Congress can't defund the ATF or any agency under the DHS umbrella. They would have to defund the entire umbrella. Congress already tried to partially defund the ATF for blatant overreach. At the same time, they increased funding for other DHS agencies. DHS just redistributed the funds. With the creation of the DHS, the White House gained control over those agencies and Congress lost oversight. That was a huge power grab by one branch of our government. We have George W. Bush and his buddies (Clintons, Obama, Biden) to thank for that.

Great point. Wonder if congress can limit the legal appeals fund for the ATF. Like no more than 100K a year may be used for legal defense. It would seem then that it is the ATF that is circumventing the law in its ongoing and improper usurpation of legislative authority.

What sucks is that they’re spending taxpayer money on legal fees, and every time they lose we’re also paying the plaintiff’s legal bills. This is insanity, the entire GCA and ATF are outright violations of the 2A by their very existence!
They are going to waste the money one way or another. Better they waste it here losing these cases and making lives better than blowing up people in the 3rd world
The same reason that the ATF uses taxpayer's money to argue that they can take away the people's rights with authority that they were never granted by Congress in the first place (what an awkward sentience). A regular person pulling what the ATF is attempting to pull here would be prosecuted for perjury, contempt of court, or both. And for what? Is anyone safer?
Time for a Government Accountability Act bill. We need an initiative to hold them accountable for their official actions. With no accountability, there will be no compliance.
I'm so sick of this BS. The government has no right to make laws that restrict the way we protect ourselves and our families. That right was granted to us by God. And we are all family in his likeness .
If this right was granted by God, then what is stopping anyone from exercising this right? It seems as though the words written on papers are more powerful than the hundreds of millions of people in the USA. Those words clearly aren't powerful enough to make these illegal firearms disappear, nor can they stop actual criminals from accessing these firearms. What exactly is stopping anyone else?
Health is not written into the constitution. Shutdowns and jabs to keep jobs is illegal. Are there any constitutional sheriffs out there to protect Americans and our businesses from the tyrants.
A judge's job is to look at the constitution to find a law. If it's not written in the constitution it is mute, null and void. The constitution and the bill of rights was written to order congress and restrict their powers.
Just like Mark over at 4 boxes dinner, your analysis is skewed. The real problem for the ATF and DOJ as well as the courts that are avoiding this point, is that the ATF is attempting to use language from one statute (the machine gun regulation) to justify a completely different regulation (the firearm definition) !! THEY CAN'T DO THAT!!!!
How about we sue ATF for their inability to get the FORMS in and out in a timely manner. I'm an old man. I may not be here to get my stupid tax stamps!
The ATF does NOT have the authority to make rules, and never has. But they make them anyway, and as far as I know none of their rules are worth anyone making those rules.
If they say an 80% is a gun, is an 79% a gun? How about a 75%? How about a 1%? Just when does a chunk of metal become a gun? When you look at it and decide to make one, a 0% if ATF decides you thought about it?
Can someone help me understand how the STATUTE can be found restricting an EX felon from owning a firearm... But the implementing federal regulation is NOT able to be found??
The bottom line is these people want a federalized force, this way the force would have additional power and wouldn't be bared by search warrants because with them probable cause would be enough for whatever they wanted to do, rights be damn
