- The plaintiff claims his neighbor’s trees damaged his fence, but the guy didn’t do anything about it, so the plaintiff is suing. His neighbor, the defendant, insists the plaintiff’s fence is the problem, not his trees. The defendant claims the plaintiff even trespassed on his property and cut down his trees, so he’s countersuing.

defendant should have been paid for the loss of his tree , i dont agree with the judge that the plaintiff had a good enough reason to trespass and remove the entire tree . plaintiff should have had to pay him but the judge was just trying to keep the peace i guess .

The plaintiff is acting like Florida man before even living there, he will fit in just fine.
I live in Florida and have 3 acres and my property back's up to my neighbor's 7 acres. He wanted to put up a wood fence between our properties and there is a tree the sits right on the property line, more on his side than mine. He pulled a string line and I could have cared less if he took 6"inches of my property line to included the tree. But no when he got to it he made an inward V shape in the fence so it would be on my side. I was out of town on business. When I got back I asked him why didn't he just run the fence straight and he said he wanted to do the right thing. This guy is a class act. I'm selling my property next month I think I'll go tell him he can take the V out and make it straight on his property. LOL He's such a good guy.

I contradict with the judge’s statement on the trespassing part. What I know about the law where I’m from is its never ok to trespass onto someone else’s property especially if you are going to touch or move something, doesn’t matter how irritated you are or what the situation is. You still have to get permission and notify the owners first. If communicating with the owner doesn’t work, get the authority(police) involve to prevent issues and find ways to resolve it cause if you trespass onto someone’s property, they have the right to retaliate and protect their ground so if you get 👊🔫 don’t go crying about it.
Actually fun fact, you dont have a righr "to the heavens". At 160km above earth (i believe thats the distance, i could be wrong), that part is actually government property

Bull crap, the defendant should have gotten a estimate to evaluate what the cost to replace the now missing tree. Whuch normally if missing crucial evidence she would do somewhat "Rough Justice". The guy had the obligation and went and removed a tree not his property what the heck is going on here...??
Plaintiff is ridiculous. Trees are precious, nature is good, hurricanes are act of God, that's what insurance is for. No insurance, that's on the plaintiff.

Nope, wrong answer and act of God you pay for the damage on your home regardless of whose tree it is less you had a tree Expert, write a letter and deem it a dangerous tree that needs to be removed prior to it causing damage then you have a leg to stand on otherwise you do not. It happened to me.
Morally the plaintiff was more right about the damage but absolutely the law says act of god and don’t trespass so the ruling was fair neither one gets a penny

Tree trimming case from 2 years ago she awarded fees for trespassing to overtrim the tree, also was in Florida

@@alexrossi4464 you realize these cases are arbitration in front of an arbitrator right? They're an arbitrator with the title of judge for the TV show since they're retired Judges.
Both of which would have been in trouble if they handled themselves in the same manor in a real courtroom as a real judge.
