    Nurses usually know when babies are born with NAS (Neonatal abstinence syndrome-drugs usually) The poor babies are tense and jerky from withdrawal and cry when they should be sleeping. It’s literally the sadest thing to see. They are required by law to report this to CPS in most states but if a drug test comes back negative for both mom and baby there is nothing they can do.100% they should be charged.

    • @badsocks756
      @badsocks756 2 ปีที่แล้ว

      What if the woman was in treatment (say she goes to a methadone clinic or something similar), and tries her hardest to stay sober, but the baby is still born with issues that let's stipulate are not typical of methadone treatment (or whatever treatment) alone. Let's also stipulate that the clinic has records that show she went to the clinic every day as she was supposed to and was otherwise compliant (meaning she went to all her scheduled group and individual counseling appointments, etc), and that she was simply not able to get completely off the drug in time before she had the baby. Should she still be punished, if she's trying her hardest to do the right thing and simply falls short?
      I would argue that that is a very different situation, because I think there is value in recognizing the fact that addiction is a chronic illness that people simply do not choose, and hence the addicted person's ability to simply stop using drugs is not like this on/off switch you can hit once you realize you are pregnant, nor should we expect people to be able to do so. This is why Destiny's analogy doesn't work; a pregnant addict can't just stop using out of nowhere both because of withdrawals and because like i said, it isn't a simple decision like the decisions you make while driving.

    I got banned from this sub once because I said ghosting should treated as sexual assault. Apparently the sub thoroughly believes it is rape, so I got -700 votes before I got banned for defending rape. Literally, my comment was
    "I agree, ghosting is terrible, though I think twenty years might be a bit too over the top for something that might happen on accident or because of poor communication. I think one to five years, like with serious sexual assault, is more the range of prison time I think is fair."
    In response to someone calling for twenty to twentyfive years in prison for ghosting (removing the condom during sex).

    • @ReverendLeRoux
      @ReverendLeRoux 2 ปีที่แล้ว +11

      I'm glad you explained it at the end. I thought ghosting was like not even opening a message from them and was super fucking confused.
      If the partner does not consent to unprotected sex and only consents to it under the pretense of protection and you remove that protection, I genuinely find it to be a breach of consent and therefore rape. I'd be open to hearing another argument though.

    • @utopian4769
      @utopian4769 2 ปีที่แล้ว +2

      @@ReverendLeRoux
      The thing about rape is that there has to be force involved/unwillingness to engage in the act of sex. Rape by definition is having intercourse with someone against their will. While taking a condom off mid sex is a crappy thing to do, that isn't rape.
      Rape has connotations that inherently imply a lack of agency or choice. You could argue that taking off the condom without letting one side know that you haven't fits the latter, but that still wouldn't be forced intercourse. It's admittedly a dubious technicality, but that's how I see it.
      This is probably a bad example, but it's like a kid stealing a gift their parent bought for them before Christmas. It's bad that they did it, but it's not theft since it is technically theirs anyway. It's a breach of trust for them to go in it when they're told not to, but it still wouldn't be theft.
      If a woman actively and willingly chooses to sleep with a man, then there cannot possibly be rape in any sense involved since she still chose to have sex.
      This however doesn't mean their shouldn't be consequences for breaching someone's trust, though. Taking off a condom without telling is still a reprehensible thing to do.

    • @ReverendLeRoux
      @ReverendLeRoux 2 ปีที่แล้ว +2

      @@utopian4769 if you have sex under the pretense that protection would be used and then remove that agreement mid way without the consent of both parties, it is altering the agreement beyond the grasp of consent and therefore meets the definition of rape.

      @utopian4769 2 ปีที่แล้ว +3

      But if both of the parties in question agreed to have sex to begin with, then it can't be rape. There was no coercion and/or force involved. There were boundaries set(which should be abided by), but no one was actively resisting or denying advances.

    • @ReverendLeRoux
      @ReverendLeRoux 2 ปีที่แล้ว +1

      @@utopian4769 thats not how that works at all. Consent is both given and maintained with a certain degree of understanding. You can consent to protected sex but not to unprotected sex at the same time, which means slipping the condom off is a breach of trust that violates the terms of consent, making it rape. Not to mention that consent can be withdrawn at literally any time.

She miscarried and was charged for it. It’s a lot different if the woman was raped or planned to abort, but when you are actively trying to bring a life into the world while doing things you know would harm it’s growth severely it is different.
