    Here’s something my law of lease professor told me: once a tenant fails to pay, you can’t just kick them out, but you can invite anyone else into that property. So you can get someone to go live there and make that squatter’s life hell.

      And find yourself wearing free orange overalls in prison for up to two years with a huge fine of up to R20000 and a criminal record affecting your employment in the future. Not good advice from a law professor.

      I don’t think that’s part of the law anymore. Lease implies possession and use. You can’t invite someone else in because you’ve already handed possession over.
      The golden rule is that you can’t transfer more rights than you have.

      yes, i know of people that have hired people to do that, they pay them about R10 000 to R15 000 and a group of 5 to 8 men move in, they take over the rooms, they eat their food, wear their clothes etc and live there until the non paying tenants leave

      @@LucidAnarchy-187 until the owner ends up with a tenant who knows the law and finds himself out of R20000 due to a fine as well as two years free accommodation at state expense while getting a nifty orange overall to wear every day too. That action is very illegal and those men moving in will find themselves arrested and facing a barrage of charges too. And if there is a person "hiring out" thugs like these he will be nailed too. Big trouble all around. I get non paying tenants out in 30 days legally. Why go the illegal route and become a criminal?

    There is a law in South Africa called Trespassing. If a person doesn't have a right to be on a property they should be arrested and removed. It is a crime.

    The landlords,especially in Cape town is way too expensive, therefore people can't pay or if anything happens, like food prices going up,fuel prices up,up,up,they just can't pay.If the landlords stop asking bond prices, which the tenants in the first place can't afford or they would have bought their own house as a matter of fact,absolute greed in a country that is falling apart.By the way the interest rate went up last week.

      So true. It's only Cape Town that has very high rentals. It's a whole scam compare to what you get in Jhb for the same cost. The rental policies should be revised to suite all pockets fairly. Landlords are getting way to greedy.

      I see the same issue living here in Cape Town. The rentals these landlords want is exhorbitant , especially if you look at the size of these flats. The majority of young people already cant afford to buy property in Cape Town. At the end of the day its all about greed...making more money at the expense of those that are barely surviving.

    Lets be honest about a few things:
    1. SA has a squatter culture... While you might own a piece of land somewhere, when you move to a town for work, you will squat outside of town while you work inside the town and then send money back to your wife, mother, etc. at home.
    2. SA has also has a opportunistic criminal culture... While protesting, you will find that some might riot and loot and then steel, because the opportunity arose. The same now goes for those that do seek out property to rent in the rental market, desperate landlords giving fist time renters a gap and then struggle to get those people out, simply because it was seen in the market how tuff it is to get rid of non-paying tenants and that there is very little you can loose by not paying the rent and then squatting.
    3. SA's legal system then has the habit of not being able to apply the law equally, or promptly, very often dragging race into the court room and South Africans has long realized that they can and will get away with their illegal activities.
    My very last point is that owning and renting comes with risks, and if you cannot for see a risk and take the needed steps to minimize the risk, don't expect the government to come to the aid of its private sectors pocket any time soon. I for one would also not advocate for Government to step in. Investing in property has risks, this being one of them, and hence not for all.

    There should not be a technical process. You not paying then you should not be there. The law should automatically recognize it. Now you gotta drag it in a tribunal then court... seriously nobody in gov see how wrong it is.

    It's about time that the eviction process be revised. If you can't pay, you have to move out. As an Agent I meet too many people who wants to rent the newest properties that are more expensive than an older properties. Their spendable income doesn't justify renting the newest property, but still they don't want to live in an older, well maintained home.

      Hie sorry to ask but I wanted to know if a Landlord gives a tenant a notice because they want to come back to their house if its a 2 month notice does the tenant have to keep paying for those 2 months

      What the media is not discussing is the increase in a number of houses in estates that is now vacant. Many people are moving back to their parents to cut the cost of living because our economy is failing workers while many companies are also liquidating.

    I've rented a building for 3years always payed on time. Never missed a payment. I was retrenched. I couldn't pay rent for 5 months. We spoke. I maintained the yard. Cut down on water lights to make it easier for landlord. I now got a job and I'm paying R2000 extra as agreed till I'll be level with payments.

    I have been in an apartment for 5 yes years. My rent was paid regularly every single month. Than I had covid and then a stroke but I paid. Than they sent debt collector's and my attorney wrote to the agent. How ever I appeared in court and the magistrate was not impressed with the agency and asked them why should she grant me eviction. Now I have paid for and they don't want to remove the legal fees. But now I'm just paying my rent and not the leagal fees because I was in contact with the agency stating that I'm in hospital and I will pay. So I don't understand. The thing is the supervisor of the complex see my health situation but I make my payments I'm not responsible for leagal fees.

    I have a tenant residing on my property. Living in one of my furnished garden apartments. She has wrecked the place and does as she pleases. She brought in a washing machine and a tumble dryer and denies using it but says she is entitled to do her washing etc. The rental is inclusive of electricity however it has not been taken into consideration the extra usage of these appliances. She refuses me entry to her apartment and lied to the court in order to obtain a harasment case against me. When I tried to approach the court about her lies, obstructing the course of justice, the tenant and her wriley lawyer embarked on a method to exhaust my funds by the time we go to.court. which is exactly what happened. They brought numerous law suits against me I.e moving my own garden tap which was situated outside her apartment. She suddenly claimed rights to the tap! My only garden tap to water my garden and fill.my pool! I was arrested and charged criminaly for this act!
    And then a civil matter of spoilation was brought against me as well. They exhausted over R400 000 in legal fees of mine.
    And when I had a mental breakdown they extorted 8 months free accommodation out-of me as I had no money to defend myself any further. In lieu of withdrawing the charges.
    She is currently still living here and turning my life into a hell. I have some wonderful tenants but these criminals need to be jailed.
    If you don't have money for a lawyer then you have no rights!!!!
    She parks in front of my driveway and I can't get access.
    The police do nothing.

      I understand your frustrations and sorry to hear about your predicament. However be cautious of making a comment like....If you dont have money for a lawyer, then you have no rights...Everyone has rights whether they can afford a lawyer or not!!!!

      Everyone advocating illegal advice here have clearly not read the post properly. She already has a spoliation order against her. That is an order given by the court on the basis that she deprived someone illegally of something they had in their possession. This can result in a large fine and also jail time for two years. Be careful just throwing advice around. The posters tenant is clearly a problem.

    Disagree. Rental Tribunal has authority. As they operate as Court . First is Mediation and then Aberration. Tenants Receive Judgement and we have seen Evictions with attachments. Process takes up to 3 Months report immediately if no payment after 2 Months. Landlord should not wait. Lawyers Charge up R30000 and drag the Process out.

    This makes no sense. You should vacate the premise the moment you fail to pay your rents unless you get into an extension agreement with the landlord. It should be that simple. Because renters are now taking advantage of the system to stay in houses illegally and not pay rent. And you wonder why people get killed over such nonsense.

    The law is to blame as the tenants has more rights than the landlord owner of his own property. The law must change that the police can forcefully remove non paying tenant but in SA criminals has more rights unfortunately

    I empathize with landlords who experience bad paying tenants and I also understand how some landlords are just horrible and refuse to even accept proof once you have began to claim funds you are owed by an ex employer especially when it is documented that the process takes time also after such landlords have not bothered to pay your award. Lol, man this is deep.

      Then move out and go to a place that you can afford. Some of us are still paying bonds of our rental properties. It is not fair that the landlord should pay her bond, and the tenant wants to live in a property for free.

The domino effect is happening now and how people never saw this coming is beyond me, I don't know what people expected or thought would happen when the economy is clearly not doing well.

      @@mossfairy3060 that's the very problem. There is no such thing as a cheap attorney and you can't approach legal aid neither. I deal with the problem of non paying tenants every day and that's why I put together an affordable and legal method to assist property owners without causing them more grief. Trust me you don't want to take a chance. The wrong person crosses swords with you and you will have headaches increased by a factor of 10. No kidding.

    Reading the comments there is a lot of "advice" casually being thrown around that would get property owners into serious trouble with huge fines and even prison time of up to two years. There are legal and cheaper options. It's what I do so property owners with a problem could message me.

      @@Jay-Leigh863 Hi Glenn, I've been reading your advise to a lot of commentary & would like to ask something pls: what if your landlord decided to terminate your lease agreement in April 2022 & not renew after living in her property for 5yrs approx. Bearing in mind that COVID adversely affected everyone but the tenant made inroads to pay rent though at times not full amounts but during the 2021 till current made full rental payments to a point where the tenant even overtook paying off the water & levies ontop of the monthly rentals because the landlord had decided to stop paying the water & lights. The very landlord continued to accept rental payment in May 2022 with the tenant asking the landlord her decision of not renewing the lease, the landlord said she's reconsider but never did but then started harassing the tenant via unsavoury texts to date, June rental payment was made, July paid even August 2022 rental paid but the landlord decided to bring 5 unidentified males to evict the tenant: on the 2nd of July 2022 without a proper court order then locked the tenant out, upon advise the tenant was advised by the lawyer to move their furniture back into the unit, then the housing tribunal had intervened as the time & the matter meant to sit on the 5 July 2022 but didn't as the landlord sent mail stating her unavailability. The landlord again came with a 'sherriff' with a court order on the 25 July 2022 but the sheriff refused to give the tenant a copy of that eviction notice even on the insistence of the tenant's lawyer demanding that over the phone. The tenant's belongings were again removed by the landlord. This past Friday, the landlord came announced & wanted to gain entry into the unit but the locks had been changed by the tenant & she started causing a racket & banging on windows, police had to be called but our police always fail us, they only arrived an hour later as the tenant has made many attempts to have the landlord sign the protection order but the landlord is always elusive. As I type this, the tenant is awaiting another date from the tribunal as there was spoliation, damage to tenant's furniture & the constant harassment by the landlord, any recourse in this regard Glenn?

      @@Jay-Leigh863 the attorney was for those illegal evictions but as you know lawyers are expensive & I unfortunately cannot afford one but have had to go via the tribunal where we're awaiting a new date for the sit-down.

      What about the landlord paying off their bond? Best is to always talk to the landlord or agent and discuss a way forward. Just not paying is worse for the tenant.

      You can't remove them yourself is a criminal offense you can get a fine or go to jail you can't even switch the water off as that can also land you as a landlord in lots of trouble the only way is for a sherif of the court to remove them and that takes time

    Name and shame them is all I can think of. Same thing happened to my parents with tenants taking advantage of the law. Planning on putting posters throughout the town and even want to make a Facebook sponsored post 😂. Only way is for people to know them.
