House of Representatives Proceedings - Two Peculiar Divisions (Speaker Voting & No Majority)

  • On 5 December 2018, during a time where the government of the day did not hold a majority on the floor of the House, two interesting divisions occurred.
    The first division happened after the Manager of Opposition Business, Tony Burke (Member for Watson), moved that the question be now put during debate on an amendment of a motion relating to the scheduling of the House's consideration of the Senate's message:
    "The Senate transmits to the House of Representatives the following resolution which was agreed to by the Senate this day:
    "That the Senate calls on the Federal Government to legislate to phase out long-haul live sheep exports.
    "The Senate requests the concurrence of the House of Representatives in this resolution."
    With the Ayes and Noes being equal, Speaker of the House, Tony Smith (Member for Casey) used his casting vote in accordance with the rules set out by Speaker Denison.
    The next division happened after Adam Bandt (Member for Melbourne), moved a suspension of standing orders in relation to the business of the day.
    While the Ayes had a majority of one, a suspension of standing orders motion without notice can only be passed by an absolute majority of the House, that being 76 seats, in accordance with standing order 47.
