That IS the "safe" way to board in open waters. There were 4'-5' seas around us. If I were to stop completely or for them to come alongside, then one wave could knock one boat on top of the other and fling the Coasties off their RIB. Furthermore, after they've boarded, I told them I needed to pick up a bit of speed, otherwise my crew would be throwing up all over the place. They were cool with that.
What a pain in the ass. Boot marks on the deck etc. Some are great and some have a wicked attitude. Get your inspection sticker at the dock so you don't have to deal with this non-sense.

They have complete autonomy, they can go through your wife's purse, rip your boat apart, shoot you if need be, and there is nothing you can do about it....
Yes they can go through your wife's purse if reasonable suspicion arises. Whats a smart way to deal with that? Don't give them a reason to have to go through it by abiding by the laws.
Title 14 section 89 of the United States Code authorizes the U.S. Coast Guard to board vessels subject to the jurisdiction of the United States, anytime, any place upon the high seas and upon any waterway over which the United States has jurisdiction, to make inquires, examinations, inspections, searches, seizures, and arrests. The U.S. Coast Guard does not require a warrant to conduct search, seizures, arrests over any United States Waterway or high seas. The U.S. Coast Guard also have full legal law enforcement power on any land under the control of the United States, as needed to complete any mission.
Coasties are taught to board the vessel in various ways, but usually the most comfortable ride is when the boat is making way into the seas. Getting on board, this team used poor tactics, turning their backs on the crew and should have had 2-3 Coasties on board, with another covering the team from the small boat.
***** Nice language! Why the name calling?? Please do some research and you'll find that the US Coast Guard has the authority to stop any US flagged vessel within the navigable waters of the US, the high seas and within other country's waters with permission of that country, to enforce all applicable laws. That includes a guy and his wife while fishing. If you choose to go boating, you are choosing to partake in a very regulated industry or past time, depending upon whether you are doing it for recreation or for commerce. IF YOU DON'T LIKE IT, WRITE YOUR CONGRESSMAN OR SENATOR AND HAVE THEM CHANGE THE LAW. Until then, watch your language, get educated. If you do get educated, you'd realize that Coasties often board vessels that appear to be a 'mom and pop' boarding at first, then quickly it turns into more than checking boating safety gear. I myself caught people with active warrants while they were just putting around a harbor and waving at our boat. When we boarded and ran them, whoops, they had warrants; one lady had an active forgery warrant. Now if that was your name she was signing on fraudulent checks, I bet you would have been happy that Coasties caught her. Other times, guys that I trained went on a vessel and found illegals hiding out. The list of enforcement activity like that goes on and on.
***** Agents are special agents from CGIS, the rest of us are officers (former in my case, i got out). Officers don't know who is dangerous and who isn't. So, being polite and respectful is part of USCG training. Addressing the owner as skipper or captain is the norm. Keeping the boat underway, fishing and not interrupting the voyage (or at least as little as possible) is the norm. In my case, I was assigned to LEDET 7A from TACLET South. That was the CG's only SWAT teams prior to 2001 (TACLET North, South, Gulf and Pac Area). AFter 2001, MSST's came into being. These are the teams that guard terrorists in GITMO, capture pirates off the coast of Africa, conduct SWAT take downs of hostile boats, capture drug boats or boats laden with illegals AND they do 'mom and pop' recreational boardings like this video showed. They do it with professional attitudes and don't go around beating people or shooting people. when I was on TACLET South, I was told by Officers from Miami PD that we were 'too nice' to the Haitian immigrants that had been captured by a cutter, transferred to Base Miami and were being processed by us. We were inside a fenced enclosure with a 10ft tall fence (tennis courts) with only batons and handcuffs. The armed team members guarded the perimeter. We were respectful of the immigrants, searching them for weapons, intelligence like phone numbers or names of contacts and for anything illegal. We then fed them, kept them shaded, set up bathrooms for them, all the while the cops were telling us we were 'too nice'. They weren't fighting us, threatening us, trying to escape; they were completely cooperative, so we treated them with dignity and respect. On youtube, check out Coast Guard SWAT; that is our composite team from LEDET Miami taking down a boat where the stowaways were trying to take control of the ship. We took them down safely; no one on our side got hurt and no immigrants got hurt, this despite the illegals throwing 4x4 by 6 foot long wooden beams at us to keep us from boarding the boat. I was the point man with the glasses, mustache and shotgun. Once onboard, I faced 13 of them alone; and they weren't happy. I managed to get them on their faces with arms out prior to the 2nd Officer getting up the ladder. They could have rushed me and possibly killed me, but when i racked the shotgun and pointed it at them, they complied with my orders to get down. When we didn't do boarding like that, we were out with border patrol, Everglades park rangers, Florida Marine Patrol, and many other police maritime units doing 'mom and pop' boardings to teach people how to be safe on the water. One guy was pissed off at me for boarding him. Several weeks later, he saw my partner and I out with FMP and stopped us. I was thinking it was going to be more attitude from him; instead, he thanked us profusely for making him move his gas tank so he didn't sit on his gas tank while smoking and driving. He credited us with saving his life. That's what the 'mom and pop' type boarding are about; educating the public so they don't become a statistic later on and end up in a body bag. With all the negative publicity about cops recently, just remember the attitudes that the regular public gives most cops now. They are husbands, sons, daughters and wives too, and most are hard working decent cops. Some are criminals with badges, but most are just trying to do their part to keep their part of the world safe. If you don't stand behind the law enforcement officers in your area; take up the challenge and stand in front of them when the bad guys want your wallet, your wife and your life.
***** By the way, the TACLETS and MSST's go into combat zones, teach the Navy how to do boardings then augment the boarding team as experts in the field. I did a tour that took me to Desert Storm and Bosnia while with TACLET South. In the thousands of boardings, I layed hands on a guy once for pushing past me and ignoring my directives and drew my weapon only twice; once was my pistol when clearing a suspected drug boat in ventura harbor CA and the other was the shotgun on the SWAT takedown of the freighter carrying stowaways. Coasties aren't renegades and just want to go home when the day is done. Remember that if you're on the water and need the USCG's help.
LEDETCoastie Good civil response. If people did some research, they would see that many countries (and this includes the maritime community) respect the CG. Even when there was talk about the U.S. and Panama arguing over the Panama region and them wanting all U.S. Military out, they would agree to allow the Coast Guard to come in and "manage" the U.S. portion of the canal operations. However, the CG said NO F'n way (didn't want no part of it) but the U.S. worked it out and the dust settled. My point for those who care is the CG has a reputation of not using lethal force to put someone down. A 280lb BM can do that just fine. Last I heard, the DOG's were being resolved. Mistake.
We are a product of a harsh reality that few will ever understand. When I conduct boardings I've amended my intro to say that I will ask to see equipment to complete the INSPECTION
@@JonGriffinMusician So i suppose, by your logic, if you are away from the US, the police can come into your home and search whatever they wish? i mean you have no rights outside the borders, right? Boating is a highly regulated activity and such a limited intrusion by the government has been upheld in court. For a "normal" rec boat boarding the CG is conducting an inspection not a search. They will not conduct a search without PC. Only ask to see safety equipment. You can look up exactly what our limits are.
CoastiePirate You are SOO wrong!! There is NO "SUPREME LAW", this is NOT Iran or China.I don't know what court you are talking about, because the US Supreme court, has upheld the IV amendment, against acts like this, cops trying to put GPS on cars without a warrant, searching your car, boat, property, because they "thought" something!. They need a warrant to search or come on your property. The Coast Guard are USA government employees, covered by the laws of the USA and the constitution, which the coasties, swore to defend. The only reason they get away with this, is because people like you, bend over and let them in. I have refused the Coast Guard boarding MANY times, I read the IV amendment to them over the radio, then ask for the commander's name, so that I can sue him/her personally, for violating my civil rights. They back down EVERY TIME!! Freedom is not Free, you have to fight for it.
Mike William Actually Mikey, Coastie pirate is correct; boating is a highly regulated past time and the USCG has authority to check all US flagged vessels on US navigable waters, the high seas and within other country's waters with permission of that country. Look it up; it's the law. The 4th amendment protects your right from being searched unless there is probably cause; Coasties can conduct an inspection for your required gear and then if they work up to probably cause, they can search your vessel, then finish the inspection of your gear. If you don't like it, write your congressman or senator and have them change the law.
Read the 4th amendment and you will have your answer. The coastie swore to follow and defend the constitution. Per. the 4th amendment, they have no right to search or stop. Even if they want to call it a "safety check". Just like the police can't stop you and check "your papers" or search you without probable cause or a warrant.
My friend ,you just give up all your rights..!! No they cannot board you without a warrant..! You just throw your 4th amendment over board.! A dumb game warden try to do that in my brand new bowrider an I call him off inmmediatly. You touch my boat and my lawyers will chew your ass in court. They back off right away. Safety inspection are only by observation not physical .Life jackets .documents ,fire extinguisher ,horn ,nav lights etc. .everything visual only.

Safety checks are nothing to be pissed about. Most of the drivel on this thread is from non-boaters or very casual boaters. The CG would rather make sure we are all safe than rescue us from our own ignorance later, which is not only a valuable service but the cheapest and most efficient way to accomplish that mission with the tax payers money. I've been a blue water and coastal cruiser for over 30 years and believe me, I and those of my ilk, LOVE these guys. And all those haters on this thread have no idea of the laws or even the rules of the road on the water. And they have never seen what happens when someone gets in trouble (and it will happen eventually, the sea is a harsh mistress) picks up their radio and asks for help. They don't have the faintest idea of the scope of these services or that they are there for THEM. They have no clue that a mariner on the high seas or in coastal waters has the entire resources of the United States of America at their beck and call with the push of a button. No, they cry "FREEDOM" at the idea of doing their part and being responsible citizen/boaters when required to keep a few safety items on board and in working condition. Anyone who goes out on the water should take note that their country cares about them and is providing them with an incredible service. Or...they need to go back to their video games and stay off the water. And I would say to the coasties that engage them in this drivel, remember you are a professional and point the haters to the educational resources they need, say "Have a great and safe day"....and let it go. I have been boarded many times and rescued once and I say "THANK YOU FOR YOUR SERVICE".
I suspect these boarding videos are staged to show is how nice the coast guard is and how well they treat us. Unfortunately this is not real. If it was real they would have all gone into the quick draw stance and asked if there were firearms on board. What goof balls turn their backs all at once as the board a vessel or exit it ? I was boarded once and they were pi$$ed because I did not have a life jacket on. When I told them I was wearing a coast guard approved float coat the lead guy was extra pi$$ed and said humf what is that. The younger guy calmed him down and explained it to him. My radio antenna was clearly down and the lead guy was Poed that I had not answered their radio call. Radios are not mandentory. The younger guy pointed out that perhaps my radio was down because the antenna was down. The coast guard has it place and once was good, Under homeland security they suck when interacting with Americans. They could very well call in for a check on the numbers on a boat and then once they see your papers act like you are human. I am retired Military and would never treat a citizen as they do.

@Dildo Gaggins Agreed... But, the point is, the coast guard has a tremendous amount of power and autonomy. More then people realize...
Coast guard welcome on my boat anytime. Hell I would probably take them all fishing.
They don't give a damn if they are welcome, they will come anyways.

The question, then, is who does that square with the 4th Amendment?

@@markpitchford7375 It doesn't.

They have to ask permission to board
Umm, sorry, but thanks for playing along.
No, they do not
Coasties are taught to board the vessel in various ways, but usually the most comfortable ride is when the boat is making way into the seas. Getting on board, this team used poor tactics, turning their backs on the crew and should have had 2-3 Coasties on board, with another covering the team from the small boat.

Nice language!

Agents are special agents from CGIS, the rest of us are officers (former in my case, i got out).
*****
By the way, the TACLETS and MSST's go into combat zones, teach the Navy how to do boardings then augment the boarding team as experts in the field.
When I conduct boardings I've amended my intro to say that I will ask to see equipment to complete the INSPECTION
do you have to let them on your vessel without a warrant?
Hmmm, yes. As a matter of fact, you will let them board. No warrant needed.

No caption, I have no idea what you guys talk about.... Deaf here.... Just curious why do you have to keep move forward, why not come to full stop?
When the seas are a rough like they were, it is much more stable to keep moving.
Amendment IV; The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized
Mike William
Actually Mikey, Coastie pirate is correct; boating is a highly regulated past time and the USCG has authority to check all US flagged vessels on US navigable waters, the high seas and within other country's waters with permission of that country.
Mike William Please explain what they did and how they did it was unreasonable?
Read the 4th amendment and you will have your answer. The coastie swore to follow and defend the constitution. Per. the 4th amendment, they have no right to search or stop. Even if they want to call it a "safety check". Just like the police can't stop you and check "your papers" or search you without probable cause or a warrant.
I'm glad they're out there... the Border Patrol had its hands tied by Obama.
Nope, thank the republicans for that
they are welcome on my boat anytime

As a Coast Guard vet, I know you are talking out of your ass. Give it up, troll.
Steven, Got a question for you. How come there boarding on and off on the go, wouldn't it be safer if the boats were stopped? And yes I know nothing about boats just an enthusiast that someday will own a yacht.lol
The boats are more stable while moving. When stopped, they bob about more.
Thanks Steven
As a CG vet as well, never did I go on a boarding where we didn't treat everyone with respect unless it was a hostile boarding, which was exceptionally rare. In my experience if a boarding were anything but cordial, it was entirely because of the attitude of the people aboard
Yes they can board without permission. You think that's funny huh? Very strange, weak, cowardly, submissive, lacking any admiration. Don't joke about being spineless, the opposite of brave, the opposite of Davy Crockett. Very bizarre to be proud and joke.
you guys looked like terrorists...so the boarding was necessary. what a friggin waste of time and money. do realize they do this stupid shit so they can report that they did something.... how many terrorist did they catch that day or week or month or year? the answer...wait for it... none. and if you say we are looking for drugs.. you mean the war on drugs which is an utter failure.
