It's a sample, which many genres base their music off of; It's like saying Biggie Smalls or Tyler, The Creator plagarise their music. It's unfortunate how TH-cam's copyright system works but that's not the remixer's fault. Not to mention that the remix falls under fair use, at least under American law.

Sad thing is Shibayan or ZUN won't be able to reverse any of that, because of the copyright-free nature of Touhou works. Deadman breaking ZUN's guidelines was the worst part. ZUN actually launched a service called Touhou Doujin Music Distribution in 2018 which acts as an official distributor for both original and arranged Touhou music. This allowed for arranges to be sold digitally. However, at the time of the incident it didn't allow music streaming platforms yet. Deadman monetized his remix in ways arrangers weren't even allowed to. Interestingly, Touhou Doujin Music Distribution already supported youtube's Content ID at the time. My guess is that it wasn't active for all registered circles just yet. By the way, Tiny Little Adiantum's current Content ID still has the "Omae Wa Mou" album cover for some reason.

Seems it might be more common than some people think for western musicians to "sample" things from Japanese media and put a generic hip hop beat over it. Another example-albeit slightly less egregious-is No Social Media by Wiz Khalifa. It very blatantly just takes Main Theme from Higurashi and doesn't even try to transform it in any meaningful way. But still, Yuuka's theme went through fan-made iterations, then a remix of a remix hijacked with its popularity, yet bearing barely any traces back to Shibayan or Touhou Project. Few years later, seeing that people thought that omae wa mou was the original i immediately was in disbelief because i thought "Wait a minute i've heard this before". At the time my memory was blurry but despite that i knew that it wasn't the original so i dig deeper and found the original that was uploaded by Alice Margatroid.

I think the main reason this situation Always makes me so mad to think about is because it's such a desecration to the creative process in doujin Touhou media. You will likely never run into the situation where you've found a touhou remix and can't figure out who made it, the original track it's based on, when it came out, where to buy it, etc etc etc. ZUN's creative works policies are so lax more than any other creative I've ever known and it has become such an integral reason for the series' influence on online culture everywhere.
I feel the same way about this how I do about Rooster Teeth stealing assets from MikuMikuDance models and monetizing those seasons. Ironically enough, the main assets stolen and used on RWBY were primarily assets from Touhou Project MMD models made by Montecore. Similarly the community around MMD is big on proper crediting and basically any asset you'll ever use on that program comes with a readme with a terms of service, which 90% of them include a disclaimer not to use their materials for commercial profit. Oftentimes Japanese creators will even translate it for English users. It's all just so insulting to have people come and take advantage of communities that are making really good art oftentimes completely for free out of the passion they have for the topic.

as a brazilian (and also a bossa nova fan), it's really cool to see that one of our best music styles is still recognized around the world, especially because this genre has lost relevance here in brazil.
but I gotta make a confession, I unfortunately... only discovered about shibayan because of deadman, and I initially thought the arrange was his... sorry... Ever since I discovered the original source I immediately feel in love with shibayan's music, and I still listen to it today (i'm addicted to "Farewell, Narcissus").
discovering it also made me rediscover touhou too, even making me actually play the games, before this I didn't knew a lot about it (there weren't a lot of touhou content in portuguese, and I didn't spoke english at the time yet).
I hope this video gets recommended to as many people as possible, what deadman (and lil boom) did was really bad and people gotta know who the original author is, plus, I can be wrong, but if I remember correctly, they also stole other music from other people as well, can't remember if it was before or after this drama, but I remember hearing this at the time.

Touhou Project has a beautiful culture of fan works (art, manga, music, fangames, novels, etc.), encouraged by ZUN's lax leaning towards allowing anyone to do what they wish in reference the content of the series, so long as its not just cut+paste and in fact your own original work, and most importantly that it credits Touhou Project, Team Shanghai Alice and ZUN with the original source.
ShibayanRecords is a well beloved arrangement collective with a long history and a wide variety of music genres.

@@patricklewis9787Honestly this is just my 2 cents but calling Sampling as Plagiarism is just weird.

At the same time i don't agree with that at all because "Usually" right you don't just take that Slice of Cake put it in a Box and then Sells it, no you the usual procedure should include how you take that Slices to your home, try to understand what the hell is this, try to make it yourself and using that as a base to make your own Cake and then selling it.
If you just take a part of it and directly sell it, it's not Sampling imo it just Theft exactly how Deadman does it.

@@Azazantei I think my issue lies with what line dictates whether a sample is (or isn’t ) plagiarism. The reasons I see people come up with more subjective if anything. We can call deadman’s sample “lazy” or “uninspired” or whatever but it doesn’t stop the fact that it can still be considered his own “song”. I don’t agree with it but it is what it is.
For example in Kanye’s song “Power” he sampled King Crimson, and the band sued him for doing so. Even though the “Power” doesn’t come off as plagiarism they had every right to do so, even if I think they shouldn’t have done that.
Also the cake analogy was a pretty decent one.

Speaking of unauthorized/uncredited sampling or plagiarism, that happens with plenty of Japanese music. Young Girl A got sampled for Paranoia and there was initially no credit for the source until the artist added it, while Dragonfruit got sampled for Dragonfruit Salad. At least for the latter, the artist for it admitted to making it a little bit too similar with the OG and promised to sample more ethically. That being said, All My Fellas may not be one of the examples despite sounding similar to Moonlight because the artist for All My Fellas made a whole video explaining how the song was composed and how different its composition was, though he also admitted he may have been subconsciously influenced by Moonlight

To add, a good number of fans recognize this as the "deadman incident", that's what we called it. In fact, if it were not for a few good die hards, deadman would have actually gotten away with this for one small reason, the excuse of "fair use"; and it's because a majority of people don't understand what "fair use" is or how "fair use" applies. If you don't know what "fair use" is, read it up. And because it affects someone/something outside of America, American law doesn't apply, thus the excuse of "fair use" is also defeated, because a completely different set of rules is enforced. This is where the few die hards came in, because they had to research, link, and convince multiple touhou fans across the world to work together to put in copyright tickets to the TH-cam system. Even a petition was created. This lead to a strong 30,000 fans, afaik, worldwide to take action. Originally, Shibayan was afraid of what would also happen to them, because of what deadman did. Because, would this also mean that entire circles be destroyed? Everyone feared what ZUN would ultimately do if he found out. Part of the "old rules" was to never commercialize the touhou music, and that's what eventually happened. However, theft is theft.
There were two people involved, "deadman", obviously stole the track, did his thing, releases it as "Omae Wa Mou", though the video today is edited, that was the original title. There were also no credits in the original description, though It's there now. In fact, the original description was him selling "samples" of his "sample". From there, his friend or cousin, "Lil Boom", he "sold" a sample to. Lil Boom takes the sample, uploads it to YT, calling it "Already dead". Lil Boom also tries to sell "samples" of his "sample" to other people, calling himself a "distributor", while "deadman" was the "producer".
After the huge hits and fame, they decide to sell the music to a label. The video misses one other label, there was another one other than "United Masters", forgot what the name was, so 3 parties involved. From there, United Masters and the other label both "acquired" the "rights" from deadman and Lil Boom and not only distributed it everywhere, like Spotify, but also sold it on platforms where they could, like iTunes, Amazon Music, etc.. However, thanks to brave Touhou fans communicating across the world, and also finally somehow magically getting in touch with ZUN, he was alerted. Everything afterward became "hush hush" is part of the dark history of the Touhou Music circles that nobody is really allowed to talk about, even Shibayan forbid people to bring it up. Some legal stuff happened, the other music label company backed out (dunno what happened to them, however United Masters was still there. For a time United Masters still had "rights" in some areas, then they finally disappeared. Finally, it got around to deadman, and he ended up in court. Then all the bio stuff, and all the videos and description on his channel were either changed, or deleted over time (he also sampled and sold other older and lesser known Japanese songs, but were popular in Japan, like Plastic Love by Mariya Takeuchi). There were no more details after that. However, there were still independents (literally people reusing it or doing covers) making the song in odd places and selling it. Dunno if that ever got shut down.
In light of all that, a new copyright Content ID checker system rolled out from YT, and in addition to this, that's also when everything on YT went crazy and started striking everything, and that's how a lot of videos disappeared. A lot of YT accounts disappeared. Then on Facebook, after the crisis was over, something very extremely unusual happened. All touhou fandoms were getting busted (potentially from either lil boom or deadman during talks with the government, because they literally picked up them up, and the two kids had also threatened to bring the touhou fans to court over harassment). A lot of FB users got terminated, and many groups simply vanished, even some people completely disappeared, no details on the Twitter side. And it wasn't just in America, it was all over the world, wherever touhou existed.
In the end, did justice get served? IDK, that's up to you to answer. Even if you did say yes, then it was bittersweet, and the Touhou fans who stood up paid a price as well in the end. This is part of the dark history that nobody really knows or talks about. I admire the effort to spotlight this touhou incident, however, there were just a few things you either didn't know or left out. However, it tells most of the story.

The song is literally the miku song, but the guy makes noises over it. He is able to now copy claim anything that has the original song he stole. It's amazing how much trouble covers can get you in if you are stupid enough to pretend that you aren't covering a song. If people want to plagiarize music, all they have to do is claim it's a cover. It's amazing how easy it would have been to make this theft "justifiable". Literally, all Deadman had to do was release them as covers, and then direct people to the original artist when asked about production. It's also interesting how there seems to be a wave of trendiness every decade or so, where sampling and covering is the norm, then a decade later, people claim it's "plagiarism". In the 90s, covers were so common that they could sometimes be clones (especially with 90s happy hardcore). It's annoying that the term "plagiarism" is so much more subjective when it comes to music than other forms of media.
Edit: please keep in mind, this was written before I saw the copy pasted leadin for that one song, and heard about the copyright claims. It's pretty clear that Deadman would NOT be able to avoid controversy by releasing it as a cover. That's wild that he actually copy and pasted the part of that song... How is someone who is capable of producing music on a computer not capable of realizing that that's guaranteed to blow up in your face?

I wouldn't have any problems with them if they did, but for some reason people have a hard time giving tribute to the OG. It's not the complicated, just use this format: "OG TITLE (REMIXER/BOOTLEGGER ARTIST remix/bootleg)." Or if you want to give it a new name for whatever reason: NEW TITLE (REMIXER/BOOTLEGGER ARTIST OG TITLE remix/bootleg). And if you have new vocals throw in a "ft. VOCAL ARTIST" after the title. As long as you let people know you didn't invent the song, do whatever. The problem is when you don't and plagiarize it.
