    If someone gets a felony for driving, you don't lose the right to own a car, so it's all about limiting as many people as possible from owning a firearm, period.

      @@gottiic6529 Even after revocation, you can still get your license back for the so called "right to drive", but you still can't "legally" own a firearm. In either case, having a license to drive, or a permit to carry a gun is nothing more than the government taking your rights and selling them back to you.

      In my state (Wisconsin) a minor can be charged with a felony of child porn production and distribution for sending nudes to their high school sweetheart (who can either be the same age or just a tad older/younger) or whatever and then lose their gun rights as well as register as a sex offender because of that, and the receiver can be charged with child porn possession (again, regardless of age) and have the same thing happen. It's an incredibly fucked up system. Also, the only way to get gun rights restored to a felon in this state is by pardon, and our governor Scott Walker has his head far up his ass and doesn't give out pardons so he can retain his "tough on crime" campaign stance so he can keep getting re-elected.
      The system is fucked. And people don't realize how fucked the system is. And no legislator will change the system since their re-election hangs on it.

      But we have some of the largest populations of people in prison, here in the USA. Too many people in prison for crimes they shouldn’t be jailed for.

    I know people who have been convicted of a felony who I'd trust more with a gun than some people who haven't been. My question is, if someone is released from prison but can't be trusted with a gun, why are they out of prison?

      Absolutely not. Paying a debt is pretty damn far from showing that you can be trusted. Especially since society has to force you to pay it. Screw criminals, I don't care what their excuse is, they shouldn't have any rights they can't be trusted with.
      As for voting rights, THOSE should never under any circumstances be tampered with.

I've tried so many different things and when it gets to that back ground check then it's always the same and I don't qualify. I understand why so many people go back to prison now.

      Chris Anderson ..... hey bro your not alone.... i spent 8 years in a state penitentiary in the Commonwealth of Pennsylvania. I was convicted of a 2nd degree felony. My first ever offense. Outside of traffic violations. My Lord and my creator governs all my actions. All my beliefs and most of my thoughts. Im certainly not perfect. What im seeing now out on the streets of America breaks my heart. I love this country. I served this country . I went to war for this country. In the end none of that mattered in the court room. Theres a whole book i could write on that alone. The point is.... an honorably discharged veteran is never going to allow any piece of shit that thinks it has some sort of authority dictate to me what i can and can not have. Regardless of what it is.

    The second amendment says a persons right to bear arms will not be infringed which makes any law that says a person cannot own or carry a firearm, no matter what crime they committed, a violation of The Constitution of the United States.

      False. The Justices of the Supreme Court of The United States are the Final Arbiters of the Constitution, as per the Constitution.
      This makes such rulings from the Supreme Court lawful, and Constitutional.

      @@tylerb556 I don't know what you're trying to say. The Constitution gives the Supreme Court jurisdiction over matters of Constitutionality. That makes a Supreme Court ruling on a matter of Constitutionality de facto Constitutional Law.
      The Constitution is the Supreme Law of the Land, and the Justices of the Supreme Court are the Final Arbiters of the Constitution. This adds up to their rulings being, by definition, Constitutional. Yes, you are legally bound by the decisions made by SCOTUS, should they apply to you.

      The Supreme Law of the Land does! The inferior statutes make the exercise of fundamental, individual, "incorporated" rights "illegal". Those laws are NOT "law" at all but instead are known as a "nullity" and are unenforceable in any honorable court in the land. But each American must know their rights and how to defend them.

      The Lautenberg Amendment, is way over reaching, I can see and agree that a convicted felon should seek some counseling, before his or her gun rights are returned, but a life time ban is totally unfair.       @@Kurio71 Neither slavery nor involuntary servitude, "except as a punishment for crime" whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction. It gets rid of slavery unless you commit a crime. That's how they can take a person's right for the 2a if they commit a felony, even if its non violent. Also it's how the prison system can get away with forcing inmates to work while they make a large profit.

      Pretty much. If your a free man, you may bear arms since it is a natural right, if you cannot, you are not free. If someone's too dangerous to have a gun they absolutely should not be in public seeing as you have cars, knives, swords, chemicals, explosives and even an easy means to manufacture a firearm and ammunition, let alone buy one or steal one.

    I got a felony 1week after I had my 18 birthday. I was in my dads car and my brother left a gun in car. I was polled over and cop found gun. My brother went to police station and said it was his. They took us both. I got a felony and 3 years probations . Now can't own gun. U can jump border and have more fights then me. Only in America

      Austin France Far as I'm concerned the constitution n bill of rights not up for debate. It clearly states " shall NOT be infringed" therefore these laws are illegitimate. Seems to me some fat cats are due to be dismissed and brought up on charges and punishment of their own up to and including no tax funded armed security guards or pension.

    I served in the Marine Corps in an anti-terrorist unit. I recently decided to purchase my first gun, a Ruger 10/22. Here in Minnesota you need a permit to purchase to buy a hand gun. Most people can walk in and buy a rifle or shotgun unless they have a felony. I was denied the purchase of a rifle. The only thing on my record that I can even imagine is the reason. Is when "I" (not her) decided to divorce my crazy brazilian ex-wife, because of her infidelity She threatened that I would come home and find her and my 2 yr old daughter dead on the floor. She threatened at least 10 times she would take my daughter back to Brazil and I would never see her again. As a father protecting his child. I decided to tape record my phone line, to find out if strange men were coming over. Or if she was making flight arrangements to leave the country. The tape recorder was found at some point, not hooked to the phone line anymore. It was in the trunk of my car. I was charged with a gross misdemeanor of Invasion of Privacy/Stalk/Follow/Pursue. For tape recording my own phone line. I did one day of sentence to service (no jail time) I paid a $200 fine. Luckily, the court felt I was just a father protecting my daughter.
    When I was denied the purchase of this gun. It pissed me off! I am buying guns because I have been out of the Marine Corps since 1997. I just want to have fun target shooting, see if I still have the shooting abilities I was trained with. This was just one of many guns I had wanted to buy. So I sent an E-mail to NICS to find out why I was denied. This is the answer I got, "The specific reason the flag was set could not be determined" "If you wish to challenge the accuracy of the denial, you may submit certified court documents pertaining to the prohibiting record identified above."
    Ok so if they have no idea why I was denied!? What court documents should I send!? If they don't know why I was denied, then wouldn't sending my court records just give them a reason to find a reason to deny me!? This is the most ridiculous thing I have ever heard. Luckily, I can buy guns private party. Even better I can build my own Ar's.
    I wanted to buy a gun, and I wanted the government to know what I have. I don't care! I wanted to be honest about owning these guns. To honest, and forth coming with what I have.       The 5th amendment says you can forfeit your rights as long as you receive due process of law. Putting murderers in prison is not an infringement on their right to liberty because they have forfeited that right by murdering someone and the state has given them the chance to defend themselves against that charge and proved the charge beyond a reasonable doubt to a jury of their peers. The loud argument = domestic violence thing is total BS but I am very happy with murderers, robbers, and rapists being prohibited from possessing guns. However restricting the ability of LAW ABIDING people to own or carry guns is absolutely a violation of the 2nd amendment.

    I have never had even a speeding ticket... No encounters with law enforcement in my life other than hunting/fishing license check and pulled over for having a dead coyote in my truck by a deputy sheriff who after he seen who I was didn't even wanna check my licenses.
    But anyway every time I buy a firearm I think "Man some of these things are so unfair." I agree 100% with what these guys are saying.

      I have a friend who is a police officer. One night his crazy ex-wife tried to gut him with a butcher knife. He ended up needing 12 stitches to close up his hand from disarming her-- he was bleeding like a stuck pig when the cops got there, and they were about to take him to jail until he produced proof that he was a LEO.
      Why? His wife's wrist was bruised from him grabbing it to stop her disemboweling him.
      If he'd been a normal joe, he'd be barred from exercising his right to keep and bear, probably for life, because having your rights restored is not cheap nor guaranteed.

      ***** Pending felons, not yet convicted, can keep/possess guns they already own. And also buy/trade private dealers. They will be denied by federal licensed gun shops while pending, and after conviction (if there is conviction). Once convicted, you'll always be denied and your probation/parole officer will want you to give up previously owned guns (I'd imagine), other than your trusty old (or replica) muzzle loader (sorry, no Thompson Center Fire folks). If no conviction, your rights will be restored after you clear it up.
      Or, you could just run from the law and remain pending (no one found = no one to convict) until your statue of limitations runs out (not all felonies have limits). Also, not all felonies are extraditable from one state to another = easy to "hide" = just don't go back. .......... so I hear

    Overall, violent felons probably shouldn't be able to own guns, BUT, if they are safe enough to allow back into society, then why not be able to own a gun legally? If they are not presumed safe enough to own a firearm, why would you trust them to release them back into society where they can access knives, etc.? That doesn't make a lot of sense.
    As for domestic violence, I don't think that should be a gun-removing law. It's too broad of a definition to enforce properly. It's a good intention law but I don't know how effective it is.

      you're wrong dude. this video is wrong as well. it is simply not true that all felons are prohibited from owning guns. if you're convicted of a certain violent felony OR misdemeanor, then you will lose your gun rights. there is a list of crimes which cause this. for some crimes, such as misdemeanors, you only lose your gun rights for 2 years. for other crimes, such as felonies, you lose them for 5 years. however, the VAST MAJORITY of felonies AND misdemeanors are not on this list at all. domestic violence is one of the only misdemeanors that is on the list. most felonies will not result in you losing your gun rights. it only includes violent crimes, serious financial crimes, and serious drug crimes such as dealing large quantities of schedule 1 drugs. so you don't lose your gun rights for committing victimless crimes. if you commit certain nearly-victimless crimes, you only lose your gun rights for a couple years, and you can appeal to have your gun rights reinstated. even if you murder somebody, you can still appeal to have your gun rights reinstated, though you probably won't win.

      I just wanted to point out that many violent felons are simply NOT safe enough to be released back into society, but are nevertheless discharged when their sentences are up. Regardless of their crimes or their behavior while incarcerated, felons MUST be released when they have completed their sentences. That is the law. Behavior and the likelihood to reoffend are considered only when inmates are released early on parole. Many states will attempt to parole an inmate whom they know is dangerous, because the parole process allows that offender to be monitored by a parole agent, who can in turn, catch the offender committing another felony while he is subject to monitoring, and get him locked back up again before he can hurt someone. If he flats (completes his full sentence without parole), he can just walk out the door without being legally subject to any monitoring whatsoever. This is why dangerous inmates will often refuse parole. They know they are likely to get busted again while on parole, so they would rather flat their sentences in order to keep from picking up another felony conviction.
      shmediaproductions is absolutely correct. Different states have different laws regarding whether or not a felon can regain his gun rights. Many states return your gun and voting rights after a certain period of time, or never take them away at all depending on the crime. Domestic violence is the exception. Restricting gun ownership for domestic violence is a federal law. However, in many states (like mine), you do not permanently lose your gun rights for domestic violence, and the state will not enforce the federal law. Therefore, if you live in the right state, you could possibly buy a gun from a private party for use inside your own state.
      The video was also incorrect about domestic violence arrests. They spoke as if every time the police arrive at at domestic disturbance, someone is going to get arrested, charged, and convicted. This is simply not true! Convictions for domestic violence are actually somewhat rare, because the participants often change their minds or their stories somewhere along the way. Granted, cops will often make an arrest in order to separate individuals who could end up hurting one another, but this seldom results in an actual conviction. Cops will often attempt to convince one party to simply leave the house to avoid having to make an arrest. The odds are slim that you will lose you gun rights for slapping or pushing your spouse. But beat the crap out of them, and yes, you'll probably do time and lose your gun rights for at least some period of time.

You can wreck the shit out of someone with mental abuse and that is not a thing in the courts. If you had a box knife in your pocket you used at work and you get attacked and you win but the attacker ends up with collateral damage... say loses an eye ( and you stopped the attack without pulling the knife), you WILL still be charged with assault using excessive force and when they frisk you, you are now in possession of a deadly weapon.     In Louisiana first offender convicted felons automatically receive a pardon. After ten years of completing your sentence/parole, or probation firearm rights are given back. there are some crimes that are excluded from this law.

    Only reason I'm a felon is I couldn't afford a private counsel in 1990 when I was 20. I got in no trouble what so ever for 27 years until a traffic violation. I was in court the public defender actually said to me "ah chad..... Looks like you've been off the radar awhile..." 27 years later you never repay your debt.. Great video guy's good advice!

    If a felon can't be trusted with a gun, then why are they out on the streets in the first place. If a felon wants to commit a crime with a gun, having a law against it won't stop them. If a felon chooses to live lawfully, then having a weapon only adds to the safety of society. If its safe enough to let a felon out of prison then they should have the same rights as everyone else. If they are not safe for society then let them rot behind bars.
    Why do we think that someone who is a felon should not be able to defend their love ones from some some scum who decides to brake into their house and murder and rape their wife and children. The second amendment should be for all free people.

    Thank you for making this video. I was convicted of marijuana possession in November of 2000. Since then, I've straightened out my life, went to college and graduate school and am now a math professor in Southern California. Now, since I had a weed charge 16 years ago, I can't legally protect my family. My situation really sucks. Fortunately, my wife can own guns, but still. I would really like to have a collection, but nope. I can't even take possession of my Grandfathers guns including his WWII Colt 1911 sidearm.

    I just got my firearm rights back after getting a weed felony 5 or 6 years ago. cost quite a bit and took some time but its possible. keep in mind my felony was nonviolent and I didnt have a weapon on me when I was arrested.

    I have a relative who had a felony on record for a violence against an officer. Was not allowed to own a gun. About 15 years later, living clean, he was able to appeal at the courts and he was granted back that right. He now conceal carries everyday.

    Convicted felons can get ALL their rights restored and legally own a firearm. I personally was convicted of a class b felony / armed robbery and was granted a "certificate of relief of disabilities" and applied to the FBI for a UPIN that I use on the NICS form. My approvals take 2 minutes at most.

    While domestic violence is no joke, someone always going to jail is. So is the simple things you can go to jail for. Ive seen it many times. Such as taking keys or even their phone will get you a charge. I'm a totally different person 10years later. I barely recognize me. Lol. All the change is for the better and I dont drink anymore. I think I deserve the chance to hunt again. Its a huge part of our rural life.

    I remember back in the day you used to take calls at the pawn shop to talk to people coming from the channel. I called in one day and of all people, Barry answered. I had a wonderful conversation with the man, and I remember that I asked him about his opinions on this very topic. This video hadn’t come out, so I had no idea what he’d respond with, but when this video did come out (I think it was a few weeks later), his opinion hadn’t changed. Still the same man I talked with on the phone. Thank you Barry for those 10 minutes you spent talking with a stranger, and may you Rest In Peace.

    For non-violent Felony's you can go to court and get it reduced to a misdemeanor after 10 years, my brother had a felony drug charge dropped to a misdemeanor after about 12 years and bought a handgun legally.

    I know you're voice is small. But, I greatly appreciate you speaking out about this issue. I made horrible choices in my youth, I served a few year in prison. For drugs. I understand it was wrong and I did my time and payed my fines. Since then have lived a normal life and had the same job for almost 20 years. Even with changing I can never touch a firearm forever. It's sad as I used to love to hunt and target shoot.

      I was convicted of 2 b and es and 2 grand larceny s in 94, dist of marijuana in 97 then got a family domestic charge in 09. I hired a lawyer in 2020 in Roanoke VA and I now have my gun rights and concealed permit. I hunt and can purchase guns too

    Domestic violence is the most unfair and to me unconstitutional overreach in the books. My Aunt has psychologically terrorized her husbands and own father, and is party responsible for killing 2 of them by emotional abuse. She walks free and cannot be charged, but a man who raises his voice the wrong way can be ruined for life.

    No Constitutional authority granted by 'the People' to government to disenfranchise any free man his inalienable rights. The Court held that the right of an individual to "keep and bear arms" protected by the Second Amendment is incorporated by the Due Process Clause of the Fourteenth Amendment and applies to the states. [McDonald v. Chicago, 561 U.S. 3025 (2010)] I still do not know how the government can disenfranchise a felon of his right to bear arms. The inalienable right ratified in the second amendment, nor any part of the Constitution does not say a felon can't own a weapon. My question is, why can we disenfranchise a felon of his/her 2nd amendment rights for life, even if the crime was unrelated to violence? Such as bank fraud, or embezzlement. It is a right, not a privilege. Secondly, and more importantly, if we can disenfranchise a person of their inalienable rights, well then why not their other inalienable rights such as their first amendment rights? Why can't we tell a convicted felon to shut up? Why can't we take away their right to peacefully assemble, or practice religion, or even basic free speech? Why can't we strip convicted felons of their 4th amendment rights, and give police the power to pat any convicted felon down, warrant or not? If you have a logical answer as to why their 2nd amendment and inalienable rights can be disenfranchised away, I hope you have a logical answer as to why their other rights CANNOT be stripped away.
    How is this not discrimination of a free man who has served his time for a crime and then forced to live with a life sentence of having some inalienable rights infringed upon him? How is this not double jeopardy? Where in the Constitution does it say that government can disenfranchise a citizen of their inalienable rights after they have paid for their crime? Where in the Constitution does it grant authority to government to wield the power of granting clemency over a free citizen [who must submit an application asking for their rights] in order to restore his/her inalienable rights after having served their time and released a free individual?

    I have drug felonies from back in 2006. Literally caught with only “residue”. Never fought with a cop, anyone. Dumb kid having some nose beers. I hope I can get this expunged soon.     About11 12 yrs ago, I was pulled over on my way home from Mardi gras for some shoe polish on our rear window in Arkansas.
    Yes I was carrying a pair of brass knuckles and was slapped with a felony charge of a prohibited weapon.
    I took an inch thick stack of letters from police officers, school principals, friends, parents of friends, all notarized and the judge refused to even look at them. Every letter stating that I'm not a violent person, that I never,and I mean NEVER been in a fight what so ever.
    I'm a peaceful man, who just wanted to carry some kind of protection.
    Now I cant even protect my new family because i didnt have 5000 dollars for a lawyer to get the case thrown out

    Got my felony when I was 19. Got into something with a couple of friends, wound up breaking into an empty house. Wound up with 5 years over that. I'm 31, and I have to use big bore airguns if I want to hunt or target shoot. It's really expensive, limiting, but at least I have an option I can take and still be abiding by the law. If i wanted to commit a crime, i'd just commit two while I'm at it and use a real gun. But I don't so this loss of rights only applies to law abiding ex felons.

    Scariest moment of my life. Girlfriend and I got into an argument I grabbed my phone and ran out the door she yelled she was calling the police I told her to go ahead. Police met me halfway down the road. I was detained, my girlfriend had a red mark on her wrist where I guess my fingernail caught her. The officer said I know you didn't do anything but I have to arrest you under corporal punishment. It's a felony charge.
    The prosecutor promptly threw it out of court. In fact we never even went to court, but it still cost me $5,000 and a 2 weeks of mental anguish wondering if I was going to have to give up my firearms.

    I have a BCD for less than a qtr of weed. I was stationed at Fort Lee and there was a big drug problem at that base. I was accused of selling cocaine, which I had never even seen at that point in my life, facing 78 years. Now I am a felon with no rights.

    To those saying that there's no such thing as a victimless crime: in NY or CA, it's a crime to have what they CALL an "assault weapon". They CALL a rifle with a single piece of plastic in the wrong place an "assault weapon." A single piece of plastic. Please explain to me what "victim" is affected by that piece of plastic being on a rifle as a crime.

      There a large number of AR15's and other "assault weapons" in California that are legal to buy and own. Go to any Turners Outdoorsman's store and see for yourself!!!!!

      That's the thing, they aren't "assault weapons" by the law's flawed definitions, so they're legally sellable. But if God forbid you change a certain feature, all hell will break lose and children and TSA agents and feelings and shoulder things that go up…

      … because (in the eyes of the guys that make these laws), if you make it into an "assault weapon" it will immediately control your mind and make you rape churches and burn women and stuff of that nature.

    What part of "shall not be infringed" don't people seem to not understand?
    If you make exceptions from taking the rights away from some people, then what is to stop those rights being taking away from you one day?
    The National Firearms Act of 1934, Federal Firearms Act of 1938, Firearm Owners Protection Act of 1986 have already taken those rights away from millions of Americans and make it likely that the right to keep and bear arms will be further infringed in the future.

    I had two domestic violence no contact violation felony's back in 2000, I petitioned the courts last year to restore my rights to own a gun and not only did I get my gun rights restored I was able to get my cwp. Check the laws in your state because it might be easier than you think to get your gun rights back! I filed the petition myself and the total cost after paying for the background check, paperwork and court costs came out to $425

      No Constitutional authority granted by 'the People' to government to disenfranchise any free man his inalienable rights. The Court held that the right of an individual to "keep and bear arms" protected by the Second Amendment is incorporated by the Due Process Clause of the Fourteenth Amendment and applies to the states. [McDonald v. Chicago, 561 U.S. 3025 (2010)] I still do not know how the government can disenfranchise a felon of his right to bear arms. The inalienable right ratified in the second amendment, nor any part of the Constitution does not say a felon can't own a weapon. My question is, why can we disenfranchise a felon of his/her 2nd amendment rights for life, even if the crime was unrelated to violence? Such as bank fraud, or embezzlement. It is a right, not a privilege. Secondly, and more importantly, if we can disenfranchise a person of their inalienable rights, well then why not their other inalienable rights such as their first amendment rights? Why can't we tell a convicted felon to shut up? Why can't we take away their right to peacefully assemble, or practice religion, or even basic free speech? Why can't we strip convicted felons of their 4th amendment rights, and give police the power to pat any convicted felon down, warrant or not? If you have a logical answer as to why their 2nd amendment and inalienable rights can be disenfranchised away, I hope you have a logical answer as to why their other rights CANNOT be stripped away.
      How is this not discrimination of a free man who has served his time for a crime and then forced to live with a life sentence of having some inalienable rights infringed upon him? How is this not double jeopardy? Where in the Constitution does it say that government can disenfranchise a citizen of their inalienable rights after they have paid for their crime? Where in the Constitution does it grant authority to government to wield the power of granting clemency over a free citizen [who must submit an application asking for their rights] in order to restore his/her inalienable rights after having served their time and released a free individual?

    The problem with the knowing right from wrong argument concerning the law, is that often, laws have nothing to do with what's right or wrong. America is filled with cumbersome, useless laws that don't do anything but make money for the government.

    The biggest problem with this situation is that gun shops are following the unconstitutional rules. The sellers should be the ones refusing to follow any law that is unconstitutional. The store owners are the ones forcing the public to comply by refusing to recognize our rights. Can’t respect a gun store owner or employee that doesn’t respect my rights.
