عقد الهبه هل لابد من تسجيله؟

عقد الهبة هو عقد يتصرف بمقتضاه الواهب في مال له دون عوض، ويشترط لقبول الهبة أن يقبلها الموهوب له أو نائبه. في مصر، يجب أن تكون الهبة بوثيقة رسمية وإلا اعتبرت باطلة، إلا إذا تمت في المنقول بالقبض دون الحاجة إلى وثيقة رسمية12.
أركان عقد الهبة في مصر:

الكويت: تتطلب الهبة وثيقة رسمية، ويجب أن يتم قبولها من الموهوب له.
الولايات المتحدة: تختلف القوانين بين الولايات، ولكن بشكل عام، يجب أن تكون الهبة موثقة ومقبولة من الموهوب له.
ألمانيا: تتطلب الهبة وثيقة رسمية، ويجب أن يتم قبولها من الموهوب له، ويمكن أن تكون الهبة مشروطة.
A donation contract is a contract by which the donor disposes of his property without compensation, and the acceptance of the donation requires that the donee or his representative accept it. سأعطيك مثالاً على حالة من قوانين عقد الهبة في مصر:

السيد أحمد قرر أن يهب شقته في القاهرة لابنه محمد. لإتمام هذا العقد بشكل قانوني، يجب على السيد أحمد اتباع الخطوات التالية:
نية التبرع: يجب أن يكون لدى السيد أحمد نية واضحة للتبرع بالشقة لابنه محمد.
القبول: يجب أن يقبل محمد الهبة.
الوثيقة الرسمية: يجب أن يتم توثيق عقد الهبة بوثيقة رسمية لدى الشهر العقاري.
التسليم: بعد توثيق العقد، يجب أن يتم تسليم الشقة لمحمد.
تفاصيل إضافية:
