      Many tenants, trust me. We sold all our properties because it was too much hassle. They don’t pay their rent, they destroy the property, deal drugs, fight with neighbors. I will never again own rental property.

      @@mymia1027 sounds like you got some houses in a bad area. I'm on my 5th year on 12 rentals and only went with 2 evictions. Always get references. If they don't have 3 references listed I don't let them lease

    I rented from my cousin before buying my house,I made sure he had rent in hand on the 1st of every month.When I moved out I cleaned until it was cleaner then when I moved in.Why? Because I didn’t want any gossip about me in the family 😂! My cousin does talk about me though,that he wishes I was still his renter woot woot!!!!

      Rob Mullin same here we are sadly very rare, we did not have to pay a security deposit to move into our 2 bdrm apt which we were thankfully for after 5 yrs we bought our own house but we left it cleaner than it was when we moved out, got settled into our house we never thought about no more then one day we get a check for 820 dollars I thought give it back this does not belong to us we did not pay a security deposit the company said it was for cleaning everything so nice they were able to rent it out the day after we moved and said if we ever need a place to please call them.

      I not only scrubbed the last house I rented, I painted the walls, and replaced the blinds. I own my house now, and probably don't treat it as well as I treated the rentals I lived in. I stayed steadfast friends with my last landlord, all the way up to her death. It's called respect.

    The Sheriff does NOT have the right to not evict the people. A Judge has ruled. The Sheriff is in contempt. I would report him to the court.

      We just bought three rentals that the old landlord rented to his son, and his x-girlfriend. As a summary of the crisis, he died. The stress of them costing him $500/month more then they were paying, likely was one of the reasons. Also, the son cost the estate $50,000, because he didnt pay $3000, and was refusing to leave. Be very careful renting to family, especially a drug addicted son. Plus the son is crying around town, because of the december eviction, where is the christmas spirit, while he has not paid rent in a year. His son needs to be booted out of the nest, and start living his own life. Nothing wrong with him.

      The guilt that you feel when you have to put a family member out is offset by the fact that they briuvht it on themselves. When they smoke in the house, bring in company, don't clean up and pay bills, it is time for them to go. That saying that this is going to hurt me more than it hurts you, is so true. It is painful to stand your ground no matter how pitiful they look on the way out. Then to try to pretend the eviction was not warranted, they go on social media and say bad things about you. I guess that helps them cope by trying to pay you back. The people who know the truth will support you. The one's that don't have a clue believe the lies, no realizing that they are behaving like idiots and need to mind their own business. Or, let the person move in with them. And see how they like it.

    People say it's not my house I'm not cutting the grass. Anytime you rent anything it's yours until you move. Treat it good, keep it clean and pay your rent on time it's respect to yourself and the person your renting from. Since the recession most of us still struggle and need to remember accident's happen and most of us are one paycheck away from being homeless.

Nothing in the contract States you get special privilege's. You don't pay your rent your evicted. You don't pay your auto loan they repo and your credit is ruined.       Yes when I've been a good tenant for over 2 years and I'm only short $100 that they'll get a week later I do expect them to work with me it's their loss they lost a good tenant and I made sure everybody I knew knew not to rent from him can the people I knew there didn't renew their lease and moved out so they f***** themselves not me

      Most states have laws about not executing evictions in bad weather. If you dont like the laws then get out of the landlord business or stop waiting 10 months to evict.

    I would file a complaint with the courts, the actual sheriff(not the deputy) . The deputy overstepped his bounds and had no authority to stop a legal court ordered eviction.

      @kris haskins just notify the clerks office with a copy of eviction signed by the Judge and tell the clerk you would like to make a formal complaint about the actions of the deputy during the eviction with the Judge that signed the order. The clerk will tell you what papers to file. DO NOT go to I.A every cop will know who u are and will go out of their way to make any evictions you're part of a living nightmare. Just my advice. I'm a Va. Bail Enforcement Agent so I deal with similar situations involving a few Deputies. Good luck in the future.

    It's not up to the sheriff to give his personal opinion. It's his job to do his job. They had 10mths to find a place. Let the sheriff open his place to them if he's so upset about it.

      But in some states the tenants can sue the police dept if they allow the furnishings to be put out in the rain and things are damaged. Not right, of course, but in this litigious world it's a fact - and also a fact that the people with the least skills or ambition to make their own way in the world have the best skills in taking advantage of these kinds of rulings. Sooo let their goods stay for another day or three (in fact, exterminate for the bed bugs in between!!!) then don't let them in (because they will probably refuse to leave and then you'll have all kinds of hassle getting them out), but have someone put their stuff out when the rain stops. Done and dusted.

      Not about the property rights of the building/land, but about the property rights of the tenant. Putting it on the street in the rain raises liability for damage, however small. City can be sued. No need to do it that day. Give the owner/renter a few days to get the possessions out.

      I have a guy in my house that I own, he is my mothers husband my grandmother asked me if I wanted to let my mother have a life time estate I said sure. The deed was made with my mother with a life time estate and me and my brother as secondary owner at the death of my mom it goes to us. My mother passed almost two years ago, her husband who she married about 20 years ago way after the deed was made who has no rights to the property “we done the lawyer thing it’s mine and my brothers” we still trying to get him out. We pay the land taxes, and the insurance damn free loader lol. Now it ever gets better my land runs up into the churches property and they tried to claim our land saying they own it, took my deed and survey to the court house and proved it was mine, so now they have changed for they own it my grandmother said they can use it so they have the rights to it.. lol. My grandmother died 27 years ago. Well they went to a lawyer and was told they are crazy it’s not their land, just face it if you want their land buy it from them...

      Your distance of knowledge isn't very far on this subject I dont even fuck with real estate nor have I ever been evicted and I know you cant evict someone in poor or extreme weather its inhumane you can say what you want but it's the owners fault to begin with for allowing this to go on so long

      @Charlene Robertson girl....do you know I just went through this crap with my cousin. He's a 47 year old ex con. Never ever had his OWN appartment. Always ALWAYS lived with a woman. That should have been a red flag right there. But...he was family. And I was stupid.
      Anyway, he lived with me and my mom for a whole year rent free. Getting him to partially pay for utilities was like pulling teeth. By month 8 I was ready for him to go. The last straw, was when he physically assaulted me, my mom who is immoble and blind, and our 85 year old grandma. I had to file an eviction notice which gave his non rent paying ass 30 days. I even got a restraining order and pressed charges. This happened August 20 and today it's September 2nd. I had a lock smith change my locks.

      In DC they can't evict you if it is raining, if rain is in the forecast, they won't evict you, I used to work on evictions.

    In Ontario Canada eviction day means eviction day that's it you pay $300.00 for the Sheriff to use force if needed to get the bums out. You have a court order in hand signed by a judge or justice of the peace dated for that day only!! Not if it rains or snows it's all called off?? WTF In my case I already waited up to 3-4 months by then!! TIME TO MOVE!!

      What state is this? I used to do evictions for a mortgage company, and our attorneys took care of this stuff and we just had a company go in and clean it out once there was an order.
      In some states, when they leave behind the contents and it is worth something, not just trash (values vary across states), then you have to do a possessions eviction.

    I'm curious. What would have happened if the owner went ahead with the eviction WITHOUT the Sheriff's consent? The Sheriff was already on the property and the owner could have just started moving stuff out. Would the Sheriff arrest the owner? Then that would be a major lawsuit against the Sheriff's department in my estimation. The Sheriff was in the wrong and since you had everything on video, you would have proof.

      Most cases if the owner starts without the Sheriff's consent the eviction can either be stopped for now and the owner arrested which is rare. Usually it's just a fine or warning. Even if they're arrested you can't sue just because of that.

      Many counties will not proceed with evictions in foul weather. They sometimes hold them over if elderly people or small children are involved.

    I have moved people out at the landlords expense, I put it all in storage and pay the first months rent. It's up to the tenant whether they pay the second month, but at least we are rid of them.

      They get 14 days notice that they are definitely being evicted too. So it's not like they didn't know. I can only assume that the tennent assumed that they could get away with it because the house owner was family. Which is very likely why the situation had gone on for nearly a year, the landlady obviously gave them the benefit of the doubt for far longer than she needed to. This type of situation exemplifies why it's not the best idea to do business with family. It's sad to think that this situation could a huge rift in her extended family possibly for decades.

      @A. G. I used to be a landlord. I evicted tenants. No, getting a lockout is totally normal under certain circumstances.
      My state calls for removal on the day of eviction, but if a tenant would have their stuff destroyed by rain, then of course they'll give a delay. Eviction is not a malicious act under the law. It's not meant to cause unnecessary loss or destruction.
      Also, I am not a liar. My words have a lot more credibility than your ever will.

Never checked to see if it was legal cause I never had a problem with that. My house ain't always spotless, it's sometimes lived in but I'm not destroying it so I have no problem with inspections with a 24 hr notice.

    Back when I did evictions in the early 80's we'd straight take their stuff and put it in my bosses storage, they wouldn't get it back until they settled up with him. If they didn't settle up they'd get charged for storage and a bad mark against their credit. My boss was a slumlord in T-town in the ruff areas, we'd show up deep and ready for fallout and it got hairy with some drug dealers several times, I didn't mind evicting them, they suck. Then one day we had to evict a Vet and it broke my heart, he showed up begging us to give him his bike back and since my boss wasn't there yet we said take it and ride. Got fired a week later. I was looking for a job when I found that one so I wasn't worse for ware about it...

    I use to do rent court. Some of my clients had tenets making particle payments, no payments, for more than 10 months. I never took case were folks were related. Problem is, not everyone is cut out to be a landlord.
    I don’t know why you’re surprise. The sheriff don’t evict folks in the rain or snow. Not new, just disappointing to an eviction company.
    Hated rent court, so I ended that business.

    It wasn’t raining ten mos ago when she stopped paying rent I have lost jobs and went straight to my landlord to let him know the situation and if it takes me 2 mos to fix the problem I evict my self leaving the apartment exactly how I entered my deposit goes to one month and as soon as I get a job I’m making payment on the month owed till paid in full with 10 percent interest. No big balance and still have landlords respect and he at least gif to rent out the property to someone else

    If you can never rent to a family member, and secondly don't become too friendly with your tenants. It might sound a little harsh, but if you become too friendly, they might use an excuse to miss one week's payment, and because of the nature of your relationship, you believe them, soon it becomes two and then three missed payments and so on.

    I own properties in Michigan and here I don't believe the sheriff can say anything about it he is there for one reason to overlook and that's it on my last eviction it was april and the judge said straight out you be out or you will be moved out RAIN SNOW OR SHINE the sheriff that day which was Friday said they were moving and didn't have much more in there and said it would be easier if I could give them 2 days till sunday but it was completely up to me so I gave them till sunday when I came back sunday they were gone but...……………….. there was a funny smell !!!! they had been throwing all the garbage in the basement not even in bags for about 6 months I called the sheriff back out he said without them there that he couldn't do anything and I should have had them removed on Friday like the judge said I told him it was his idea to give them extra days he got mad and said but he didn't make me ………………….. ok no more mr. niceguy from now on its while the sheriff is there rain snow or shine there out bye bye !!!!!

    The laws are worse in NYC. Civil Court judges will allow non paying, destructive tenants to stay in your property forever. All the while your mortgage gets further into arrears. I’ve literally seen little old ladies lose their homes and become themselves homeless. That’s what happened with my My first investment property; turned into a nightmare that knocked me out of the game for a few years. I should have had at least 3-5 properties by now.

      hell i got sick bad was in HP for 2 months after that i was at home medical bed machines everything and was evicted the cop came in and started telling the owners go ahead and unplug the medical machines monitoring me ended up calling 911 on him medical had to come move me first before they could start anything ..

    I'll tell you what happened to a friend of mine who's Tennant refused to move and had roaches and bed bugs. After 8 months of fighting with them and the Sheriff my friends waited till they went on vacation and they moved all their things to their families home and they knocked the house down. The house was beyond repair.

Have tarps ready and perhaps the sheriff will be more willing to disregard the weather. Or even just some cheap plastic sheets to cover everything w/, even cheaper than a tarp.

    Technically the Sheriff was wrong but it was a blessing in disguise. Everyone that would’ve touched their belongings could’ve taken bedbugs home. Am I the only one who sees an unexpected blessing from this? Because trust me when I say you DO NOT want to deal with a bedbug infestation in your home.

    It was due to the weather conditions. Now,had it rained after their stuff was put out then so be it. So a lock out was the best thing. The owner went without payment for 10 months and she was still trying to get the money. I think she just wanted these folks to pay. They pushed her hand with the eviction.

    That point you made about mortgage companies is 100% factual. Why does there have to be all of this discussion and exceptions made for evicting tenants when the time finally comes cause it's raining? When the mortgage company says the time has to get up outta there, you WILL get up outta there through hell or high water, 0 discussions lmao.

    Bed Bugs. Had 1 bad tenant at an apt complex I lived in bring them. He infested the entire unit. Everybody threw away mattresses, couches, bunch of clothes, and moved out. I ran all my clothes through a commercial dryer twice and let them sit in a storage unit for 2 years. Had all my appliances sprayed outside by an exterminator. It was expensive. Bed Bug anxiety is real and nobody understands until they experience. It's afraid to stay in you own place. The cost of treating this empty house for bed bugs will could be about $1000 or more. Depends on how infested.
    All of these guys that went into this house need to strip completely before entering their on home and double dry. I never want to experience that again!

    I’ve done evictions with the Sheriffs for 10 plus years and they have never once hesitated. I’m from CA and they say when they hit the door “time to go it’s eviction time” they clear the house and tell everyone to get out and I get the locks changed. The only difference is we may allow someone accompanied with with me to move their items for a day or two during a certain. Time but they can no longer stay at the unit and I have too secure the property at the designated time. This will save the owner time and dump fees. On top of all the lost rent.

      That’s exactly how its done across US, timeframes. May change, ability to get a stay due to hardship - but it must be done before the sheriff gets to the door. A tenant can even get in front of the judge for a hardship extension up to an hour before, Judge allowing, but once there no more moves.

      Even mortgages from the banking lenders have 15 day grace periods- usually the 15th of the month- as do most rentals- usually until the 5th of the month.. Don't play apathetic. In addition, one can pay a late fee due upon next months mortgage payment or rent.

      Not in Texas. A writ of possession can not be executed when it is raining, sleeting, or snowing.

    It's not up to the sherriff, since when does a sherriff overrule a judge? NEVER!! Bc the judge does the eviction and rules over the eviction, so the day the paper says is what you go by he was straight up lying he must know whoever it was! Bc the whole judicial system would be even worse than it is already if a sherriff can overrule a judge, lol!!! Now if it is legal in this place then something is really wrong!!!! What a joke, not to mention that sheriff has to much power he can ignore a judge's ruling and keep someone out of their own home until he says its ok, and waste the owner and the 4 people she brings and the people helping move and the camera man's time! Yall need to rewrite some laws there, lol!!

    Very sad for the owner who obviously tried to work with the tenant and then got the shaft from a sheriff deputy. In California, we get a writ of possession and the sheriff allows you to enter and re-take possession. We do have to store any remaining belongings if the value is over $600. The tenants sometimes claim their broken furniture is worth thousands and they left brand new clothes and expensive jewelry behind. That makes pictures and videos worth gold.
    These people who are still there the day of the eviction are unbelievable, but it does happen now and then.

      Same here in Pennsylvania make sure you take video of all the tenants property so they don't say they had solid gold chairs and the are now missing.

      I think EnginePaul was trying to say the writ of possession allowed him a tool that would have prevented what happened here. Preventing the damage or theft of expensive personal property is reasonable if it was you that was getting evicted as people do have life smack them in the butt w/o them being at fault. But of course, that's usually not the majority of evictees.
      As for California & their laws & regulations. Yes, it definitely has expensive areas, but businesses thrive in California, it's the 5th largest economy in the world & the state budget is handsomely in the red. If you're an independent, maybe you could set up shop in a lower priced, homier location...a lot of people commute to live in same.

I don't think it was real gold but my mother was a single mom to nine after our father walked out and she worked full time and was proud that she could get it.

      Would be a waste of time. They can't pay rent for 10 months, so it would be like squeezing blood from a stone. I'd count my blessings just finally getting them out.

      You have to pay a fee in small claims court to sue them plus you have to provide the court with the ex tennants new address so that they can go serve them, then you have to wait up to 25 days before you get a court date. So your out the rent money then the fee for court then the extermimator money, then you have to get the apartment back in shape so you can rent it again and hope that this time he/she is a good paying tennant.

      You're not understanding the court system or lawsuits....
      1) Lawyers take PI ( Person Injury) Class Action, Employee Discrimination type cases on contingency...if a) They see POCKETS big enough to get PAID and/or b) They feel they have a chance in hail to WIN.
      They are essentially becoming PARTNERS with the person who slipped and fell to SPLIT the LOTTERY winning...if it seems like the ticket isn't a winner, it ain't happening, period. ( There are some media slut lawyers that will stand in front of cameras for Free publicity, before bowwing out onnce the case doesn't settle quickly and the lights are gone...can you say Gloria Alred?)
      2) So this typecof case falls under neither category....no lawyer is going to VOLUNTEER to NOT get paid, along with the poor sap of a landlord. Lawyers (unless it's cousin Ray Ray for practice) aren't in BUSINESS to just work for 'free'....it's amazing how many ppl in the public think 'their' work/time needs to be paid but don't think most lawyers wanna a guaranteed check for the work that they do ( again the lottery lawyers work on 'commission' to get cases and they take a HUGE portion when they win to offset the time spent on losing cases...it can be a tough racket) but regular landlord/tenant, personal lawsuit etc cases are work for PAY cases....
      3) As mentioned, one can't be a landlord if their going to get in their feelings and think that they ate gonna recover, that kind of nonsense in American courts.
      Just not gonna happen, this is why landlords take security deposits and do background checks....
      Landlords are STUCK with all types of B.S. with tenants and the stuff that happens EVERY month in 🇺🇸....truth is you aren't gonna get CRAP, nada, nothing, air
      Either understand that or get out of that business....sure a judge will allow a landlord to keep security IF the paperwork and/or notice is done absolutely properly or you might OWE the tenant if you mess 'that' up.
      But you may as well blaze up a fatty if you think you can't get RENT that you have legal paperwork on the exact how much and it's plain as day the tenant consume the rental unit w/o paying that they'd successful win some OTHER money when you can't get THIS 💰....
      As if THAT 💰 is going to EVER appear vs back rent, the BEST you can do in most cases is PAY to get access to your own property so that YOU can PAY to get it ready for your NEXT roll of the 🎲 worth of tenants.
      Tenants is like dating or a box of chocolates....you really don't know what ya got till you get deep in there but at the end of the relationship, you're just lucky you survived, the 💰 is gone but some of the headaches and extra pounds ain't going anywhere

      @@ericstewart517 well my landlord pressed charges a day before the agreement date to pay the rent one month, AND charged us for refusing to vacate when she never gave notice to vacate in the first place. Then she realized I had every conversation in text message and dropped the charges. Landlords can be real bitches too. And I didn't think a lawyer would be necessary to sue the tenants for damages

    I would’ve been selling those things giving things away, found an agency to help me get a job revamp my life and met God half way. However I do have a heart and I don’t like for this to happen I’ve been homeless however I was homeless for a reason I would show my heart by making pamphlets to give to these evicted tenants to get there life on track to show them hey I care but you gotta care 1st now this is a lesson to learn here’s the help I know that will help you.
