      I’m just confused about the incident that started the whole thing. If the purpose of affiliates it to generate clicks and you have an affiliate who has not once generated a click despite being an affiliate for months, then it seems eminently reasonable and not at all arbitrary to disqualify them from a contest for affiliates.

      This whole case goes to show, but companies exist to make money, is poor logic for defending a company. Since here we have a company doing something to save some money and going by their logic, didn't make any money off this person. If what they said about no one clicked on the link is true. For companies often get so greedy, they make choices that just end up backfiring, for it might make money or in this case save money in the short term but in the long term burn everything to the ground.
      Which of course It is just lovely to see this company burn down to the ground, over their bad choices. It truly feels like justice, to see this wanna be Uruk-hai, get what is coming to their company. Along with it just feeling good to see a company being punished for being a massive ahole for once. Which I do love how everyone but this company just basically won here. I don't have enough popcorn for all of this. For I think basic common sense should of told the wanna be uruk-hai behind artesian, that you don't change the rules in middle of a contest or when it over. For rather sure that against the law, even if it not. That is underhanded and shady as can be, is just a negative pr hit waiting to happen.

      What i don't get: They knew that the random winner might be someone very small. If that's a problem, filter out the bigger ones and use that group to draw a winner.
      I think there's the phrase that every publicity is good but I think even that shouldn't go as far as making people go like "I'd like to buy X, but not brand A because of their behaviour".

If he doesn't normally have problems with small numbers of followers, then the only other information he was seeing at the time was their appearance or other similar attributes. But he used the small numbers of followers as a less shitty excuse to reject them.

I'd be like, "Yeah, you with literally 1 viewer on twitch, you won this $2,500 gaming PC!". Which I think wouldve been fair of them to say/do, if a little crappy because it would typically help the bigger creators instead of the smaller ones. But you could have a fighting chance by advertising them properly and driving traffic to them, instead of just putting their name in the corner of your screen. Idk, most giveaways are shady anyways IMO

      @@martymcfly88mph35 as far as I understand in order for a giveaway to be considered a giveaway every person entered into it has to have equal weight, or at least the capacity for equal weight.
      Having criteria that some people can meet and some cannot is akin to consideration, and would make it a lottery, not a giveaway anymore. Sure, a giveaway can let people have multiple entries, but the criteria for multiple entries has to be something anyone participating could easily meet.

      Funny thing is, giving it to a smaller one would probably earn them lots of PR points, people likely to think well of a company helping the smaller people out and possibly could make a company go viral, the streamer would equally likely throw endless good words and thanks/praise to them, they missed a marketing opportunity and got what they deserve.

    I've had success with some affiliates and it can be successful. I agree that most affiliates do not reward you as much as you should be awarded. As a rule of thumb we generally stick to formal sponsorships - makes life so much easier. Great video by the way. We need to stick up for what's right when companies change the rules of giveaways like this!

      "Affiliate" stuff is usually akin to working in a call center on commission, unless you already happen to have a wide audience. Sticking to proper sponsorships is the best bet for most people 👍

    Glad you got around to cover this along with explaining how shitty these affiliate links can be. I used to stream years and years ago in like 2016 under a different alias, I peaked around a few hundred viewers at a time and used to have the worst affiliate deals. I got lucky my cousin knows a lot about laws so I'd always have her take a look at contracts in case there was skeezy shit in it. I think I took maybe like 5-10% of the overall deals and that was after I had to fight tooth and nail for deals that didn't dick me over. Thanks again for the video in any case, good shit as always.

    Lots of good info about the sponsorships that I never knew about.
    In my day job, we always make sure to have "we will pay, not to exceed X" or "you pay us the greater of X or %" clause. Need to make sure there is a lower bound you get paid, or an upper bound that you pay out. And negotiate it back and forth so both parties are happy in either case.

    Wow, that part about affiliates and scamming content creators was really eye-opening. I had the exact same impression you described, whereby it's normally seen as a positive milestone, but the degree to which they prey on content creators who don't know law is really upsetting. I could go for a whole video on that topic

    I’m late to the game here and I’m just a casual YT watcher who had no clue about this stuff. The way you explained it and the reasons why, along with the perfectly placed insults (muuah!) says a lot about your integrity and that you’re truly looking out for others just starting out no matter the blowback. Everyone starts as a beginner and finding people who don’t view them as competitors and lead them astray, has become so rare.

    Thanks for the great video. I am glad that thanks to Artesian, we now talk more about bad and exploitive business practices that try to take advantage of small content creators and their constant struggle to grow.
    Just as another thought: you see the PC builder in the artesian clips next to the wanna-be-ironman-dude? He asks "no subscribers?" in a way, that is absolutely clear that he knows what is going on and probably everyone else in this company knows what is going on. This is not an idiot CEO having a bad day, this exploitive practice is one that is deeply inhereted in the culture, practice and business models of these shitty companies. Their whole marketing strategy is build on taking advantage of others and I am thanksful that you pointed that out from your experience within the whole video. We need definately more awareness of that topic!
    Always remember, everyone: If you are creating content, you are a brand. The power of your brand is your own alone. You have the power to decide what to do with that brand alone. Don't let others tell you something else and take advantage of that.

    Also who be this Lawyer.. maybe one day I will need him for signing contracts lol. A contract lawyer and criminal lawyer are two very good things to have in this world.

    This is so upsetting to hear about. I actually recently launched a product business of my own with an affiliate marketing program. It’s just my wife and I that run it but we’ve poured our blood sweat and tears into starting it and spent a year of hard work getting it started. I completely recognize and acknowledge small creators are the backbone of it, and I absolutely want to be able to provide a sincere and lucrative opportunity to small creators and grow together. I super appreciate everyone we partner with and do NOT equate their following to their value as human beings. I see the potential in them and their awesome personality and think “wow, I’m so lucky to have found them before they got big” as if it’s inevitable. I just can’t comprehend how companies can prey on these people, that would just never be an idea that enters my brain.

    @KiraTV Would you mind not using these harsh bleep sounds? It's not like you're censoring a live show and have to overpower the original audio. Also youtube's algorythm recognizes these bleeps and if you use too many of them in succession too early in a video even tho you techinically avoided all profanity you will lose monetisation anyway. Personally I much prefer animal noises or just a mute over the harsh bleep. Ofc you don't have to, but I think you should know. Also good on you for standing up for your fellow creators.

    Hands down one of the best and most useful videos I've seen in a while. Also to people who get pissed at channels that have paid sponsors...grow up. You're not the ones with bills to pay. I say take the sponsors money regardless of views on things. i.e, I detest mobile gaming, i'd still take Raid's money cos until people stop buying it and make it go away, channels should milk those sponsors for all they can

    I gotta say, that statement by Mizkif was garbage. He got a totally garbage/shoddy computer but had no problem continuing to shill it out to his audience for the income. Couldn't talk about it because of "legalities?" BS. You could have cancelled the sponsorship when you knew you were recommending bad products to your audience. There's a lot of pre-built PC companies out there.

    He didn't destroy his business in 24 hours and the treatment of the contest winner on-air wasn't the main cause. The company has been behind on taxes for quite a long time. He ignored them so long, CA revoked his business license.

    Yup... My first sponsor gave me a few cheap things as bait, promised other things if I promoted their business, and then expected me to pay for high dollar items to move forward... all the while leading me with a carrot. They're no longer in business.

    On my older channel I actually used to make content, nothing huge for views but had like 2 or 3 10k videos when google first bought out youtube. I was offered from a few companies to join their ranks but unfortunately for them I was in high school at the time and would do anything but my homework and decided to read the entire contract from both companies and they each had grammatical errors and spelling mistakes. So, I told them to contact me once they proof read. Never heard from them after that and the offers were under shit. I didn't realize at the time but I was just upset they didn't treat me like an adult.

    I have yet to find a university in the USA that makes Business School students take mandatory ethics classes.
    As a biologist I had to take a 300 & 400 level ethics class as an undergrad.
    also the biz half of my family are like this ceo.
    Also spent some time working for a tech recycling company in the NE called Castaway Technologies with racist Ceo Cameron Deery. If you are a tech company in Mass, do not choose his company, he's also quite bad at his job, like telling a racist joke during a mandatory company meeting.

    I'm also wondering how this company is doing an "employee-led company buy-out" when the company itself as an entity is suspended for tax fraud. That's extremely disingenuous to me.
    A lot of people don't know it seems, as a side note, that US law requires some types of giveaways and sweepstakes to be open and free (at least one entry) to the qualifying public. For some, the chances don't have to be equal for each participant, but they have to at least offer one chance for free, monetarily. This guy could've easily positioned this giveaway as a sweepstakes similar to that in build and made requirements for things that most average people could obtain to enter (such as posting a shout-out) in addition to the one free entry.
    Not a legal expert by any means, but I have delved into sweepstakes and lottery laws a bit in the past for the US in general. This definitely wasn't a lottery, but he could've done so much with this giveaway to make it go his way, legally and morally, AND made some good PR. What a fucking dwote.

Look, I get that it's rarely the truth when TH-camrs talk about how much they love x-y-z product, but also (even more rarely) is it ever a scam. "Ads", and things of that sort are a fact of life. Ads have been a thing since the dawn of electronic powered media. You don't see people get angry when a commercial appears on tv, and it's no different here. That's why networks always have "we do not share the opinions of x-y-z" in fine print. TH-camrs, go get those bags! You earned them!

    I do know that all chanced based prize promotions are highly regulated (probably for tax reasons). There has to be a path for customers to enter the sweep stakes free with out having to pay money or being forced into other things(No purchase necessary law).

    Bankruptcy is very much a part of the business world and its used for good and bad purposes. Like getting of debt, giving a middle finger to people who sued you (they get nothing), and or just a way to move assets around. Trust me, bankrupty is a beautiful thing when its not your SSN, it's the corporation's identity that goes Bankrupt. Plus all the employees (especially the officers) will get paid including bonuses when you make it part of the deal.
