Ever wonder what the difference between a lawful vehicle repossession and grand-theft-auto? Ever wonder what the difference is between kidnapping and the Child Protection Services lawfully seizing a child? What's the difference between Trespassing and Lawfully possessing property? How can the IRS levy your wages or bank account without a Court Order? A private administrative process allows rights to be enforced without a Court Order, because there are too many things to get permission and mediation through a Court, and they are not all required by law. Your paperwork (or your RECORD) between the parties (a Contract or a Trust Indenture) and the record of other communications between the parties (Notices, Notices of Default, Conditional Acceptances, etc) is going to give someone the right to file a lien, seize property, etc.

When signing a contract above your name according to ucc1-308 you reserve your rights without prejudice meaning you're not giving up the Constitution rights to a contract this protects you from any obligations for you to perform something without knowing or volunteering which does not disclose everything in the contract according to truth and lending act all contracts must have full disclosure nothing hidden. Signing your signature using UCC 1-308 secures not to perform to any obligation that is not true.

When you pay off a mortgage, a bank will not always send a closure of account, meaning, they still technically lien your house after you pay it off. Dont be an idiot and sue them. Simply call the bank you dealt with, ask for a lien release statement and close the account officially in writing. A day later, they send you a document releasing lien over your house. You sound tough, but being professional eliminated a lawsuit time and money. I NEVER THREATEN WITH ATTORNEYS or lawsuit. Everything I do consists of lawful negotiation of contract, not bullshit or bullying people.

Just sealing up my conditional acceptance of law enforcement oath, in exchange for my willingness to pay and even go to jail; so as long as they can prove any potential claim against me the private man. This way, silent acquiescence is agreement, and I'll be looking for a judgment in ESTOPPEL if any demands/ presentments are given to the debtor I represent.

Just a point to consider.. social security and unemployment are essential relief benefits for times of incapacity to support the life of the person. We like to think that we will never encounter a circumstance where we can't support ourselves, but, it is a reality that most people face at some point in their lives. I am a little concerned for many of the so-called sovereign citizen movement, because if they give up their citizenship then they might lose a relief benefit that they may legitimately need someday. Conservative authoritarians don't want to pay for anyone's basic essential needs and they want everyone to rely on people's charity which is, at best, unreliable. Also, what happens if a sovereign becomes disabled? Do they lose eligibility for disability benefits because they are no longer a citizen? I'm not trying to be obtuse and I hope you see my point.

Question... so in family court, your ex filed false drug abuse claims on you, you took a hair folicle and passed but still they took your kid and forced you into weekly drug tests, they gave full custody to your abusive ex, court ordered that the only way you can talk to you son is through supervised phone calls that the court order were to be supervised by your abuser. Everytime you called to talk to your son your ex would be yelling and screaming at you calling you names and making up lies all while yiur son is on the phone, barely letting you even speak to your son. Courts refused to stop it. Then files to have yiur rights severed saying yiu abandoned your son and yiu were abusing drugs. You have 3 1/2 years of clean drug tests, but yiur lawyer refusing to allow you to enter in any evidence older then 6 months or call your witnesses, your ex edits a bunch of drug test resukts making it look like you fsiled a bunch of the drug tests. Since your lawyer refused to enter in your evidence, you prove to your lawyer that your ex edited a bunch of the documents almost all of his exhibits are doctored or edited and giu have proof. Yoir lawywr finally tried to enter in proof, but the judge and yiur ex's lawywr refuses or objects. Yur lawyer says that your ex's exhibits were forged. They denied letting allowinv yiu to enter in your evidence and says they would just remove his exhibits, the judge allows it and then has it destroyed and has the whole conversation deleted from transcripts. Then the judge makes their ruling based on the evidence that was "supposed" to be removed and ruled in favor of your ex after proving they have an untreated mental issue and no evidence or proof was provided, but the judge ruled in favor of severeing your rights. You put in an appeal and your appeals lawyer says he doesn't see any evidence to appeal the case, so now you have to fight the appeal pro se... oh i forgot to mention that your ex's mom was a paralegal for the prosecutors her entire career... all of that in mind if yiu sent your ex an affidavit with all of the laws he has broken stating facts and case law, then stating your terms, and if not complied with your intent to sue. Would that count as a new claim and halt the severence claim? I know there is a lot more to that just trying to make it short

Just research what the elements of a promissory note are, and research promissory notes. You can write a promissory note on a napkin after that.

i know this super old but is there any remedy for someone who paid off there car the payment went thru and they sent the title and removed the lien took it off my credit report and then all of sudden the payment reversed and now im getting a notice of default??
With the Administrative process send them a conditional acceptance, & add an affidavit. Basically, you are saying you are willing to pay whatever they want so long as they can rebut the affidavit with their own affidavit. Make sure you make a clause stating if they don't cease & desist then you will start billing the X$ amount. FYI This process is powerful because now you have evidence for a defense & to make a claim, the notaries don't know it by this name but by a Notary Presentment.

@@thatoneguy4646 okay will do thank you seriously it's a long story but some State Nationals that I know have figured out exactly how the accounts are created in what the actual location of them are and we are basically proving to them that we know what they're doing and how they are using our strong man but it's a long story and I wouldn't have enough space in here to type it all but just know that there is a way to get a clear lien-free title and your car loan taken off your credit report but they might still chase after you like in my case oh and also I was wondering if having a ucc-1 filed against my strawman would help in this situation I have yet to file a UCC 3 with all the particulars like security agreements and all that but I was wondering if just the ucc-1 was strong enough alone to be used in my favorite is if they took the lien off then I would be next in line right?

Understand ContractLaw I have a case where the plaintiff does not want to move forward with criminal charges. I recorded him telling me he's already informed officer that he wants charges dropped. He said officer said he would drop charges and take to the magistrates office. He also said officer would be dropping off paperwork to have charges dropped. Plaintiff even came to hearing but since there isn't anyone assigned to my case yet he pretty much came in vain. My court date is set for December 6th. He said he'd come again if he had to. Even the officer called me and said he was going to drop charges. Court system is complete garbage!!! I know a guy that knows law very well and sent him the recordings and he said he could have charges dropped by using administrative process . The charge was taking 2 PlayStation 4 controllers valued at $120, but it's listed as felony since it was cut off the rack when there was a device that needed to be removed first. My first offense but a really stupid one. Smdh. I know the manager pretty well and he doesn't want to pursue the case. This was an eye opener for sure. I won't put myself in this situation again. Guy I know says he can take care of this without me having to go to court by using this process.

Hi, I my car cash, I insured it and register it with mass RMV(I thought that was the right thing to do.?), months later I was park in my usual parking spot cops drives by once on the second time he comes to my window asking what I was doing there? My answer was minding my business! He ask for my license and registration, my answer was no , because there was no crime or complaint! Or any open container! Which he claimed in the ticket/citation for parking the wrong way and open container. All this was done after the Lieutenant came to speak to me . I was in my car there was no parking sign that says permit or private parking where my car was park other cars was park the same way as me. He threw the ticket in my car because I refused to accept the $500 ticket/citation. Now I’m dealing with a new charge for operating on a suspended license /Equipment violation???? Not civil? Criminal!? That’s how they can destroy your piece of mind! How can I deal with all this ? SEVEN ELEMENTS OF JURISDICTION:
1. The accused must be properly identified, identified in such a fashion there is no room for mistaken identity. The individual must be singled out from all others; otherwise, anyone could be subject to arrest and trial without benefit of "wrong party" defense. Almost always, the means of identification is a person's proper name, BUT ANY MEANS OF IDENTIFICATION IS EQUALLY VALID IF SAID MEANS DIFFERENTIATES THE ACCUSED WITHOUT DOUBT. (There is no constitutionally valid requirement you must identify yourself, see 4th Amendment; also see, Brown vs. Texas, 443 US 47 and Kolender v. Lawson 461 US 352.)
2. The statute of offense must be identified by its proper or common name. A number is insufficient. Today, a citizen may stand in jeopardy of criminal sanctions for alleged violation of statutes, regulations, or even low-level bureaucratic orders (example: colorado National Monument Superintendent's Orders regarding an unleashed dog or a dog defecating on a trail). If a number were to be deemed sufficient, government could bring new and different charges at any time by alleging clerical error. For any act to be triable as an offense, it must be declared to be a crime. Charges must negate any exception forming part of the statutory definition of an offense, by affirmative non-applicability. In other words, any charge must affirmatively negate any exception found in the law.
3. The acts of alleged offense must be described in non-prejudicial language and detail so as to enable a person of average intelligence to understand nature of charge (to enable preparation of defense); the actual act or acts constituting the offense complained of. The charge must not be described by parroting the statute; not by the language of same. The naming of the acts of the offense describes a specific offense whereas the verbiage of a statute describes only a general class of offense. Facts must be stated. Conclusions cannot be considered in the determination of probable cause.
4. The accuser must be named. He/she may be an officer or a third party, but some positively identifiable person (human being) must accuse; some certain person must take responsibility for the making of the accusation, not an agency or an institution. This is the only valid means by which a citizen may begin to face his accuser. Also, the injured party (corpus delicti) must make the accusation. Hearsay evidence may not be provided. Anyone else testifying that they heard that another party was injured does not qualify as direct evidence.
5. The accusation must be made under penalty of perjury. If perjury cannot reach the accuser, there is no accusation. Otherwise, anyone may accuse another falsely without risk.
6. To comply with the five elements above, that is for the accusation to be valid, the accused must be accorded due process. Accuser must have complied with law, procedure and form in bringing the charge. This includes court-determined probable cause, summons and notice procedure. If lawful process may be abrogated in placing a citizen in jeopardy, then any means may be utilized to deprive a man of his freedom, and all dissent may be stifled by utilization of defective process.

7. The court must be one of competent jurisdiction. To have valid process, the tribunal must be a creature of its constitution, in accord with the law of its creation, i.e., Article III judge.
Lacking any of the seven elements or portions thereof, (unless waived, intentionally or unintentionally) all designed to ensure against further prosecution (double jeopardy); it is the defendant's duty to inform the court of facts alleged for determination of sufficiency to support conviction, should one be obtained. Otherwise, there is no lawful notice, and charge must be dismissed for failure to state an offense. Without lawful notice, there is no personal jurisdiction and all proceedings prior to filing of a proper trial document in compliance with the seven elements is void. A lawful act is always legal but many legal acts by government are often unlawful. Most bureaucrats lack elementary knowledge and incentive to comply with the mandates of constitutional due process. They will make mistakes. Numbers beyond count have been convicted without benefit of governmental adherence to these seven elements. Today, informations are being filed and prosecuted by "accepted practice" rather than due process of law.
Jurisdiction, once challenged, is to be proven, not by the court, but by the party attempting to assert jurisdiction. The burden of proof of jurisdiction lies with the asserter. The court is only to rule on the sufficiency of the proof tendered. See, “McNutt v. General Motors Acceptance Corp, 298 U.S. 178 (1936). The origins of this doctrine of law may be found in “MAXFIELD v. LEVY, 4 U.S. 330 (1797), 4 U.S. 330 (Dall.) 2 Dall. 381 2 U.S. 381 1 L.Ed. 42

It says right in the California code, that marriage is NOT a religious event. If one wasn't aware of that fact, then, the license is void from the application. The Catholic Church, within the last few years, was putting out articles informing people against the application for marriage licensing and a push back to holy matrimony. Thanks for the reply. Your example of building a fence around a neighbors pool and writing a contract to do so, is COMPLETELY BOGUS. First if all, each state has private property and no trespassing laws. ANY person who is on your property without permission is trespassing. You cant build anything on yours or anyone elses property, 1ST: because your trespassing. 2nd; you need to pull a building permit for your project, and only the owner can do that, you would not be a party to the property owner contract to make decisions on that property. 3rd: because you trespassed and built a fence without a permit, the owner could site you with criminal trespassing and file charges against you through the building department fro: contracting without a license, not getting a building permit 3th: none of your labor or materials will be compensated to you. In fact, if you try to take your materials back and take the fence down, not only are you trespassing a second time, but now you are stealing the neighbors fence and you can be fined for not getting a demolition permit, as well as not being a licensed contractor to take down the fence your illegally built while trespassing.
I stopped listening after this crap. I have bee in contract law for 30 years, a contractor and studying law for over 12 years. You like to hear yourself talk. Some of what you say is legit, other things or way out there. the only time a contract by silence is enforceable, is when it is specifically stated in the contract as such. Many property deeds have old addresses or PO boxes and getting a hold of an owner is hard. Even if you send it registered, certified mail to the property owner, your certified letter can be legally sent back to you as rejected, as long as you place it in a separate envelope and mail it back as soon as you receive it.
You do not know the entire process of law to enforce a contract. You are generically giving the jist of contracts, but lack full foundation of writing them.

And in proper terminology the lawyer is refered to as an Officer of the Court, and the client (especially a public defenders client) is refered to as an incompetent ward of the state, since he is incapable of understanding and handling his own legal affairs.. What's even more concerning is the irrefutable proof of fraud, criminal collusion and conflicting interests is the system of governmental kickbacks in the form of 10k-25k non taxed cash rewards for judges, clerks prosecutors and defense attorney's for every case conviction.
