It's 38V / 440 Ohms = 86mA (or something slightly less in practice). Pretty much. Could easily harm LEDs very fast. I would preferably use appropriate MOSFET transistor with Gate shorted to ground and a Source to ground constant current limiting resistor (20mA?) for a broad range of applications. Your way you are dissipating about 3W of power on your resistors unnecessarily. With the 20mA constant current source, you would dissipate 0.76W of power on MOSFET at the most.
