2nd case was the mom's fault. You should always watch your children at ANY laundromat. Not the businesses responsibility to watch your kids.

    • @tsgrandma9837
      @tsgrandma9837 ปีที่แล้ว +20

Your right, it's not the businesses responsibility to watch your child. However, it is the businesses responsibility to place a lock on a faulty machine which they know works without coins. The owner also knew the machine locked when it started and would not unlock until it finished. A piece of paper with broken written on it is not enough. A parent could have their back turned long enough to pull clothes out of a washer or dryer and this exact thing happen. Mom was at fault as well because she saw her child climb on/in that machine and didn't stop them. I agree with the judge.

you should watch your children EVERYWHERE!!! as a teacher this UPSETS ME TO NO END!!!! watch your kids and be diligent on them behaving! YOU DONT, THEN IT BLEEDS INTO THE CLASSROOM. then be prepared to MAKE ENOUGH TO BAIL THEM OUT OF JAIL because they'll never amount to anything other than a burden on society. WATCH AND DISCIPLINE YA KIDS!!!

@@Muncho_informationnot watching her child is 100% her fault. But the woman said she knew her kids would climb into those machines as they've done it before. So she should have locked this machine or disconnected it. If she's going to allow kids to run a muck around her business place. They were both at fault. I mean as a single mum of 2 with a disability, I watched my kids like a hawk. I'd have had them help me fold the washing. And they'd have enjoyed it. I would not be letting them run around climbing into washing machines. That's lazy parenting.

And I did not need to hear that she's a single mother and that they all sleep together and are so close, etc. She tried to portray the laundromat owner as a horrible person, which she isn't, but she could have softened her approach a little. I think that's why the judge kind of sided with the mom. But the whole "thank you jesus" genuflecting at the end made me bilious.

I agree with the judge. She’s not fully responsible, yes she should have been watching them. However the machine should have been shut down or blocked off in someway so a curious child can’t climb inside. The woman could have put duct tape or something else to keep the door shut. The laundrymat is therefore liable because they knew of the broken machine and what it was doing. The mother didn’t know, even though there was a sign. The sign wasn’t specific, so she couldn’t have known what would happen. The owner did. The owner should’ve have been a more responsible business owner. If I saw a sign that said broken on a washing machine, my brain would automatically think it probably just doesn’t work as in turning on. Not that the thing fills up by itself without you paying.

@@hansenhollla6705 Listen to the video again. She explained why 1 washer can't be unplugged from the rest of the bank of washers. That said, she should have duct taped the washer closed. The lock wasn't busted. Those machines are designed for the door to remain locked until the wash completes. The woman was there with 2 kids. The kids area has 2 chairs at a table for kids. That's where those kids should have been. Or at least at the mothers side. I did laundry at a laundromat when my kids were young. I took them with me to do laundry every week. There were no kids play areas. They stayed at my feet sitting on towels on the floor. I took books, coloring books, crayons - stuff to keep them busy ON their towels. I come from the era where parents are responsible for their kids or got kicked out if they didn't keep them in line. The only thing the business owner did wrong was not taping the door of the washer closed. She should have been 20% responsible for the child's medical bills and no responsibility for pain & suffering going forward.

If the balcony banister was just recently painted he should of checked for rotting. Any time we’ve ever repainted our balcony, we inspected and checked it for mites, and rotting beforehand. I also used to work in the hospitality industry and part of my job was making sure the property was safe structural wise. Because we knew if any of our guest got hurt by a broken floorboard, or carpeting that was pulled up slightly. We were held responsible because it’s our duty to provide a safe place for people to stay and enjoy their vacation. It’s really slumlord like to not make sure your properties are properly maintained, and that they are safe for any of your guests. The first guy really shouldn’t be operating his ranch as a place for people to stay if he can’t live up to that expectation.

Agreed. However, the owner should have locked up, (pad lock), the broken machine. I agree with judge on this one. The owner is 60% at fault because it was her property and her responsibility to protect her customer's, (including their children), and herself. The very same thing could have happened while the mother's back was turned taking clothes out of the washer or dryer; which is something you have to do when doing laundry. Broken machines always had padlocks on them in every laundry mat I've ever been to.
What I do disagree with is the mother saying the owner didn't care. If the owner truly didn't care, she would have tried to stop the man from breaking the window on the machine. She didn't. At the time, she cared less about her machine and cared only about getting the little girl out. It didn't occur to any of them at the time to throw the breaker in order to cut off all power to every machine. The door would have still been locked but the tumbling would have stopped. Those machines should also have an emergency button of some kind for the possibility if this very issue.

Gotta watch your kiddos. Especially toddlers... toddlers zip into things their not supposed to be in like the flash. My kid has me looking around like a crackhead sometimes because it only takes a moment for them to seriously hurt themselves, and they don't have the sense to not do things that WE find obvious like for example... CLIMB INTO A FLIPPING WASHER... so be aware, even if you look like a crackhead 😂. It's okay though, that stage can be exhausting sometimes but it's not forever.

24:00 even if the child area is small; as a parent you ALWAYS keep control of your kids. Yes it’s terrible this happened but it would not have if she was watching her children and kept them close.

I lost it at that guy's reaction to when the judge ruled in favor of the girl who fell through the railing 😁😁

In the first case the moulage is bad. The owner’s response is incompetent. His railing should not have been so easy to break. A judgment without evidence of permanent impairment of this much is ridiculous.

    Not mentioned here.
    Did they have business insurance?
Did they follow proper building codes?
Why didn't the owner say something to mom when the business owner saw the children running around and knowing there was a potential danger present?
Why wasn't adequate signage used to inform machine out of order, children must be supervised at all times, children not allowed to play in equipment, not responsible for unsupervised children, laundry rules etc (Big, bold and highly
visible signage) a hand written sign is not adequate.
I agree with the judges decision. There is neglect on both sides

Video #2 Was definitely the moms fault. I have children 5 and under and go to the laundromat too and never have I ever, even as a child myself experienced a babysitter inside them joints. You are 100% responsible for your personal items and children. Seriously there’s signs and notices everywhere you look in them places. Mama need to take accountability, busy or not your children are your responsibility regardless of where you go unless left in someone else’s care.

The second case is honestly just bs tho. I feel terrible for the kid, no way should anyone ever have to go through that. But the thing is, the mother shouldve been the one taking responsibility cuz THATS HER KIDS, she should have kept them close and kept an eye on them. Did she do that? No, cuz if she did then this wouldnt have happened. I dont see how the other lady was 60% responsible for this

She was an invited guest and the property was not well maintained and he should have had signs posted and he should have told her not to go on the balconies ect, so that makes him 100% responsible for her injuries.
