  • Back in January a John Deere 3046R was up for sale at a Public Auction. We bought it remotely through family members. Once Tim had a chance to see it, we noticed a few oddities about tractor, after a bit of detective work, Tim found out it had been stolen from a John Deere dealer.

    Sorry to hear about the stolen tractor. It is nice to see honest folks like yourself doing the right thing. Last year my girlfriend and I went to a box store to buy a few items. One of the items was a multimeter for about $95.00. She dealt with the cashing out of the items (she's a big part of the finance committee...lol). Anyway, while we were walking back to the car I realized the total amount for the items we just purchased didn't seem right. Sure enough after looking at the receipt I noticed the cashier didn't ring up the $95.00 multimeter. Of course we went back in and paid for it. I told a few people of what had happened and I was surprised how many said they would of just gotten in their car and left. You mentioned that you could of not said anything and kept the tractor but you were not that kind of person. Just want you to know that although a sad situation its a good feeling knowing that there are honest people in the world. Thanks.

    I can’t believe the auction house is doing you like that. Call their bluff and take them to court. They will get slapped with a fine and will lose lots of business once the word gets out. You’re a stand up guy and I respect what you did. Not many people have those kind of morals anymore. I would also like to offer to contribute $100 toward the legal bill if you go to court.     You did the right thing, just a suggestion, you could find a schedule of their future auctions and stand outside with a sign that says "this auctioneer sold me stolen property" and when everyone walks away, they just might give your money back, make them lose money and they will act fast!!!

    Go back to the news station, there's a stroy in it for them, bad publicity for the auction house and satisfaction for you. Give it a day and there lawyers will be on the phone offering you your money back.

    That's a terrible thing to have happen to you. I hope the Auctioneer does the right thing and gives you your money back without much hassle. There are very few honest people left in the world like you, but I am one of them and commend you for doing the right thing.

    WOW, I just watched a clip from Messicks about how they get robbed all the time, and what are some of the things you can do to deter someone from stealing your tractor. I'm looking up some things over and above what Messicks suggested. I have full coverage of my NEW tractor but don't want to go thru the hassles your going thru. SO Sorry for your loss, I hope you get your money back and I applaud your moral character, not much of that these days. Robert

    I've always heard it was illegal to buy and SELL stolen property. Since you stepped up and did the right thing as soon as you recognized wrong doing,you would think the auction company would do so as well. Best of luck to you.

    You did the right thing and I advise you if you haven't already get you lawyer involved immediately you can recover your money plus expenses and damages incurred from the auction house....they are liable and they know it and the sooner your lawyer sends them notice the faster you will get your money back!
    oh yeah bravo to you for not only talking the talk of honesty but for actually living it! Most men nowadays will talk the talk but when it is their 14k on the line most start to whisper if they talk at all!!!
    Your the real type of honest hero I hope my kids and grand kids look up too!

      No, no. First, my family doesn’t have a lawyer. (Thankfully). I didn’t have one for the first 51 years of my life either! I mean that my lawyer is ‘working on the case’. Sorry for confusion

      lawyers can be helpful in situations such as this. I admire you and families honesty and that fact you posted this video on top of that for all to see. Many youtubers probably would have hushed it up and said nothing. I have my fingers crossed and will keep you in my prayers that you get your money back and whatever costs you have incurred due to the auction house not doing their due diligence.

    I would say you most certainly are first in line against the Auction House. You bought it from them. The dealerships connection to the tractor is with the dirtbag that stole it and with their insurance company NOT the auctioneer.
    Don’t back down because of a liar (oops.. lawyer) commenting about $20,000 legal fees on a $14,000 tractor. You will win and they will pay your lawyer.

      and it will be an equivalent amount of cost for the auction house to fight the case in court, way cheaper to refund, btw the auction house have insurance to cover shit like that.
      threaten to turn up to the auction next year with a huge sign advertising they sold a stolen tractor and won't make amends, they will lose big time with every person who walks away.

    Sounds like everyone else involved is crooked but at least you can hold your head high and know you did the right thing. This reminds me of one of my favorite quotes to live by: "Treat everyone with kindness and respect, even those who are rude to you - not because they are nice, but because you are." You may have gotten screwed by the crook and screwed by the auction but even amoungst that, YOU acted with integrity and honesty. You will be rewarded for that many times over! I know you will!

    Tim, you did the right thing. You're probably going to lose some money on this one. My advice would be to try and buy the tractor from the dealer in its current condition. I would think the dealer has insurance to offset their loss anyway.

    You need to engage a lawyer. You might be surprised what happens when the auction house's lawyer gets a letter from a lawyer. They're hoping you think it will "cost $20,000" - it won't. You need to get a lawyer and let the lawyer file the appropriate complaints with the police, state attorney general, etc. Until the auctioneer's license is put in jeopardy, they're hoping you'll take the loss for them.

    Here is copy of the email I sent to the auctioneer. If just a few hundred of us do the same. I bet it will change the outcome.
    Back in January you fenced a stolen tractor to a TH-camr called Tractor Time with Tim. Now it's all over the Internet. You really should make this right by Tim before he sues you. Not to mention the bad publicly you have and will continue to get as this drags on. Tim did the right thing. Now it's your turn to do right by Tim.

      George Post my issue is greater than just them doing right by Tim (and yes they should) but that they did not live up to the standard of the law to ensure the well being of their customers.
      This is for several reasons 1) it is a legal requirement, 2) I have family in the farming industry and auctions are a way of life for farmers. They deserve that protection weather they are buying or had equipment stolen.
      Also if they failed to ensure that the equipment was not stolen what other poor practices do they do.
      No insult to Tim, but it did not seem that the items that raised concerns for Tim should have been to hard for someone that frequently does equipment auctions to be able to spot.

Now I don't know him or his brother, but maybe his brother is not a big auction attendee and is inexperienced. Tim also noted that it was extremely cold and you can see from the photos that the tractor was covered in said snow. In this case, I'd say the fault lies at least 90% on the auction company for not following protocol. I'm also pretty sure Tim & his family will be much more careful @ auctions from this point forward.

      ROTAXD no where in what I stated did I mention Tim’s brother. Nor will I now. My statements were and ate directed toward 2 groups and in my opinion weather does not relieve their responsibility to provide due diligence for customers on both sides of this issue. Those 2 groups are 1 the organization that sponsored the auction. And second the auctioneer. Both of these had responsibilities to proper owner of said equipment, the insurance company and the potential buyer in this case Tim’s brother as his agent. Both groups as mentioned failed greatly. Those 2 groups should either split the cost to provide Tim a better piece of equipment or split repaying Tim cost of equipment and expenses to recover his money including travel.
      If it goes to court, then they stand to encounter professional fines in addition to this cost.

      Law is clear, Onus was on auction house to get and confirm clear title, they owe him money. If not and has to sue, then the should be for full amount of new tractor costs ( loss of tractor thought was legit to begin with) and all applicable attorney fees his attorney will add, plus could be even more for pain and suffering, cheaper for them to return his original amount.

    Doing the right thing is not always easy.I applaud your ethics and choice. I truly hope you are compensated in full. It would be nice to see local people and media put some pressure on the auction house that sold it. Its too bad they can't be charged for dealing in stolen merchandise.

      No, there will always be a fabricated need for a corrupt police force who hide behind badges and taxpayer funded legal defenses. Even if everyone was honest and good they'd still devise ways to harass us and extort more of our money.

    I had the same luck a few years ago it was one of those deals it's too good to be true. Losing money sucks and makes it harder for the next purchase, don't get discouraged just keep digging. thanks for sharing

    Aww man that is awful. I feel bad for you. I have bought many things at auction and never been concerned with them being stolen. Also I have sold things at auction and the auction has always checked things out to ensure I wasn't selling stolen items. That auction house SHOULD be responsible!

    This is incredibly easy to fix and any lawyer would have recommended he go-to the local police in the area where the auction was held and file a complaint for receiving and selling stolen property (aka fencing). Then once that's done file in small claims, his States small claims goes up to $25,000. Their scare tactics of spend $20,000 to get $14,000 is bull lol, small claims filing fee is $174 there.

      Quite honestly, he should have kept the tractor until the court ordered it returned. This would have put the JD dealer in the mix against the auction house and the thief. I have had to deal with this when someone decided to rob my place. I was told I was "SOL" and had to go after the thief for damages and restitution even though they had buyers names and such of whom he sold my property to.

      danman1012 - considering that I just went through something similar...no, no they don't confiscate it immediately. If you notice, the Deere dealership took possession, not the police. Now the dealership has their tractor back AND insurance has paid out for the theft, the auction house got their cut when it was sold. Tim is now SOL and must fight for restitution from the thief - alone. But anyhow, think what you want, until you go through a situation like this, you have no comprehension how raw of a deal it really is. I feel bad for TIm and wish him the best of luck. My thief skipped bail (2,500 exactly like this thief) and I got to sit for hours at the court house and was told I would be served another subpoena when they located him and have a new court date to appear on.

    I had another thought, as a last resort you might file a claim with your insurance company and let them battle it out with those responsible for your loss.
    I was wondering why Tim sounded so sad in his last video, now I know why.

I really enjoy your videos started following your channel about 2 months ago, I’ve learned a lot having never owned a tractor or lived on a farm I found your videos very helpful seeing the functionality and versatility of your 1025R un-like the 20 second commercial John Deere advertises seeing the different tasks you preform we took the plunge today and Purchased 1025r with front end loader 54” deck & box blade & I match Quick hitch I never would have done this without watching your videos. I told the salesman I’m buying this tractor because of Tractor time with Tim on TH-cam hopefully he’ll do something with that. Not everyone grew up in the country they should indorse you. Anyway thank you and your family for taking the time to do all these videos I’m sure there’s a lot of work producing them. Look forward till the next one if you get a chance to do one on box blades that would be great.

    I almost think if you don't take them to court, there's no reason for them to actually try to not screw somebody over in the future... its sad that this local auction company considers itself above the law because they think nobody will enforce the law.

    Wow! That is something you don’t expect! The auction house is not being fair. If that auction house can get away with doing this to you, they have created a Business Utopia for themselves where no liability and no risks are assumed because other peoples’ money is used (risked). Yes, it is a Business Utopia for them because they Profit Without Risks or Create Wealth Without Risks; it is a win, win situation for them. Shame on them!

    Have you tried reporting the auction house/auctioneer to their own licensing boards? Normally there is a process to leave a complaint to be reviewed at the renewal of their license.     File a Statement of Claim against the auction house and they will fold immediately. Its not just you that has to pay fees, and in the end they will have to pay yours too. Don't play with this any other way, equity and the law is against them and they do not have a prayer. Your good deed will serve you as it should.

    You need to contact your district attorney's office in regards to the auction house fencing stolen property. You will get your money back. The auction house will have to eat this for not doing their job.

    When I farmed with my father, we never doubted anyone who sold us a tractor. Now we have to be more careful. I am glad you guys caught it. My wife who is a Deputy Sheriff said you could be charged for receiving stolen property, even if you did not know it. A lesson for us all.

    My question is it the dealers ? Did they file an insurance claim ? If so, it is the insurance companies paid the deale for it, .The sheriffs office should of taken possession of it then held it as evidence then transferred to insurance company. If the dealer filed an insurance claim they are out only their deductible. Just my arm chair law degree from Duwie Cheatum and Howie collage.

      A stolen item unless it is needed for evidence is always returned to the possessor that owned the item at said theft. It is then up to said owner to notify their insurance if they have accepted a claim payment of the recovery or they will be guilty of insurance fraud. The insurance will then come out and evaluate the property and see if it is valuable enough to take or if it is not leave it in the possession of the owner. They also may choose to negotiate a paypack if the owner wishes to keep the item minus damages inflicted on the item. (Such as the hours of use and the removed serial numbers).

      @@Morpheen999 As Tim also pointed out is it the responsibility of the auction house to verify the title. They were negligent in doing so and thus their insurance even if they had a policy for such things would not be required to reimburse them unless they could prove due diligence in trying to verify the title.
      And as far as the dealer when they had their property returned to them even if the insurance didn't require a payback they lost the profit that could be had from the equipment as the condition it was in would result in a sale that was far below the supply cost.

      @@Cragified It was a long long time between theft and recovery so, I'm sure they were paid in full the value of the tractor by the insurance company, because a lot of these tractors you never see again.. then once the tractor was recovered.. the dealer pays the insurance for the diminished value of recovered tractor.. fix the tractor and make profit on the deal a second time..
      They have the system figured out

      @@Morpheen999 I like how you make several wrong conclusions and also important omissions.
      1. The dealer gets reimbursed the value they paid for it, minus deductible. Not what they would have sold it for. Insurance protects you against a value loss not a profit loss.
      2. You omit the cost that goes into repairing the unit AND that they cannot sell it as new now it is a used unit that has has to be repaired.
      So take that initial supply cost, subtract the deductible, subtract the repair costs, subtract the restoration to the insurance once recovered of the diminished value and you are already at a point that you will likely at best break even.
      And in many states it is quite illegal to misrepresent something used as new. Or not disclose issues with it. Which dealers are held to a higher accounting then individuals.

    This type of shady dealing angers me to no end. I would make sure not to ever deal with this Auctioneer or Auction House ever again and I would also make sure that the word got around so others do not suffer the same fate as you did....

    It would be cheaper for the auction house to just give you your money back. Because if they try and fight this they'll lose not just the 14 grand but all the legal fees. Not to mention the damage to their reputation.
    I wonder what would happen if your 30,000 subscribers went to their facebook page and politely asked them to give you your money back..... just saying hehe

      I agree with Jay. Also, I admire your honesty Tim.
      Having been in a few law suites, it has been my experience that you can ask for your money, your legal fees, and perhaps even something for your aggravation. Especially with such clear case law. If I were to guess, a sternly written letter from your attorney (citing some strong cases to establish precedent) may resolve the issue for only a few hundred clams out of your pocket.

    The Auctioneer is liable for any sale he or she makes. As you said there is liability in the fact they didn't catch it or I would even venture that maybe they knew but tried to play off that they didn't. Money does bad things to some people. I tried to use the link there in your description to do some research and see if I could see what the contact information was. Wouldn't you know it the page was blank so they know they did something wrong and now they are going to do anything to discredit you and your good deeds. By taking down their information they take the admission of guilt. In the big grand scheme of things you pointed it out and got a hold of the authorities to prove the fact of it's status. Now the thing to do is use the before mentioned auctioneer to help with the laws and procedures of the auction houses to help prove that the auctioneer who sold the machine to you is liable in the fact that they did not verify a vin and or clean title. Nor did they make certain that the innocent parties were taken care of so they kept customers after it hit the news. Now everybody knows not to buy or deal with the auction house or the auctioneer. I sure hope you and your family well and hope you can come out better than you came into the situation. I hope you don't get kicked to the curb like myself however my situation is a bit different but still legal. I was involved in a accident that left me disabled not able to work. I have no income, No help from state or federal, forced to live with my parents who are elderly. The State of Utah employee was the one who was at fault due to me being a passenger in one of their fleet vehicles. In the end the State claimed that they were a "Governmental entity" and that they had "immunity" to being sued. At that point my lawyers dropped like flies. Nothing I could do about it I called and wrote governors, senators, the president, FBI, FTC, anything and everything I could and got nowhere. I know it is a little different but the moral of the story is don't let them step on you. You are innocent and you did the right things to do when in this kind of situation. Therefore you should be compensated for your time and your grief and mental anguish due to the stress this put on you and your family. They are the crooks not you. Now I know legal battles are expensive but the legal aid society might be of some help. Also contact all the legal aid you can there may be some that will only take payment after they win the case. I wish I knew that years ago when I was dealing with courts.

      Auctioneer auctioning the item is no different than someone selling a stolen item. Regardless of what others may think, they are liable. They don’t get rewarded without some kind of liability. Auctions and CL are no better than pawn shops in many ways. Buyer beware. Auctioneer take notice.
