  • HR Basics is a series of short courses, designed to highlight what you need to know about a particular human resource management topic. In today’s HR Basics, we explore employee rights affecting the employment relationship and the appropriate management of those rights.
    Employee rights are the powers and privileges derived from the law and tradition within the context of the employment relationship. Employees have some basic rights as citizens, but those rights are further influenced by human resource policies and rules an employer establishes. However, there are now a multitude of laws and employee rights that affect employer-employee relationships.
    Rights are offset by responsibilities, which are obligations to perform certain tasks and duties. Employment is a reciprocal relationship in that both the employer and the employee have rights and obligations.
    Employers have an obligation to recognize and respect the rights of employees through appropriate management practices: Employee rights are the powers and privileges within the employment relationship. Rights management is the planning, organizing, leading, and controlling of employee rights.
    The employment relationship is a reciprocal one in which both employers and employees have statutory and contractual rights, as well as responsibilities. The employer has a unique obligation to manage employee rights in balance with organizational needs.

    The ADA can be pretty easily gamed if your smart or desperate enough. I had a company I worked for on its knees just because I wanted to be fired simply because I hated working their. As one with Apsergers it drove me crazy to never have consistent break times and to work in a particular part of the plant that stressed me out.
    So to take advantage of that to make them want to get rid if me I got my breaks garunteed to me at the same time every day, often leaving a higher up to find someone to finish my truck. They wanted me to quit but I made them fire me instead me quitting by doing nothing more then what we agreed on my ability to do. After all if they did can me they would of been sued for way more then unemployment, That is how you get out of work my friends...

      @@7ngel No they just laid me off basically, not fire me. Specifically "My position was no longer needed" so I was off the hook and got my unemployment like I wanted. They knew what I was doing and I knew that they knew but they couldn't do anything about it except find a loophole to get rid of me. I was satisfied though, now I work night shift at retail and make more money for less work and in a better environment. Pretty good deal at the end of the day, they got to replace me with someone willing to go through the crappy work conditions and I got my unemployment XD.

      @@celiafrostborn I don’t believe I have any form of autism but I too get extremely irritated when I don’t get consistent work/break times, but most of all if I’m ripped out of my position to do something else. I always explain it that once I’m in a position it’s like an addiction. I’m like a bullet train and anything stopping me from doing my assigned task is like a barrier that pops up and I always drive through it at 1000mph.
      Just this week I mentioned to my supervisor that I ‘MIGHT have to take a day off tomorrow’ because my back was sore. I immediately got a call from the company’s health department asking me my symptoms, they then had a dr call me and he asked me follow up questions and the dr said I was good to go. My supervisor then calls me and tells me to give up the company truck and to go back to work I must have a dr’s note. I was so enraged I flew through traffic to the ER and demanded them to check me out and give me a Dr’s note and after $170 down the drain I sent them the Drs note and heard nothing but crickets from them. I found out today what they did was highly illegal as the company cannot request a Dr’s note unless that person is out of work for at least 3 days and they must have a thorough reason as to why which in my case I was not out of work at all and I was already cleared by the company dr.

    My supervisor and manager want me and other workers to do a supervisor job that I have never done before without paying me saying that this is my job and at the RMT rally they said they would not pressure any employee to do a supervisor job. Supervisor application says purely that it is a supervisor job and my contract does not state that I have to do the job. They began with a tactic of interrogating me, threatening to scare me and to create stress.

      Leave. Find something else. Spend no more time than ABSOLUTELY necessary there.

      Nope. You should look at the employment law. Work place fairness and harassment for sure. And bc your contract say your not in a position to do supervisor work on a regular employee pay. And they cant retaliate when you report them. Definitely knock them down a few notches before you skip out. That way they know that people will not give into the bully tactics and they won't try to do that again to others. Not sure what the fines are in your state but my attorney is adding them up for me against my former employer. This will continue to happen of employers keep getting away with it bc people just quit or give in bc they are scared of being fired. STOP! You have rights. We all just need to start exercising them.

    So a company makes a friend of mine use their own car during the day. They have told the company that it is getting old and that they do not want to do it but the company told them they have no choice. This is in Texas. What route should they take?

    Can your job contact you while your on short term disability asking when are you coming back? Even when you submitted Dr notes and medical treatment sent to your insurance?

    I am being made to work 11 hrs a day with no break, I mean nothing. Also I am being denied any holiday due to "no cover". I work for a company worth over 1bn.
    Time to quit?

    The only thing an employer has to do is prove they don't discriminate against any protected groups or break any fed/state laws. Alot of states have horrible laws, or the lack there of, when it comes to employee rights. Employees don't have any outside of not openly being discriminated against, sexually harassed, assaulted, or not paid over a certain period of time. Outside of that good luck, and since emoyers look for ways to do all kinds of crappy things to the people that work for them they know these laws and rules and work around them while still getting what they want...and again...good luck. So many emoyers out there worried about having to pay a dime extra for anything, so you can include legal cases and settlements in to that. I live in a at will state so we have no rights here. It breeds horrible utcomes for all parties by the way, but funny enough the employer still doesn't lose their advantageous edge 😒

      My gosh have you given up completely. I live in a at will state. I have an attorney who is currently representing me and other current employees in a lawsuit. And its nice knowing that everyday they have to look at us and they cant retaliate against us for exercising our rights bc the law is on our side too. Bc we are not scared or going to backed into a corner by a employer with scare tactics, threats, and bullshit. Maybe you wanna get served up shit on spoon for the rest of your life but dont tell people to follow suit. That's even worse then what they are doing. If you have good reason to need help in employment law, it's there. Dont be lazy and not search for it so it can stop. At the very least make the call to the labor department to ask them or file a complaint. Something so employers know that people will not keep taking this shit laying down. You need to pick yourself up and get down to the library and start reading. You obviously have a negative feeling on work life and it doesnt feel great so why would you want to pull anyone in that miserable hole with you. To many people are just wasting time in that funk. You have to help yourself if you wanna stop eating shit and smiling. Please please have a better day for the goodness of your soul. ✌

    I'm wondering if it's lawful for my employer's hired security guards to search on an employee's person? I've been asked multiple times to remove articles of clothing and to lift up my pant legs going through the security gate in the lobby. I've also been asked to open up my wallet to show what's inside. They search our jackets which is kind of understandable, but I've been asked to lift up my shirt and sweater before which I feel is over the line. The females aren't allowed to carry purses so they gave us all clear bags to tote through, but they still ask us to open them up so they can see inside. I feel it's a violation of my 4th amendment, but I can't find anything online for my state's (Georgia) workplace laws regarding employee rights. There's nothing in our workplace handbook that says anything about being checked like that by the security in the lobby. It does state that they can check our lockers and work areas with probable cause. The security guards change things up every other month, basically doing what they want to do how they want to do them. I know I've never signed any kind of agreement to this. Their excuse for doing these searches is that they caught a couple of temps stealing. I just want to know my rights on this and follow through with them without feeling like I'd get retaliated against.

      Basically how it goes is security personal have no right to force a search upon you but the security personel are hired by your company/the property manager and carry out a set of post orders from manager/ person hiring them. So what this means is that u can refuse a search but the guard acts on the behalf of the person who hired them and is well within there rights to refuse your entry into the building and turn you away.

    Hi just asking po... Panu po ung company ng wife ku, after this ECQ and now GECQ na tau in metro manila, bigla nlang pong sinabi sakanila sa gc na dito na daw po cla mag ooperate... Ibig sabihin Wala ng babalikan na work ang wife ku ng ganun nlang... Walang back pay or something ayuda from there company.. Need help po qung Anu po ba ang dapat or right's nilang mga employee na nwala na tlga ng work...?

    My bos just kept writing me up for every lil thing especially what i wear in my wardrobe i was told yesterday that my outfit was drawing attention and it was not appropriate but in the dress code it only say no spaghetti straps or short shorts i wear a long skirt and a thick strap tabk top under my skirt i had shorts just incase when i have to squat its warehouse it was work appropriate the skirt was pass 4 inchs my hand barely reached the bottom of the skirt anyway i was pulled in the office just because i was making some employees fe el uncomfortable just on what my wardrobe i was like why are they focus on my wardrobe they shoulx focus on themselves he like didn't care he said im marken this in your file your going have to go home and change but come back i said wow i been getting written up for every lil petty thing since i started god for bid i do something wrong or dress in the clothes i feel comfortable in im like u know what im done i handed my badge to hr said i cant keep doing this i was so upset i left.

    ...okay so my boss took me from being a back up driver to being full time driver and ruining the whole yard. Isn’t that a raise? or am I wrong for asking for one ?

      Ask only if you think you deserve it. Never ask for a raise if you dont think your performance has been lacking. You just rencently received one. Or you think that your got the position bc it was more convent for them to put the next guy/gal in line in that position instead of hiring over you or others that would have to train your new head. Basicallyvif you've put in the hard work and hours and they cant dispute any wrongdoing then ask. It's best to go in prepared. Ask questions. Since I'm the foreman on the yard now is this bc of something I've done in my work performance that qualifies me and has your confidence in doing so. If so what was it. And is there anything you think I need to work on to do better in this new position. Are more hours required and is there a pay raise since I'll have new or more duties over the delegations of work between the other workers and keeping that order. This will be like a yearly evaluation. And please for the love of all things holy ask questions even if its stuff you know yall need to do the job but nobody has said so or things that might make something run smoother. The worst that can happen is they say no. Put in the hard work and try again in 9 weeks. If your worth it and they are a good employer then a yes is on your side. Do this on 1st or 2nd work day, at the end of the day or request time to set with them and let them pick a time. Good luck. Hope something I said is useful or gives you your own ideas on how to handle this. Also money is always negotiable you dont have to take what they say. If you think youve earned it say so and a number that your more comfortable with. Gosh I hope they are as good of a human as I have in myhead. A good employer listens otherwise he will have a yard full of untrained workers constantly. Ok I'll shut up. 🤞

    Hi, just want to know if my brother can demand compensation or medical benefits caused by his job? He developed anxiety and in deep depression caused by his job. In the midst of their big conference at job he passed out and it was witnessed by all. In lieu of that my brother were traumatized and do not want to be in that place, everytime time comes to go to work he panicked until he succummed into depresion. Any advice on what is his right, he scared that he will ne terminated he don’t want to loss his job either.

      He can not sue the company for the reason he can not perform his duties. If he struggles with his mental health, the HR team should be able to help.

      Check your labor laws in your jurisdiction. It's better to ask a professional then take the word of some youtuber who says no you cant.. a employer has to provide a non hostile work environment for employees. Obviously they are not. You have rights and it's about damn time people start exercising their rights instead of taking the word of that underachiever who commented first. People like that is the reason why companies get away with shit bc they dont wanna do shit but go to the next job and not try. Tell your son to call your labor department tell them what's happening and see if this could be a workers compensation or failure to provide a non hostile work environment. See what he can do. And if he can put in a complaint then do it... the company could be fined and made to be held accountable. Then this crap will stop happening if they know people will go after them for wrongdoing. And they cant retaliate against him. If they do and fire him then he can file lawsuit and then comes a payment to him and more fines for the company. The shit only needs to happen a few times or once before compies start treating people better. He has rights. Obviously some people have forgotten about the US Constitution and the Bill of Rights. Dont worry, us conservatives who only do for ourselves are here for everyone regardless. Suffering from mental health and breakdowns bc of the work place is a hostile environment not being checked or changed bc of poor employers and should be made note of at the very least. It will eventually stop if more people would exercise those rights so companies know they cant keep doing this to people and expect to have good, reliable, healthy workers for years instead of a high turnover rate.

      Why should they fire people who smoke weed. It’s practically the same as cigarettes but usually it’s for medical purposes and if not again cigarettes

They don't want to have to put in the effort to find new help or one of the higher ups parties with them and won't do anything incase the investigative line runs back to them, or will include them. Go some place else that doesn't play that BS.

    In reality, what people consider to be "worker rights" are not rights at all but simply a reduction of the worker's freedoms. For example minimum wage laws don't grant the worker anything they didn't already have, such laws actually take away the freedom to work for less than minimum wage.

The added power and control over everyone's rights allows them to effectively sell that power to the very lobbyists and corporations that liberals claim to dislike.
