SHOCKING GMP Arrest Video Footage Revealed - Mark & Shaun Share Their Nightmare Etihad Story

  • This video concerns the arrest of two Newcastle fans Mark and Shaun (father and son) for using hand held flares at the Man City V Newcastle match. I witnessed the whole incident.
    Approximately 45 minutes before KO, two or three lads let off hand held flares outside of the Etihad Stadium, on stadium land, but outside of the inner security barriers. They were several meters away from passing fans. These flares extinguished themselves after a minute, or two and were never thrown.
    Police however ran towards the lads and immediately took hold of two of them. It was clear they were being arrested and handcuffs were used to secure them. This resulted in Shaun being resistive and being taken to the ground by officers. Shaun continued to struggle, resulting in officers needing to escalate their force to secure him. At this point I began filming the incident. Bothe Mark and Shaun were then taken away.
    I completely accept that they broke stadium laws, that carrying a pyrotechnic on stadium land is a criminal offence and there are safety issues regarding the flares. However, I personally took exception to the heavy handedness in how police dealt with this incident and I felt that the arrests were unnecessary and disproportionate.
    Police of course have powers of arrest under SOCPA and PACE but is a tool that should only be used as a last resort. When an officer makes an arrest, they are required to prove that the arrest was 'necessary' and that the incident couldn't be dealt with in some other way.
    The police indeed could have dealt with this incident differently. They could have approached the lads in a way that didn't appear confrontational. They could have taken them to one side, carried out a stop search and then obtained their details. The officers could then have reported the lads for summons to court at a later date and instructed them to leave stadium land. They could then have alerted their colleagues of the incident and to keep an eye on them. Should Mark and Shaun bring unwanted attention to themselves again, the police could have escalated their response.
    Instead, the police didn't see an arrest as a last resort, it was their first response, even adding in some alcohol consumption and potential verbals (although there is no evidence of this). The situation obviously then escalated with officers struggling with Shaun on the ground. It caused an unnecessary scene that erodes public trust in the police. It also compromised the safety of the lads, the officers themselves and passers by. It also took four police officers off the street. All of this paid for at public expense. Because of the arrest, the lads also missed their coach and were forced to get back to Newcastle at additional cost and inconvenience.
    The police made absolutely no attempt to deal with this situation in more professional and appropriate way and to give the lads an opportunity to curb any anti social behaviour.
    In addition, one supporter stood several meters away, was voicing his concern at the scene. He was in no way interfering with arrest. This resulted in another officer coming over and shoving him in the chest, instructing him to get away. This is unjustifiable in law and in fact a criminal assault.
    Another way to deal with this incident and is my personal view. The officers could have simply carried out a stop search, obtain their details, give them a verbal warning and instruct them to leave stadium grounds with a warning of arrest should they carry on again. This would have seen the police in a more professional light and is just a decent human being way to behave in the circumstances. If the lads behaved like arses after this warning then they would have had no sympathy from me.
    I was personally appalled at the whole police response to this and felt compelled to allow the lads to tell their story. Of course, they are remorseful for their part in breaking the law.
    The police in general do amazing work to keep us safe, but this incident was an example of poor policing that should be highlighted.

      Eddie you’re great at what you do, but you surely know that pyro is being clamped down on at sports grounds and there is zero tolerance of anyone using it. Clubs expect those who are guilty to be arrested, prosecuted and banned.
      Surely anyone would know that letting pyro off on land owned by City would not be tolerated by City and they’d expect
      action to be taken. Otherwise every week people will be casually walking to stadiums swinging pyro.
      There’s no way NUFC would support these lads as it sets a bad precedent.

    As a City fan, I'm disgusted at the police response to this,as the vast majority of City fans are im sure. Glad the fans are ok, and hopefully nothing more comes it. The fkn scousers do far worse than that and the cops do nowt. Best of luck for the future, you guys deserve the good times like we've had. Always had a great away day at the toon, best of craic with no dramas.proper fans.

    City fan here, hey lads! Sorry that you was treated like that in Manchester. I get what you are saying about not using them if you had known, but even if you did know about it I still think the police could have had a quite word with you I really do. Sometimes wonder why ordinary folk distrust the police. Its a shame they didn’t drag Boris to the floor while having a party in a restricted area isn’t it?     Shocking this, hope the club get involved and sort this out. A little word from the police would have worked - jumping on them and wasting taxpayers money in the courts completely unjustified, we live in an authoritarian state.

    Can nobody remember (prior to the Pandemic) when a pre-arranged Pub-stop around the Manchester Area was the focus of a Riot Police attack? Unfortunately for the local Plod, one of those hit with a truncheon was a senior policeman himself out with his son to watch the match so it made the local news.

    Manchester polis are well known for being heavy handed & dishing oot football banning orders like confetti, I know from personal experience! In 2007 I was run ower by a polis horse ootside the Etihad after an early kick off & when I remonstrated I was brayed to the floor by a plod with a big day stick then hoyed to the deck resulting in multiple lash marks up the back of me legs. I missed me coach hyem & luckily Wor lass transferred some £ for me to get the train back hours later. I too had to return to Manchester magistrates & slapped with a 3 year banning order & ultimately had to give up me season ticket. Once I breached the order through no fault of my own after not being sent a letter to surrender me passport for the euros even though England never qualified & the magistrate at North Shields said ‘why is it I seem to get a heck of a lot of these orders from the Manchester police ?’ It seems like nowt’s changed in that respect & the negative impact it’s gonna have on this Fatha & son cannot be overlooked & stop them doing something they love for 2-3 years at least ACAB

    Great video Eddy. Takes me back to the late 60’s when police would take unruly fans into a portacabin and bounce them off the walls.

    Eddie as ever you are such a great ambassador for the TOON ,the city and people. Unbiased reporting is always great from you. This does seem to be heavy handed and my thoughts go out to the people involved as it appears to be a rather petty offence being dealt with by overeaction techniques and any common sense seems to have been left behind when putting on a uniform that day. wish the lads well and good luck .

    What an excellent utilisation of public funds by the police - oh and the added bonus of taking valuable court time up for such a major dangerous offence. Of course there is so little crime in Manchester this is a good method to improve the arrest stats. I wonder what the policing staff cost was by the hour to deal with these hardened criminals.

    They must have completely different laws on Merseyside. I saw loads of red flares when Liverpool paraded the prem trophy and when the Toon played Everton last season even more. Even Adam P looked like a Smurf entering the stadium.

    I'm normally pro police but the Manchester plod are notoriously heavy handed when dealing with Newcastle fans. I've had this happen on several visits to watch Manure away. They heard us like we're cattle. I'ts plods like these that turn people against them. The lads did wrong ok ! Tell them off and move them on was all that was needed.

    Sorry to be a killjoy but carrying any pyrotechnic including smoke bombs is an offence under uk law and ignorance of the law is absolutely no defence. It might seem like harmless fun, but the reality is that smoke bombs do pose a risk to people, for example, how does a bystander know whether the smoke is harmless or not? Could a bystander have a negative effect of the smoke - asthma attack or something? If you set one off by a road it can distract or reduce the visibility to someone driving their car - potentially putting pedestrians in danger.
    In regard to the heavy handedness of the police, at first glance it does appear heavy handed. However, I’d be asking why the police have acted in such a way? We only see a very small portion of the arrest without seeing any of the build up towards it, but there was a small portion of the video which suggested at least one of the offenders was resisting arrest which may explain the heavy handedness.
    If the young lad were beaten blue by the police while held in the cells this should be on video and could prove police brutality - however I think it’s complete nonsense.

      I witnessed the whole incident and the police response. I filmed what I could. It was disproportionate and unnecessary and the police have many powers and tools to deal with low level (criminal) incidents like this 👍🏻

    It does appear a bit heavy handed from GMP, but there have been one or two incidents inside the ground when flares have been thrown at fans in recent years during hostile high profile games against the likes of Man United and Liverpool, and the Police have probably decided to take some kind of zero tolerance measure out on any future use of them by ALL fans, home or away ..... and even though the incidents i speak of have previously occurred inside the ground, it looks like the Police have extended their policy to cover outside the ground too.

    fully behind you on this, police being too heavy handed. their a law unto themselves , absolutely no need. disgusting, disgraceful but the same thing happened to me and my son at St Jameses Park. 10 years ago. I've seen it happen there a few times to other fans .

      I’m a city fan and the answer is definitely yes. They are sanitising football to such an extent you will soon get a lifetime ban for farting. Swearing and flares are hardly deserving of any police intervention, can understand the problem letting them in the ground as every chance would get lobbed onto the pitch or in opposition end. This is why atmosphere is disappearing fast from all grounds. Won’t be happy until only a raising of an eyebrow is the way to react to conceding a goal. Lot of time for Newcastle fans. And hope these lads are ok.

    That is correct for every ground it is illigal to have flair or pyro but as a city fan I agree the gmp are heavy handed, but just to make u aware they arrested 3 city fans outside the ground despite their being 30 city fans flares!!! Sorry you had such a experience at Manchester city but it isn't city it's gmp

      The other problem is and it isn't just gmp is that match day policing for all football games isn't just provided by gmp so the gmp will put a national wide request for officers to do overtime at football grounds as they are contracted to provide this service by the football clubs so effectively the club's are hiring gmp to provide the service so they need extra officers over and above the normal policing, so they just do what they please!!! No need for the navy handed tactics even if it was illigal and is know that you can't have them anywhere at a ground, that includes coach parkz car park ect but they could have used discretion and said hey lads put them out

    Seems very heavy handed I normally raise an eyebrow when someone who is being arrested says the police were rough but their is no doubt on that given you filmed it Eddie, it looks like the police had a zero tolerance towards visiting fans and that leads me onto the question, what if it was it was Man City fans. Guess we will never know.

    Well, I am a City fan and I have to say this spoiled the spirit of the day with your good natured chat with City fans! (I saw the previous video where you went into the City pub with all the lads) I have every respect for Newcastle and their style of play and I am sorry to see the Police so heavy handed! I know Newcastle are going to do well this season, just as last, so let's just enjoy the football and support other football fans! A few years ago I had a great evening at a bar in Thailand where I live and there were four Liverpool lads came in to watch the game too and we had some great banter over a few beers and this is just the way it should be! I just love football and appreciate the hard work and skills of the players!

      Aye, this incident was very disappointing as I’d just left Mary D’S Bar. The heavy handedness of GMP in this instance needed highlighting. They could have just warned the lads and sent them on their way. The arrests were appalling.
      It hasn’t dampened mine or Helen’s day as we had an excellent time in Manchester and loved the banter in the pub. Much respect 🫡
      To clarify, it was just me and Helen in the pub 😃

    Well done Eddie showing the vid. I was really worried for the coppers there as you can see the two Geordie lads look to be a real handful they must be about 12stone wet through that’s between the two of them. One thing you can rely on with the cops that’s lack of common sense.

    You don’t have to let off a flare inside a stadium for it to be a criminal offence. Possession of a smoke bomb or flare is itself a crime if you even attempt to enter a stadium - and that can include possession en route to the match. The law doesn’t actually distinguish between smoke bombs, flares or fireworks either.

      Nobodies disputing the offence mate. The police could have dealt with it by way of reporting them for summons and escorting them off stadium land.
      An arrest was clearly disproportionate

      If the lads' account is completely correct then the police handled it poorly. We haven't seen the full footage. Were the lads cooperative? Uncooperative? I assume they had a few shandies on the coach. The young un resisted arrest therefore more force was needed. He mentioned damaging a cell as well, what happened there Eddy? Did he scratch something, urinate or deficate in the cell? I think we only got half a story.

I can see others are arguing over it without knowing the full facts. I do think it's worth pointing out that the lads were possibly drunk, one of them resisted arrest and possibly caused damage in a cell.

      If that’s the case how come Everton fans set of flares when teams arrive and the police are present I don’t see or hear of arrests during the welcoming of the teams?
      If it’s an offence like you say and I don’t doubt you why is no action taken against Everton fans?

      Unfortunately ignorance of the law is not an acceptable defence. Plenty of cops are evidence of that. It was over the top given the minor nature of the offence. No doubt those cops will get a right back patting back at the station.

    As a season ticket holder at MCFC for 47 years and on behalf of City supporters we’re very sorry you two had this nasty experience at our club. This is typical of GMP and doesn’t reflect on us as City supporters. There’s only a small percentage of idiots who want to spoil the day, you can tell the father and son are proper fans and didn’t deserve this treatment. GMP are pathetic and see football fans as an easy target, try getting hold of one when you’ve been burgled or assaulted and you’ve no chance. What an absolute waste taking this to court. Hope you 2 chaps can carry on following your club.

    Looking at the video I can completely understand where the lads are coming from but we can't hear what was said and we don't know if they used verbals against the police which then caused them to be arrested.. I personally wouldn't ever consider lighting a flare anywhere, let alone outside a football ground .

      I watched it and the police put up with verbals every day.
      The lads could have been reported for summons to court and escorted off the land, rather than causing an unnecessary scene, reduce risk of injury and taking four police officers off the street

    Eddie Man Citys ground is not owned by Manchester City its actually still owned by Manchester City Council so its a PUBLIC AREA and not private ground.....its the same as Newcastle leased out by the council

      Hi mate, if I may explain an important difference.
      The council own the land but it’s leased by Man City, maintained by Man City funds and not by the tax payer, making it private land that is fenced off and gated. This isn’t ‘public land’ in terms of criminal law.
      The public have an implied invitation to enter the land of the Etihad on match days but can be lawfully removed should you not abide by stadium rules, or laws. This can’t happen on ‘Public Land’ ie walking down the street, unless there is a temporary law in place that makes it a ‘Designated Area’.
      The exact same laws apply at St James’ Park. I can be forced to leave the stadium land outside of the ground, even though the land is ‘owned’ by the council. The land is leased by the club and therefore have particular rights in law regarding trespass.
      I hope this clarifies things 👍🏻

The police must have thought that's my arrests for the day, and gone back to the station and written up their reports and spent the rest of the day drinking tea!     Definitely heavy handed by Police, I’m sure the situation could have been handled better.
    BUT! My opinion is any kind of pyrotechnics 🧨 Flares, Fireworks etc should be banned from sale to the public. They can fall into the wrong hands, children & idiots.
    I have seen horrific injuries from misuse to both people & animals. 😡
    SO WHY TAKE A CHANCE?
    A national ban on possession of such items should be enforced, then everyone knows the score.
    Don’t see the point of them really.

    Hi Eddie looks a bit strong handed by footage tbh, however simple rule of thumb do not take things like flares anywhere full stop very little sympathy. Flares are not designed or meant to be used for any other reason other than what they are made for they have no place anywhere else full stop. Maybe this will teach a few others a valuable lesson

    Where are these cops when the Stop Oil idiots break the law left right and center? The police offer them water. Yes it was daft of the lads but it was handled way over the top, no wonder the once vaunted police force are currently vilified, they dont show up when there's a real crime but 2 daft geodies having a bit of a celebration and they come out mob handed, was this really the way to deal with this incident.     From the small clip I have seen it seems GMP officers acted inappropriately it also appears as if they failed to follow the Miranda Act, personally I would advise them to contact Hudgell solicitors based i manchester they have a good track record taking on GMP.

    Eddie, please explain to me why football fans find it necessary to set off flares and why are they even legal to buy! What is the point? Between transport exhaust, endless world wild fires and other crap we humans pump into the air, lets stop with the flares. Enjoy the matches and support your team properly. I saw Manchester United acting like children at the new Tottenham stadium, banging their hands against the walls keeping time to a song about a long gone player. I understand that Old Trafford is barn but still, respect property people.

      Warnings only work if you keep track of people. I don’t any facial recognition tracking people over the day, or some national database tracking people over their life over something minor like this.

    Manchester city actually let off fireworks in the ground before kick off when they were showing off the flags. i think this was out of order to be so heavy handed. I hope the club come in and try and sort it out for them.

    Absolutely unbelievable. Mind I remember going to Man City in the eighties and we had gone in a transit van and we had parked at Victoria station. We put on bus back to the station after the match . All the fans who were on the football specials had left we were leaving the car park and out of nowhere all these City fans surrounded our van and there was about ten lads in the back and they managed to open the back doors and they slashed one of the lads ! My mates dad who was driving drove off and there was a PC across the road and i opened the passenger window and said did you see that and I continued to say that where was the nearest hospital as I explained that one of the lads gad been slashed and amazingly he said P””s off you Geordie scum !! So the lad needed stitches.
    So hopefully the CPS come to their senses and let these lads off .
