    Hi Atty. I am your valued listener, from Toronto, so ang issue, noong 1996 naibigay sa amin ng byeyanan ko ang titulo ng isang kapirasong lupa na nakakapangalan pa sa kanya, pinahintulutan na kaming mag patayo ng bahay , so may bldg permit and other documents para maipatayo namin ang bahay..
    After 5 yrs. pumanaw ang byenan ko na di pa naililipat sa pangalan namin ang titulo..
    2011 sumonod na pumanaw ang asawa ko (voidable po ang marriage namin).
    After na mailibing ang aking asawa ay pinalayas kami ng mga kapatid at pina upahan nila ang bahay namin at kahit singko di kami binibigyan ng aking anak..
    Hawak ko po ang original na titulo na under pa sa name ng byenan ko.
    All construction documents and expenses/ receipts are under my name. Ako po ang nagbabayad ng amiliar, pero I stop paying since pinalayas kami.
    Ang tanong ko po Atty. ay paano po mapapasa amin ang property. May habol po ba ako sa monthly rent?
    I need your legal opinion po at ano po ang unang hakbang na aking gagawin.

    Sana po mabasa ninyo ito, Atty., at mabigyan kami ng kaukulang advice about dito sa concern ng parents ko.
    We have been in this parcel of land owned by my mother's uncle (with Tax Declaration na nakapangalan sa uncle ng nanay ko) for 36 years na. I remember I was in grade 2 or grade 3 noong magsimula kaming tumira dito (year 1987). In this parcel of land, nagtanim ang tatay ko ng mga cassava. Ang bahay namin that time was made from nipa. Walang anumang kasulatan between my parents and my mother's uncle sa pagstay namin sa kanyang lupa and even sa pagpatayo namin ng bahay made of nipa dito sa parcel of land. This uncle left for Manila noong maliit pa ang nanay ko. Ni minsan, hindi siya umuwi para kumustahin itong parcel of land. Even ang mga anak niya ay hindi rin nakatuntong sa lugar namin. Ni hindi nga alam ng mga anak ng uncle ng nanay ko na merong parcel of land ang kanilang tatay sa probinsya.
    One day, noong 1987, nagkaroon ng Cadastral survey. Kami ang nasa possession ng lupa noong time na iyon. As I have mentioned, merong mga tanim na cassava during that time. Hindi alam ng parents ko what had happened after the Cadastral survey pero ang alam lang namin na open, notorious, exclusive, continuous at peaceful ang pamumuhay namin sa lupang kinatitirikan ng bahay namin. As the years went by, meron ng mga improvements na ginawa ang parents ko sa bahay namin. This time, nakapagpatayo na sila ng concrete house (1993). Then late last year, nagstart na rin magpa-renovate ng house ang parents ko. Before kami magpa-renovate ay napag-desisyunan namin na mag-apply for titling muna. So, we gathered all the necessary documents at nagpunta kami sa ROD para magpatulong papaano ang process sa titling. Noong nasa ROD ay nagulat nalang kami kasi binigyan nalang kami ng Original Certificate of Title at ito ay nakapangalan sa nanay ko. Itong OCT ay na release pa pala noong 2015. Nagkaroon ng OCT ang nanay ko dahil sa Free Patent.
    Then early this year (2023), isa sa mga anak ng uncle ng nanay ko visited our place. Nalaman daw niya, through his nephews and nieces na we were collecting documents for titling sa lupa na kinatitirikan ng bahay namin. Ang sabi niya, ibebenta daw niya ang lupain ng tatay niya (patay na po pala ang uncle ng nanay ko noong 2021 pa). Itinanong niya sa amin kung bibilhin daw ba namin ang lupa. Ang sabi ng tatay ko ay hindi dahil may titulo naman na ito na nakapangalan sa nanay ko. Then, three weeks ago, naka receive nalang ang parents ko ng summon. Nag-file ng civil case ang anak ng uncle ng nanay ko against my parents: Nullity of Title (Recovery of Real Property) with Injunction and Damages. Kesyo daw hindi naman ibinenta sa parents ko ang lupa, hindi din daw donation but out of goodwill and tolerance lang daw ito ng heirs ng uncle ng nanay ko ang pagpapatira sa parents ko sa lupa na nakapangalan sa tatay niya ang Tax Declaration. Ancestral lot daw ito. Hindi ko lang alam kung nagbabayad sila ng tax eversince pero lately for 3 years, kami na ang nagbayad ng amilyar (2020-2022). Ni minsan, wala ni isa sa kanila na heirs ng uncle ng nanay ko ang umuwi sa lugar namin to check this parcel of land. Ngayon lang dahil sa mga sulsol ng isang kapatid ng nanay ko. I have a convo through messenger dito sa anak na nagpapatunay na hindi niya alam na may lote pala ang tatay niya dito sa probinsya..
    Ano po ang maari naming gawin, Atty? Meron silang hawak na Tax Declaration. Kami naman ay OCT. And we were in this parcel of land for 36 years: open, continuous, notorious, and exclusive possession.

      Base sa narrative mo you have an upper hand over the property. The issue is a matter of evidence in proving acquisitive prescription. Dahil mayroon na kayong summons na natanngap, secure the services of lawyer upang masagot and oppose the complaint upang di kayo ma-default.

Yong kaibigan ko po ay nasa U.S. meron syang Deed of sale, and certification which is fully paid na sya sa lupa sa isang subdivision nuong 2017 pa. Bale ngayong 2023 hindi pa po nalilipat sa pangalan nya ang titulo. Tama po ba na kapag bago na ang president nila papalitan din nila or gagawa sila ng bagong Deed of sale and Deed of restriction para malipat sa kanya ang TCT?       Inilipat ng assignor o ng may-ari ang kanyang rights sa lupa sa ilailim ng isang titulo sa ibang tao sa pamamagitan ng deed of assignment, ang deed of assignment with consideration ay para na ring deed of sale.

Pero bakit po yung binintahan niya lagi siya pinaperma hanggang ngayon yun po di nmin alam tapos death of sale po inantay. Ang tanung lang po pwede pa po ba mabawi nmin yun ang lupa kahit 20 years na nakalipas or hindi na ask lang po ako attorney sana mapansin salamat po .

    Good morning po atty.ask ko lang po kung may habol po ba kami sa lupa na mana po ng aming ama sa kanyang magulang na ibenenta po pala ng aming ina na wala po kaming alam po at bilang heirs po wala kaming perma sa deed of sale po at ngayon lang namin nalalaman mahigit sampong taon na pala ito mahigit sampong taon na pala itong ibinenta ng mama namin may expiration po ba ang aming karapatan sa pag habol sa lupa na di namin alam ang bintahan po?     Good day atty.., paano naman kung ang ninotaryuhan ng lawyer eh UNILATERAL deed of absolute sale pero may mga conditions naman na nakalagay doon like naibigay na yung susi, nacheck na yung bahay at nagkaroon ng turnover kahit di totoo, pero walang kaalam alam si buyer/owner kc nasa ibang lugar siya, in fact, wala siyang consent sa nasabing unilateral doas, si seller lang ang nakapirma at ang witness empleyado din niya, pero ninotarized pa din ni lawyer? Di ba yan forgery o fraud? Pwede bang ireklamo si lawyer sa ibp? Itong si lawyer ay VP din ni seller? Kaya masasabi din na may vested interest o imoral o may conflict sa interest si lawyer? 2nd scenario naman, may isang bahay naman na namana ang 5 pamilya galing sa namayapa nilang kaanak. Pero nagbentahan yung apat walang kaalam alam yung isang pamilya. Nabisto at nakakuha ng kopya ng kontrata itong panglimang pamilya na hindi nila isinali? Nakalagay sa deed of sale nila, yung bahay ay apat lang may ari bale tig 1/4 sila? Di ba yan forgery o may fraud/deceit din? Hindi ba liable si notaryo publico jan? Kc ninotaryuhan niya kahit ang nakalagay doon na may ari 4 instead na 5? Cguro naman yung abugado humingi ng kopya ng titulo, extrajudicial settlement at nagtanong? Kung sinabi noong 4 na sila lang ang may ari, lusot na ba si notaryo publico? Paano kung hindi dineny noong apat at inamin nila na 5 ang heirs o may ari, kaso yung panglima na heir nakipagswapping sa ibang property kaya apat nalang sila, diba dapat humingi siya ng katibayan muna kung totoo, like extrajudicial settlement? Hindi iyung basta basta nalang magnotaryo? Pwede bang ireklamo si lawyer kapag ganyan naman? Diba yan null and void mula sa umpisa palang.., parehas yung first and second na kaso? Diba ang prescription period maguumpisa kung kelan mo nalaman o nadiskubre? 30 years ba ang prescription period kapag ganyan? Ano naviolate nilang mga batas, sa first and second na kaso?

However, in the TH-cam platform, there is a compelling need in use of Pililipino-tagalog language for the sake of our "masa" viewers who are more comfortable in the use of Pilipino-tagalog language.
