    One of the reasons the crime rate in South Africa is so high because the law is way to soft on criminals and gives them way to much opportunity to get away with crime. Many of the laws are outdated and was created in an entirely different South African era. Serious revision of many laws must become a priority along with an upgrate in law enforcement effectiveness. Criminals are simply walking right over the innocent and then the law ties the hands of the innocent instead of tying the hands of the criminals. The main reason for the high crime rate is due to a culture problem. Mandela was a good man and believed his people are good also. They prove him wrong...

      The justice system was intentionally made weak so that if by any chance the ruling cadre and friends endup before the judge, they will walk scotfree. It's not a mistake. They know exactly what they are doing.

      I Agree with you in most of the analysis but would add my opinion on the last part, " All races have all sort of people, any situation within human beings can trigger different reactions mostly unlikely situations ".     Joh, I remember some tenant's also wanted to take over, we had to move in with them that's when they moved out,😭 my advice would be to avoid letting to foreigners and big families

      Those judges live in their ivory towers. The only thing they have achieved with this judgement is the spreading of vigilantism. I read it takes ZAR 800,000 to bring a case to court. Hiring your won thugs is a lot cheaper. Perhaps someone should do this with their houses, that’ll teach them a lesson.

    This happened to a friend a few years ago already with a house she rented out. She also had a filling station, so she gave spare keys to all the workers. That evening when the illegal occupants returned home, they were greeted by 5 guys already making food in the kitchen. That was the end of it

      We had a problem with squatters in NL for decades, before they criminalised it. Friends of mine had an empty house taken by squatters, the municipality did nothing. So, they waited until the squatters went to work, moved all their property out and put it on the curb (under a tarp). Then they went to town on the house, removed the doors, the windows, electricity, capped the water and even took of the roof tiles. Needless to say that was the end of that.

      @@trustingnobody628 some of these syndicates could be working with corrupt people at the deeds office, they are able to transfer properties in their names without the knowledge of the owners. Many people lost their properties through hijackings in places like Hillbrow, Berea, Yeoville, Betrams, Rosettenville, Turfontein including many properties in the inner city. By now something should have happened to address the matter. City of jhb, Dudula and many people know about this problem.

    Had this issue some years ago. Consulted a lawyer and after several weeks and R10k in legal costs decided that the property needed maintenance. Couldn't switch the water or power off, but could take all the outside doors for this 'maintenance'. They absconded quickly. These laws protect the crims.

    A friend of mine spent a year trying to remove a tenant from his property because she stopped paying rent. It was such a difficult process for him, the tenant had vicious dogs and always locked him out. He tried to bring police, private security and the lot. She was never there or always pretended not to be home. He resorted to poisoning her dogs in order to be able to jump over the fence to get into his own property. Even with that, she knew her rights...The law does not favour the landlords.

      So sad guys to experience all non compliance stories of hijacked buildings as l know and wonder if things are going right there ,there is a Zimbabweans couple living in a mansion house in Orange Groove with cottage for tenants and they say the owner gave them that property just nje or for pleasure ,so l wonder if they are paying for services or levies and all the taxes as they are domestic workers both of them a day they are not working the whole week working for same employer ,the women is working one day there so l wonder if things are right there and asking myself questions, legally or illegally here and how transfer of the house has been done ,heish too rough

    This is very sad. They took our farm and we went to court but to our suprise there was a lot of irregularities even now ww are still struggling but through our new attorney God will assist us to win the case.

      @@mokone4758 the 2 police officers mobilizing farm dwellers to fight us. So we only utilizing 8 ha and they took 132 ha they gave the land to commercial farmers because they dont have money to plant themselves so we are stuck with our seeds we can't plant on our land.

    I would like the lawyers speaking - can you put a clause in the tenant's agreement that if they do not pay rent, then asked to move out, and refuse, that the landlord can then have them removed because they signed the agreement??

      I believe it can be done. In the apartment I'm renting I signed this. They have a strong team of lawyers to fight evictions for none paying tenants. They also made sure that our rent is strictly debit order, and they are the first to debit as soon as the salary reflects 😅😅 I don't know how they do this.
      Also if you will be venturing on property it's better to have a lawyer for lease agreements and an agent that will help handle everything for you.

    Is very funny that some South African should be talking about exact things that Dudula was fighting for when they marched to Hillbrow twice and the police stopped them by saying those forighners are armed. Where are the owners of this flats ?. If South African whites can stop hiring this arrogant people then we together will fight this people.     We have been complaining about this long time in Johannesburg. 2011 the property we used to rent at was hijacked. We where forced to move out. I was still in College by then. We tried going to police stations, our closest ANC office to report the matter but it was just waste of time. Rosettenville, Larochelle, Turffontein, Kenilworth many houses were hijacked. Imagine some are grannys who lost there properties now struggling renting from place to place. 😥💔

Invading a property in south Africa is not even a crime coz people that invade land and other properties never even get detained by the police. Lawlessness is i a wide range system and once you let off on one side, you let off in everything.

    I have been made to understand that Nigerians and foreigners are the hijackers of these buildings. I want to know how a Nigerian or foreigner for that matter can come to RSA and take over a building. Where is the council, provincial govt, immigration, police, lands dept etc?? It is local official, police and some politicians involved in this scam.

    So called owners of residential buildings must keep abreast with who occupies their apartments. No building will be hijacked if the body corporate or so called owners own up to maintenance or maintaining the buildings.

      I have seen a building get hijack in a single night by over 300 people and the owner has been struggling for years to legally get them out, in the end, he gave up because he could not afford the finances of paying for lawyers and paying taxes on a building that was not bringing in any money. Hijackers do not follow the law, but you the legal owner has to, and the law is outdated slow and expensive.

      One tenant can bad influence other tenants not to make payments to their Landlords- giving them evil valid reasons- and where money is involved-i.e those who are bad influenced will follow suit- and in no time the whole building is hijacked- Believe me it’s bad out there😭

    Had a problem tenant with no lease. Gave a lease to 10 street men and moved them in. Tenant left in 1 day. A quick alcohol deal got the homeless out. Everyone happy. Except tenant. Shame miss him.

    what about the illegal occupation of land? Farm land listed on the departments land reform applications, have people going and occupying the land during the long process, after which they then put in an application with those current coordinates, which leaves the department in a position to "just give it up". That same farm land destroyed for wood and grazing. No development support for the occupants, funds funneled and kept within. WHY IS THERE NO INVESTIGATION ON THIS! COME TO LIMPOPO AND FIND OUT!

    I think this is a crime if someone occupate your apartment, stolen your furniture...this have to be punished like this!!!. You as owner have right to go inside your apartment and change the door key...even change completely the door!!! Its your property!!! Install security cameras inside so you can see on your phone in real time what happens in your apartment and instal alarm!!! You have right everytime to go inside in your apartment but with some BIG guys never alone. It's your property you not have any agreement with the people what are inside....
