  • In this lecture, Dr. Lindsey Robertson gives an historical introduction to the complicated issues surrounding Native Americans and the Constitution. From the time of ratification onward, a gradual process of incorporating Indians into the American constitutional system has resulted in a somewhat idiosyncratic scheme of rights and powers retained by Indian tribes.

    We are all standing on sacred ground. I'm embarrassed to be a white person when it comes to the initial horrific treatment - and continuing hellacious treatment - of the Native Americans in this country.

    Dude is wrong from the outset. The state's legislation outweighs the federal legislation. The supremacy clause only applies to the constitution itself.

      @@kenlandon6130 Federal law is supreme over State laws insofar as it is made "in Pursuance" of the Constitution. If federal law is not made "in Pursuance" of the Constitution, that law is null and void according to the Federalist papers, and any conflicting State law would be allowed to stand. In other words, federal law is supreme over State law but only within its delegated spheres of authority.
