      Maneesha Mukhi, Immigration Tips Hello, a question, my sister-in-law is an American citizen and submitted an I-130 application for my brother, they are married, the I-797c form was received on July 30- 2018 and then the I-797 was received and said that his case was sent to National Visa Center on August 16, 2019, my question is how long does it take to receive the welcome from the Visa center and follow the 6 steps because today's date is already more than 1 year since the center was sent of visas

      What if people outside usa have their prioriry date become current what is the process for them to move forward with the application?

    This was an excellent explanation on priority dates and visa backlogs, thank you for your time. I would like to point out there are many cases where the applicant is in the US but will have to do consular processing because of an illegal entry. Even though he/she might be a spouse of a USC, this will still require consular processing, just because this wasn't discussed in this video and I got the idea that as long as you are filing through a USC spouse you can adjust inside the US, that's is not the case- from my experience.

    Thanks for this incredible information. I'm a US citizen who filed for my wife and children, but because of the slow processing at NVC due to the pandemic, I've been following the Visa bulletin for fresh update, not knowing I'm not suppose to worry about visa bulletin update.

    Good Afternoon, I submitted an adjustment of status and it was ejected it said that there were no visa available for my priority date. my priority date id April 30, 2001 and I am an F4 category or Mexico . I checked the bulletin for April 2024 but it has no C. letter on it or a U letter. How do I know when to submit my I485.

    1) What is the benefit of applying for 485
    2) What is that we get from USCIS when we file for 485 (485, EOD, AP)
    3) What is AP
    4) Can we travel on 485 if we do not have H1b
    5) How many years we get 485 for (Should we keep on renewing)
    6) Do we need to do medical everytime
    7) If we want to stay on H1b and also get 485 Still the pain of going through the client letter and stamping is their
    8) Can we change employers after getting the 485
    9) If we change employer do we need to apply h1b then again go through the process of GC labor , 140 and 485 again
    10) Previously we were maintaining just h1bs going fwd we will be mantaining 2 doc- H1b and 485

      The 485 is the last stage of the green card process. You file the 485 so you can get your green card. It's not something you renew - you just wait until it's done processing which can take anywhere from 8 months to 2 years, but processing timelines are always changing.
      AP is a travel document that lets you travel in and out of the country without abandoning your green card process. So it's a good idea to apply for the AP along with your 485 (in case you need to travel). You cannot travel using a 485. It's just a form you file to adjust your status from H1B to permanent resident. If you change your employer and your job is materially different, then yes you start the green card process all over again (but might be able to keep your original priority date - you'd have to ask a lawyer about that).

      Also - your company lawyer can explain all these things to you in more detail (except for switching employers, don't ask your company lawyer about that).

    My son's priority date is Aug. 27 2015, Final action priority date for October 2020 is July 22nd 2015, do we have to wait our priority be current or can anybody do it with anticipation. Great videos, you do it with simplicity which makes them easy to understand.

      What category is your son? Is it an EB category or one of the family? For anyone waiting to file form I-485, you can use the Dates for Filing Chart dates in October. But yes you do have to wait until they get to August 27, but hopefully it's coming soon, you are getting close now. Just make sure you are looking at the right chart.

    Hi, during the pandemic (may 2020), i received the letter that my my immigrant visa petition was approved, and that i have to log in into the CEAC to submit all documentations and pay the IV and AOS fees.
    But was not until past week (may 2023) that i was able to submit everything.
    My priority date is: 02-NOV-2015
    Preference Category: F2B
    VISA CLASS: F24
    i do not understand very well the Visa Bulletin.., what is next?
    What should i have to expect?
    How long do i have to wait for the next step?
    Has my priority date passed?

    Hey thanks this was very informative. You had given an example with the Netherlands saying their application for a green card may take less time than the average. Would the "All Chargeability Areas Except Those Listed" column be applicable to a country like the Netherlands since the demand for green cards would not be as high ? Therefore the date for Netherlands may be sooner than the dates listed on the bulletin ?

      Thanks for watching! The first part of the process, Form I-130, will take the longest. Processing times for the I-130 vary by which service center your application goes to. For example, the Nebraska Service Center estimates 12-16 months to get an approved I-130, but the Vermont Service Center estimates ~17-22 months. Then your case goes to the NVC and you should get an interview a few months (sometimes more) later. Right now, interviews haven't been happening because of covid, but if you are just starting the process, by the time your I-130 gets approved, Covid will be over. I can't say for sure, but I'd guess 1.5 -3 years for the whole process start to end (assuming F2A stays current) depending on where your application gets processed and what's going on with the USCIS. Hope this helps!

    Hello Maneesha, Can' t appreciate your work & videos enough here. Very informative. I do have a couple questions though, (i)Our EB2 PD is July 2013, Would you suggest we should apply for a Downgrade or should we wait for the Nov'20 Bulletin and possibly the EB2 dates would be allowed to file also? (ii) Are we too late already to work on the Downgrade, as my employer has not yet approved the downgrade?

Quick question- in an example where say the priority date is june 5 2015 and the visa bulletin for the associated category lists the date of August 2015 then would the priority date of june 2015 qualify or the month of priority date should match with the month of the visa bulletin? Since I get married end of September, I wonder if this is too late to send my DS260. So is there a deadline or any disadvantage to sending it a little later (but before October begins)?

    My priority date was current in filing date and used that to submit the documents. Now the documents are in NVC. My question is that unti my priority days is not current in final action date, my interview will not be scheduled. Am I right. Even if my documents are qualified?

      From what I understand... Yes that is correct, just make sure you are reading the date for the correct category and country.

      Have you watched my video called "Applying for a passport for the first time" It talks about how much it costs, etc. As for the wait, they seem to be getting through the backlog and have said normal processing times are resuming this fall.
      People seem to be getting their passports back anywhere between 2 weeks to 2 months currently (based on all the viewer comments I've been getting). If you're traveling in Jan, you should be more than ok if you apply now..

      Yes they can migrate with principal beneficiary only if they are under the age 21 and are unmarried

Can you please elaborate on how a country that doesn't use many green cards each year, can move faster, when on the bulletin board the 'final action date' for 'all chargeability areas except those listed' indicates that there's a 15 year wait (f4 category)?     Hi, if a person won DV lottery and he is in US legally, he can just file I485. If he needs to wait some time until his runs # becomes current? How to check if it is current?

      travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin.html This visa bulletin tells you the cut off dates that are being processed. Scroll all the way down to where the DV charts are.
