The lawsuit was about asian students being discriminated against. Why is there no mention of asian students in this entire report?
I don't believe that they were actually being discriminated against any more that any non legacy , no white students. I believe the main challenge they have faced is that the methods they focused on to get selected by these highly selective school were never going to be automatically get them in due in part to how many other highly qualified students there are from other groups . Another challenge seems to be a misunderstanding that theses schools just admitted students based on who has the highest test scores and GPA' etc

As there is zero evidence that Asian students were discriminated against any more than any other non white , non legacy students ... and since that Blums case has concluded ... I don't see why it should have been covered at this point.
Not a single Asian student whose parents also work extremely hard, who also face adversity and discrimination, who themselves have to work three times as hard as any other AA student was interviewed for this documentary.

If they abolish legacy admissions it's likely universities and colleges would lose a part of their funding. I personally don't have any issues with it, and don't see what the problem with Legacy admissions is.
Get rid of legacy admissions and affirmative action.. Make it 100% meritocratic. If students are good enough, they'll get in.

NEWSFLASH: attending an elite college isn't a prerequisite for success. Speaking as an engineer, any accredited university (including unranked state schools) can be a pathway to a good-paying job. You'll get out of your education what you put into it.
Yeah, but you get more out of it if you go to MIT/Harvard vs DeVry or Univ of Phoenix for the same whatever bachelor's degree. Not to mention, it could be make or break when you try to go to a graduate school.

Get rid of legacy admissions and donor preferences if it’s supposed to be based only on merit. I worked at a university, and I can tell you that legacy admissions, legacy hiring, and donor preferences are very much real. Scores and GPA aren’t anything much when rich/famous parents can buy their kids into universities. Legacy admissions and donor preferences are what the Asian guy should have gone after. He was used, and doesn’t even realize it.

Definitely for the first part. research has show the benefit is pretty much the same between legacy vs. AA, given same academic level. However, the AA is also overwhelmingly favor rich Black and Brown, not disadvantaged kids.
as an Asian, I am not against to be used as tool as we cannot get anything with our own power. Both AA and legacy should go. Use us as tool again legacy too, please.
@Zigest Most of legacy admissions favor white students because their great grandparents, grandparents, and parents attended. A lot of minority students don’t have that legacy. So in a way, yes it is. Also, most wealthy donors are white, and the universities bend to them because of money.

Race-based Affirmative Action is a blunt instrument that does little to address disparities and only increases racial tensions. Take for example Emily Rodriguez's family. Her parents came from Mexico as immigrants. By definition they had to start from zero and it had nothing to do with discrimination and everything to do with them migrating from a poorer country. For her to now say that she's been "pressed" is absurd. On the other hand take for instance a person of Chinese descent or Japanese descent who's ancestors arrived in the late 1800's. They would have actually faced racial discrimination at the hands of the govt (Those anti-chinese laws during the California gold rush and Japanese internment during WW2) yet according to the Race-based Affirmitive dogma Emily & her family would be oppressed by the aforementioned East Asians. Emily can claim her family was oppressed based on events that happened WHEN THEY WEREN'T EVEN IN THE USA AT THE TIME, and then get preferential treatment over people who actually were discriminated against! It's completely ridiculous. The Hispanic example is very important because it's a fast growing demographic. In no small part due to migration from Central and South America. Many arrive with little else besides the clothes on their backs. So the disadvantage they face is not due to "historical marginalization." It's a function of them being recent arrivals from a poor country. Now imagine a poor white person whose ancestors were laborers and sharecroppers in the antebellum South, whose family has been trapped in poverty for generations. Imagine another white person, a refugee from Ukraine arriving with nothing. Or one whose family migrated in the late 1800's escaping the Irish Potato Famine. These 3 aforementioned would be considered "oppressors" vs an upper middle-class Black person. No doubt there is a very real and very ugly history of discrimination in America, but the answer is not a clumsy tool like Race-based Affirmative Action.
A more sensible policy is to target people based on their economic circumstances. This will ensure that everyone gets a fair shot regardless of race. And in any case, many of the people that proponents of this new racial discrimination point to will benefit anyway. Minority groups are overrepresented in poverty stats relative to their population proportion, so they will still largely benefit anyway. At the same time while also giving opportunities to deserving people who are currently being discriminated against. But ofcourse that's not acceptable to the proponents of the new racism because its seems their agenda isn't what they say it is. It's quite sad listening to Emily regurgitate the woke nonsense. Same for Hamza. It's worth noting though that I get the impression that Hamza's Dad's comment were edited in a sneaky way. He clearly appears to be against Race-based Affirmative action but it doesn't fit the narrative so it had to be censored. So sad.

@@jamieson88 Well yes, that's a large part of the Harvard lawsuit -- Asian applicants needed even higher grades and test scores than White applicants. Affirmative action was being used to reduce Asian enrollment for the benefit of White enrollment.

People need to stop talking about college admissions as if that is the beginning of education and/or the solution to educational inequality. Education starts in kindergarten and that is where inequality starts, which is why the civil rights movement introduced Brown vs Board to address educational inequality back in the 50s when high school was all that was required for a "good job". Primary and secondary school are mandated by law for all citizens and there should be no inequality in resources and funding across public schools. It is pointless to focus on college admissions while ignoring 12 years of unequal and inadequate education in public primary and secondary school, which is taxpayer funded. This country can find trillions of dollars for wars and other foreign adventures but cant find money for a proper 21st century education system. That is pathetic.
Affirmative Action may have had a use for a short time but now it affects the opposite of its intended goal.

My whole problem with the the AA decision is that they did not address the real issue. Merit alone will not guarantee college admissions. It never has. There was no proof given by the courts to show that removing AA would make all college admissions based on merit. On the contrary, it just removes race based. All the other forms of unmerited admission still remain and will continue as it always has. Just seems like they purposely picked on race and ignored all the other problems. A very 'American' decision in my opinion.
because supreme court is not a legislation. They need a constitution base to make a judgement. Here they can use equal protection clause but it is not clear legacy is a subject under the same legal base.
No one said removing AA will bring world peace and prosperity for all.....All SCOTUS said was discrimination based on race is wrong even in college admissions. Asian students faced overwhelming discrimination for half a century to benefit everyone else including whites. Many wanted continued and further discrimination against Asians not only in college admissions but in all sectors of society. Supreme court said no.

Courts make rulings based on the facts of the case brought before them. File a lawsuit about "All the other forms of unmerited admission" and they probably will get struck down as well if you make a compelling argument.
The court can only rule on what is before them, and they really should avoid making broad decisions outside the scope of the case which border on rulings that are more akin to legislating from the bench which can end up getting overturned later on the grounds it was outside the scope of what they are allowed to do.
Look it up the definition of racism. Affirmative action fits the definition of racism. Reverse the roles and everyone would be crying.

Why would Universities do that? It seems the student wants to tell the school how to function. Asians want admissions to be just GRADES because that would advantage them. They don't want any other criteria JUST TESTS
Grades and public service should be the only determining factors. A really stupid rich man's girl went to school with mine, who was going on academic scholarships. Mine did go on to become a Vetrnarian. The man's daughter went on to become a nurse because he bought her degree. Is that what you want? Your health care providers with bought degrees? He didn't even graduate high school himself. He married a woman after leaving his wife and 6 kids who herself had married for money.

As a kid I was told the Civil Rights Act was one of the greatest things ever, and that all men and women were equal and that no one could discriminate on race, sex, or religion and on.
And then you grow up and find out that it only applies to some people. And worst of all you're the one it doesn't protect. In fact you're passed over for jobs and opportunties exactly because you're designated 'white' and other people come first. When the federal government proudly announces 80% women appointed to top jobs, or that they're looking for a minority not you for this or that job. Or when companies announce they're hiring '40% black talent', or Google tells people to pass over 'white' businesses and buy from 'black' ones in broad daylight.
The Civil Rights Act is a sham, and its disappointing. I want to believe in the freedom and equality for all the system advertises on its sleeve but there's a certain level of expectation the system has to live up to.
Except none of that is actually happening or harming YOU. Lifting up those who have actually been historically discriminated against and given NO access is not the same as mandating exclusion of you or people who look like you. You interpret it as such because you forget that equality cannot be guaranteed if there is no equity at the start.

Also: college admissions are a zero-sum game, since there are a finite number of seats available. That means "lifting up those who have actually been historically discriminated against" also has the consequence of denying (harming) others that would've otherwise been admitted.

Honestly diversity is a good goal, but lowering standards so specific races can get in is stupid. One child shouldn't have to work harder than a different child in a similar financial situation just cause their skin is a different color.
Diversity is not a good goal, MERITOCRACY IS. Diversity is resource inneficient, destroys the economy in many ways.

If the Supreme Court really cared about making things about merit, the first thing that should go is legacy based admissions. Someone buying a building for a school does not mean their kids are going to be great students.
People know all this already, and it was never really about making an even playing field.
Perhaps legislatures should eliminate legacy admissions, but I don't think there's a strong argument for them being *unconstitutional*.
@@JamesStewartfish The constitution has its flaws because minorities were not even allowed in schools at one point, which made AA necessary (even though minorities in certain categories don't even benefit from AA). "Separate but equal" was also constitutional at one point, so I am not using some antique legislation like it is a gold standard.
Most people say AA (including some people who went to the Supreme Court about AA) makes the playing field uneven and goes against merit. If we really are a meritocracy, then legacy admissions have absolutely no business in anything, period...
Except the Supreme Court was just hearing about this case, not one related to legacy admissions. They don’t make up laws out of the blue like you’re suggesting.

The issue before the court was concerning race based affirmative action policies; not legacy admissions. Even if legacy admissions came before the court it would probably still be constitutional because private universities can decide to extend admission to the children of previous alumni. Legacy admissions aren’t even remotely similar to the issue of race based admissions; though they’re certainly just as anti meritocratic.
Skin color shouldn't get someone in school
Cornell has a history of instituting a needs-blind admissions policy. An applicant is admitted based on merit by admissions department, then Financial Aid reviews the financial side and makes sure applicants can afford it through creating financial aid packages. I'm commenting from the perspective of being a Cornell graduate from a working class family who was accepted early admission and from the knowledge gained while serving as a Cornell College of Ag & Life Sciences Alumni Board member. The comment in this piece about getting accepted early admission, having to accept the offer without knowing if you'll be able to afford it is unfounded. If you're admitted, Cornell will make it possible ad affordable. Students and their families need to know this. Bravo Cornell! Congratulations Emily! 👏

Agreed. I can understand the family not realizing this - I didn't know how things worked before I went to school either - but there's no excuse for the journalists to not report the facts. It makes it seem like they're conveniently leaving it out to play up certain parts of the story and make sure you walk away with the impression and opinion they want you to have. I go to an Ivy League law school and they didn't consider financial ability until after we were accepted, at which point they offered grants according to our family's income/wealth.
With the way black people reacted to race swapping Ariel, you would think that solved all their problems. I guess there are more important things than media representation huh?

If you watch this it becomes obvious that the problem is not race, its class. It's interesting that the reporter dismisses the guy who says that class is the real problem not race.The other thing that is blithely ignored is the massive disparity in resources between schools. Also, why does there need to be the Ivy League to begin with? Why do CC's and state schools that incidentally serve the most non-white students and students of color get the least money? More black students will attend wonderful Black Colleges that will give them a great education and a sense of belonging.
You should be fully qualified for a job , regardless of race, color, age, etc. My brother worked for 6 years and went to college to get his next promotion. But the job was given to a woman not qualified. Then he has to train her. She just was not qualified. Total BS. Thank goodness this is done. Color and race shiukd never be considered. this is very interesting to me. I go to a primarily Asian college. I commute from 45 miles away, so I drive 45 miles there and 45 miles home while also working a full time waitressing job. It blows my mind when I score higher on tests and get better grades than the Asian kids who only have to focus on school because their parents pay for everything.
So it's a matter of financial background not race then.
That sounds racist to lumpsum all Asian kids to receive help from their parents. Their parents likely didn't have much when they immigrated just like other immigrants from South America. They look very different and can't speak English so the adversaries and discrimination they had to go through were immensely higher than most of Americans. Of course, you don't know how much bullying and discrimination Asians kids had to go through growing up and couldn't get help from their parents because no media talks about it and you barely know about them at all.

Colleges and higher education has been losing tremendous value over the years as more and more ppl ended up with student loans that they may not be able to pay back no matter what they do !

Of the four main races in the US, brown and black students place 3rd and 4th, respectively, in public school state proficiency tests. So blaming colleges for not admitting more "POC" is just dumb. These students need to pay attention in class, do their homework, and study or stop complaining.

where I work we are forced to take a random sampling of applicants. In the end a very small percentage of them pass the entrance exam so we wast a lot of our time. We have to go through 10 times as many applicants from the areas where we know it's unlikely they will pass just to get a few viable CANDIdates.. We could have a much higher percentage of passing CANDIdates if we went to the areas we are likely to bl find good applicants yet that would look like discrimination. is it? how much should we bend over backwards to find cANDIdates if the natural order of selection can produce them.
This goes back to merit. if you can handle the work you should be offered the job. Instead someone's gonna cry that no one of a certain type is hired by this company and therefore they must be discriminating. are they?

Vet schools are among the hardest to get into. A friend of mine was accepted into the first med school he applied to but struggled to get into a vet school. He finally went overseas. Working 12 hour days would have been much shorter work weeks than I put in most of my career. I'm mixed race. Being female was much more of an issue than only half white in the job market.
Grade scores should be the determining action for college admission people of color are just as intelligent as anyone else just keep those grades up
All people, not just blacks should just be viewed by their achievements.

Ivy colleges are kept afloat by wealthy donors. The wealthy have their own networks and the intent of the action by the man that financed the reversal of AA in colleges was to keep more Asian students out. In the 90's Asian students were filling seats in IT classrooms. There's been white male resentment of Asians b/c they've been majorities in many STEM classrooms for decades. If Asians knew black history, they would have recognized they were being setup to fail by the man paying to win. Black students are less than 1% in those schools. They were the least impacted by the decision. They'll continue to be 1% or less. Ending AA means it's not an entitlement to new migrants. AA was created for that 1%. It's expansion is too wide and failed to repair the harm done to the 1%.

@@anpdm1 It's just been a few months since the end of AA, so it's still too early to call. However, the end of one preferential policy has spawned others. For example, I've read that some universities are giving those who live in "underserved" zip codes preferential admission in an effort to increase black and brown enrollment. Although some Asians live in those areas, they are predominantly black and brown.

Better get your papers in now. Equality of outcome is no indicator of ability but rather socioeconomic status, race, gender, etc. Affirmative action can completely ignore aptitude.

lol. Those schools that the Asian students complained they couldn’t get into took this decision and started letting in more legacy admissions. This didn’t help the Asian students and Black and Hispanic student have other options.

My nephew got deferred at his first choice. He have friend, who at private day school in Boston, very demanding and he very good student. He have both parents, Yale. He well rounded. He white. He get deferred, too. Only one, among nephew's pals from elementary school, who get in Early Decision, a kid, who's parents from Nicaragua, work 2 jobs, food and janitorial. He in at Harvard. He attend, and he have sister, there, too. My sister really angry, cuz she say affirmative action still in place, maybe even more so. I like the idea of affirmative action, until you doing group project, with group chosen at random, and you can only do so well, cuz a group member not pulling his share of the load, although effort not an issue. Not the case, with this kid, though. He pass every test, along the way. I think people think of affirmative action as minorities, going to crappy schools, where you do extra credit to have a 4.8 GPA. That worse case scenario. A lot of minorities, taking a gift, early on in they lives. They have to get into a good elementary, middle, then high school, if they in city. They have some realistic idea how they do at elite school. College admissions basically who you talk to, who have kid that age. Parents, who say they want they kid to replace a kid, with lesser grades, do not understand a human being, and how a person, even if you view him or her under he lens of admissions, not ALL gpa. Who you gonna accept, if you have Chinese kid with 4.0, and you have another kid, who Hispanic, who have 3.6, BUT he show signs of being great writer, and he send in some samples of his writing?

I agreed with Affirmative Action when it was established, but when there so much evidence that people with higher scores and more experience keep being passed over to continue to advance people who had for decades had disadvantages. One would think that with AA that these people would collectively work hard so they wouldn't need to relay on AA to continue granting them avenues to advance. Okay some of the education system that they still have to relay on aren't the best, but the education systems through out the country have degraded overall.
My grandfather was in one of the first classes at Penn State, when it was basically an Ag school. So I guess I’m 3rd generation. He ended up becoming an engineer at PECO but never got his degree despite going to night school at Drexel for years. Both parents got bachelors. Uncle started but never completed his engineering degree. I got my engineering degree, first in the family! 🎉 what’s funny is how full circle everything has come. I will be teaching my kids… learn a trade or start a business. That’s it. DON’T GO TO COLLEGE!!!

I've always been conflicted with AA. On one hand, it is a form of reverse discrimination based on race. On the other hand, I don't ever want to attend a college that's 70% Asian, whose helicopter parents paid for a lot of afterschool programs and private tutors (I was one of those tutors for a long time and know the game inside and out).
What's real intelligence? Is it just memorizing useless facts and figures? We have A I for that now. How about someone who could invent something new think outside the box not just memorize how to find the volume of the box with a formula.

You’re living in a fantasy world where you can make something from thin air. To make tires, you must know how to make rubber. To make a car, you must know how to make an engine. To make an engine, you must know how to get metal. To get metal, you must know how to make metal mining equipment. And so on and so forth. No such thing as inventing something without any knowledge.
it is cheaper for parents to sacrifice their all to pay for those after school and private tutors hoping their kids will get a free college ride.
@localnemesis82 So in my many years, it was quite rare for those kids to get a full ride to a prestigious school based on grades alone. The ones that did set themselves apart with a particular special skill. Afterschool programs and tutors didn't help for that.

They have advantages that other students who are aspiring to get into the same school may not have. Let’s be realistic here now.

No the goal is to bring wealth inequality up so diversity will grow. Most people of color are poor because they can only afford minimum schooling. So by fixing wealth inequality this creates better schools and better quality of education. Therefor students of color will have the money and skills to perform and excel in a higher teir of education.
It should be removed from employment as well.
