Japanese anti-defamation law is closely related to privacy rights. You cannot publicly disclose the truth if it infringes on someone's privacy and harms their social reputation. For example, if you witness someone committing adultery, you can tell their spouse directly, but you cannot post it online or in a newspaper. So I think it's perfectly fine to leave a review of the clinic. I think the clinic is threatening him to get the review removed.
Freedom of speech. Freedom of expression. And the most delicate issue of all "hate speech"... I think it's very important for each person to acquire a balanced knowledge of each of these three issues.
To complicate matters, in Japan there is both criminal defamation under the Penal Code and civil defamation under the Civil Code. Furthermore, there is also the crime of insult. While Japan does have "freedom of expression," and this freedom should be protected, we also believe that "honor" should be protected as well.
I’m not a lawyer so could be wrong but I don’t think defamation law doesn’t forbid telling the truth. It’s against spreading the facts claimed to be the truth by someone who has the intention of socially destroying someone or an establishment. There are and have always been whistleblowers in Japan but they don’t get punished by this law. They are, as expected, harshly harassed by bad guys.
A girl said men smelled bad. She was an anchor. She lost her job. Many stupid guys sent her messages. She said Tokyo did too. Then, she got many anti-comments. However, many guys are saying women smell bad in social media. They were fine, but she can't. That's too strange to me. The Black Experience in Japan had videos about their experience in Japan. Some videos were deleted. The black people were talking about their experiences. What happened to Naomi Osaka? They want to erase the inconvenient truth and opinion. If Japan's government let them do what they want, Japan would be crazy.
Well, I think firing her is too much, and I also agree that men can smell bad sometimes, lol. But let me ask, if she had said something like 'Black people smell,' would you still defend her the same way? If it’s true that Black people "tend to" have a stronger body odor, it’s kind of similar to saying men "tend to" have stronger body odor, right? If 'men smell bad' is acceptable, then wouldn’t 'Black people smell bad' be okay too? Personally, I think both statements should be allowed, but what do you think?
@@oooow6861 What is bad smell? What is good smell? I don't know how Kusaya smell, but I think bad as I hear the story. The kusaya lovers may aslo they smell bad, but they like it and it is not only bad smell. Kusaya haters may say smell bad, but this one means stronger feeling, perhaps., and it means opposite things against the lover's opinion. One groupe of men smells bad. It is fact. She doesn't like it. That's fine because that is her sense. She has free will and everybody does. If she said unfalse fact of men or black people, she is wrong. It is very clear statement.
The difference is that the online posters are doing it anonymously and not disturbing the public order. While the Anchor was clearly messing with the public order and creating divisiveness in society. I do wonder that if the US implemented Japan style slander laws if there would be less division in society, and less political name calling.
You should make a comment on the suicide of a famous female professional wrestler after sever criticism. If you permit more freedom of speech for denouncing other people, you could accept more suicide tragedy.

It doesn't look like there is freedom of speech in the United States today, though, does it?
