      You're absolutely correct, it is promoting equality. This law really applies to those who have severe conditions such as pcos, fibroids and Endometriosis (as the video clearly states you'd need a doctor's note to benefit from this law) that cause disabling pain and other associated symptoms that impair daily function. Therefore, these conditions can indeed be considered a disability under the equality act 2010.

      @@TheGQBrotha as the video states, you need a doctor's note or letter from a medical professional proving that your menstrual pain is indeed disabling. Many people have conditions such as pcos, fibroids and Endometriosis that cause severe and debilitating pain resulting in loss of daily function. This is ultimately for those who suffer from such conditions that could be considered as a disability under the equality act 2010. Therefore it cannot really be abused, since you'd have to qualify in the first place as having a condition that causes such extreme pain. I hope this makes sense.

      @@TheGQBrotha People abuse the system all the time, men included. Without diving into it, I would guess men are more likely to exploit paid leave. Doesn't mean you get rid of the system. It's needed. People need security when they're injured or sick.

      Yes you would, since you cannot discriminate those who have disabilities. This law applies to those who suffer debilitating menstrual pain caused by conditions such as pcos, fibroids and Endometriosis. You actually need a doctor's note in order to be entitled to make use of this law, as the video states.

      @@ageorgiev89 I think you know the answer, so I'm not too sure why you're asking me, but I'll make it clear for you anyway 😊 unless you have another candidate who is more experienced or highly skilled than the candidate who menstruates, then you would be at risk of discrimination if you didn't employ the person who menstruates - especially if they have a genuine medical condition causing severe menstrual pain therefore inability to work on certain days, just like any other medical condition causing flare ups. Hope that makes sense

    Imagine, 4 restaurants staff and all female
    And 2 of them happen to have menstrual at same time, 2 of them will be on leave, so this resulted companies potentially crippled
    Doctors can be paid to give them Leave certificates
    I can always tell my doctor” im in severe pain”

    Not the wisest decision. Someones gonna pay for this from some other sector. Three days off with paid leave every month for a year for nearly half the workforce. That's a loss of productivity. How will the government account for it.
    I'm not against the idea of some sort of medical relaxation policy for women, but this is absurd. What's next? School only 18 days a month for girls who reached puberty?

      I honestly think it will not be so bad, though, because I think a degree of pain warranting a paid leave from your job does not affect 30% of women, as was said in the video. I have only ever known two individuals, who suffered from such severe pain, and this might have been more like 2% of all women I've known. I think 30% is a gross overestimate.
      On top of this, you will only have significant productivity loss in sectors where the workforce is treated badly, is overworked and/or unmotivated. In the field of academia, for example, people tend to work much more than they are paid for and are highly competitive and motivated. Because of the huge flexibility they have in that sector, they will be able to relax when they really cannot work and then make up for it on a Sunday. This is common practice already.

    Image you're an employer: would you choose a guy who's available 30 days a month or a woman who might take a paid week off every months if we so wishes? That's like 25% of her productivity down the drain. This way you're only gonna get more discrimination against women.

You will need to hire more staff overall which with government compensation is neutral at first but you need more space/clothes/equipment as well. Different and more strict labour laws might apply if your business exceeds a certain amount of employees. There's a lot of Potential disadvantages which make the law controversial

      Clearly flow is not an employer. If so it's very few employees. No one running a business looking for a certain amount of production would even consider such a thing. You're going to lose out on that production and have to have another employee to cover for an employee you're still paying. Where is the common sense in that? You will be forced to raise your prices and be less competitive in the market or hire a man.

    So this essentially amounts to what is a special right for women, no longer about equal rights. They could be doing the same job as a man but get paid the same for working less each month after month. Meanwhile men will have to pick up the slack for the missing female employees.

      Are you taking into account the fact that the stigma around a very normal bodily function would cause many more women to never even consider taking this leave? Even if they suffer from debilitating pain every month? Also, don't worry. I'm sure companies will try their best to let women know *subtly* that if they want to keep their job, they should just grin and bear the extreme discomfort and pain they're in.

      You're wrong. It literally says in the video that you'd need a doctor's note in order to be entitled to benefit from this law. You'd need to prove that you suffer debilitating pain and disabling other associated symptoms. Examples are PCOS, fibroids, Endometriosis

      Anyone can take advantage of sick or injury leave assuming they can get a doctor to sign on. Paid leave is 60% of wages. It would only affect a very small percentage of the workforce, and even some of those will probably work through it. Your comment is absurd.

    Taxpayers pay for all of it. So no, employers nor the government will pay for it. If I drop a hammer on my foot do I get to take indefinite leave? So we want women to get equal opportunity UNLESS, paid time off each month is available.

      Yes, you get injury leave and compensation if you drop a hammer on your foot. Menstrual pain doesn't affect the entire workforce. According to one study, menstrual pain was reported by 84.1% of women, with 43.1% reporting that pain occurred during every period, and 41% reporting that pain occurred during some periods. According to a women's health site, 5 to 10% of women experience pain severe enough to disrupts their life. I'd imagine it would be a small percentage of women who would take 1 or 2 days off per month, with a slightly higher percentage only when needed.
      Spain already has 30 days of paid leave per year for everyone. 15 days for marriage, 2 days for family death, maternity and paternity leave of 16 weeks and some of it can be divided or reduced hours, 1 day for moving residence, longer if required by employer, and a load of other paid leave. Sick leave is paid by the employer at 60% of wages and reimbursed by social security.

      As I understand, that is already the case that you can ask to leave if you have a proper reason but actually had to be a proper medical problem and menstruation wasn't in that category of reasons. Even if you had an immensely painful menstruation, that was not a proper reason so now this law change allows women to leave if it's really that unbearable.

      Then you could get sued for discrimination 😊 as the video states, you'd need a doctor's note or letter from a medical professional in order to qualify for this as this law only really applies to those who suffer such extreme menstrual pain such as from pcos, fibroids or Endometriosis which can cause severe and disabling symptoms and can iindeed be classified as a disability under the equality act 2010.

      The period in the menstrual cycle lasts 3-7 days, let's say its starts on a Friday, lasts 5 days and the woman is honest, this means she will be off work until the next Wednesday or Thursday, paid, that's if she's honest. Now if you run a construction company or car mechanics, where the vast majority of workers are men and the secretary which is probably the only female takes a week of every month (that's 3 months a year) it may not be that bad. But if you run an architects firm like me, or supermarket, gym, school, etc where 50%+ of the workers are female, this adds up.
      And OK supermarkets and gyms can do without their employees, but my practice (as with others) works by strict deadlines, so it's not helpful that 2 of 8 employees on a project are claiming leave, paid as well, because of something natural.
      So how about I save myself the future trouble and just not hire women? This is the reason why men didn't want women to work, I'm sure women have been complaining about their periods from the beginning, so men were like "don't worry stay home, I'll work" but now you want to stay home and receive money too? 😅 Come on, the worker is owed what's due, not you can stay at home and receive payment although nothing is wrong with you.

      I won't hire women in a country that allows women to have paid menstrual leave, its my business I can do that.
      And if it falls on the weekend, which the period is 7 days of every 28 days, meaning they will have a week off, that's 13 of 52 weeks off, ¼ of a year. And in my design practice that's a lot of time.
      And OK that's personal, what about schools, hospitals, police force, etc which all have a high percentage of female workers, every month ¼ of the workers will be at home for their time of the month? Which means these industries will have to find more workers which they already struggle to find workers as is.
      And unless they find males to replace them or women that have been through menopause, it just takes up more revenue.
      And let's face it (I'm going to be really blunt) most men are better workers then most women. I've seen it practically, all through school, work and the real world.
      If women want this equality to mean anything then they should be willing to take on equal responsibilities, otherwise they should stay home bare foot and pregnant.

    It doesn't matter if the government pays or not...what matters is the increase in workload on the men left behind. Will this cause physical and mental stress on men trying to balance the workload while these women take holidays. Will this raise work related deaths due to stress on men? And Yes, its a holiday...can men who suffer sore muscles everyday in the labor force take a recovery week off when they are in great pain from this? No, you replace them with men capable to do the job. A sick woman has no place being a burden on employer and or society. Stay home if you know you will effect all around you. First women ask for equality...then they want to do only soft work, now they don't want to work as their bodies engage in normal activity. This is why "primitive" man and woman put the woman at home where safe and not effecting all around! How long before fools today realize equality between two different sex´s simply is not possible...and there has to be some degree of rational thinking rather than alternate reality. We have equal brains... but physically we are water and chalk. There is no equality!

    So equal pay for less work. Yeah, that's a great idea. You just wouldn't want to hire someone who took off 3 to 5 days off each month and you were forced to pay them. It doesn't make any sense because companies would be less profitable by hiring those staff members.

      Companies already hire people with numerous medical conditions to do their jobs, this is no different. This isn't for every women going through period, again, as per the video, you need a doctor's note that your period is the type that hurts so much it impairs your work performance.

    1. Technically. It's nothing new. Your doctor could have always given you a paid leave. But, as this is funded by the government, the doctor would have to specify that it's because of menstruation. Basically feeding your medical and private data to the employee.       @GapYear Thing is in most of Europe they already can take these days off without bigger problems. There isn't excactly a Limit to sick days and paid sick leave exists as well
      The fear here is employers realising/fearing that women could call in sick like clockwork which for an all female workplace would bloat your staff requirements by 10-25% in the worst case.
      And those fears were not brought up by conservatives but by members or the spanish socialist Party, Union leaders and the Representative of the Network for those that suffer from Endometriosis. So opinions on this are VERY split

If someone doesn't go to work for several days, every month, that's a giant problem, even if you don't have to pay that person. I am not saying women should go to work if they have actual pain. I am just saying, it doesn't solve the problem for the employer. Probable consequences are that men will be preferably hired and more likely promoted. Another negative consequence will most certainly be, that some percentage of women will take advantage of this. I mean, you don't have to prove it and you are offered to work maybe 1/4 less for the same pay. Some will abuse it.

      The thing is that paid or unpaid the pain is there, and the women who suffer from it will take the days off ,anyway. Also, stigma towards women exists, here is someone who couldn't find work for a year because she had no help for her baby .       @@JM-zg2jg I agree. Infact, in my personal comment to the video, I stated that I believe this law should privilege women with conditions such as andometriosis, for example. I have worked through period pain with no problem my whole life and only sometimes I had to take sick leave because of it...I understand that a lot of people will just use it to their advantage, so it should be very carefully studied and researched. The idea is awesome though. Its a natural thing and trust me most women can't wait for it to be over to enjoy their lives...its not just the monthly thing but also the hormonal imbalance...its horrible, nature was quite cruel to us XD

    In one of my previous jobs we had a woman who use to regularly take sick leave because of menstrual pain.
    The thing is this is in a IT department so everyone except her was male and no one questioned little details. For example these menstrual pains happened the day after she had been out drinking and partying, also it wasn't monthly, sometimes she would suffer menstrual pain on a weekly bases.
    The head of IT never questioned her about her menstrual pain. Weekly menstrual pain always after you've been out drinking, is a bit strange.
    This happened in the UK, where British law gives people sick leave, so why can't existing laws about sick leave cover Spanish menstrual pain?

      While ur case sounds legit, i used to have really unpredictable periods
      Sometimes every 2weeks, sometimes every 8weeks. Id b fainting throwingup n diarrohea from the pain, was no way i could work those days. If i had issues from boss, doc supported me with my history n all was well. Im in UK. I can see some abusing this, but im glad for those like me n as long as there are checks n balances, such as historical data from doc to support, i think this is a good thing

    It's a medical condition that women have. It should be treated as such but also not ignored.
    I know only two women who have it bad. But really really, debilitating bad.
    Likely, because of the stigma that will probably come from it, few women will take it in the beginning. It would be good if option of teleworking is there for those days as well.
    Depends on the job of course, but occasionally when I had it worse than usual, I would have given a lot if I could have just stayed home, in darkened room and answered my emails from the bed.

      @GapYear no you don't. Many people find it strange to go without their Period so most solutions are designed to let them have a period once a month, but it is not required at all.

    My uterus was severely tilted. My periods were like childbirth. (I have two kids, so I can compare. Not as bad as transition, but everything up to that I felt every month!)
    I had doctors notes to keep me out of marching band practice, but the one female director told me I couldn’t ever sit out because “periods aren’t that bad.”
    Do not judge someone else’s pain level. I promise you, you know nothing.
    Hooray for Spain! Now make it law, Folks! 🎉💜

      Yea I understand your feelings. I sometimes just feel sad when I work, so I should get mental health leave. But they just tell me I'm lazy

      the issue are the women who will take advantage of this law but aren't in as much pain as you. the employers will stop hiring women, bc they cost too much to employ if they are taking a week off each month.
      this will hurt women in general a lot, especially those who are truthfull about their pain and those who are willing to work despite their menstruation afterall its easier and safer to just hire a man.

    This should be law everywhere. Where are those feminists now that fought for their rights ?i dont think women were meant to work,thats why they didn't before. If it's not pain to the point of throwing up then its super tired,bloating and lethargy before your period, seems each age we go through something different, no matter who you are. My FAVOURITE thing in all these comments from men saying it is rare for women to have problems during PMS. Assuming most of these men live in spain, most of them must not have been raised properly to respect women.

      Not victimized in any way. I just oppose identity pollitics, sexism in this case. This compensation isn´t for unequal career opportunities, but for the inconvenience of menstruating. Let´s not muddy the waters.
      Since women tend to live 5 years longer than men, nature already compensated for that at the tune of 4 days a month. So this is a non-issue solved by yet another divisive law.
      It still may seem unjust, to swap free days in their prime against free days as an elderly citizen. But then again, during menstruation women are partially incapacitated too. That´s why this bill was introduced in the first place, wasn´t it?
      So how does this not even out?
      (Raise your hand if you consider every woman a victim that needs to be compensated in any which way :)
      Of course, women who have severe pains should be compensated for, just like people with diabetes or migraines. But that goes without saying.

    I think this is a VERY good idea. I knew someone who had PMDD and she was practically incapacitated due to her extreme period cramps; this would make things alot fairer for women who have to go through this.

      It would make it easier for some women but fairer? Is it "fair" if you get paid the same for working let's say 3 out of 4 weeks per month, as someone who literally works 1/3 more?
      Being nice and being fair are not the same thing.
