The cops escalated it with the passenger. If the window tint was illegal( which it was, and very dark), then how could they tell if the passenger had a seat belt on?
My mom used to say. Don’t argue or fight with the cops. Yes sir, no sir. When you go to court. Tell the judge what happened. It’s up to the judge to decide.
And as a cop, kudos to your mom. If a judge pleas our charges to minor stuff, which they typically do a lot to avoid a jury trial, so be it, we don't mind, we did our job and the courts are beyond us. But we appreciate just being able to get on with our lives so you can get on with your life too and no one has to have a bad time or a bad taste in their mouth of the other party.
I do the same. More often than not, if you are respectful towards them like that and make the stop easy they will just give you a warning. Having just a little bit of intelligence and self control can save you so much money in a lifetime.
I would also like to add it is your constitutional right to decline questions that do not have a lawful basis to be answered (such as your identification in a legal request for such.) You should absolutely express this right, and well before you have your miranda rights read to you. Traffic stops are often more of a game to see how much you'll admit to as the court system is on your side, not the cops, and so the cops need extra to confirm that your defense in court for a traffic defense is not possible. When you do need to answer the cops, be respectful, be polite. Do not be an aggressor. And for questions you do not have to answer, do not answer, but politely. Don't be sassy, just politely decline to answer. If the cop starts instigating, let them, and don't react. It'll be their day in court, not yours.

I'm pushing 50 and still call my friends parents and my parents friends Mr. & Mrs. I could never in my wildest dreams EVER imagine talking like this to someone in uniform PERIOD! My family doctor is the same age as myself and she told my I can call her Nicole and I told her I'd never do that unless I see her outside of the office, and that is only not to draw attention. Also my friends father is a retired Judge and has told me over and over to call him Rod and NOPE, I call him Judge Clarke. He understands the way I was raised and I was told by his daughter that he's happy I still call him by his title and has told her "you need more friends like him, friends that have respect".

I do have a pet hate for over tinted windows. It's obviously fine for brilliant sunshine but when you're turning at junctions in unlit at night you can't see any pedestrians or cyclists it's proper dangerous.

While my doctor has offered many times to write a script for me to get super dark tint for my car, I politely decline and wear very dark sunglasses anytime I am outside. Even I feel the super dark tint is dangerous despite living in FL.

I disagree with "comply with demands." I understand why that seems fine but Cops are taught to lie and ask for things they cannot have without permission. Its important to know your rights and when you do and do not have to exit a vehicle (depending on state and local laws) or consent to a search.

Straight up, this was a little aggressive. These kids are tools, but I'm not sure this level of aggression was really warranted for a couple of dumb kids who didn't immediately get out of the car. The cops could have de-escalated this a little more. Should the kids have just obeyed? Of course. But did they really need to pull them out of the car, arrest them and charge them with obstruction? I'm actually not sure. A little more patience from the cops might have avoided this. I mean dumb people gonna be dumb right?

Look, from my perspective there are two ways of evaluating this incident. 1) were the cops legally justified in what they did? and 2) was this the best/most productive way of handlining this situation? So, were the cops legally justified? Yes. But did they really need to escalate this trivial situation so significantly? No, I don't believe they did. You said they showed MEGA patience, but it was a little over 60 seconds between initiating the stop and having the passenger ordered out of the car. That's MEGA patience? 60 seconds? No calm conversation politely explaining to what is clearly a confused kid what the law is? Within another 15 seconds the officer is now reaching into the car, a few seconds after that the second officer threatens to break the window. A few seconds after that the officers are now using force to remove the passenger. Is that MEGA patience, or rapid and unjustified escalation of an extremely minor and trivial traffic stop? Unless huge segments of the video are missing I'd call that rapid and unjustified escalation (and pretty piss poor policing). Just imagine this, instead of insisting that these two kids immediately comply with their lawful order and threatening them with force and legal consequences (and then drag them both out of the car and arrest them, by which point both were hysterical), what if the cop had spent another minute or two just calmly and politely explaining to both of them what was required under law, using a friendly and polite tone of voice in an attempt to DE-ESCALATE the situation? (i.e. good policing). Imagine he had just said "look man, this is no big deal, there's no reason to be upset, no one's getting arrested or getting in trouble. I just saw you without a seatbelt on and its my job to issue you a ticket. If you had it on and I'm mistaken you can absolutely challenge it at court. Just explain to the judge and they might simply give you a pass. But I saw you without one on and I have to do my job or I'll get in trouble. You understand my situation right? That's all I need your name for, so I can write the ticket. Its really not a big deal, i'm not trying to screw you over or do you dirty. So, if you provide me those details we can all be on our way and you can get on with your day. However, if you refuse to give me your name I am going to have to arrest you for failure to identify yourself. I wont have a choice. Now, I don't want to do that, and you don't want that either, It kind of would be a big deal at that point. I'll have to drag you down to the station in handcuffs and there's no reason for that, especially over a seatbelt ticket. So look dude, just identify yourself and this wont turn into anything serious. Its just a ticket for a seatbelt. If you think I'm wrong here then you can absolutely take it up with the judge or my department, but I have to identify you." Imagine that had been the way the officer approached the situation (that would be MEGA patience). What are the chances it ends without anyone getting arrested? Pretty high I would say. Much higher than the approach these officers took. These dumb, harmless kids were clearly mistaken in their belief about what the law is, but instead of calmly explaining the situation, these guys expected instant submission, and then they didn't get it they escalated the situation rapidly, jumping to physical force within 60 seconds or so. You ever watch Fridays with Frank? That guy is an excellent traffic cop. You think he would have handled this situation like this? Or do you think he would have talked these kids down? Sometimes good policing isn't about what is legally justified, its about de-escalation and using words, rather than force, to get people to comply. Especially when we just have some dumb kids who were pulled over on a tiny traffic stop and clearly were no threat to the community (they were hardly gang bangers) and now will hate the police forever.

In my 63 trips around this sun, I have learned that when dealing with an officer, a little respect goes a long way. I know, there are bad apples in every bunch, but for the most part, respect is the way to go.

I had a old ram that wouldn't pass emissions and drove it for 4 year, got pulled over 4 times, each time i explained the situation and was told get it taken care of and a warning, all because i was polite and respectful, the last officer chatted with me for like 20 minutes about his diesel and mine, turned out to be a great conversation 😂

And as a cop, kudos to your mom. If a judge pleas our charges to minor stuff, which they typically do a lot to avoid a jury trial, so be it, we don't mind, we did our job and the courts are beyond us. But we appreciate just being able to get on with our lives so you can get on with your life too and no one has to have a bad time or a bad taste in their mouth of the other party.
I do the same. More often than not, if you are respectful towards them like that and make the stop easy they will just give you a warning. Having just a little bit of intelligence and self control can save you so much money in a lifetime.
I would also like to add it is your constitutional right to decline questions that do not have a lawful basis to be answered (such as your identification in a legal request for such.) You should absolutely express this right, and well before you have your miranda rights read to you. Traffic stops are often more of a game to see how much you'll admit to as the court system is on your side, not the cops, and so the cops need extra to confirm that your defense in court for a traffic defense is not possible. When you do need to answer the cops, be respectful, be polite. Do not be an aggressor. And for questions you do not have to answer, do not answer, but politely. Don't be sassy, just politely decline to answer. If the cop starts instigating, let them, and don't react. It'll be their day in court, not yours.

I disagree with "comply with demands." I understand why that seems fine but Cops are taught to lie and ask for things they cannot have without permission. Its important to know your rights and when you do and do not have to exit a vehicle (depending on state and local laws) or consent to a search.

Straight up, this was a little aggressive. These kids are tools, but I'm not sure this level of aggression was really warranted for a couple of dumb kids who didn't immediately get out of the car. The cops could have de-escalated this a little more. Should the kids have just obeyed? Of course. But did they really need to pull them out of the car, arrest them and charge them with obstruction? I'm actually not sure. A little more patience from the cops might have avoided this. I mean dumb people gonna be dumb right?

So, were the cops legally justified? Yes. But did they really need to escalate this trivial situation so significantly? No, I don't believe they did.
You said they showed MEGA patience, but it was a little over 60 seconds between initiating the stop and having the passenger ordered out of the car. That's MEGA patience? 60 seconds? No calm conversation politely explaining to what is clearly a confused kid what the law is? Within another 15 seconds the officer is now reaching into the car, a few seconds after that the second officer threatens to break the window. A few seconds after that the officers are now using force to remove the passenger. Is that MEGA patience, or rapid and unjustified escalation of an extremely minor and trivial traffic stop? Unless huge segments of the video are missing I'd call that rapid and unjustified escalation (and pretty piss poor policing).
Just imagine this, instead of insisting that these two kids immediately comply with their lawful order and threatening them with force and legal consequences (and then drag them both out of the car and arrest them, by which point both were hysterical), what if the cop had spent another minute or two just calmly and politely explaining to both of them what was required under law, using a friendly and polite tone of voice in an attempt to DE-ESCALATE the situation? (i.e. good policing).
Imagine he had just said "look man, this is no big deal, there's no reason to be upset, no one's getting arrested or getting in trouble. I just saw you without a seatbelt on and its my job to issue you a ticket. If you had it on and I'm mistaken you can absolutely challenge it at court. Just explain to the judge and they might simply give you a pass. But I saw you without one on and I have to do my job or I'll get in trouble. You understand my situation right? That's all I need your name for, so I can write the ticket. Its really not a big deal, i'm not trying to screw you over or do you dirty. So, if you provide me those details we can all be on our way and you can get on with your day. However, if you refuse to give me your name I am going to have to arrest you for failure to identify yourself. I wont have a choice. Now, I don't want to do that, and you don't want that either, It kind of would be a big deal at that point. I'll have to drag you down to the station in handcuffs and there's no reason for that, especially over a seatbelt ticket. So look dude, just identify yourself and this wont turn into anything serious. Its just a ticket for a seatbelt. If you think I'm wrong here then you can absolutely take it up with the judge or my department, but I have to identify you."
Imagine that had been the way the officer approached the situation (that would be MEGA patience). What are the chances it ends without anyone getting arrested? Pretty high I would say. Much higher than the approach these officers took. These dumb, harmless kids were clearly mistaken in their belief about what the law is, but instead of calmly explaining the situation, these guys expected instant submission, and then they didn't get it they escalated the situation rapidly, jumping to physical force within 60 seconds or so.
You ever watch Fridays with Frank? That guy is an excellent traffic cop. You think he would have handled this situation like this? Or do you think he would have talked these kids down? Sometimes good policing isn't about what is legally justified, its about de-escalation and using words, rather than force, to get people to comply. Especially when we just have some dumb kids who were pulled over on a tiny traffic stop and clearly were no threat to the community (they were hardly gang bangers) and now will hate the police forever.

I had a old ram that wouldn't pass emissions and drove it for 4 year, got pulled over 4 times, each time i explained the situation and was told get it taken care of and a warning, all because i was polite and respectful, the last officer chatted with me for like 20 minutes about his diesel and mine, turned out to be a great conversation 😂
