*WARNING: THIS CASE IS GRAPHIC IN DETAIL AND CONTAINS THEMES OF EXTREME TORTURE AND MURDER. VIEWER DISCRETION ADVISED*
Due popular demand by our viewers, we recount the tragic torture and murder of Kelly Anne Bates - an English teenager who was murdered in Manchester, England at the age of 17 by her abuser and live in partner, James Patterson Smith, who was roughly 30 years her senior. She was tortured by him over a period of four weeks, including having her eyes gouged from their sockets up to three weeks before her death, before being bludgeoned over the head and drowned in a bathtub.
The murder inquiry was headed by Detective Sergeant Joseph Monaghan of Greater Manchester Police, who said: "I have been in the police force for 15 years and have never seen a case as horrific as this." William Lawler, the pathologist who examined Bates' body, described her injuries as the worst he had seen on a murder victim.
Smith, with a history of violence and torture against former partners, denied killing Bates but was convicted and sentenced to life imprisonment on 19 November 1997.
This case has been compared to the Junko Furuta and Sylvia Likens case, and once again highlights the topic of bystander apathy.

Hi from across the pond England 🇬🇧.
Our justice system is an absolute joke, only a few and I'm talking probably less than 1% actually receive a life sentence as in die in prison. And those that commit serious crimes probably do 14 years maximum and then are free.
We give Pedophiles, rapists child killers a few years if that, oh and then to top that off, some criminals get new identities if it's a big case, because of Human Rights WTFFFFF
      🤬🤬🤬
      Perfect example!.
We had an 10 and 11 year old boys who decided one day, they wanted to try luring toddler's while in the shopping centre, 1st child they tried the mother caught them, didn't call police nothing, so they tried again, and they unfortunately managed to get a 2 year old away from his mom, they walked the little boy for ages then walked up onto railway tracks, those 2 boys stoned the child to death then put him on the railway tracks as they thought if a train went over him it would cover up their murder. 7 fucking years they did in a Young offenders then got given new identities, Oh this gets better. They came out at 18 and 1 of them has been arrested at least twice for child pornogra##y and guess what!?.
Was given another new identity ?.
Soo that's a little taste of our disgusting legal system

You are completely correct about the nerves in the eyes. My father lost a battle with some needle nose pliers, and had his eye gouged. The eye dr. was really concerned about him going into shock....on jab. (Not multiple so I cannot comprehend how she lived throughout that). Great job, y'all should do a piece on Hailey Dunn. If I hear someone calling for help or hear any other violent noises, I am the kind of person who will call the police.
I used to live in an apartment; it was a lovely place in a very safe neighborhood. I only lived there for about a year before my fiance and I bought our first home. My neighbors to the left of me were a younger couple that tended to have loud arguments. One night I heard a lot of arguing back and forth, but then I listened to her scream and cry for help. I immediately called the police while still hearing her call out; that was loud enough for the 911 dispatcher to hear. While waiting for the police, she ran to my apartment, knocking and begging me to let her in, which I promptly did. She had stab wounds all over her, apparently done with scissors. He came over and started banging on my door and trying to bust it down as he threatened to kill me if I didn't let him in. The police showed up and put him in handcuffs, and paramedics came in to help her. She was hospitalized for a few days, and I visited her every day. When she got out, I took her to the police station so she could file a restraining order against him. He was charged and convicted with felony attempted murder and some misdemeanor charges and was sentenced to 8-10 years in prison. Since that night, which was about 20 years ago, she and I have become the best of friends, and when she introduces me to people, she always tells them that I saved her life. I believe, and she also believes that if I hadn't called the police and/or let her into my apartment, he would have killed her that night.

Junko's killers are free, Sylvia Likens killer got released, I believe most if not all of Shanda Shears killers are free, Tim Mclean's killer is free, James Bulger's killers are out! Also one of James Bulger's killer got rearrested for child porn I think, so hes not out, but he did get released for the actual murder
(Probably untrue not-very-fun fact thats mostly unrelated but I so rarely get to bring it up; my school used to be a boarding school for misbehaving boys and one of James Bulger's killers apparently went there. The eyes being gouged out is specifically pre-mortem...3 or 5 days (IIRC) before her death...imagine all this happening to you and then you are blinded for the last several days because your eyes were gouged out...it's so horrific. I'll never understand what can make another person inflict that level of horror on another living being, much less another person.

I can't imagine being in a situation where the only person around wants me dead and they want me to suffer. A lot of times it's someone who supposedly loves you so that means they are the only one who can get that angry with you that they want to destroy you piece by piece. You know that nobody is coming to save you. That has to be terrifying OMG, especially if it's more than one. It's a nightmare and I think the death penalty is made for those types of people. We need to stop letting people sit on death row for 25 to 30 years. They have served a life sentence and then you want to execute them? Get them while they are still the same piece of sht that they were when they committed these crimes. After 30 years, they're not the same person and probably would never do that crazy sht they did before. If we're gonna have capital punishment, do it right. Do it like China. When you're condemned, you don't have long at all. That's why they have nowhere near the crime rate that the US has. Sorry I wrote a book and it wasn't all about this story. Sorryyyyyy

I can't understand the mentality of ppl that can hurt others so flippantly, but more importantly 2... the victims deserve for ppl to know what they went thru 😢 they hurt an suffered, and their stories should be heard, unadulterated even if it's uncomfortable. These cases are sad an hard af to hear, but shouldn't be minimized. In certain cases where perpetrators are up for parole....our voices matter in keeping them where they need to be. I can appreciate how people are shocked that "the neighbors did nothing" but the reality is neighbors report violence and abuse, the police show up, the parties involved say "everything's fine" and then the police leave. Then the neighbors are left to face the wrath and harassment of the violent offenders. Every report to the police results in them saying "Well, there's nothing we can do" and the violence and harassment get worse. I had a friend who reported children being hit and left outside at a house on his road. The police came, the people say "nope, not us", the cops leave and, mysteriously, the neighbor's dog was shot dead a week later. Until there are laws with teeth and enforcement of those laws, people are reluctant to paint a target on themselves.

Random creepy fact… eyeballs pop out pretty easy with enough pressure on the inside or outside corner of the eyes. And so long as the eyeball is undamaged and remains intact, doctors can just pop it back in.

I’m from Scotland 🏴󠁧󠁢󠁳󠁣󠁴󠁿 and as much as I hate to say it... our justice/sentencing laws are like a slap on the wrist compared to a lot of countries, especially where you guys are, American ! For heinous, horrific, torturous crimes (and any crime committed against an innocent baby/child/kid/preteen/early teens (any child who isn’t an adult by law) life should mean life and for any crime against a child should be mandatory natural life in prison and if the crime was as heinous as SA /trafficking/ pedo rings/productions and viewing and sharing “child *porn* / child R@p€ and or murder this is when I would say is the one reason death penalty should be used *it should be brought back in the uk 🇬🇧 * for CSA ! But that’s just my opinion!
20yrs minimum is as harsh as you can probably get here which shocks me to the core and any one thinking of committing a heinous crime like this will certainly not be put off by the chance they get caught and hit with a lifer as a lifer is usually between 15 yr - 25 yrs prison (usually time off with good behaviour inside 🙄🤬) so its certainly not a deterrent for any monsters willing/thinking of doing this harm!

For those reading this. I need you to understand how horrible drowning is in and of itself let alone being tortured before it happening. Drowning is one of the most painful ways to go, it's not some peaceful sleep. Your lungs burn and your brain fires off distress signals that it can't rectify. Before passing out the last thing you'd probably be feeling is your heartbeat threatening to burst from your chest before it slows.

I would take starvation over drowning any day because towards the end, you're very apathetic of death. I was never a suicidal person but it felt okay to go after starving for so long. Drowning, you don't have that apathy and are trying to cling to life still.

I almost ended up in a similar situation with someone who was my age because I had never been taught to say no or that I had all the right to leave something if I felt I wasn’t being treated right. As far as neighbors not calling the cops in DV cases. I know from experience that in my own life, when I was in a horrible physically abusive relationship that the neighbors did call the police quite a few times. But I see where there does come a point where you’re calling them 2-4x per week, and they come out and just nothing happens. The girl won’t say “Yeah he just beat me horrifically” she’ll often say “oh I’m clumsy I was falling down the steps” or whatever. And the police know that it’s bullshit. But since nobody actually witnessed the abuse with their own eyes there’s just not a lot the cops can do.
    So people stop calling
MY ADVICE-if you have a neighbor where you frequently hear violent fights taking place.
    CALL. EVERY. TIME.
even if you feel like you’re being a pain in the ass. Even if you don’t think that you’re helping. Just calling and saying
“I can hear a lot of noises coming from my neighbors and I believe a person is being hurt in there”
    CAN HELP.
If not that moment. In the future. If this person gets the strength to leave the abuser, all those 911 calls can help them to get protection in a situation where it’s he said/she said or whatever.
    ALSO-
Don’t treat the abuse victims like a pariah when you see them. If you hear your neighbor screaming crying for her life. And then see her run out of the apartment all bloody. Don’t take it personal if you call the cops and she says that it never happened. When you see them outside or in the hallway or wherever just say hello and talk to them like you would any other person. Even if they have a busted lip and an eye swollen shut. Don’t look at them with pity. dirty looks and judgement really just make the person feel lower than they already do feel. And it’s also easier for the abuser to convince the victim that “they’re calling 911 out of spite. Just to be a b*tch.”
I could go on and on about this subject but that my two cents.

hi yerby and drewby ! i absolutely love your channel. you guys are telling the stories that ALMOST EVERY OTHER CHANNEL IS TOO SCARED TO TELL! for fear of demonetization. these are stories rhat need and DESERVE to be told. the child aboose, esSAy, torture (sorry for the awkward censoring, i dont want this to get removed) and murder. these stories are so heart wrenching , but some people turn a blind eye and think these things dont happen in modern areas/ timeframes etc .... these victims deserve to be remembered and for new laws to be brought to the forefront and advocated for.

I am in the UK. One of my schoolmates had a child by her brother at 13 in the 80s. It was, at that point, shocking and gossip fodder but less noticeable than it is now. I don’t even know if he was prosecuted. It was a family matter. She was sent away to have the child. Much like unwed mothers were in previous decades. Thank goodness for updated laws and modern consciousness.
I myself went through things that we would now consider sexual assault or physical abuse but were then just matter of fact. I think about that a lot.

I cannot imagine the pain and fear she went through. I am so thankful for your channel since you not only bring to light these cases, I've heard this one before, but you discuss how we can stop these things from happening. That is also what I am constantly pondering about. My main idea is to start teaching children, maybe middle school age, about recognizing abusive relationships, etc. Other than that we need more laws and longer prison sentences for such horrific crimes.

These injuries were all antemortem. You read this stuff and see videos and you pray for them to die. It is truly astounding how hard the spirit fights to survive, and the catastrophic injuries that one can survive over a protracted amount of time. These cases are just the limit of human depravity and even if the countries don’t have the death penalty, it should be allowed to be an option in cases like this. Anyone that can show such depraved indifference to the human suffering they have caused cannot be rehabilitated. You cannot rehabilitate someone capable of this level of violence. That being the case, their lives should be forfeit and they should be destroyed. None of this drifting off to sleep bullshit. Bring back drawing and quartering, or the brazen bull. The punishment must fit the crimes in cases like this. I am pro choice and anti death penalty,, but I do believe in absolute evil, and evil like this should not be allowed to live.

The giving of no possibility of parole is very rare in the UK I can only think of three on the top of my head. I will say although they will say no parole for 40 years when the offender is currently 60 years old knowing he/she won’t live till their parole date. In horrific cases like this and others giving no consideration for parole for X amount of years but well known it’s just “consideration” and is very unlikely to be granted.

Just a touch of insight from someone who works in the legal field - most jurists are uncomfortable rendering a verdict without letting a decent amount of time pass during deliberation. In many cases, they know exactly how they are going to vote before they return to the jury room. They tend to feel that coming back to the judge with a decision "too quickly" could make them look bad or anger the judge. I constantly hear about deliberations going on for exactly two hours before the verdict is delivered. I think that pattern is fascinating. Also, I believe the term "At Her Majesty's pleasure" is what's used for an indeterminate sentence, so I'm pretty sure they technically have the ability to hand down a life sentence.

In the 70's and 80's it was still very much frowned upon to be in a relationship with a much older man. Where did you get the information that families in poverty were ok for their daughters to marry into money? That happened in Edwardian and Victorian times - not in modern times. The father of the girl would have punched this guy's lights out rather than allow their daughter to live with a much older man which surprises me that these parents did not go to the police if they had supposedly tried everything else to stop the relationship.
