Accused in Sandro Muhlach complaint detained by Senate panel

- Jojo Nones, one of the accused in the sexual abuse complaint filed by young actor Sandro Muhlach, was cited in contempt and detained by a Senate panel on Monday (August 19).
Present at the hearing of the Senate Committee on Public Information and Mass Media were Nones and his co-accused Richard Cruz; Muhlach, via video call; and Muhlach's father, veteran actor Niño Muhlach.
During the hours-long probe, Nones was repeatedly asked by Senate President Pro Tempore Jinggoy Estrada whether he offered financial contribution to any charitable institution of Niño Muhlach's choice.

Nones maintained it was not a settlement, and refused to answer with a "yes" or "no" which drew Estrada's ire and subsequent motion to hold him in contempt.

Estrada is so unprofessional he gets angry easily and shouts at the accused. He always come off as arrogant and very accusing when he should be unbiased. I’m not siding with the accused but if you’re treated like that then he should’ve just invoke his right to self incrimination. 🙄

this is very common as election is right around the corner if you get my drift. for them this is just a show to catapult them to the lime light and get the miles / momentum needed for the election. it is a trapo move. everyone that disagree is a fool and will be forever be swayed by this people.

Good thing Estrada isn't a judge. He clearly shows bias. What happened to innocent until proven guilty. This is a criminal case so let the justice court handle it. If he is guilty, then should be punished according to the provisions of the law. Pabibo at pakitang gilas lang naman tong senate hearing eh. Focus on more pressing and useful legislation.

Senators make bipartisan legislation and to be able to the job you have to be a graduate of political science or better off a graduate of law school. Padilla ? An actor? What does he know. When he hit his talk is mediocre if he don’t it laughable. Wake up and vote with your brain, don’t be to emotional or joining the popular bandwagon. Your future and the future of your children is at stake. This case should go to court, it’s appalling to have this under the senate by the time this goes to court all the evidence is tampered. This looks like a show for Estrada on center stage being testy and belligerent.

Just want to share this opinion on the issue involving Aga Muhlach's nephew (the son of his first cousin) and two contractual workers from GMA7. I must also address the behavior of Mr. Jinggoy Estrada, whose conduct in this matter has been nothing short of rude, arrogant, and biased. It’s worth noting Mr. Jinggoy.
First, with so many critical and fundamental issues that Senator Padilla's committee should prioritize, is it truly appropriate for the Senate to focus on matters such as this? While I am not dismissing the significance of this issue, and I fully acknowledge the Senate's authority to investigate, it is important to remember that our courts are the proper venue for such cases. Legal professionals should be the ones debating these matters, with a judge ultimately deciding the outcome. This approach also helps prevent the risk of "trial by publicity."
Secondly, I must ask, Mr. Estrada, what was your rank in the 2022 senatorial election? 12th right? I believe it’s better to have just one Estrada in the Senate. You don't deserve the people's vote. I'm glad I didn’t vote for you. Your conduct suggests that you believe yourself to be the Chairman of the Committee on Public Information and Mass Media. However, it is imperative that you allow the actual Chairman to preside over the proceedings. Remarkably, you have spoken more than the Chairman himself, Senator Padilla. Mr. Estrada, you must remember that the Senate is not a court of law. Your demeanor and remarks indicate a premature judgment of the 2 accused, which is wholly inappropriate. It is essential that you refrain from forming personal judgments based on a single perspective. The rights of both the alleged 'victim' and the 2 accused must be safeguarded equally. Your role as a senator is to conduct an impartial investigation, yet your behavior suggests that you have already passed judgment on the 2 accused, as if you were a witness to the events in question. This is particularly troubling, given that only the alleged victim and the two accused individuals were present during the incident. No one else can provide firsthand testimony. It is essential to remember that this is a matter of contested facts, not an opportunity for you to impose your personal conclusions. You must refrain from being disrespectful and overbearing in your questioning-the two accused have not been convicted, and you have no right to treat them as if they have. As a senator elected by the people, it is your duty to serve with integrity and to exercise your position responsibly. Your apparent bias in favor of the alleged victim is concerning, especially given your history as an accused individual. You confidently labeled one of the accused, as a liar by saying, 'You're a scriptwriter.' But would you dare say to the alleged victim, 'You're an actor,' given how you’ve uncritically accepted his narrative? It’s important to ensure that both sides are treated fairly, without prejudice."
Furthermore, the individual claiming to have been "abused and molested" was alone when he's voluntarily entered the hotel room of the 2 accused. Upon realizing that there were only two individuals were there, why he's still chose to stay and had drinks. Moreover, Could he not have simply said, "I’m sorry po, Direk, but I cannot stay"? There was no indication that he was coerced or threatened to remain there. This was a choice he made freely. He's 23 years old already, and fully capable of making decisions, and certainly able to leave or resist if he felt uncomfortable. When he was allegedly given money wrapped in a roll and a powder-like substance, does he really claim to have no idea what it was? Really? To be honest! And let’s assume that he genuinely had no idea what it was-why did he try it? He hasn’t mentioned that he was coerced. Isn’t that so? Did he not have the capacity to resist? The two accused individuals, one who is reportedly small in stature and another who was allegedly very drunk, as he said in his statement and both are gays. You, as a 23-year-old man, are taller and stronger-why didn’t you resist? At the very least, you could have said, "This is wrong. I will report you if you insist. I need to leave." If you had done so, it is highly unlikely that anything "against your will" would have occurred-assuming it was truly against your will. You are not a child-you had the ability to say no, to resist, and to leave. So why didn’t you?
Let me be clear: I do not seek to invalidate genuine claims of abuse, nor would I ever condone such behavior. I have deep empathy for true victims of molestation and abuse-again, for the "real" victims.
Regarding the NBI's statement that the alleged victim's behavior changed "after the molestation occurred," I must ask: Has there been a conviction? These are serious terms to use, especially from an investigative body. You even stated that CCTV footage shows a change in the alleged victim’s behavior before and "after the molestation occurred." Naturally, after consuming alcohol, behavior may change. I urge you to refrain from pre-judgment and to conduct your investigation in accordance with proper legal procedures. Be mindful of the language you use, as the public is watching, and premature conclusions could harm the true victims in this case. As it stands, we do not yet know who is lying and who is telling the truth. So, who is the real victim here? Let us not forget that the accused also have rights that the government must protect. Ultimately, our collective goal should be to uphold the rights of every Filipino, regardless of their social status or gender.
Remember, a person who genuinely does not want to do something will refuse, no matter the circumstances. He will resist with all his might, even if it means putting up a fight. The only exception would be if he were immediately incapacitated upon entering the room, such as being forcibly drugged to prevent any resistance. But that was not the case here. Why did it progress to the point of drinking alcohol if, from the very beginning, he knew he was alone with just the two accused? According to his own statement, he asked, 'Who else is with you?' and was told by "Direk" I'm with the production team. Upon realizing that only the three of them were in the room, why didn’t he leave immediately? If he felt obligated to stay because it was the 'director,' a polite excuse after a single drink or just finishing a glass of wine would have sufficed to leave. Logically, he must have wanted to stay, which is why he got drunk. He is not a child and must have understood the potential risks, especially given that he was in the company of two gay men.

@@ramonyupano5109 all i can say is the senate must focus on creating law, if they think that the accused will not be condemned due to an absence of such a law , then make it or revise it or ammend if its not enough to condemn the accused but not to procecute the accussed whether he is guilty or not.
