      Do "Gosnell." It's based very closely on a real case, with the primary investigative officer and primary prosecutor serving as expert advisors, portions of dialog taken from transcripts etc.

    I know this is a year-old video, but in response to the comment during the the cross-examination of the old lady where "you want to be on top of the information ahead of time and not be asking these questions during the trial" Vinny was on top of these things. Just looking at the cross is ignoring the earlier establishing scenes where Vinny is interviewing the witnesses and taking his own photos of the evidence. He was asking questions that the witness had already answered for him in those interviews, but he had the witness answer them on the stand because it is more compelling to the jury to hear the witness say something in their own words rather than just a yes or no.

    Defense lawyer here and an adjunct prof. @10:00 , whenever possible , use the State's witness(es) to establish the facts in your favor . It carries more weight with the jury and bench . There are no such thing as "gotcha questions ", but any facts you can elicit from an expert witness not your own bolsters your defense. The tire questions are brilliant because they sow reasonable doubt and the State has supplied that evidence.

      I totally agree. Whenever you can get admissions from the opposing expert that helps your case it's a big win.

    He did interview all the witnesses so he knew she was blind

    iirc Vinny actually did do his homework already on the witnesses, so the conversational tone and open ended questions is just his "style" of cross. He already know how it's gonna go down, and he is not in a hurry to throw leading questions to get where he needs to be. I would assume Vinny would start asking leading question if what he is doing didn't work, but it did, so he didn't.

      I have a colleague who is a master at using open ended questions during the cross. You are correct, if you plan it out and know what the answer is it can work. You are living dangerously! For me, I'm not that talented, I stick with the leading questions.

    I never watched the OJ trial. I did know the famous "if it doesn't fit, you must acquit"line from the defense, but I didn't see the actual trying on. I just went and watched it. The way he fake struggled to put the gloves on reminds me of how people fake struggle to perform a mundane task in an infomercial before trying to sell you a product that makes it easier. 😂

    The complete thing about this movie is Vinny was trying to get the Jury to be comfortable about the way he would approach the witness and yes he did push a lot of wrong buttons, but he did get his point across.

    Can you do "Gosnell"? I know it's not a well-known or popular movie but since it's often taken verbatim from a real case it could be very enlightening. (I caught a huge mistake, which is that one of the pieces of evidence was a totally wrong piece of medical equipment, wrong to the point of absurdity.)

    It only proves that when you make the movie too realistic, it messes up the cinematic effect.

    It's been some time since I've seen this movie, but iirc, they establish earlier that one of the reasons Vinny got into law because he likes to argue. Some of the "errors" might be not how another lawyer would do it, maybe not smart for a lawyer to do, but they're true to the character.

    The problem of the first video clip is that he has probably no access to a projector device to show the photos to the judge and jury.
    FYI : It is just a comedy movie which has little kernel of truth to it unlike some court movies or series which are all exaggerated though.
    Some people or lawyer dismisses the exaggerated scene and focus on their argument which is great clips.

      Plus, Power Point didn't even exist in 1992! The most he could have done is have transparancy copies of the pictures made to use on an overhead projector.

    It's a comedy movie though. Comedy movies or series tends to be stupid and hilarious.

    Mr Scramin Your analogy was very well . Only one thing you Left Out when the Judge asked the Defense attorney How does your Clients Plead . ?
