Pre-crime. This officers questions might constitute as a threat and strong-arming to prevent political protests.
Ya’ll are mistaken...people literally plan crimes in facebook groups and then brag about it after...not just facebook but instagram, forums and other social media. Yea this specific topic is a little ridiculous...but yes people are this stupid.

@@calebmatthews7268 She didn't say she was going to, people make jokes about things like this constantly. It's not something worth policing unless they were actually organizing plans to do it. It is absolutely wrong for police to show up at someone's house asking questions, because they posted how it would be funny if they did some petty illegal thing in jest. It's part of daily life for most of the population to talk about what they wish they could do, but won't. All you people defending this kind of policing are clowns.

I think he was trying to be light hearted about this situation. He had the job to knock on her door to basically tell her don't do the stupid thing you posted on social media. As soon as she confirmed she didn't intend to do a stupid act he was quick to leave and not bother her further. I commend him for being a polite as possible and not try to make the situation worse as I've see mean other cops do on ATA. He could of prolong the interaction longer to try and get her to commit a crime.
@@dawwww you find post of me discussing a crime against you that you don't want to happen. Sure, have the police come and verify I'm not going to do crime I've discussed in a public forum. It'll teach me to be mindful of what I say in a public space and that some people do get sarcasm.
The cop had a petty job to do and he did it in a reasonable manner give the situation. You got grief with them showing up then that's more on the person voicing the concern/compliant.
Police are issued an identification card, that looks official and shouldn't be easy to counterfeit. Always ask to see that card. Don't trust a badge (or gun), it means nothing, it could be bought or owned by a security officer. If the officer refuses to show that card, call 911. If you have any question about the authenticity of the identification card, call 911.

I gave this vid a thumb-down for the massively high grade given to the police failure. This was clearly an attempt at intimidation on the behalf of whomever was the civilian hanging around. Cops should know better.

Yeah, I'm not seeing how she got a B+ here. Realistically I'd give her a D+ or a C- at best. Granted she didn't do much to further incriminate herself, but she sure did a lot of talking for someone pleading the 5th, and she had a fundamental lack of understanding about trespass law, which her not being a lawyer is understandable except she sure seemed certain about it for being so wrong. She was equally ignorant and arrogant regarding the officers' non-requirement to identify the citizen. She should have just approached the citizen in a non-threatening manner and asked who they are if she was that curious, not that the citizen has any requirement to tell her but she might at least get them on camera. She would have done better to just state that she isn't answering questions, asked if she was free to go, then said goodnight and closed the door.

That cop handled it well. I actually respect the way he did it. If somebody was talking about messing up my house, I’d like the cops to stop by and say they’re keeping and eye on the situation. She was looking for trouble at the end.

People still think they can get out of things or dazzle a cop with a TH-cam law degree. Never works.
There is a certain amount of talking that you NEED to do when interacting with a cop. You at least want to get their names and badge numbers, for example, and you may need to state that you're pleading the 5th or demanding a lawyer. But beyond that it is far better for you to not talk to the police, at least until you have consulted a defense lawyer about the situation.

Don't even open the front door and shout through "please leave my property!" Say nothing more than that and video everything through an open window! Once they've left, submit a FOIR (Freedom of information request) and take appropriate action after! The fact that the Police are likely to escalate the intimidation is all the more reason why you should not allow them on your property!

He would have left if asked, and he was leaving... You are allowed to approach someone's property and knock on the door to have a consensual encounter... It's not trespassing until you are asked to leave, and refuse. Learn the laws numb nuts.

As someone who almost always sides against police intrusion - that kind of chatter was reckless and a knock on the door about it wasn't surprising.

A West Virginia State Police Trooper charged a suspect with felonious assault on a police officer because the guy was sitting in the back of the squad car cut a fart that was so bad, the cop had to pull over and air out his car...lol. So he charged the guy but I think it was dropped.
I was on this lady's side until she started following the cops out and asking about the private citizen. It's pretty obvious she's an instigator.
@Skip: I wish that she had confronted the other person directly but it is not hard to determine that they were a team.
Plus we only have her blatherings that the woman was on her property. No video despite her lies to the contrary (it became a lie after the event when she posted the video w/o a disclaimer). No-where on the video is that woman seen other than on the sidewalk or road continuing in the direction she appeared to come from. I suspect that, being cautions and not wanting bystanders in any risk from the homeowner escalating the encounter, the officer directed her to cross the road and not pass between the cruiser and house which continuing on the sidewalk would require.

This officer's response for identification was an example of his distain for citizens.
When someone asks an officer for identification, they should simply follow their department's regulations on providing ID.
I am guessing that "handcuffs and a gun" are not considered proper identification.
I would hope that wouldn't be considered proper identification. Lots of people own guns in the US and anyone can buy handcuffs. And in poor lighting he could flash a fake badge and claim to be a cop. He clearly didn't display it long enough for her to see anything identifying him.

It's okay to have absolute disgust for people threatening harm on government officials. Watching the news on Jan. 6th was the wildest moment in the US news since 9/11. Luckily the traitors didn't make it even worse or it could have been the deadliest terrorist attack our nation has ever seen.

Since they already went over what constitutes as trespassing, no one had told the woman to leave and there was not sufficient signage or fencing to ward her off from being there in the first place. Even if she was, you are allowed to walk onto and across the curtilage unless otherwise notified. How else would someone come up to knock on your door legally? She was just being difficult because she was (understandably) upset, but also she is the type of person that wants vengeance rather than justice.
Since she got her camera in advance, she should have just kept the door closed and avoided the entire encounter. Don't answer the door for unarranged visitors.

Um, what makes you think that? I'm willing to bet the property in question has a fence and a closed gate surrounding it. And, of course, the whole reason the cop was there was to TELL HER SHE WAS NOT WELCOME THERE, so she would have been trespassing if she had gone there from that instant forward.
And even if there were no fence or signage or verbal warning of any kind, entering someone's property for the purposes of committing a crime (like littering or vandalism) is itself a crime (burglary, specifically).

E.g. poster in front of your house supporting a politician. You cannot claim that that poster was supposed to be private and unknown. Furthermore you do not own the space you occupy on Facebook or social media. You are using their service and space. Same as any company. If you say stupid shit in the middle of Walmart and get recorded, you are not given the right of privacy just because walmart is private property and owned. The only way to prevent your data from being handed over to the police without a warrant is to private everything and hope non of your friends tip the police off. If they get a warrant they can get your data regardless. So if you really are concerned about privacy just don't use social media. You aren't being forced to use their service.

Agreed completely. The officers followed up on HER discussion about committing a crime to simply say: "Hey, dont do that. It would be illegal. Have a good night."

Police can't randomly identify people who are on public property OR her property - as far as I can tell from the video she was only on the sidewalk, but with a civilian having the same "knock and talk"-rights as the police (with the options of starting to go up to her house and turning away if police are there / being turned away by police because of an "ongoing investigation") they have not broken any laws and police have no reason to demand their identification. Also, police sure as hell can't produce an identity they haven't taken nor time travel and trespass someone who has already left the premise. What are they suppose to do? If someone plans criminal acitivites in a public forum - even in hyperbole - and the chillest fucking police on the planet comes knocking because someone reported it and basically tells you "Don't do crime, its bad mkay? Ok thanks" is a pretty reasonable result of it. If you have to work that hard to become some kind of legal martyr you are most likely in the wrong.

Given the context of the scenario, they were openly talking about dumping garbage in someone’s yard and I didn’t see any sarcasm, especially since the tone of the root post was said in a serious tone. I agree that it’s difficult and important to state that tone through text can be difficult at times to read.
But that’s why you need to word the following way in a sarcastic or joking manner or add lmao at the end among other ways. Personally, I think it’s easy to identify when someone’s joking or not, but I don’t think the lady in question did anything to make it sound otherwise.

Clearly law officials thought this warranted a warning, although not sure what they expected to happen from that. I had a knock and talk at after 3 am waking me up. It was a deputy and other witness asking if I was a witness to too a major crime that I slept thru two doors down. The house next to me didn’t have tenants so I was the closest occupied house to the crime. I didn’t know about a normal legal hourly limit. I didn’t mind. It made sense to wake me up.

Its all subjective here. According with the text that ATA posted one is considered a victim if they are threatened with a crime, and again like it has pointed out the conversation has on basis of possible conspiracy to commit a crime and she did mentioned the possible victim.
Personally I feel that tjhe officer is kinda done with the situation and he just went there to say "just dont do something stupid ok"
IMO it has a little unnecessary but there is evidence of the threat of a crime and if the person threatened made a complain it has right for them to issue a warning and they are very cleary trying to de-escalate the situation as a whole.
Have said that, I believe the woman should get a C instead, in the end she tried to escalate the situation and her post the next day tried to paint the story with a narrative different from what we see.

For once, I think the cops were on the right side here. They saw a two people discussing a crime and came to check and warm them to tread carefully and did it professionally.
Although I suspect the person is a RWNJ, I find the courts ruling and police use of the ruling to be very creepy. Having said that, it behooves those of us who are active on social media to immediately knock down such talk in social media discussions if not for one's own legal protection then to head off those who would take actions far and above what may have been originally intended, if at all.
There are agents provocateurs, foreign entities and others who would foment insurrections and criminal acts in order to discredit legitimate protest and/or give the police a rationale for making arrests, if not start surveillance. Don't give them that opportunity.
I agree, however I'm curious as to why they decided to react to her post specifically. We've seen posts go to action really quickly with the tearing down and defacing of monuments and statues.
