    My team and I genuinely appreciate and admire the hard work that public defenders do, often under challenging and under-resourced conditions. Public defenders are often good, if not great at their jobs. The issue is that they are frequently overworked and underpaid, which is due to lack of funding. A 2023 National Public Defense Workload Study found that public defenders are “dangerously overworked.”

      It’s by design since the more people who go to jail, the more people to do unpaid slave labor. Therefore, people who can’t afford a private lawyer get stuck with a public lawyer who doesn’t have enough time or energy to make a good case.

      I was my public defender's first case ever. I was a stupid kid and didn't know any better so I pled guilty to one 15 year felony instead of 23 one year misdemeanors. She said to me "do you want to do 15 years or 23 years.?" so I pled guilty to the felony. She did NOT tell me all 23 counts would be run concurrently or that I could have it expunged from my record in ten years or if I violated my probation the most I could get was the remainder of the one year sentence. So no 41 years later I can't vote, never had a decent job and live in a 190 square foot illegal apartment with a 10 amp electric box that I pay $1200 a month for and by the time I'm done paying my bills with my minimum wage pay check I'm deeper in debt than I was last month. All because I let a rooky PD con me into what she was conned into by the prosecutor's office.

      I only think they have to much work going on, maybe some of them got worse deals or some better deals bc they handled often simmular cases. Or they are maybe new lawyers. But i dont think they are that bad of a deal. But if someone has the money and time to get a lawyer that they pay themself they can of course.
      In germany we usually get rhe stuff paid from the staate if we dont have enough money or a bit paid at least, if we fill a form before and they say yes. Lawyers are less expensives, but the process itself costs more then in the usa. If u have a wining case anyway the other person needs to pay ur fees and ur lawyer, if u need a lawyer. Also they need to pay all costs of you driving there for the process like if u couldnt work or ur gas.
      I like it that u can choose a normal lawyer, and so people get paid and dont get to many cases at once.

      I used a public defender because that was all that was available to me. That was for actual crimes.
      I have represented myself in traffic court and landlord Tennent court half a dozen times and won every time. I do my research where most people just stand their with their tongue hanging out confused. Turns out that you can cross examine the cop who pulled you over. If they don't bother to show up for court it usually gets dismissed. Of the four traffic cases I was involved in two of the cops never bothered to show up. The other two I cross examined them and one could not logically explain how he determined my speed and the other could not present evidence that the radar gun was properly calibrated. I obtained the manufacturer user manual for his model of radar gun and found that it was supposed to be calibrated at certain intervals and they were supposed to maintain a record of calibration for the courts. He could not produce the record of calibration nor could he describe for the court how the calibration was to be completed and could not say when the last time the radar gun was calibrated. I then produced the manual and gave a detailed description on how the radar guy was to be calibrated. Then I presented photos of my tire marks with a tape measure indicating how long they were and how if I hit the brakes like the cop said the skid marks would have been almost twice as long for that make and model. The judge stopped me before I presented the rest of my evidence and dismissed the case and scolded the cop and suggest the department hire me to teach calibration.

      Depends on the state. Some states immediately hire a private attorney or have pro bono PAs.

      Bad idea. Some judges will force you to represent yourself or hire your own attorney at your own expense if you keep having issues with multiple public defenders.

    • @TheShadoDev
      @TheShadoDev 2 วันที่ผ่านมา +1

      @@hobeone1192 No it isn't. You can waive your right to an attorney through your conduct. Look at the Sarah Boone case. She went through 8 public defenders, and the judge said he wasn't going to appoint anymore so she needed to either get her own or represent herself. He set the trial date and said she needed to be ready by then, with or without an attorney.

    public is fine... problem is they are overworked and that is what makes it hard... becuase they might no have time to speak with you to get the info they need. and this combined with working on let's say 6 other cases makes a diffrence. yes some could say that a private is better.... but i mean education is the same for both diffrence is the time they have for your case... so really i a public lawyer is more then fine (atleast with me, might be, because i dont do stuff that is sueable :D)

    You get what you pay for... or don't pay for. Unfortunately, most of us have no choice due to finances. Personally, my situation has not been that bad regarding representation. Being the victim, I found pro Bono lawyers tend to care and give my case and myself balanced attention. I can't speak for the perps.

    You forgot that you often have to qualify to even get public defense, and that often means you don’t even make/have enough money to get private defense if you qualify. Same for the opposite side, you often cant get free public defense if you make/have enough money.
