Which I think wouldve been fair of them to say/do, if a little crappy because it would typically help the bigger creators instead of the smaller ones. Having criteria that some people can meet and some cannot is akin to consideration, and would make it a lottery, not a giveaway anymore. Sure, a giveaway can let people have multiple entries, but the criteria for multiple entries has to be something anyone participating could easily meet.

Yea they totally broke USA law and the law for a lot of other countries. When it comes to sweepstakes/giveaways the stated criteria in the contest are a binding contract that both the host and the contestant agree to (this is why contests usually have a mile of terms and rules). And he totally fucking breached that contract.

The Hooters owner was extremely misleading about what his employees would win which in the eyes of the law equates to lying about the prize. I couldn't find anything more about him afterwards, but hes really lucky if he got away without the FTC hitting him with a fine and barring him from having contests again.
That small streamer who won the giveaway probably is getting the clout now, Artesian Builds. She gained like 20k+ followers because of the shit Artesian did. Now that's a lovely ending.
This whole case goes to show, but companies exist to make money, is poor logic for defending a company. Since here we have a company doing something to save some money and going by their logic, didn't make any money off this person. If what they said about no one clicked on the link is true. For companies often get so greedy, they make choices that just end up backfiring, for it might make money or in this case save money in the short term but in the long term burn everything to the ground. Which of course It is just lovely to see this company burn down to the ground, over their bad choices. It truly feels like justice, to see this wanna be Uruk-hai, get what is coming to their company. Along with it just feeling good to see a company being punished for being a massive ahole for once. Which I do love how everyone but this company just basically won here. I don't have enough popcorn for all of this. For I think basic common sense should of told the wanna be uruk-hai behind artesian, that you don't change the rules in middle of a contest or when it over. What i don't get: They knew that the random winner might be someone very small. If that's a problem, filter out the bigger ones and use that group to draw a winner. I think there's the phrase that every publicity is good but I think even that shouldn't go as far as making people go like "I'd like to buy X, but not brand A because of their behaviour".

I’m just confused about the incident that started the whole thing. If the purpose of affiliates it to generate clicks and you have an affiliate who has not once generated a click despite being an affiliate for months, then it seems eminently reasonable and not at all arbitrary to disqualify them from a contest for affiliates.
The lack of flexibility to pivot the conversation says all you need to know about the company. Do a drawing and every winner is a small steamer, perfect position to go on a campaign how you care about the little guy, and maybe even get them all together in a livestream later on to push the product even more. Some of the big guys win it and a few smaller streamers win it get them both together and increase your brand image even more. The only loss here is thinking you were giving away a product in the first place when what you were supposed to be doing was increasing your brand.
I'm impressed at how shitty this company was. If I was commiting a crime, I'd try to appear as the most squeaky clean person ever. I'd be like, "Yeah, you with literally 1 viewer on twitch, you won this $2,500 gaming PC!". I've had success with some affiliates and it can be successful. I agree that most affiliates do not reward you as much as you should be awarded. As a rule of thumb we generally stick to formal sponsorships - makes life so much easier. Great video by the way. We need to stick up for what's right when companies change the rules of giveaways like this!
"Affiliate" stuff is usually akin to working in a call center on commission, unless you already happen to have a wide audience. Sticking to proper sponsorships is the best bet for most people 👍

Glad you got around to cover this along with explaining how shitty these affiliate links can be. I used to stream years and years ago in like 2016 under a different alias, I peaked around a few hundred viewers at a time and used to have the worst affiliate deals. I got lucky my cousin knows a lot about laws so I'd always have her take a look at contracts in case there was skeezy shit in it. I think I took maybe like 5-10% of the overall deals and that was after I had to fight tooth and nail for deals that didn't dick me over. Thanks again for the video in any case, good shit as always.

It was never meant for the small streamers to begin with, just for the good PR of giving something away. They likely wanted a big streamer to win so they can give them the machine but still make money overall
Funny thing is, giving it to a smaller one would probably earn them lots of PR points, people likely to think well of a company helping the smaller people out and possibly could make a company go viral, the streamer would equally likely throw endless good words and thanks/praise to them, they missed a marketing opportunity and got what they deserve.
Yeah, funny thing about sponsorships, they actually care about their image and tend to be concerned when someone does something that could reflect badly on them for "supporting" that bad behavior with their sponsorship.
Lots of good info about the sponsorships that I never knew about. In my day job, we always make sure to have "we will pay, not to exceed X" or "you pay us the greater of X or %" clause. Need to make sure there is a lower bound you get paid, or an upper bound that you pay out. And negotiate it back and forth so both parties are happy in either case.
Wow, that part about affiliates and scamming content creators was really eye-opening. I had the exact same impression you described, whereby it's normally seen as a positive milestone, but the degree to which they prey on content creators who don't know law is really upsetting. This is bizarre, the conditions for a "winning" a PC are insane, as if they lay golden eggs that contain the cure for cancer. It's very "up themselves" about how awesome they think they are. Imagine too if you give away something awesome to a small streamer, publicly, it would be free positive publicity for all involved.

This is so upsetting to hear about. I actually recently launched a product business of my own with an affiliate marketing program. It’s just my wife and I that run it but we’ve poured our blood sweat and tears into starting it and spent a year of hard work getting it started. I completely recognize and acknowledge small creators are the backbone of it, and I absolutely want to be able to provide a sincere and lucrative opportunity to small creators and grow together. I super appreciate everyone we partner with and do NOT equate their following to their value as human beings. I see the potential in them and their awesome personality and think “wow, I’m so lucky to have found them before they got big” as if it’s inevitable. I just can’t comprehend how companies can prey on these people, that would just never be an idea that enters my brain.

Thank you Kira for an incredibly valuable video... it's imperative in this day & age that you _get someone else you trust to look over contracts or agreements you might be signing,_ even if it's just a switched-on/experienced friend or family member if a qualified lawyer isn't needed. It's natural to miss things when reading contracts or docs using marketing language or legal-ese (especially if you're excited about the opportunity), so a 2nd set of eyes can be a huge help in understanding what you're likely to get out of said agreement. Even if it's not as bad as the examples Kira gave, it can help you negotiate better terms & set yourself up to succeed.
I wish those numbers were accurate haha. They are just social blades metrics which are a broad guess. I've made good money in 2021 but not close to that from ad rev and my expenses are also relatively high. Maybe in 2022!

I have yet to find a university in the USA that makes Business School students take mandatory ethics classes. As a biologist I had to take a 300 & 400 level ethics class as an undergrad. also the biz half of my family are like this ceo. Also spent some time working for a tech recycling company in the NE called Castaway Technologies with racist Ceo Cameron Deery. If you are a tech company in Mass, do not choose his company, he's also quite bad at his job, like telling a racist joke during a mandatory company meeting.
Good video covering this. I'm not sure why though, but as I've been watching a number of your videos throughout today getting caught up on this and that, this one had one odd issue. I'm only 16 minutes into it and I've gotten Ad rolls about 9 or 10 times already. It's a little bit absurd, and I'm unsure of why it's only doing it to this video. Makes it hard to follow along at times when sentences keep getting cut off in the middle.
@@KiraTV1 Yeah I have no idea! The shortest time between ads for me was 30 seconds at one point. Some seemed like they came at fairly natural points, and then others would pop on their own mid sentence a few different times. Very strange, as none of the other videos did that to me lol.
@@erythsea Regrettably I'm starting to think so. When TH-cam Premium started becoming the bulk of the ads that I was getting pre-video, I noticed that ads started popping up much more frequently. It sours me to think that there may be some intentional tomfoolery going on to make the service less comfortable just to sell a solution to their own problem, though. My internet is atrocious though, at a maximum of 3.5 MB/s, but realistically I get 2 Mb/s download on a good day. Not having my videos constantly stop to buffer ads, and then rebuffer the actual video itself again every time would be nice though lol.

The most infuriating part is that despite committing something that's an actual crime in many jurisdictions live on video, I'm sure in his mind he did nothing wrong and he's an unfair victim of entitled yoof's mob cancel culture.

When it comes to sweepstakes/giveaways the stated criteria in the contest are a binding contract that both the host and the contestant agree to (this is why contests usually have a mile of terms and rules).
And he totally fucking breached that contract.

@@Abigail-hu5wf Just finished looking at it. That one was equally as sleazy buy in a different way. The Hooters owner was extremely misleading about what his employees would win which in the eyes of the law equates to lying about the prize.
I couldn't find anything more about him afterwards, but hes really lucky if he got away without the FTC hitting him with a fine and barring him from having contests again.
Their newest twitter message: "At this point we are examining a potential employee-led buy-out of the company. Thank you for your support."

This whole case goes to show, but companies exist to make money, is poor logic for defending a company. Since here we have a company doing something to save some money and going by their logic, didn't make any money off this person. If what they said about no one clicked on the link is true. For companies often get so greedy, they make choices that just end up backfiring, for it might make money or in this case save money in the short term but in the long term burn everything to the ground.
Which of course It is just lovely to see this company burn down to the ground, over their bad choices. It truly feels like justice, to see this wanna be Uruk-hai, get what is coming to their company. Along with it just feeling good to see a company being punished for being a massive ahole for once. Which I do love how everyone but this company just basically won here. I don't have enough popcorn for all of this. For I think basic common sense should of told the wanna be uruk-hai behind artesian, that you don't change the rules in middle of a contest or when it over. For rather sure that against the law, even if it not. That is underhanded and shady as can be, is just a negative pr hit waiting to happen.
What i don't get: They knew that the random winner might be someone very small. If that's a problem, filter out the bigger ones and use that group to draw a winner.
I think there's the phrase that every publicity is good but I think even that shouldn't go as far as making people go like "I'd like to buy X, but not brand A because of their behaviour".

If he doesn't normally have problems with small numbers of followers, then the only other information he was seeing at the time was their appearance or other similar attributes. But he used the small numbers of followers as a less shitty excuse to reject them.

I’m just confused about the incident that started the whole thing. If the purpose of affiliates it to generate clicks and you have an affiliate who has not once generated a click despite being an affiliate for months, then it seems eminently reasonable and not at all arbitrary to disqualify them from a contest for affiliates.

The lack of flexibility to pivot the conversation says all you need to know about the company. Do a drawing and every winner is a small steamer, perfect position to go on a campaign how you care about the little guy, and maybe even get them all together in a livestream later on to push the product even more. Some of the big guys win it and a few smaller streamers win it get them both together and increase your brand image even more. The only loss here is thinking you were giving away a product in the first place when what you were supposed to be doing was increasing your brand.

I'm impressed at how shitty this company was. If I was commiting a crime, I'd try to appear as the most squeaky clean person ever. I'd be like, "Yeah, you with literally 1 viewer on twitch, you won this $2,500 gaming PC!". Instead, these shitheads cheated the little guy out of their commissions AND acted snobby and shit about E fame.
That's how you get more attention you do stuff for any one and every one will think they have a higher chance at winning.

I've had success with some affiliates and it can be successful. I agree that most affiliates do not reward you as much as you should be awarded. As a rule of thumb we generally stick to formal sponsorships - makes life so much easier. Great video by the way. We need to stick up for what's right when companies change the rules of giveaways like this!
"Affiliate" stuff is usually akin to working in a call center on commission, unless you already happen to have a wide audience. Sticking to proper sponsorships is the best bet for most people 👍

Very informative video. I saw ItsaGundam's video about Artesian but you also including your own experiences is, I think, very valuable to helping you tell the story and get your point out to people that these companies do NOT have streamers' best interests in mind.

Glad you got around to cover this along with explaining how shitty these affiliate links can be. I used to stream years and years ago in like 2016 under a different alias, I peaked around a few hundred viewers at a time and used to have the worst affiliate deals. I got lucky my cousin knows a lot about laws so I'd always have her take a look at contracts in case there was skeezy shit in it. I think I took maybe like 5-10% of the overall deals and that was after I had to fight tooth and nail for deals that didn't dick me over. Thanks again for the video in any case, good shit as always.

they do a classic scam scheme, "we are going to help the small streamers with pc giveaways, a big streamer joins the giveaways just for the lols and to help us to be more knowed in the comunity, oh look the big streamer won the pc what a concidence
It was never meant for the small streamers to begin with, just for the good PR of giving something away. They likely wanted a big streamer to win so they can give them the machine but still make money overall
at one point dude looked at a streamer, saw their rig on their stream and dude went "your pc is already a beast you dont need ours" and rerolled
Funny thing is, giving it to a smaller one would probably earn them lots of PR points, people likely to think well of a company helping the smaller people out and possibly could make a company go viral, the streamer would equally likely throw endless good words and thanks/praise to them, they missed a marketing opportunity and got what they deserve.
it is the same as fake giveaways, they want to clout of giving something away for free but the fact is that they are doing it for publicity.
You've just restored my faith a bit in humanity. There are still good people out there.
One of my favorite streamers used this company. Sold $31K for them, earned like $130 from that all.
Yeah, funny thing about sponsorships, they actually care about their image and tend to be concerned when someone does something that could reflect badly on them for "supporting" that bad behavior with their sponsorship.

Lots of good info about the sponsorships that I never knew about.
In my day job, we always make sure to have "we will pay, not to exceed X" or "you pay us the greater of X or %" clause. Need to make sure there is a lower bound you get paid, or an upper bound that you pay out. And negotiate it back and forth so both parties are happy in either case.

I had the exact same impression you described, whereby it's normally seen as a positive milestone, but the degree to which they prey on content creators who don't know law is really upsetting. This is bizarre, the conditions for a "winning" a PC are insane, as if they lay golden eggs that contain the cure for cancer. It's very "up themselves" about how awesome they think they are. Imagine too if you give away something awesome to a small streamer, publicly, it would be free positive publicity for all involved.
How is it free if the PC costs thousands of dollars and giving it away to somebody with 5 viewers would most likely not be worth it.

This is so upsetting to hear about. I actually recently launched a product business of my own with an affiliate marketing program. It’s just my wife and I that run it but we’ve poured our blood sweat and tears into starting it and spent a year of hard work getting it started. I completely recognize and acknowledge small creators are the backbone of it, and I absolutely want to be able to provide a sincere and lucrative opportunity to small creators and grow together. I super appreciate everyone we partner with and do NOT equate their following to their value as human beings. I see the potential in them and their awesome personality and think “wow, I’m so lucky to have found them before they got big” as if it’s inevitable. I just can’t comprehend how companies can prey on these people, that would just never be an idea that enters my brain.

Just as another thought: you see the PC builder in the artesian clips next to the wanna-be-ironman-dude? He asks "no subscribers?" in a way, that is absolutely clear that he knows what is going on and probably everyone else in this company knows what is going on. This is not an idiot CEO having a bad day, this exploitive practice is one that is deeply inhereted in the culture, practice and business models of these shitty companies. Their whole marketing strategy is build on taking advantage of others and I am thanksful that you pointed that out from your experience within the whole video. We need definately more awareness of that topic!

This was a GIVEAWAY, something the company didnt even need to do at all and they managed to completely ruin their company in the process. In todays always online and always politically correct world, information travels so fast, I cant believe how disconnected he was from the power of social media.

Thank you Kira for an incredibly valuable video... it's imperative in this day & age that you _get someone else you trust to look over contracts or agreements you might be signing,_ even if it's just a switched-on/experienced friend or family member if a qualified lawyer isn't needed.
It's natural to miss things when reading contracts or docs using marketing language or legal-ese (especially if you're excited about the opportunity), so a 2nd set of eyes can be a huge help in understanding what you're likely to get out of said agreement. Even if it's not as bad as the examples Kira gave, it can help you negotiate better terms & set yourself up to succeed.

I wish those numbers were accurate haha. They are just social blades metrics which are a broad guess. I've made good money in 2021 but not close to that from ad rev and my expenses are also relatively high. Maybe in 2022!

The way you explained it and the reasons why, along with the perfectly placed insults (muuah!) says a lot about your integrity and that you’re truly looking out for others just starting out no matter the blowback. Hands down one of the best and most useful videos I've seen in a while. Also to people who get pissed at channels that have paid sponsors...grow up. You're not the ones with bills to pay. I say take the sponsors money regardless of views on things. i.e, I detest mobile gaming, i'd still take Raid's money cos until people stop buying it and make it go away, channels should milk those sponsors for all they can

Good video covering this. I'm not sure why though, but as I've been watching a number of your videos throughout today getting caught up on this and that, this one had one odd issue. I'm only 16 minutes into it and I've gotten Ad rolls about 9 or 10 times already. It's a little bit absurd, and I'm unsure of why it's only doing it to this video. Makes it hard to follow along at times when sentences keep getting cut off in the middle.
That's strange because i got none. So maybe you got all the ads that should have been distributed among all viewers.
Not sure how you got so many ads since I can see where they're located in the video. There's 6 in the video I believe(not at my pc to check)
@@KiraTV1 Yeah I have no idea! The shortest time between ads for me was 30 seconds at one point. Some seemed like they came at fairly natural points, and then others would pop on their own mid sentence a few different times. Very strange, as none of the other videos did that to me lol.
@@erythsea Regrettably I'm starting to think so. When TH-cam Premium started becoming the bulk of the ads that I was getting pre-video, I noticed that ads started popping up much more frequently. It sours me to think that there may be some intentional tomfoolery going on to make the service less comfortable just to sell a solution to their own problem, though. My internet is atrocious though, at a maximum of 3.5 MB/s, but realistically I get 2 Mb/s download on a good day. Not having my videos constantly stop to buffer ads, and then rebuffer the actual video itself again every time would be nice though lol.
