mention anything about the B-Wing.
    I'm willing to bet Studio Saru asked LFL to provide reference for the ship, got this and used it in good faith.

    When it comes to the Marvel Artist's copying name the names. You might not think it will do anything but getting it out there will have an effect. Disney itself will never notice but the Marvel division will. Disney is not a monolith where everything comes from one source it comes for different sections. Each one must be dealt with. It's like Hydra after all. I am a big Disney fan but I am more than aware of what they do. Comic artists stealing other's art is bad business if it gets around and management will "fix" that issue within when they notice. And Marvel has had more than it's share of screw ups for the last few years.
