In a case before the Madhya Pradesh High Court, two officers appeared in person, while one officer appeared in place of the collector. When the Hon'ble Justice inquired why the collector was not present, the officer in court handed over a letter from the collector, which was against the protocol. The Hon'ble Justice Gurpal Singh Ahluwalia then stated that both officers will be placed under suspension. This summary and the court proceedings are strictly for educational purposes only. Judge is more Agitated by the fact that Additional District Magistrate wrote a letter dircetly addressing him, than the content of letter and the case in question.

There is a notification by the government whereby clear guidelines have been issued as to how to communicate with officers above or subordinate to them. A collector is way below the judge. He cannot write a letter directing a judge. He can only Write a letter 'Requesting' a judge. It's not about about ego. It's clear cut violation of protocol and perhaps a contempt.
@@zaedkhan9440 a judge is not under govt then how can govt issue notification regarding how to deal with judges. Judges cannot be superior or inferior to Collector since both of them belong to different wings of democracy. Superior and inferior officers means within govt. And if it is a violation of any such guideline then it is for the govt to initiate disciplinary proceedings against the collector. Wednesbury caselaw clearly states so
@@sp6098 a judge may not be under the government but government does have power to frame protocol rules where persons are placed according to their designation and adhering to this protocol is mandatory part of training. A government functionary cannot issue 'Directions' to a judge because this is a blatant disregard of protocol as well as judicial independence and in the same way a judge in his personal capacity cannot 'direct' a government functionary but obviously he can issue directions in his judicial function.
The government updates these lists from time to time. So, the judge is right here cuz the Collector has by way of letter issued directions which is a flagrant violation of protocol as well as puts judicial independence into question.

In mine case opposite party filed appeal from D.J court to high court but get dismissed.than they approached to apex court exparty decision passed when petitioner was major he approached honorable apex court and direction passed to approach the appropriate court.now there is citation that even though slp disposed but even left member could approach under article 226.but in order it is written that each and every appeal of petitioner get dismissed and slp also dismissed.he was minor never he approached and every decision was in favour of his father and grand father each decision was filed with writ .and you are stating this statement.when they couldn't understand fact or law related case atleast hear whatever counsel is submitting after that decision could be passed.
