Kenyan legal expert Lumumba delivers Tiro lecture

  • POLOKWANE, 08 September 2017 - Professor Patrick Lumumba will give the 5th annual Onkgopotse Tiro Memorial Lecture at the University of Limpopo. Tiro,a student activist, was killed by apartheid agents in 1974.

Funny how people always want to claim ownership of a Pan African revered across the continent, and somewhat try to to remind people that he's from a certain corner of the continent and yet tribalism and corruption is what defines them, and it obviously reflects in their electoral process.

    Professor Lumumba, although I have only a couple of weeks heard of you and listening to your messages and speeches have realized my history. I’ve been on a full throttle search for the pass four years after a three week stay in London England. My journey actually started with another world view aside the one I have experience in the United States. The emptiness that clutches my very soul, wants and need to be filled with as much Africa history and status for the rest of my life. You are beyond amazing, I have much love and respect for Prof..Lumumba I don’t have the words to express how your speeches have impacted my mind and thinking. My life here in the USA has been 75 years of degradation, miseducation, biblical deception. My love is for my family, friends and the Creator GOD almighty, which one I’ll understand everything. I don’t want my life to end here. I want to come to Africa.

      @ Samuel Kimani. You are entitled to your own opinion but I'll have you know, I had the privilledge to learn the law under the tutelage of some of the most erudite legal minds in the UK. My Public Law Lecturer (Constitutional and Admnistrative law) was and remains one of the best in his field. He had a fantastic grasp of the law, history and politics, coupled with a simple delivery, he married all these skills beautifully to our great benefit. He was the genuine article subsequently, I can tell a charlatan from a mile off. PLO is a charlatan and a verbose one for that matter. I highly doubt if you held him in high esteem prior to the recent election case in which he represented the IEBC. Now, that Fred Ngatia, first class! Top banana. PLO? Rubbish! To you, I suggest you work on your grammar before you embark on policing others. Good day!

    As an outsider I can tell Afrika that Afro People as whole have such great qualities that no other people or continents have. I not only observe ur speakers, the sheer excellence of their speeches, but I also observe the sheer excellence of the listeners who digest each & every word in rapt attention & respond so well to what is being said. It proves that Afrika has the quality to rise to the No.1 spot in the Comity of Nations because Afros are undoubtably the Children of the Greatest God for our planet... Time will prove me right...     I've never come across this man's speeches until recently not more than two weeks. This is thw kind of people we want who can speak the truth without fear, who can move the minds of our today's youth towards rightful thinking by reminding them their history, enlightening them about the present, and putting them on the right track for better tomorrow.     This lecture should be watch by South Africans of ALL races & political persuations ! It is one of the most observantly astute, lectures I have listened to in ages ! This guy has hit a host of nails squarely on the head. But I guess, not many will watch this & then they will continue to scratch their heads & continue to moan about the "State of South Africa" & do nothing to try to positively change it. It is for those, that I weep in frustration !

      Tobrok Wa Mike He didn't actually. He was head of the anti corruption committee and they threw him out as they couldn't pay him out. You will find that the people who claim he defended theft are those who are against him defending the electoral and boundaries commission on their recent Supreme Court case and if you have any basic knowledge of the lawyer, you'll appreciate that everyone has a right to fair representation.
      Also, you don't ignore someone's message simply because you don't agree with his actions on something totally unrelated.

    It is my first time to listen to the man, he is indeed an African Icon, today I have listened to more than 5 speeches delivered by this great man and I wondered how could African Leaders be failing Africans while there are just a call away from a man like Prof. Lumumba who could give them direction and advise . This man is great, he is what Africa needs.

      Wena Sazini Sibiya, jealousy has got nothing to do with it. To claim that Kenyans are averse to PLO because of envy is akin to saying that people don't like Zuma out of jealousy. You need to read up on the history of this man to understand why Kenyans are unimpressed with him. Very few Kenyans understand the Black Consciousness Movement or even comprehend that there were other parties such as PAC or AZAPO who played a huge role in shaping the struggle discourse in South Africa. I really don't think PLO even quite understands what Tiro and Azapo stood for. I don't know who thought it fit to ask him to speak on Ongkopotse Tiro, he is not fit to utter Tiro's name.

      I Agree and it is in most of the time undermined, hence we lack it. So this man whenever he speaks he educates you about the African Politics, African Leadership, African Problems, African Socio economic Issues etc. Something our own colonized education does not teach us. I agree with you 100% when you say we need Action and the unfortunate part of that is we need Action from Politically hygiene, corruption free leaders of our society at large.

      PLO hasn't got a clue of the dynamics of South African politics that is why he has got nothing new, original or radical to add to the discourse. Goodness gracious the man can't even sloganise properly, when one says "Mayibuye.... iAfrica" x2 and the crowd responds, s/he must then turn around and say "iAfrica... Mayibuye" x2. And to refer to Lesotho as LesoTHO, for heavens sake the H is silent...one says LESUTU. I can bet you he refers to the people of Botswana as Botswanians as opposed to Tswanas. Bloody ignorant African.
      Whoever invited PLO to speak failed to vet him. This here PLO is nothing but charlatan. Not an original thought in sight. Trots out the same speech over and over again, the only difference is when he is in Ghana he will name check Nkurumah, in Tanzania he will name check Mwalimu and in South Africa he name checked the usual ANC suspects with the exception of Biko, Sobukwe and Tiro. Tiro was not ANC he was AZAPO. AZAPO and the PAC consisted of some the brilliant minds in the South African struggle. They were the backbone of the Black Consciousness Movement. Way back in the 60s and 70s they foretold of the malaise that would beset South Africa if the Revolutinary Movement did not uproot the status quo. Fact. In the 90s, the ANC sold out South Africans at CODESA. Those in the nous said so then and now they are being vindicated. PLOS speech has done nothing to improve the discourse as pertains South Africa then and South Africa now.
      If you are looking to be educated on African Politics, African Leadership, African Problems and African Socio Economic issues then I suggest you start by reading Steve Biko's 'I Write What I Like' and Thomas Sankara's 'Sankara Speaks'. Although these were written decades ago, the messages remain relevant to this day, for what ails Arica remains the same, then and now.

      @Qiniso Truth. I appreciate the fact that you speak solution to a problem. Most of PLO's speeches are about corruption and the the true reality of Africa's shortfall, the malfunctions of the continent itself. I See his speeches as more of a moral consciousness tool, education to my Black African soul.
      @Qiniso Truth there is a saying that says there are two sides to a man, the bad and the good, all you can do is to take the good out of him. So i do not think its of good deed to discredit him based on his pronunciation the words you quoted above, i am sure you would agree with me if i say i would also struggle to pronounce most of East Africa indigenous words as oppose to my own in my Land. At Home here, Zulu can pronounce the name of the province i come from "Limpopo" so it is a deficiency we most suffer the point however is to get the massage across, so if a Zulu man come to me and say;"i want to go to Limpompo" my unconsciously without even rep reminding my mind i know his referring to my homeland. So Take the Good out of the man and leave the bad things to himself. With the good you will educate yourself.
      Lastly, Thank you very much for the African literature you have cited as recommendations, i do have Steve Biko's "I write what i like" i will look for Thomas Sankara's "Sankara Speaks".

      No he is wrong about Mbeki, Mbeki had to go, we could not change the Constitution because of him, thats how a dicatorship starts. The only thing that was wrong was to recall him in September 2008 before his termed finished in April of 2009.

      Stikskubwa, I'd rather someone read Bantu iko's ' I Write What I Like' than listen to this schill. Even Malema has more integrity than this charlatan. His tenure as Chairman at the anti-corruption unit turned out to be a huge mess, all because he was foolish enough to accept contributions ( for his foundation) from the very people he was supposed to be investigating. Talk about conflict of his interest. He was turfed out so fast. Sadly the drama he created only served to put back the anti-graft fight in Kenya.
      He then goes on to defend the IEBC? If he really believes in democracy, in the Rule of Law, he should have recused himself. His arguments were completely lacking in substance, it was clear that he could not find any law to marry to the facts in hand so he just went about wittering on in that verbose way of his. Any good law will tell you that a strong legal argument is one that marries the FACTS to the LAW. The facts of the case were hot mess there is no way, they could be tied to any law. Thank God for the God fearing astute Supreme Court bench. They managed to sift the wheat from the chaff and handed down a stellar ruling.
      PLO showed his ass and he will never again have good standing before any right thinking Kenyan or Pan-Africanist. End of!

Thing is, PLO purports to speak up against these things and then you find him in bed with some of those very same corrupt individuals he is harping on about. Sanitise this! Sanitise that! His call for African gorvenments to sanitise themselves now amounts to nothing. Indeed as a lawyer, the 'kerb rank rule' stipulates that a lawyer is expected to represent whoever knocks on his door, by the same token, under the LEGAL ETHICS allow for a lawyer to decline to take on a case if s/he feels they cannot adequately represent the client. PLO opted to represent the IEBC, based on this, I believe it is correct to say that PLO took this recent case because he felt that the IEBC case had a merit (s). And therein lies the problem! I cannot for the life of me see how a genuine Pan- Africanist could do what PLO did. His actions illustrate that this is a man who is not afraid to speak from both ends of his mouth. Africanists like Tiro or Biko or Sobukwe would never have fixed their mouths to defend the very system that oppressed them, so how can PLO defend IEBC and by extension, Jubilee? He has shown his true colours and rest assured, Kenyans will never forget!

    I have been watching speeches by PLO Lumumba, and was very impressed and considered him as the only great African SPEAKER who could tell the truth, democrat, Loyal and non-corrupt. I WAS QUITE SURPRISED WHEN I SAW HIM PARTICIPATING IN KILLING DEMOCRACY IN HIS OWN COUNTRY KENYA. This is a great SPEAKER than others who is talented in speech making but doing contrary to what he speaks. If truly he means what he speaks, let him apologise to Kenyans. Since I saw him killing DEMOCRACY in court I started hating him like I do hate other hypocrites who are everywhere in Africa.

I'm sure you well know that Kenya recently held elections of which the results were heavily contested leading to a seminal judgement. Can you believe this man actually defended the Respondents in that court case? Granted the 'Kerb Rank Rule' stipulates that a lawyer must take the first brief that comes on his table, but at the same time, a lawyer is allowed to recuse himself if he feels that his moral stance does not allow me to take on the case. Well, P.L.O took on the case but luckily Kenya's Supreme Court Judges are God fearing intellectuals. They applied the facts to the law and ruled that the Presidential elections were null and void, Thy went on to instruct that a fresh election be held in 60 days. Suffice it to say, no right thinking Kenyan can stand to look at this man. He should have recused himself but I guess the price was right. And now he stands here eulogising Tiro? Get outta here! Ongopotse Tiro must be turning in his grave.

Much as the 'Kerb Rank'stipulates that a lawyer must take whatever brief that comes across his desk, LEGAL ETHICS ( small topic covered in 2 hours in law school- 1 hr lecture, 1 hr seminar) allows for a lawyer to recuse himself from a case if he feels that for whatever reason s/he cannot adequately represent the client. PLO spends substantial amount of his time going on about how African democracies need to pull up their socks. The recent election case in the Kenyan Supreme Court was a seminal moment and PLO by choice somehow managed to find himself on the wrong side of history.

      On 17th October, 2017 , we will hold the fresh election that the Supreme court ordered.
      President Uhuru Kenyatta will win it again because he won the first one on 8/8/2017.
      he was robbed off victory by our activist Supreme Court.
      That judgement was bogus at best and legal banditry at worst.
      President Kenyatta referred to the judges as 'wakora' [thugs]. That is exactly what they were.
      Sample this MR. Truth,
      The world over, elections are about numbers and votes. When we voted, the difference between the legitimate winner, Kenyatta, and the loser, Odinga, was 1.4 million votes.
      Mr.Odinga petitioned the election in court NOT ON THE BASIS OF VOGTES, but on the basis of how the votes were transmitted.
      In other words, he petitioned not on votes, but on how the votes were transported and reported.
      INhis petition, Mr. Odinga never questioned the presidents 8.2 million votes.
      He never even disputed his own 6.7 or so million votes by alleging that he could have got more.
      He never disputed a single vote for Uhuru Kenyatta.
      He never questioned the margin (the 1.4 million votes).
      NO!
      He 'disptuted' the transmission.
      In other words, the infrastructure.
      What was being transmitted were VOTES and nothing more, nothing less!
      It is THE VOTES that were being transmitted!
      The correct votes were transmitted but then , there were some logistical issues like unsigned forms because some returning officers didn't sign the forms (and most of these were in Raila's stronghold).
      It's even been said that it was sabotage on Raila's side in order to reject the election which he probably knew he was going to lose.
      In some instances, where forms were to be scanned and then sent, the scanners and coyping machines broke down!
      There was NO HACKING of the electronic election manangement system and even the manufacturere, theFrench company said as much.
      There was no culpability on the part of the third respondent, in this case Mr. President.
      Mr. President did no wrong!
      that is according to the Supreme court.
      The person on the wrong was Prof. Lumumba's client; the IEBC (electoral commission).
      Now, my question is, how can the court overturn an election due to the way results were transmitted?
      Why punish the voter?
      Why punish the country?
      Why punish Uhuru?
      This court is an embarrassment!
      It put process adn procedure over and above substance and in this case, substance was the votes!
      The court didn't even order an examination of all the ballots as well as a recount yet, that is within its purview!
      ....adn by the way, Uhuru had no business asking for a recount!
      He won!
      Winners never ask for a recount!
      It is the loser who asks for the recount but in this case, he never did because he knew that he had lost.
      The KIEMS kit (Kenya integrated elections management System is foul proof!
      Kenya conducted the best election Africa has ever had!
      Transmission or no transmission (what is transmission by the way) , Kenya conducted the most credible election on African soil and Uhuru won hands down and he will WIN AGAIN!
      The supreme court disgraced itself.
      The precedent set by the supreme court is so low that if a returning officer refuses to sign a form from a given constituency (which is part of transmission), then, following its own precedent, the Supreme court can nullify the repeat election again!
      ....and again and again and again!
      No election is perfect but the retarded SC of Kenya ruled that elections have to be perfect in the way votes or results are transmitted and reported.
      they may not have used the exact words but that is how it ruled!
      This court is a den of iniquity.
      'finally, Lumumba did a great job at the bogus supreme court. the odds were stacked against his IEBC and the president.
      There is nothing any reasonable man could have done were he in the shoes of Lumumba or the presidents lawyers.
      This was a travesty of justice and I truly hope no one uses it as case law either in Africa or anywhre else in the world.

      @ Natiive son. Before I proceed, I'd like to make it known that the correct mode of address should MADAME Truth. Back to the issues at hand. According to the law (The Constitution) and previous judicial decisions, in order to access the validity of the election results, the following things were going to be assessedd;
      a) voting
      b) electronic transmission of results (by image and text to tallying centre)
      c) the display of results in a public portal that is accountable, verifiable and accurate.
      *The aforementioned standards determine whether or not results meet the constitutional threshold.*
      Kenyans queued and voted peacefully. The shenanigans began and escalated at the point of counting and tabulating the votes. At which point the mode of transmission was brought into question. I don't know whether it is lack of comprehension on your part, or whether you are just hell bent on spinning a pack of lies. Understand this, *the issue was not the infrastructure per se, the issue was the information (NUMBERS) that was fed into the electronic facility and then transmitted!*
      NASA went to court and successfully argued that the numbers were not adding up. In regards to the numbers, Nasa argued that
      a) an algorithm had been fed into the server such that once Raila's votes were fed into the system, Uhuru's votes automatically increased by 11%! This was demonstrated by the fact that when tabulated on a graph, Uhuru's votes increased in a straight line. Anyone who is familiar with statistics knows that in an event such as an election, it is highly unlikely for results to pan out in a straight line.
      b) Still on the issue of numbers, it was established that almost 0.5 Million people went to the polling station and voted in the Presidential elections alone. They did not bother for other representatives. On examination of the results, it was found that votes cast in the presidential election (15,588,038) far exceeded those for Governors (15,098,646) and Members of the National Assembly (15,008,818) by 482,202 and 567,517 ballots respectively. How can one go to the polling station and not vote for a Gorvenor/ MP/ Senator/ MCAs/ Women's Rep? Very odd! Uhuru was the actual beneficiary.
      Any right thinking person can straight away tell that the number of people involved in this anomaly was too high, too high, such that it cannot be easily passed off as a coincidence. The law of probabilities stipulates that there is no way the difference between the Presidential elections and Guberbatorial elections as well as the Presidential elections and MCA elections would amount to almost roughly the same figure. When pressed, the IEBC lawyers tried to argue that the other 5 ballots may have been cast in the wrong box, what is known as 'stray votes'. Coincidence? I think not.
      When pressed, IEBC papers admitted that IEBC could'nt account for the stray BALLOT PAPERS!
      At one point, IEBC lawyers argued that the 0.5 M votes could be mainly attributed to prisoners and diaspora votes. *NASA argued that these two groups could not make up 0.5 million.* because only the Kenyans based in Tanzania, Uganda, Rwanda, Burundi and S. Africa were allowed to vote.* *As of March 2017 it was established that only 1,500 in the diaspora were registered to vote*. The prison numbers were even lower, for example, only 7 prisoners in the notorious Manyani prison registered to vote. Again, probability dictatesthere is no way, diasporians and prisoners were going to vote for Uhuru lock and stock!
      *Bottom line, once you add up the numbers of all the prisoners and diasporians eligible to vote, the figure does not add up to 0.5 Million!* Red Flag!! In simple English, there was just no way to account for 0.5 Million votes that Uhuru is alleged to have received!
      c) Nasa had some copies of the original Forms 34A and Forms 34B. They went on to argue that the results on some Forms 34A did not match the results on Forms 34B. There were many instances where, it was clear that by the time the results were being transferred to the Form 34B, Raila's results were being deducted, whilts Uhuru's results were being bumped up! There were 40, 483 polling stations i. When you add all those extra votes Uhuru got and you begin to understand the gravity of the matter.
      The Supreme Court didn't just sit there and take NASA's word for it, instead they asked for the digital footprint. They asked IEBC to open the servers so that they (and by extension the world) would see the forms that had been scanned, transmitted and logged/filed into the database. The digital records would have been enough to ascertain whether the tranmitted information that was correct! Hence the issue of transmission! I repeat the issue is not the technology, the issue is the records that went into the computers!
      When the Court requested access, IEBC and Jubilee lawyers weren't happy. They argued that granting access to the server would leave the system open to tampering.
      The Supreme Court then went on to instruct IEBC to provide 'READ ONLY' access but IEBC (egged on by Jubilee lawyers) refused to comply. Limited 'READ ONLY' access was finally granted very late in the day. If Uhuru won, then his representatives should have been extremely keen to provide the digital footprint showing the numbers! Instead they made it nigh on impossible for the Court Registrar and Court IT experts to access the digital footprint. As the matter stands, IEBC are still in contempt of the court order. The days of impunity are over and heads will roll. Somebody within the IEBC better start singing like a canary in order to secure a plea bargain.
      But I digress. When the servers were opened, the Court Registrar established a host of anomalies which confirmed that all was not well. For example, there were missing Forms 34A and Forms 34B; results from certain polling stations were missing. Even worse, a new password had been created for the IEBC Chairman Chebukati, this password was then used to gain access to the server 9,934 times! It has now come to light that this new password was created without Chebukati's knowledge.
      It's important to know why the fake Chebukkati logged in. The only way to find out is open the servers, but that is not going to happen. Uhuru would much rather lambast the Supreme Court who are trying to help him confirm his win, than lambast IEBC for messing up his win, How odd!
      You've gone on to state that NASA/Orengo/Raila never argued about the numbers. You're wrong, Orengo said that when all the factors are taken into consideration, one cannot account for upto FIVE MILLION VOTES. And yet here you are talking about Uhuru won by 1.4 million votes.
      c) Numbers aside, NASA further argued that several irregularities had taken place. * By the time the matter went to court, they had examined over 25,000 vote declaration forms and detected errors in 14,000 of the forms*. The errors ranged from inter alia, unsigned documents, or the name of * one presiding officer being shown as the official in charge of elections in multiple stations at the same time*.
      NASA officials found 443 instances of ungazetted polling stations, election results forms that had been filled out in the same handwriting, and forms that have a polling station, names and details of agents as well as their signatures but were blank in spaces meant to show results.
      NASA argued there was chickenary galore, Forms 34A, 34B did not have security features. For example, some forms did not have the watermark signs, some did not have serial numbers, some did not have barcodes and those that had barcodes, the barcodes were not tied to any polling stations in Kenya, instead they were tied to various places overseas! Such was the chutzpah some Jubilee returning officer actually scanned in results written on an exercise book paper.
      Muite tried to argue that there is no legal requirement for forms to bear security. The Bench saw right through that argument.
      d) By the time of announcing the Presidentialresults, Chebukati purported his numbers to be final. This suggested he had received all the tallies from all the polling stations. According to Nasa, by the time Chebukati made this announcement *he did not have documents for 11,883 polling stations.* So how exactly did IEBC know that Uhuru had won?
      Based on this, the bench decided that the elections were null and void because requirement b) electronic transmission of results (by image and text to tallying centre) and c) the display of results in a public portal that is accountable, verifiable and accurate had not been met!
      If Uhuru claims that he won the elections, then he should direct his ire at the IEBC. It was the IEBC's responsibility to ensure that requirement b and c were met. If Uhuru is confident that he has the numbers, then he should have been furious with the wakoras at IEBC who refused to open the servers so that his lawyers could use the digital foot print to demonstrate his win.
      The Supreme Court has set a new precedent that the world over stands to benefit from. They have established that the PROCESS counts. It's not just important for the mwananchi to queue peacefully for hours on end in order to cast his/her vote. It's important to ensure that each vote is properly counted and accounted for. Unlike in Stalin's Russia, in Kenya, not only do those who vote matter, those who count the vote matter as well!!! Those who count the vote have a responsibility to ensure the numbers tally!
      The culprit isn't the Supreme Court or NASA. The culprit may well be IEBC but truth be told, IEBC did not stand to gain anything from this mess, Uhuru & Ruto did. The operation was large scale, there is no way Raila would have succesfully bungled up the elections in such a short space of time. As we speak, Chebukati's memo has revealed even more anomalie; the GPRS for the KIEMS kits were switched off. Satelite phones weren't distributed. The list is long and endless.

      First of all, let me apologise for mistaking you for a dude. This is the first time I am coming across a name like yours. Pole.
      Secondly, the MAIN problem with the court's ruling [THERE WERE SEVERAL] is the short judgement it rendered.
      Now, I do understand that time was of the essence but most of the evidence that formed the court's opinion was not delivered and normally, this creates a vacuum which breeds rumours allegations and assertions.
      It does not mean that everything that Orengo and Co. raised is/was the truth!
      The court I am sure will address all of them in due course.
      My problem is that a case of this magnitude should have been better handled!
      Thirdly, you've raised numerous issues regarding NASA's petition and if I may just respond to a few, I'd like to talk about the controversial 5 million votes.
      Our registered voters were 19 million and about 15 millon voted. That's about 78% which is within the norm considering that 85% voted in 2013.
      My question is, what is the issue with the 5 million?
      Is it that 5 million voted when they shouldn't have or what is the issue here?
      The fact that Orengo raised it doesn't mean that there was an anomaly.
      I'll come to the 5 million in a short while.
      Now, with regard to the servers, I also fault the IEBC for not availing them on time and in the stipulated manner. This might have led to the judges rendering the verdict that they did.
      The IEBC should have complied anon and even followed up to ensure that everything that the court directed happened.They didn't!
      Now, it is not lost on anyone that the court absolved the president and his running mate totally!
      The question then remains, why would the IEBC mess it up or 'RIG' it for UHURUTO?
      For what purpose?
      That is the question that no one can answer.
      Now, with regard to the constitution a=s well as transmission of results, I think all those aer important but it is also equally important that the will of the people reigns.
      As I said, the judges put process and procedure [as well as the letter of the law] above substance [voting]!
      Now, if there was an anomaly in form 34 As and Bs, in my opinion, the remedy is not to 'throw the baby with the bath water'!
      If there was an algorith [again, this is NASA's allegation and it could be true], the remedy was NOT to throw the baby.
      If there was a disaprity between form 34As and Bs, again the remedy was not to do what the court did.
      You put it very well when you said that Kenyans voted peacefully adn that the shenanigans started at teh point of counting and tabulation of votes!

      If that were teh case, and let me also bring in the issue of the 5 million votes that I said I'd address ina short while, then, there is/was a way of verifying WHAT THE VOTER SAID ON AUGUST 8, 2017!
      The SC should have ordered a review of each and every ballot and then, order a recount!

      This is the most basic thing a court can do with regard to an election petition and that is why those who are opposed to the court's ruling have an issue.
      The court took into account virtually everything before it but ordering a recount!
      In all fairness, costitutin or no constitution, transmission is just that, TRANSMISSION!
      In all fairness, constitution or no constitution, forms 34As and Bs are just that, FORMS 34 AS AND BS!
      Forms 34 are NOT the initial step in an election. The initial step is the ballot!
      so, with a recount, any anomaly with regard to any of the forms be they the 40883 form 34As or 290 form 34Bs could have been identified and THE TRUTH ESTABLISHED!
      It is the people who are supreme adn all power , including the constitution, emanates from the people.
      The people are king.
      No wonder, two justices Ndung'u and Ojwang dissented!
      Ojwang was categorical tht that case should never have been before court!

      I ask this because the court set the bar too low.............with regard to what could lead to an annullment of an election.
      The threshold the SC set is so low that even a malicious returning officer could sabotage an election just because the results are not what he expected.
      Then, the said man can use that as grounds to have one of the candidates petition the election in court.
      Remember, the bar has been set too low by this court which argues that votes adn voters' voices don't matter. It is teh letter of the law that matters.
      This was a bogus judgement and frankly, as I said, I truly hope no one uses it as case law either in the commonwealth or beyond!
      You can never have a perfect election.
      As we speak, the US election and the Russia hacking thing is still unravelling!
      I truly hope that once we hold our election in a month's time, no one goes to court because we have better things to do than go to court!
      Finally, if Magara had ordered a recount, he'd have lent a lot of credence to the judgement but just throwing an election over forms?
      Right now, NASA doesn't want the IEBC as currently constituted.
      By the way, who used Chebukati's password and to what end?
      That is why the calls for a recount are getting louder.
