Even if his guilt was evident upfront, that's an even better reason not to allow this situation to occur. A guilty verdict for a clearly guilty criminal being thrown out on the basis of a technicality increases the likelihood of a guilty person getting away with their crime. The judge and prosecutor should know this and avoid such a conflict at all costs. The weight of the defendant's guilt is also irrelevant for the appellate panel as they're not triers of fact. Rather, their main reason for existing is to ensure the process was fair and proper; clearly was not the case in this matter.
I cannot find the actual opinion anywhere, but the Oklahoman news site has a much more detailed story on this. The relationship ended two years before the trial. The dissent said the conduct was unethical, but there was no evidence presented that it affected the trial.
I once saw a judge recuse herself from a case because she recognized either the plaintiff or a witness (been awhile) as a member of her church. She explained to all interested parties that she didn’t know the man and that (theoretically) it wouldn’t color her handling of the case - BUT she said that she was obligated to assiduously avoid even the *appearance* of impropriety. So all involved filed out of the courtroom and they had to re-schedule the trial before a different judge. She was awesome.

And the kicker was that the appeals court didn't want to grant new trials because they had " fair trials " the first time ! My partner at the time criticised the writing for being unrealistic. I disagreed and said that it was entirely feasible. Glad I have been proven correct.

I am long retired. I had one judge (IN A TWO JUDGE FORUM) with a fiery temper. No rumor of him having zipper trouble His courtroom was one of many in my fairly busy practice. I always had to tell my clients that he was going to yell at somebody that day. He had a copy of the Rules of Evidence on his bench and frequently had them in a cocked arm like he was going to throw them --he never did to my knowledge. I frequently took my paralegal who wanted to be a lawyer, to hearings so she got a taste of what it could be like. She did become a lawyer, but never took a case in that forum.

She seemed strangely hesitant but she said that she would, the next day I was called into a conference room with like all the managers in the company including the owner the owners daughter the HR person my direct Superior plus others. Just recently I learned that an affair came to light between that HR person and my direct Superior. I kind of feel short-changed to be honest, but, also glad that I was gotten out of there in hindsight, because I've worked with a lot of people at my new company who got fired from that other company, and I guess most of the management has turned over

Because of all these horrific stories Steve tells, I have prayed I never ended up in a criminal court knowing the bias and corruption involved... but I have also witnessed first hand corruption when going into Traffic Court when an Asst DA actually threatened be before going in front of the Judge with a larger fine if I decided to contest a poorly written traffic ticket.... yes, I was being "tried"... I was not informed by the DA's office or the Court that in Maine "Traffic Court" is an actual Trial Event, not some lower Traffic Court where it's you against the Police Officer that wrote the citation.
They usually resign so they can retire and keep their retirement income. Don’t think for one minute that there isn’t some relationship between judges and prosecutors. I’m not implying that they are sexual/personal relationships. The problem that you have is that they are all in the same business. So one benefits from the other. The lowest guy on the totem pole is the cop who makes the arrest or files charges. The person who is least qualified to understand the law. Again the prosecutor wants to support the cops and at times they add extra charges so yeah in the event this individual can’t robustly defend themselves, they can give some of the charges away and get a plea deal. This benefits the system including the judge because all he has to do now is put his signature on it. Always follow the money. In my county there is only one judge who castigates the district attorneys office. With misconduct you would think that all of the judges would sign on to the opinion for example that people are not being brought to trial in the allotted time. Why rock the boat.

During a 15 year child custody issue one of the opposing counsels regularly went horseback riding with one of the judges in my case. He ruled against me (father) and had the bailiff haul me out of court when I tried to get a word in edgewise. I yelled "asshole" at him on the way out. Their relationship was not sex but it still counts... Word about the incident got around the courthouse and many attys were envious of me.
This seems to be the norm in this state. It's not as bad as Lousiana, or Texas, but it is still very corrupt. Thanks for bringing this up since it didn't get much air time here in Oklahoma. That being said, the defendant in this case was guilty as sin, and got the right sentance.
That's a really easy problem to solve. Pass a state law where any judge or attorney who fails to disclose a conflict of interest or inappropriate relationship that leads to a trial being thrown out is personally financially liable for all time and expenses occurred by every officer of the court involved in the trial-- up to and including plaintiffs, defendants, witnesses, and jurors. The first time one idiot has to pay, the problem will end
I am concerned by the two who DIDN'T think this should be overturned. Where are their heads at? And who will pay his attorney's fees? The mere fact that he must pay for two trials prevents even this from being justice. If there were justice to be had, the prosecutor and the judge would pay both side's expenses in the new trial.

there should be a federal law that if these types of cases are found out and a judge should have recused theirself, the state should be able to sue the judges for the cost of the trial and be made to paid for both sides of the case
par for the course for the modern US criminal system: judges and prosecutors often behave as if they're more than colleagues, but rather allies. Shockingly common is the appearance of unjust bias in favor of the prosecution. There's a reason the Prison Industrial Complex exists, and is SO successful.

I think that courts are so hesitant to overturn criminal convictions for any reason that the fact it happened is quite a smackdown.

I was not informed by the DA's office or the Court that in Maine "Traffic Court" is an actual Trial Event, not some lower Traffic Court where it's you against the Police Officer that wrote the citation.
They usually resign so they can retire and keep their retirement income. Don’t think for one minute that there isn’t some relationship between judges and prosecutors. I’m not implying that they are sexual/personal relationships. The problem that you have is that they are all in the same business. So one benefits from the other. The lowest guy on the totem pole is the cop who makes the arrest or files charges. The person who is least qualified to understand the law. Again the prosecutor wants to support the cops and at times they add extra charges so yeah in the event this individual can’t robustly defend themselves, they can give some of the charges away and get a plea deal. This benefits the system including the judge because all he has to do now is put his signature on it. Always follow the money. In my county there is only one judge who castigates the district attorneys office. With misconduct you would think that all of the judges would sign on to the opinion for example that people are not being brought to trial in the allotted time. Why rock the boat.

Bristow Oklahoma judge was using a " pocket pal" while people were before before him. What a sicko. You should do a story on a lot of Joklahoma judges! 😂😂😂

Thanks for mentioning 2016 Oklahoma's Holtzclaw case being ruled by this corrupt judge. I think this is the time Oklahoma revisits the whole mess and the whole state prosecution system. Oklahoma is the US Gymnastics of the police world.
During a 15 year child custody issue one of the opposing counsels regularly went horseback riding with one of the judges in my case. He ruled against me (father) and had the bailiff haul me out of court when I tried to get a word in edgewise. I yelled "asshole" at him on the way out. Their relationship was not sex but it still counts... Word about the incident got around the courthouse and many attys were envious of me.

This seems to be the norm in this state. It's not as bad as Lousiana, or Texas, but it is still very corrupt. Thanks for bringing this up since it didn't get much air time here in Oklahoma. That being said, the defendant in this case was guilty as sin, and got the right sentance.
So the lesson is: If you're schtupping the prosecutor, you better be schtupping the defender as well to avoid _ex parte_ interactions. Got it! 😋

That's a really easy problem to solve. Pass a state law where any judge or attorney who fails to disclose a conflict of interest or inappropriate relationship that leads to a trial being thrown out is personally financially liable for all time and expenses occurred by every officer of the court involved in the trial-- up to and including plaintiffs, defendants, witnesses, and jurors.

I am concerned by the two who DIDN'T think this should be overturned. Where are their heads at? And who will pay his attorney's fees? The mere fact that he must pay for two trials prevents even this from being justice. If there were justice to be had, the prosecutor and the judge would pay both side's expenses in the new trial.
The judge would have to balance things out & sleep with the Defense attorney too! Not just the prosecutor then its ok. 😂 then you can say "holding all things equal". 😉

Back in 2020 there was a family court judge who was alleged to have entertained and drank, in her chambers in a Kenton County courthouse in KY.
The judge voting against a new trial should be investigated.
there should be a federal law that if these types of cases are found out and a judge should have recused theirself, the state should be able to sue the judges for the cost of the trial and be made to paid for both sides of the case
par for the course for the modern US criminal system: judges and prosecutors often behave as if they're more than colleagues, but rather allies. Shockingly common is the appearance of unjust bias in favor of the prosecution. There's a reason the Prison Industrial Complex exists, and is SO successful.
