I bet that kid was not detained every time he took out the trash. So except this incident all the others times he took out the trash were the right time and place to took out the trash. While this happened while taking out the trash, it was not about the trash, it was bout wearing neon shirt and light gray t-shirt that could be confused with white which happened to be the same as the outfit of the car thief. Police wanted to clarify who the kid was and only detainment can guarantee a conversation, otherwise if you are not detained you can refuse (and it is recommended by legal experts) not to talk with the police. You either allow the police to investigate or you can expect a higher crime rate in that neighborhood.
@@pepepiedone7127 As a lawyer, I can tell you the police can investigate all they want. You do not have to help them in their investigation; you are not obligated. They cannot detain you without reasonable, articulate suspicion. They cannot arrest you without probable cause. To put an individual in this case in handcuffs amounts to an arrest, an illegal arrest. You can only be detained in handcuffs if the police has reasonably articulated why they need to put you in handcuffs, usually for officer safety.
In this case it is unlikely a 12 year old without a weapon or attempt to evade the police is considered a danger to the officer. You do not know what an "investigation" consists of and the proper procedures because even suspects have rights.
File a lawsuit against the city since they’re the ones hiring trash to be police.

I feel like that description of the suspect is total BS. I think they added it after the fact to justify arresting him. I'd be interested to hear the dispatch call where someone reported a suspect wearing neon shorts and a white shirt. They always say that. "Well he matched the description".

Think about the most traumatic thing that ever happened in your childhood. A child takes priority over everything. Period. I saw this story yesterday and thought it was pretty sad. However I didn’t know the son was only 12 years old. Do cops really need to go right to handcuffs when investigating a potentially innocent young child?

If you haven't been watching the news for the past 20 years, cops tend to view black children as adults. Teens and boys will be called men, and girls will be called women. Black children are constantly adultified due to people's projections of their ridiculous internalized fear of black adults.

@@tiowe4860 And he looks like he's 14-16. He's nearly as tall as some of the officers. This isn't some tiny twelve year old that looks like a kid. And a shocking amount of crimes nowadays are being committed by people in their late teens, so stopping someone that looks 14 isn't something horrible.

This happened to my son 20 years ago, I was a Mother BEAR with the cops. They were looking for a redheaded older man who robbed a doughnut shop, my son is of Mediterian descent (black hair) mistaken for a redhead?. they pulled him out of his car Guns Drawn handcuffed and on the ground. He was 16 at the time and still traumatized by this, it doesn't leave you. Dosen't trust the cops, never will!

Nah, that's what the media wants you to feel. The cops were just doing their job. Look at the facts, the kid wasn't treated wrongly, they weren't racist towards him, nothing about this investigation happened differently than any other investigation. The kid was swiftly released once they found out who he was, just like in any other investigation. This is how our system works.

I’m glad your life has been perfection, but that’s not how trauma works. Having support afterwards helps, but it doesn’t mean it hasn’t already had a lasting effect.
You still need to learn correct punctuation. You’ll end up saying something very wrong to the wrong person. Wouldn’t that be more embarrassing than arguing about how another human should react to something scary happening to them? Go get a PhD, and then we can debate again. That happened to me back in 93 when I lived in Michigan a friend and I was coming out of liquor store and I saw a police watching the store when we first pulled up to it, we bought some beer and when we left the police followed us not even a block from the store they pulled my friend and I over, We had not done a damn thing, cops ask us for our ID and told us that we looked like someone that they were looking for. And that the person they were looking for had rob the liquor store that we bought the beer from. Why would my friend and I rob a damn liquor store and go back and buy beer from it. I guess all black people look alike to them. So sick of this crap.

@@davidsmiths5471 Yeah! My friend and I were hand cuffed and taken to the police station and once there the police Sargent looked into the matter and he realized that we wasn't the guys that they were looking for and we were released they apologize to us it was a mistake on their behalf.

What needs to stop is this horrible media narrative that this is some horrid traumatizing situation that can never be recovered from. The reality is this is just any normal investigation. The boy matched a description in an investigation which by definition means he has to be investigated on the spot. I recommend you looking up Terry V. Ohio for a reference. Remember, the kid was treated with full respect like any other citizen would be in that situation. It's unfortunate but these situations are a reality of having police and investigations, you have to be able to do investigating if you want to find the perp.

This happened to me when I was walking to my friends apartment. They said I matched the description of a person who robbed someone at knife point. They were about to cuff me when one of the officers to the others to release me. It made me feel uncomfortable around police officers for a bit because before that I had good relations with the police because I was a police explorer

They definitely sue, all the police had to do was ask more questions like where do you live, why are you here, etc, and confirm they got the wrong person.
They did and the police did nothing wrong. They detained the boy while they questioned him, the got confirmation that it wasn't the kid and they let him go. What the police did was totally legal and their system worked because the kid was only detained for a few minutes. I'm not at all surprised the mom will sue, she won't win and she knows that, she only wants money from a settlement. IF she sues she will only be using her son to get money.

Dashcam footage should show a suspect with the similar clothing if what they say isnt a lie. If it was the same color clothing then I think the mistake can be seen and understandable but unfortunate. The fact the footage wasnt immediately released shows they was likely lying and should be immediately fired.

I remember being pulled over once with my youngest son in the car. I was pissed off and embarrassed at my negligence(70 in a 65mph).This father handled it so much better than I would have.
The police left about the part of "black skin". You don't just put people in handcuffs without knowing what you are after. Reasonable, articulable suspicion for a detainment, and then reasonable cause for an arrest. There was none here.

That is what happened to my friends little brother in Iowa. His parents freaked when he didn't come back. The police tried to say he was a runaway cause it was late at night. The family moved away as fast as they could from that corruption.
This is why I hate police. They are predators you should keep away from your kids, if you want them safe, but that still don't mean they won't come out of the darkness to pray on your child like my friends little brother.

It's also insane that people get mad at police for questioning someone who fits the description of the one they were looking for. The kid was only detained (perfectly legal in all 50 states) for 5 minutes until they figured out that it wasn't him. To play devil's advocate for a moment, police were given a description of a black male wearing neon shorts and a white t-shirt. This kid had on neon shorts and a ligt gray t-shirt that could have easily been mistaken for white by the witness. Police detained him for a few moments to ensure he wasn't the car thief. It looks like he wasn't abused in any way and was released a short time later. Put yourself in the officer's position and think about what you would do if you saw someone matching the perpetrator's description in the area a crime was reported.

Let's turn this around ... little thief stealing cars runs behind an apartment, hears the cop cars out front, grabs a bag of garbage off the steps and pretends to be taking the garbage out, cops run past him, thinking he's not the bad guy ... they find out later the guy shoots a neighbor and NOW the cops are in hot water because they didn't question the suspect when he was carrying the garbage bag … It's a TWO WAY street, folks .... Here in Canada, the cops are allowed to detain you for up to 15 minutes without having a good reason, no judge will side with you because you were momentarily detained, the Law up here says that you can't sue because you were " inconvenienced" for less than 15 minutes, after the 15 minutes you DO have a right to sue for unlawful detention.
I've been in the same situation and all i did was walk out my front door as cops were driving down my street. They detained me for a few minutes and then let me go.

No please don't get to arrest every black man in the area, even if he's wearing similar close to a suspect. There are 12 year old car thieves nowadays... He fit the description. Male black, white shirt, neon green shorts. The only difference is he was wearing light grey shirt which is pretty close. Clothing color description isn't always described perfectly so it was close enough to detain him and clear him after investigating.
