I am in a very similar situation: I am british and met my turkish partner while we were both studying in the UK, we then both began postgraduate studies in the UK and lived together for 4 years. After her student visa expired she was forced to go back to Turkey and we have been long distance for the past several months. I have been looking for a graduate job, so she can come back, we can get married and then after 6 months of me working she can apply for a spouse visa and look for work herself. We could settle down and start a family and career. All of that has now been ruined and there doesn't look like a way out, or a feasible alternative, except moving out of the UK which is also extremely difficult - all just to be with the person I love and want to spend the rest of my life with.
I basically had the exact same situation which you're now describing but with an Azeri national who studied in Bristol. At the time (2018) it was an extremely stressful process for us but at least the spouse visa was an option for with the lower salary threshold. My heart goes out to you. Can only imagine the agony you're going through.
Me too ,we were so lucky I married my Norwegian husband in 1979 as soon that happened he was allowed to work and live in England. 1996 he wanted to go home so we just packed up and moved to Norway no problem. I feel so sorry for people who want to move to England to be will the one they love . Saying that I will never move back I just don't recognise my home , the government is disgusting and just in it for themselves . I have never seen so many poor people living on the street and it's getting worse. It breaks my heart .
We applied for a spouse visa in September which was refused as we neglected to include an important document and they don’t contact you during the process even though the guide they use say that they should. So now we’re appealing and after starting that the announcement happens that you must earn £38k. If the appeal fails I’ll be left with no choice but to leave the uk. I earn £26k and have worked for 24 years since leaving school, always paying taxes, NI etc and this is how we’re treated.
See if you can get a lawyer. But the same thing happened to us, our visa application was denied and then we had to pay the NHS surcharge on the subsequent application which we wouldn't have had to pay on the initial application. We had to stay in London because the pay was higher there but it meant a lot of the choices we had were limited because it only counted his salary, not my salary whereas when we applied for the same visa in the USA it counted both of our salaries. Other countries aren't like this and I don't know if I would say it's worth staying here.
The question of marriage visa's in general is understandably complex and divisive, and with the ubiquity of internet romance will probably become even more so. But in this particular instance, and instances like it, it's absurd. It's not like they've fallen in love across continents, and decided that they would like to live with each other. We already let this guy in, he fell in love with a local whilst here legally, and now we're going to tell him he can't stay? Are we going to demand of any temporary immigrant that they are not to date citizens, just in case they fall in love? Untenable. Even a very moderate position should surely treat this kind of situation as different. If you've already been granted a working visa, and have been resident, then the threshold should not apply for the marriage visa.
Well, moving back to Britain is off the cards for me now. I currently live in Asia, with my wife who's Japanese (been together 7 years and married for 3) and our son who just turned 1. It was always nice to have the option to come live in Britain at some point so my son could be around his English side of the family. But, it would be impossible for me to get a job that pays that instantly. So it's either come back with my son and leave mother behind or just stay in Asia. If you believe this measure is appropriate for Britain, you would presumably believe it's appropriate for any country. So you could quite conceivably end up in a situation where Japan (or any other country) implements a similar measure and neither partner can ever earn enough by themselves to sponsor their partner to live with them. You could easily end up with a situation where the only way for certain families to be together is in a third country that would agree to have them both. The Tories are deliberately splitting families up in a way that would more commonly happen in times of war or economic disasters. The reality is that loads of Brits are only allowed to stay with their partner and children because of the more reasonable policies of other countries. The principle of a spousal visa was always supposed to be to check whether the relationship is genuine, so that people can fake a marriage to get into a country. Make no mistake, if you're a British citizen who has a perfectly respectable job earning something like 30 grand, they also see you as a burden.

The level of financial threshold has always been high in these circumstances - and often much higher than the average British wage. And in the minds of most anti-immigration proponents, they think of it as being mostly Asian people, Muslims of any nationality, or East Europeans. They are not adverse to the Americans, Canadians, Aussies, people from NZ, or South Africa as such because they are already mostly English speakers and peopled by decedents of Europeans. This has always been a issue most jobs in scotland are part time the whole system is a joke i was told years ago. would have to be making 24000 minimum and for every child i have another 5000. This was because visas dont take in to account your location in the country so people north of england get fobbed of on the simple entry requirement because its based or was based on max average earning. Now that target is almost doubled is no chance. If anything it should be based on your income case by case. Its damaging to all familys. As someone whos had to try to go this route twice in my life.

It states household income (AKA the UK resident house). As the abroad partner's income is from abroad, it will not count towards it as long as they do not get a job in the UK. Which is still going to be 38.700 Pounds a year. The only way you would be able to get that sum from the UK resident is if you live with your family and they agree to display their income and sign that they are willing to support this. Or if you can manage to be some super hero to save 67.000 Pounds in a savings account for 6 months or be the upper 25% of the UK population😀
I have been through this. They asked for £18,600 at the time my now ex was working part time in the UK, in Nottingham, I was working part-time in Sussex they added the 2 salaries together. He was from peshawar in the UK, then they are for a joint bank account. I refused to have a joint bank account on the grounds. My money is my money. Third they asked that you intend to live together. It was clear as day that he was going to remain in Nottingham. The home office approved the visa. When we divorced, he switched at Nottingham University and sponsored him as a fitness instructor. We met none of the criteria, and they still gave a visa.

I truly feel for this couple and for some of the people who shared their similar experiences in comments. However, legal migration, economic migrants, asylum seekers & refugees migration have risen so much that it is paramount now to take drastic actions to slow it down in time of austerity as public services have been cut to the bone so we need to put a stop to it if we don’t want more troubles on our streets and shop vandalism. People have had enough, they need reasonable housing, school places, dentists, food on the table. Unfortunately for some who’ve met here in the uk and fallen in love, they will need to earn in the region of 38K per year to stay and work in the UK. Internet love stories will come to an end and students’ dependents and families won’t be allowed to come any longer. It seems the Tories only want to welcome the brightest and the best migrants workers to the UK. I think to earn 40k a year is a massive request, most post graduate students don’t earn 38k-40k unless they are scientists or Doctors. The government might need to rethink this as we might see an exodus of people leaving the UK for the sunny shores of other countries.

What graduate student will want to study in the UK if they have to leave their spouse and/or child in their home country? I know British citizens people who have already left because of this. We are losing well educated professionals that we cannot afford to lose.
Will also effect your children lives in future so if it doesnt effect you now dont feel secure these policies are horrendous

They're well aware that it will affect English speaking countries also. They just don't care. If they put more thought into it they'd probably make exceptions for those who can pass a standard English language assessment, but even then it would be discriminatory towards those coming from countries that don't speak it. The whole thing is just fucked, plain and simple.

The increase in income threshold to bring in spouses does seem to be quite unreasonable. I very much doubt that it has been thought through. This isn’t about sexual preference as these two people seem to be suggesting.
This has always been a issue most jobs in scotland are part time the whole system is a joke i was told years ago. would have to be making 24000 minimum and for every child i have another 5000. This was because visas dont take in to account your location in the country so people north of england get fobbed of on the simple entry requirement because its based or was based on max average earning. Now that target is almost doubled is no chance. If anything it should be based on your income case by case. Its damaging to all familys. As someone whos had to try to go this route twice in my life.

It states household income (AKA the UK resident house). As the abroad partner's income is from abroad, it will not count towards it as long as they do not get a job in the UK. Which is still going to be 38.700 Pounds a year. The only way you would be able to get that sum from the UK resident is if you live with your family and they agree to display their income and sign that they are willing to support this. Or if you can manage to be some super hero to save 67.000 Pounds in a savings account for 6 months or be the upper 25% of the UK population😀
I have been through this. They asked for £18,600 at the time my now ex was working part time in the UK, in Nottingham, I was working part-time in Sussex they added the 2 salaries together. He was from peshawar in the UK, then they are for a joint bank account. I refused to have a joint bank account on the grounds. My money is my money. Third they asked that you intend to live together. It was clear as day that he was going to remain in Nottingham. The home office approved the visa. When we divorced, he switched at Nottingham University and sponsored him as a fitness instructor. We met none of the criteria, and they still gave a visa.

Agreed. My mum was bi polar, called manic depression back then, but still managed to work as a legal secretary. Her wages were essential to keeping the house at one point as dad's wage didn't cover all the bills during the high inflation era of the mid 70s. He should go back to USA and get a job which will give the skills to meet our immigration rules.

I truly feel for this couple and for some of the people who shared their similar experiences in comments. However, legal migration, economic migrants, asylum seekers & refugees migration have risen so much that it is paramount now to take drastic actions to slow it down in time of austerity as public services have been cut to the bone so we need to put a stop to it if we don’t want more troubles on our streets and shop vandalism. People have had enough, they need reasonable housing, school places, dentists, food on the table. Unfortunately for some who’ve met here in the uk and fallen in love, they will need to earn in the region of 38K per year to stay and work in the UK. Internet love stories will come to an end and students’ dependents and families won’t be allowed to come any longer. It seems the Tories only want to welcome the brightest and the best migrants workers to the UK. I think to earn 40k a year is a massive request, most post graduate students don’t earn 38k-40k unless they are scientists or Doctors. The government might need to rethink this as we might see an exodus of people leaving the UK for the sunny shores of other countries.

This is going to be a massive issue for enrolment of foreign students at UK universities. What graduate student will want to study in the UK if they have to leave their spouse and/or child in their home country? Third level institutions heavily rely on the money raised from those tuition fees. It will result in major funding issues, and a massive brain drain for the UK.

It's really not uncommon for countries to require a couple to be able to support themselves. Especially when the immigrant is completely dependent. The reality is we need to import skilled migrants who work. This ain't that, life is harsh and I'm sorry this guy has the health conditions he has. But we need to look after our citizens first, we can barely do that at the moment. The world is rapidly crusing towards the onset of the resource wars, the UK is in a terrible position to respond to that. We need to sort ourselves out first.

The prior amount required was 18k. 38k... is just an astronomic increase. It means even most of these professionals we want to import who will be earning north of this, will probably decide against moving to the UK if they cannot bring their family with them too.
