    Wow the patronising manner is astonishing. It’s amazing he feels he can demand details and licences, Combined with a total lack of knowledge of law, together with spouting his own idea of laws on a cheap suit.
    What an awful individual and he really did well representing his hotel.

      @@s3ra9h1m you don't. Auditing as a personal pastime isn't commercial use even if you make ad revenue from posting the video online. Selling the footage or flying for some other purpose for a paying customer is what makes it commercial.
      I'm not saying people *shouldn't* have public liability insurance. Just that they don't have to.

    You can legally fly over residential and as long as you do not look in windows and you keep to the CAA height limit.

    There are no drone licenses and literally no training is required to fly a sub 250g drone.
    To fly heavier drones you can do the A2 CofC and the GVC, but they are not licenses.

      Yes they do.
      There's case law on it. A property DOES have rights over its airspace but the altitude is not unlimited. Flying too low IS a trespass.

      Bernstein v Skyways 1978.
      The claimant was not successful but in the ruling Judge Griffiths did confirm that properties do own airspace but not for an unlimited distance. As this case was centred around photography from manned flight, it was more concerned with altitudes 500ft and over.
      The ruling in this case does show that the fast emerging drone auditor's mantra of "you don't own the airspace", is incorrect.

      @@auditnerd8767 Your nearly right, but the phrase should be 'you don't CONTROL the airspace the CAA does' and they have the last say of how it's used. He was perfectly legal at any height under 400 foot with a sub 250 gram drone if there was no current restrictions in place, onus on the operator to make dilligent checks.

      @@canicant Well, if I want to build a 500ft building on my land, it wouldn't have anything to do with the CAA, - they have NO say in the matter. Its my 500 ft and as long as I satisfy planning and building regs its nothing to do with them.
      They "control" the passage of aircraft and UAVs through, MY airspace. They don't have ownership, or autonomy over it.

    If I was you, I would have countered that with, 'I'm flying my drone a safe distance around your property and not over people and I've just spotted an unsecured ladder on a sloping section of your roof that could quite easily slide off and kill someone if it hit them on the head!' 👍⚠️

    There are only limited things you can do on a Public Footpath over private land, and basically it just amounts to walking and things that go with walking, such as putting an umbrella up if it rains. You have the right to pass across on foot. That's about it. Anything else, such as riding a bike or stopping for a picnic, you are alright as long as the landowner is fine with it. But if they aren't, walking is all you have a right to do there. That is why it is called a Right of Way.

      @@jasonleesuffolk No. If it is a Public Footpath over private land, the only thing you can do that you can't do on other private land is walk along the line of the path. Anything else you do along it, like having a picnic, metal detecting or whatever, you don't have a right to do if the owner of the land objects. The simplest thing to do is just ask them. They might say yes!

      Refreshing to see one person knows the law. A footpath over private land does not give members of the public the same rights as public spaces. Flying a drone when asked by the landowner not to is almost certainly not allowed.

    and if an officer makes contact with you and is asking any questions then unless you are LEGALLY detained then you can ignore them and walk forwards and backwards and left or right or stand still and you can demand that they leave you alone and in peace ..if they try to restrict your movement and/or free speech or hassle you causing you alarm and/or distress then their actions are unlawful and you force them to settle a financial claim

      because they own it. the footpath is the public area and that's only because they alow it to be public. its a 240 acre land with 2 full size polo fields for the guards polo club. but it is a beautiful place to walk around

      This is from official UK drone website , 2022 drone law update.
      Drone operators must be able to present their registration documents if requested to do so by the police.
      A valid operator ID
      A flyer ID

    What a lovely looking building and grounds. You could ask them if they'd be interested in your donating your footage for their marketing purposes and await their kind response. In all seriousness there needs to be a strong gov't messaging about drones for the uneducated. Far too many cases of ignorant people thinking that the law forbids people from flying drones over private property. There are clear laws about crowds and distances (for privacy purposes) and the stipulation about being on public land and away from the highway. But the important message about how its fine to fly over private land has been lost. I've had farmers confront me about flying the drone above 'their farmland'......

    If memory serves any private land owns the air space from ground to 5 miles above. There is also a similar rule for mineral rights going downwards.

    I've watched a few of your videos, and the only criticism I have is there doesn't ever seem to be a resolution? When these idiots are put back in their place and told by the police you are doing nothing wrong. Your subs would blow up if you did.

      It all depends on the bylaws the local council has in place. You are allowed to do this where I was that day.       @Auditing England our local council is suffolk county council they maintain most of the footpaths here,but they still go over land that's owned by farmers so I'm not sure if it's possible to fly,I'll have to send them an email maybe.
