Signing an affidavit falsely is illlegal, and depending what exactly the affidavit the loss prevention officer signed, it could be a crime. (I did not say that in my original post, but since you’re going there…)
I have seen many cases where loss prevention officers testify that “I observed suspect enter store, select items, conceal items, and proceed past checkout with items” or some combination of that. Almost always do they state that they observed the suspect entering store, presumably without the merchandise… In this case, they did NOT go back to the entry point or they would have seen him prepay. I do not know what is worded on the affidavit that they personally signed.
Snatch and runs for thousands in merchandise are ok, but paying for your items is against the law? Riiiight!
They don't care what its doing to the person.
That officer is told that he has the receipt, but does not allow him to get it, and locks up him and his son for nothing.
People die in jail, and are traumatized by even one night in jail.
Innocent lives are ruined every single day by inhuman, callous and corrupt cops.
Sue, Sue, Sue
Meet today's winners of the 'unlawful arrest lottery'.
Qualified immunity
Hey David what do you think??
I say, 375 grand,
I don't understand drug addicts and straight up thieves are literally walking in and stealing thousands in merchandise and this poor innocent man gets arrested with him son ??????😢
I know right? They can immediately identify this man and his sons but they magically can't identify thieves that actually steal from their stores on a regular basis.
@@chorlesteajones6794 That was my first thought.. They stole stuff, but you know exactly who they are and where they live? So, did they pay with credit card and you are super stupid?
What happens at Walmart in Los Angeles has nothing to do with what goes on in Forsyth County.
Wal-Mart has too much influence
Not our fault you get all of news from facebook comments and daily wire videos.
From my years of working retail you never approach a suspected shoplifter after they leave the store. Its impossible to prove he stole it. This will be a nice lawsuit.
And this is why I ALWAYS get a receipt. It would have taken them like 10 seconds to let the man or someone else in his family get the receipt or show the transaction on his bank card, if he used one. I can’t even imagine how stressful it must have been to spend a night in jail 😮.
I want the update titled "Man wins big against Walmart after false accusations." These types of false accusation are very common.
Don't forget the city!!!😃
This is an example of the absolute worst example of security work. You NEVER acuse someone of shoplifting if you have not seen the person the entire time they were in the store. This is extremely poor work and likely extremely poor training.
100% agree, and the cops should have requested and viewed it before issuing a warrant. Double screw up.
It is Walmart, should we expect anything different?
They rely on their cameras instead of walking the floor and watching in person. THATS the training their getting...
Sue them in court
someone half-assed their job at walmart security AND half-assed their job as a deputy. time to sue and, at least, make them accountable for half-ass work that causes this to happen to innocent people
Never underestimate a cops ability to make matters worse.
Ill say.
what are you, a serial killer or someone who supports them?
You said it right...
And how did the police make matters worse here. Walmart filed a false theft report. They’re the ones who created the problem and were too lazy to check the register tapes. Now the police officers were also lazy.
Ignorance and arrogance should cost the police department thousands of dollars. Failure to correctly investigate a crime is actually a crime.
It comes out of tax dollars
Good... tax payers elect the police chief.
@@SanchoSanto Police chiefs are appointed, not elected. You're thinking of the Sheriff.
should its the key word - but "failure to correctly investigate a crime" isnt a crime according to practiced law - failure to investigate wont overcome the qualified immunity cause a reasonable officer could likley be wrong in the investigation -
Thats the problem today - in the past it was likley more servier but technology make as aware of the behavior and praticec of LEO across the US.
The practiced Law hasnt changed and the standard frase of "we investigated ourselve and found no wrong doing" is the outcome of most instances of investigation into wronddoing of cops.
Also the behavior of wallmart for "wrongfully reporting a crime" wont change soon cause the cops wont do anything about it. And even if they do something and decide to charge wallmart mostlikley the prosecutor will decline to prosecute -
wallmarts are reported to be hiring active duty cops in there freetime to provide security and this relationship could be seen as potential a conflict of intressed but no one is botherd by it
@@tasker6669 lets poke some holes in what you wrote.
"failure to investigate" its not a failure to investigate because cops were shown a unedited video that shows a man enter walmarts garden section where they keep the sand. load up 7 bags then immediately leave. this is even said in the video but not show for some reason.
then about the cops going after walmart, yes there was negligence on their part but the cops would have to prove malice for falsely reporting a crime. so more than likely they wont do that because there probably wasnt any malice on walmarts part only negligence. if there was risk for criminal prosecution for reporting a crime and being wrong then people wouldnt report anything. but it is a crime to falsely report a crime because it was done maliciously
I'll add this to the pile of reasons I will never shop at Walmart. I hope this man and his son file a lawsuit against Walmart and the Sheriff for this false arrest. Outrageous!
How did Walmart know who they were to issue warrants for? Were they recognized and known by somebody? If they had records of when they paid they should have been able to see what they paid for,
I think the theft prevention dude needs to be fired , sued along with the walmart and the cop for not taking the time & allowing the man to get the sales slip. Cha Ching 💰💰💰
Cops are NOT your friends
fired? he needs to be in prison. Firing is nothing, suing is nothing. Selling away justice for a settlement is approval of what they did to those men
If cops actually did their job and "investigated" prior to arresting someone probably 90% of innocent people wouldn't be arrested. If a man tells you he has the receipt (which is proof he paid) why would you not want to see it?
Because they're idiots.
Imagine being a judge and giving out a warrant for someone stealing sand....they must have nothing to do.
big difference between a mistake and complete incompetence....sue the crap out of both
I wonder how many people are rotting in jail on false arrest
A lot more than you think
A lot people in jail in Atlanta prisons have not been formally charged with a crime! They have not seen a judge or been offered bond. Their lives have been destroyed for nothing.
There are stories where Judges were getting "rebates" from private prisons.
There is a story where the sheriff was in charge of the prison budget. He embezzled the money and bought himself 2 properties. What he did was completely "legal" where he lived.
With all the democrat judges I'd say many! Democrats love to make important decisions based on emotion rather than honesty & logic.
How does whatever Walmart allege get turned immediately into an arrest warrant? That is a lot of power to get immediate and complete credibility over someone's life. The detective following up the next day after the arrest should have happened before a warrant was signed by a judge. Half-ass work at an innocent families expense. Hopefully a large settlement can prevent future incompetence.
Do large settlements EVER stop incompetence? There is never any PERSONAL accountability, and also never ANY changes in procedure.
The money ALWAYS comes out of deep pockets and is considered a cost of doing business.
Our society has LOST the concept of PERSONAL RESPONSIBILITY for wrongdoing. Performing official actions NEEDS to have Personal Danger involved to make it SERIOUS ENOUGH that all parties tread carefully and deliberately. For all of the risk and damage to be one one side of the equation is NOT justice.
4 magic words: we got a call
@medbob1 we don't have a justice system. We have a legal system. A broken, corrupt legal system.
If I was the guy who was arrested, as soon as this was cleared up I'd get a lawyer and tell Walmart that I've always want a Walmart of my own.
He should file a lawsuit against Walmart and the sheriff’s office for illegal detention.
Why doesn't Wal-Mart spend half this much effort to get those groups of crash and grab shoplifters arrested and prosecuted? They've got them on video too but in their case there is no question at all that they are shoplifting.
EXACTLY!!
I once kind of shoplift bananas from a Wal-Mart near me
That would be racist..😂
demographics
optics.
It’s unfathomable that a corporation as big as Walmart does not take the necessary steps and due diligence before filing a complaint against an innocent father and his children. This incident shows the security at that store needs to be retrained or even held accountable for their ineptness.
This is NOT on Walmart but on the Walmart AP who failed to follow the AP policies in opening a shoplifting case. Had that AP agent followed Walmart's directives this story would not have ever happened.
The AP directives by Walmart are the due diligence you assume they don't have in play.
It's the managers fault.
its really sad because they were not under any rush to review the video, they literally had all day to make sure they were right and failed.
@@EvilAnomaly The AP is a representative of walmart, which means walmart is ultimately responsible.
If you can avoid shopping at big corpo stores you should, because you are getting exactly what you pay for, low quality food which will give their big pharma buddies repeat business.
Walmart is the worst corporation in the world.
the incompetence of Walmart employees plus the corruption of the blue Line gang equals DISASTER for good citizens!
Walmart treats every customer like a crook. I had a cashier's assistance ringing up a tv one evening and before I could even walk 10 feet from her register a man who watched me pay for it asked for my receipt, then 3 feet beyond him another man asked for my receipt. I told him, "No, all three of you watched me go through the cashier's line and pay. Call the damn cops. I'll be in the gray Ford f150."
I literally HATE Walmart!!
DON'T Shop There ,,Then !!!
@@BigTony2Guns I DON'T!!!

@@ShalomUSA --Can Sue Walmart --But NOT the Sheriff Qualified immunity has protected law enforcement officers and other government officials from being held accountable when they violate people’s constitutional rights for decades. The doctrine of qualified immunity allows state and local officials to avoid personal consequences related to their professional interactions unless they violate “clearly established law” and has been repeatedly used by police officers to escape accountability and civil liability for engaging in violent and abusive acts against the public. In practice, this often means that, unless there’s a case with nearly identical facts on the record, these officials can violate a person’s rights without being held personally responsible for their actions.
NEVER buy electronics from HackMart. they all made deliberately cheaply. AND if you bought the Warranty, they don't even honor it! learned my lessen the hard way! learn from my mistakes, Avoid Walmart's circuitry!

Walmart: Oopsies, our bad. Sorry‘bout that. We good?
The damage is done now you and your son have arrest records. The idiot cop should have waited for you to get the receipt to avoid your having this on your record. Sue both and your son's college is paid for.
Thank goodness for Fox 5's investigation into that very upsetting miscarriage of justice!
The part that they don't tell you is that even if the arrest is expunged from your record, an arrest still shows up on your record. You'd still have to explain what that arrest was for.
So, it is still a hinderance when it comes to getting credit or applying for a job.
Not true. This was actually explained in an episode of judge joe brown by the judge to a young man that was screwed over by the law.
I hope these people hire a lawyer and sue for a lot of money, and I hope they win the lawsuit. This is just very very bad policing.
He should sue everyone
Sue them, PLEASE.
