Judges are mandated to apply the ISL for all cases unless the same fall under the exceptions which he mentioned. The offenders need only to serve the minimum sentence and they are free to go. If you visit book 2, every felony povided therein specifies the imposable penalty. Thus, with it you can compute the maximum and the minimum (ISLAW)

Accessory penalty ay yung additional penalty maliban sa kulong o multa. Ang Kongreso ang nagsasabi kung anong accessory penalty ang angkop. Kaya, kung crime against public office, madalas kasama ang accessory penalty na disqualification from holding office.

Atty. I would like to ask your thoughts about reclusion perpertua being a divisible penalty. I hope you can shed some light on this matter.

I think the reason why it is indivisible is because the convict is not meant to be given parole. The offense for which reclusion perpetua is imposed are heinous or the most serious offenses. The law treats these convicts as serious offenders who ought to stay in jail until they serve the sentence. But, an amendment can easily change that. It's really a question for the legislature.

Attorney kung halimbawa po dalAwa yung kinaso pareho pong 2 years and 4 months maximum to 8 years for attempted rape, 2 years and 4 months maximum to 8 years for assault. Pag na serve na po ba nya pareho yung minimum sentence nya paglabas po ba ng akusado yung natitira pa nya taon sa maximum kung 6 years nalang yung isa magiging 12 years po ba dhil dalawa yung ikinaso sa kanya.
