@missmindersue No. You will never find a bar certified attorney to represent you in a situation like this. A court would never consider a minor inconvenience of time as an actual "damage or harm".
Please take this advice from a private citizen with no legal accreditation:
*De Minimis Non Curat Lex* (Latin for "the law does not concern itself with trifles). The courts have deemed that minor or trivial matters do not warrant legal action.
One legal case that addresses the issue of an unreasonable search during a traffic stop but does not allow for a civil action against a government actor is Whren v. United States (1996). The Supreme Court held that as long as a traffic stop is based on probable cause to believe a traffic violation occurred, the stop is constitutionally valid, even if the real reason for the stop was to investigate other suspicions unrelated to the traffic offense. This decision states that minor violations of Fourth Amendment rights during traffic stops, such as pretextual stops, do not typically give rise to civil actions against law enforcement officers or agencies.
Even if you can prove that this was a "pretextual stop". The defence will default to Heien v. North Carolina. In which a law enforcement officer does not need to know the law, or the specific job that his title dictates he know.
A pizza delivery person needs to know how to deliver pizzas.
A dentist needs to know dentistry.
A fry cook needs to know how to cook fries.
A meat cutter needs to know how to cut meat.
However.... because of this court case,
A law enforcement officer does not need to know the law.

i witnessed one who did walk away. she stopped in my dealership's parking lot. it was the off season, so i was doing oddball stuff happy be getting paid.
at that exact point in time, i was laying weed block right next to the stop. and i was working on the edge, which meant having my knife out.
You are REQUIRED to do the breathalyzer / blood test, but NOT the made up "field sobriety tests".
In NC license automatically suspended for 1 year. Even if there was no citation or crime.
I agree however cop was already indicating that he was going to arrest him based on glossy eyes and his "inability" to answer questions. Cop was out to prove his power over the driver.

Why people continue to agree to a field sobriety test is simply amazing. It based completely on how the officer believes you did and to a large extent on how they might be feeling.
And its NOT required. Breathalyzer may be, but NOT made up "field sobriety tests".
@@Dan-yk6sy Dan, that is exactly right. I have told my own adult children that and I wish they would stop those tests completely. Another thing nobody should allow is police searching your vehicle.
In this case, the officer was basically stating he was going to arrest him based on what he was seeing. So he was screwed either way.

That’s a tough spot to be in because if you don’t do the tests you have a criminal that lets his ego and feelings make his decisions using his “experience “ to decide if your intoxicated just by the interaction so far and he already lied about your eyes and inability to answer questions. Inability and unwillingness are to entire different things. That criminal cop is a predator looking to violate and harm citizens just to feed his sociopathic ego.

@@sincitygiggles13 yes, and I also noted the LEOs evasive reply to his request. If the cop had a machine available, he knows they are pretty spot on as long as they are calibrated. Most cities share the monies received from arrests with County seats, and officers with lots of drug and alcohol busts get preferred treatment for promotions and pay increases. It's an industry all It's own.

Keep in mind, many states have ZERO tolerance laws or PER SE laws pertaining to Marijuana... impairment definitely not required for DUI conviction!!! Learn your states drugged driving laws. Just because it's legal in your state, only a nano gram (exaggerating but ya get the gist) in your blood can convict ya AND it's still a federal crime. Period. And illegal to possess on federal land!!! America 🗽Still the land of the free and home of the brave???
@@sincitygiggles13 In CA, possibly the absolute most totalitarian State in the Union, you must blow a .08 on a meter, and they are required to follow a pos lung test with a blood draw for a conviction to stick. But to get ARRESTED for DUI you can be a stone cold tea sipper, if you "trust" the judgement of a LEO with a DUI "certificate". It's insane to put your career in a LEO's hands

I also have a Class A license and worry about the same type of Road Piracy ☠️ every single day. Also when you have a CDL most if not all states lower the threshold from .008 to .004 which means depending on your bodyweight, about one beer can get you arrested.

Always refuse the field test. When I was 17 me and fifteen others had a sheriff's officer come to our facility and we all failed the test. All completely sober.

These are called Standardized Tests for a reason. Cop did not give the tests correctly. HGN was painful. Instructions for walk and turn and one leg stand were not standard. Cop in the background looking at his watch during one leg stand shows he doesn't know what he is doing either. Estimating the passage of time is not part of the one leg stand test.

@@stevetilk4926 no they take to the station and give you a breathalyzer which is a pass or fail if you take the field sobriety test the cop decides whether or not you pass because it’s objective so if they even suspect you of drinking you going to fail then you end up with a DUI on your record

If a cop ever pulls you over and asks you to take roadside tests, whether you are impaired or not, you're probably screwed. All about that revenue. Nothing to do with safety

This is the new retaliatory action for not answering questions in America. If you don’t answer the questions you are not required to answer then I’m gonna accuse you of DUI. Seen it a dozen times in the last 4 weeks.
They also tell you that if you're in your 50s or older you should not do any of these tests that they're trying to give you.
Any age, they are not required and by many news stories have shown they are used to arrest sober drivers for DUI.

Now, as to the FST, he was coerced. The moment he asked for a supervisor, depending on the department's policy, they usually are required to contact them. Some policies say if they ask 2x. Some supervisors want to see if their officers can handle the situation themselves.

In my state (Delaware) they suspend your license if you refuse a field sobriety test. So I would lose my CDL and my job.
In no state can you get into trouble for refusing the FST.
The cops go out of their way to not answer what the repercussions are for not doing the field sobriety tests. Its a double edged sword. 9 times out of 10, even if you're sober, you're most likely going to jail. If you've had anything to drink at all, you gotta refuse. They use those tests to gather evidence of your guilt, not your innocence. It worked out for him because he was OBVIOUSLY sober and the cop knew it. He was just butt-hurt because he refused to answer questions. He was hoping he would refuse the tests because then he would have arrested him saying he would have to go off of the indicators he observed and the man would have gone to jail. I, personally would have refused and gladly taken the arrest. However, i would have made it clear that i was exercising my 5th amendment right and REFUSING to answer questions, not that i was unable to. Then, when i beat the charges, i would sue the officer for using my right to remain silent against me. I've been studying the law for years now and i would represent myself pro se, knowing that i would have to appeal to get any kind of relief for the violation of my rights. I know I'd be hard-pressed to find an attorney willing to take that case. In my opinion, he did the right thing and handled the situation as best he could. That cop knew he was sober and was looking for an excuse to lock him up.
If a lane change without a blinker is justification for a field sob test than there are a shit load of cops in duluth mn who need to be field tested!

They gave me the walking the straight line test in a unlevel field with weeds in 25 degrees with 70mph winds. I'm not even kidding!!

Back in 2005 I was pulled over at 2am in the morning for doing 35-40 in a 45 mph zone, no traffic what so ever. I refused the field test and was placed under arrest. Took me to jail where I blew a .02 paid a lawyer $1000, and had my case dropped. I wish I knew then what I know now. unlawful arrest, detainment.. is a crime. punishable by 10's of thousands. I stand on my constitutional / God given rights!!!!
I was at the beginning of the flu but didn’t know it, after working a double heading home at 2am. I was also taking care of my grandparents that were 90 years old. So I was wiped out already and the flu, so I was wrecked. I had nothing to hide so I was fine with them searching my car. That bed-itch proceeded to question everything in my car, while I stood outside in the freezing rain without a coat, because I never imagined that I’d be standing there justifying what my belongings were doing in my personal car!
First and last time that will happen. That was over 20 years ago and my blood still boils when I think about it.
That was pure entrapment in my eyes. Officer was butt hurt because he wasn't answering any unnecesary questions so, he cast the line for drunk driving,=. Once the officer asks if you're willing to take the field sobriety test, you're screwed. You either do it and risk getting arrested whether you have had anything to drink or not or, you lose your license for a year. Then have to hire an attorney and go through all the BS.

The most dehumanizing part of this is the fact that driving is a privilege and can be taken at will.
Problem is that his license is his career and he has to do everything in his power to protect it.
25 years of driving I had this in mind, I never raised my voice always showed respect yet I still had cops retaliate and cost me thousands and weeks of work.

I’m a retired cop. Have done over a thousand DWI stops and arrests over my career because I detested drunk drivers.
First, on a typical stop I would have developed PC by OBSERVING IMPAIRED DRIVING. That’s all I really needed along with passive observation of intoxication, ie slurred speech, watery bloodshot eyes, unsteady on feet, steadying one’s self by holding onto the car, swaying, fumbling hands.
FSTs would “indicate” to me the LEVEL of intoxication. ie: nystagmus, heel to toe, finger count, finger to nose, standing head back eyes closed. I got pretty good at guessing within 100th before the breathalyzer.
Breathalyzer would be evidence of the level of intoxication.
All we have to do is PROVE IMPAIRMENT when driving or in PHYSICAL CONTROL of the vehicle.
Hopefully you can tell a good cop doesn’t need to FISH for a drunk. His observations appropriately documented is all he needs. FSTs are icing on the cake.
MY attorney told me NEVER do FSTs. He can argue my sobriety or intoxication in court but FSTs are SUBJECTIVE and too easily embellished by the officer. My attorney also said if you’ve been drinking do not give a breathalyzer sample too. Take the mandatory suspension. He said he stands a chance of getting a not guilty without all that self incrimination.
Look, if I’ve been drinking I’m going to get into trouble (mandatory suspension) either way. But a DWI conviction, I will get in MORE trouble. Suspension, loss of job, lots of fines, classes, suspension reinstatement fees and increases insurance premiums.
So I’ll INVOKE my right to be silent and consult an attorney before answering questions. It’s my understanding that the prosecution cannot even SAY you invoked your rights in front of a jury because it will unjustifiably make you look guilty. It would be considered a mistrial.
So Produce the documents required and no more.
Btw, this cop was pushy but very professional. I like that he gave a warning to the driver even though a complaint might roll in. He was that confident he did nothing wrong! I like him. He got away with everything because the citizen was not educated… yet. I bet he is now!!!!
One last thing. I’m 67 years old now. I can’t adequately perform any field sobriety tests when I am SOBER due to my age and beat up body.
The bad thing is is when you have a commercial license you have to follow certain other protocols

He should of just kept his mouth shut other then i’m invoking my 5th amendment right to be silent and handed over license, insurance and registration if he had itbif not shrug shoulders to cop. He had no probable cause to do dui bs until brett started talking. Hand them a card invoking your 5th amendment is even better… if u don’t speak at all and he arrest u it should be thrown out of court
He should definitely walk into the station and put pen to paper with a written complaint for that officer, it doesn't matter what the Chief's opinion is about said complaint! That Officer immediately retaliated against dude the minute he invoked his right to not answer questions, by pulling him out of the car. His rights were voilated and he was retaliated against all in the same stop! If he does not file a complaint on this PIG it will happen to some body else by this officer.

1. Abolish qualified immunity ASAP,
2. Abolish civil asset forfeiture ASAP,
3. Make it illegal for a cop to mute or turn off a cop body camera,
4. Make it cheap, easy and fast for a citizen to obtain any and all ... unredacted when possible ... records,
5. Make all internal investigations subject to independent civilian oversight. Any other suggestions ?

Totally understand why did the fst. Pick your battles. A refusal could get you arrested and taken in for a blood sample which takes 6 months or more while you're out on bond and court ordered not to drive. Hed lose his job and have an arrest record.
Sad but true. The cop said it. If you refuse the test it's up to the cop to arrest you just on his opinion of your ability to drive. We've all seen it before.
I feel so much safer.
I have a class A. I thought they could take your class A away if you refuse a field sobriety test that is designed to make you fail it.
After he agreed to do a field sobriety and allowed them to search him, I couldn't watch it any longer
