A straightforward murder conviction for Susan Berman would see Durst die in jail, and wouldn't require delving so far into the endless matters that they are currently to try and prove 'special circumstances', although I absolutely accept that this would give litlle/no justice to Kathy and her family. If they have to effectively find him guilty of Kathy's murder in order to secure his conviction for the witness killing of Susan, why not put him on trial for both?
