It discloses that the client understands that the agent is working on their behalf and will be paid by the client, regardless if there’s a sale or not. It’s the FIRST thing an agent does! I’m surprised that in the state of New York, that it’s not legally required. I don’t think the broker should have won.

Before I hear the verdict my answer would be that technically there was no contract since there is no price set. Even if he said I supposed we have to pay you a commission that doesn't mean they agree to pay 5k. Now if he can prove that is what the would have gotten and told the guy it would be 5k then he is on the hook for paying. But I think with no fixed discussion of what the commission would be...There is no contract. What if the guy came in and said it was 50k? And what kind of professional...Especially in NY would not have a contract stating the terms of their deal?
